1 VENUE HIRE TERMS & CONDITIONS Bunbury Rowing Club Hall Hire This AGREEMENT contains the details of the terms and conditions for hiring of the hall. To secure a booking, the hirer shall pay a DESPOSIT of $350 along with a signed copy of these terms & conditions. Full payment of the DEPOSIT is required to secure the booking and if it is not received the booking will be cancelled. Bunbury Rowing Club reserves the right to cancel bookings where confirmation is not received within these specified timeframes. The contract signatory is liable to pay all monies due under these Terms & Conditions. BOND The bond will be repaid to the hirer within 5 10 working days (or soon thereafter) once management have conducted an inspection and are satisfied that: no damage has occurred to the Club s premises and property the terms and conditions have been fully complied with any necessary deductions for damages and/or terms that forfeit bond, have been made. 2 CANCELLATION If notice of cancellation is given: More than thirty (60) days prior to the date of the booking; o A 25% cancellation fee of the deposit will be processed Less than thirty (30) days prior to the date of the booking; o The deposit is forfeited ACCESS & LOCKUP Reasonable access to the hall is available prior to the event start time. It is the hirer s responsibility to ensure that the premises are properly secured at the end of the hire. A key and swipe card will be issued to the hirer the day before the event that will give them access to the hall on the day of their event. Please note that: The hirer is under an obligation to ensure that the premises are secured at the end of the event. A penalty fee will be charged and deducted from the bond should this request be ignored. Forfeiture of Bond: $ CONDUCT The hirer is responsible to conduct the event in an orderly manner and in full compliance with the rules and regulations of Bunbury Rowing Club and all applicable laws. Bunbury Rowing Club reserves the right to intervene if any event activities are considered illegal, excessively noisy or offensive. Bunbury Rowing Club reserves the right to remove patrons attending events from the premises for unruly behaviour. Bunbury Rowing Club operates under the Liquor Act 2010 and thus enforces the Responsible Service of Alcohol even though you are holding a private event. Any persons considered to be under the legal drinking age of eighteen (18) years are NOT, under any circumstances, to be served alcohol. Bunbury Rowing Club further reserves the right to refuse the service of alcohol to any patron it considers to be intoxicated, and/or offensive manner. All patrons are to vacate the premises 15 minutes after the agreed closing time. ALCOHOL The premises are licensed and as such alcohol is not permitted to be brought onto the premises without prior arrangement please discuss this with Bunbury Rowing Club s Functions Manager. Our venue s liquor licence covers the service of alcohol at any events held on the premises up to midnight on Friday, Saturday & Sunday nights only. Hirers are to discuss alcohol arrangements with Bunbury Rowing Club s Functions Manager. Bottles of spirits and shooters / jelly shots are strictly prohibited. It is the hirer s responsibility, if you wish to serve alcohol to your guests at an event outside of our liquor licence regulations, to apply for an Occasional Liquor Licence from the Department of Racing, Gaming & Liquor. 3 RESPONSIBLE SERVICE OF ALCOHOL STANDARDS Bunbury Rowing Club abides by the ACT Liquor Act 2010 and associated Regulations and practices the responsible service alcohol. Persons under the age of eighteen (18) years ARE NOT be served alcohol under any circumstances. Bunbury Rowing Club reserves the right to refuse entry and/or service of alcohol to intoxicated patrons. SMOKING As a sporting club situated on land in an outdoor public place Bunbury Rowing Club has implemented a no smoking policy within the hall, toilets, balcony the down stairs paved area. Please speak with the Functions Manager regarding the designated smoking areas. Should this request be ignored and smoking occurs within the prohibited areas, a penalty fee will be deducted from the hirers bond. Deduction from Bond: $ POST FUNCTION CLEANING The hall, balcony area, downstairs lawn and paved area will be made available to the Hirer in a clean and tidy condition. The Hirer shall leave the premises as stated above at the completion of their event, in a clean and tidy condition with all fixtures in good working order and condition. The Hirer must ensure that prior to leaving the venue at the completion of their event they have done the following: Clean all toilets Swept and mopped all floors, including stairs, hall, kitchen and bar floor. Cleaned stove and ovens and bench tops. Swept the balconies. Ensured that the downstairs lawn & paved area is cleared of any rubbish and/or broken glass. Removed all decorations. Removed all foodstuffs and other rubbish from the premises. A key to the large bins can be provided by the Bunbury Rowing Club Function Manager. All doors and windows are closed, locked and lights switched off All furniture including, chairs and stables stacked away Bunbury Rowing Club does offer a post-event cleaning service at an additional price. 4 DOWNSTAIRS LAWN & PAVED AREA Due to rowers utilising this area early each morning, rubbish (including glass, plastic cups & empty bottles / cans) is NOT TO BE THROWN off the balcony on to the ground below. It is the hirers responsibility to ensure that the downstairs lawn & paved area is cleared of any rubbish and/or broken glass immediately after their event. A penalty fee will be charged and deducted from the bond should this request be ignored. Deduction from bond: $ RUBBISH REMOVAL There is 1 x commercial size bin located in the carpark for the use of Bunbury Rowing Club hirers. Please DO NOT remove the bins from their location in the car park. Bins removed from their location will incur a fine deducted from their bond. Please speak with the Functions Manager should you require access to these bins. Deduction from bond: $ DAMAGES The hirer remains responsible for any loss or damages caused by them or any of their guests, invitees or other people attending the event, whether in the function room or any other part of Bunbury Rowing Club s premises. The hirer will forfeit their right to have the bond money returned to them and will additionally be liable for the cost of any damages incurred as a result of the event, should the amount exceed the bond. Bunbury Rowing Club reserves the right to recover costs of damages that exceed the bond, including non-payment. The hirer/signee will be liable for all fees incurred in action taken by Bunbury Rowing Club to recover these costs. In the event of damage or loss from/to any part of the property, including the adjacent Waters Edge premises, Bunbury Rowing Club reserves the right to nominate repairers/suppliers and to charge the hirer for repairs or losses incurred. Bunbury Rowing Club will accept no responsibility for any damage to or loss of property brought in by patrons before, during or after the function. Forfeiture of Bond: $ COMMENCEMENT & CLOSING TIMES Functions will commence and conclude according to the scheduled times made at the time of the booking. 5 ROOM DECORATION & FURNITURE Within reason, decorations for the function room are left up to the discretion of the Hirer. Furniture MUST NOT be brought into the Hall without the approval of the Functions Manager. Please seek approval before organising furniture which includes but not limited to: Lounges / couches / sofas Tables / chairs Wine barrels Candles Any items that may scratch or permanently damage the floor Hirers MUST NOT use any of the following to secure decorations: Thumbtacks; Nails; Any adhesive tape [Sticky tape/double-sided tape]; Glue Screws Gaffer tape Additional cleaning fees will be charged and deducted from the bond for removal, should this request be ignored. Deduction from Bond: $ Arrangements for the time you wish to decorate must be confirmed at the time of booking confirmation. Setup and pickup times of decorations, displays, equipment etc must be during the event set-up & event clean-up times specified. Hirers are responsible for the setup and breakdown of any displays, equipment etc. Please Respect our Memorabilia: The moving of (especially removal from walls) or interfering with, any Bunbury Rowing Club memorabilia is NOT permitted. Any damage to our memorabilia will incur a deduction from the bond for repairs. USE OF THE LIFT The Hirer is only to use the lift for disabled access and carrying heavy loads. If the lift is found to be damaged, inoperable due to misuse or the emergency phone is used inappropriately, the Hirer is liable for repairs and the cost of the emergency call. Deduction from Bond: $ NOISE CONTROL The Hirer shall maintain the noise emissions emanating from the Hall at levels so determined and governed by the City of Bunbury Council By- Laws. In any event, such noise emissions shall particularly take into account reasonable community expectations to peaceful occupation. Any breach of such standard shall cause forfeiture of deposit. 6 INDEMNITY The Hirer shall indemnify and keep indemnified the Club from and against all claims, demands, writs, summonses, actions, suits, proceedings, judgements, order, decrees, damages, costs, losses and expenses of any nature which the Club suffers or incurs in connection with the loss of life, personal injury or damage to property arising from or out of any occurrence in, upon or at the Hall and lift during the hire by the Hirer or the use by the Hirer of the whole or any part of the Hall and lift or to any person or to the property of any person using or entering on the Hall and lift how so ever occasioned. EMERGENCY EVAUCATION PROCEDURE If smoke is detected or fire alarm is raised please proceed to the nearest exit and phone 000. DO NOT USE THE LIFT The contact person on the agreement form is responsible for ensuring all members attending your event have evacuated the building. The hirer of the Bunbury Rowing Club facilities are to familiarise themselves with all emergency exists and the evacuation plan. The assemble area/muster point is located on the grassed area to the west and east of the building. Please refer to the Evacuation Plan to familiarise yourself with the muster points.
