3 This policy is aimed to ensure good relations between the officials who govern the sport of cycling in South Africa through the regulations provided by the UCI and Cycling SA and the Cyclists POLICY STATEMENT Cycling South Africa is committed to providing a sport and work environment free of harassment. We believe that anyone who works for us, or represents us, and everyone with whom we deal, has the right to be treated with respect and dignity. Cycling South Africa will not tolerate harassment in our organisation. We will take all complaints of harassment seriously, and will ensure they are dealt with promptly, seriously, sensitively and confidentially. Action shall be taken against a person who is found in breach of this policy APPLICATION OF POLICY This policy applies to behaviour occurring both within and outside the course of Cycling South Africa business, activities and events, when the behaviour involves individuals associated with Cycling South Africa, and negatively affects relationships within our sport and work environment This policy applies to harassment occurring between any participants in the organisation. Harassment may occur, for example between: Commissaire and athlete Commissaire and coach Commissaire and administrator Commissaire and Commissaire 7.3. DEFINITIONS Harassment (general) Harassment consists of offensive, abusive, belittling or threatening behaviour directed at a person or people, usually because they are different, or perceived to be different, from the harasser. The difference may be in gender, race, disability, sexual orientation, age, power relative to the harasser), or some other characteristic. It is behaviour that is unwelcome and that could reasonably be expected to upset the person or people at whom it is directed CYCLING COMMISSAIRES OBLIGATIONS ARE TO: Ensure that they have the appropriate level of accreditation and insurance for their undertaken tasks. 4 The Director of Cycling SA may not act as a President Commissaire (only commissaire) in the Discipline he/she is Director of. The Head of the Technical and Capacity Building Commission of Cycling SA may not act as a President Commissaire (only commissaire). The Provincial Commissioner may not act as a President Commissaire (only commissaire) at an event being hosted in his/her province in the discipline he/she is commissioner of At the age of seventy (70) a Commissaire gives up the right to do UCI category races. He/she may only act as a line official or Commissaire schools races. They may also be used for training of Commissaires or as a second Commissaire in Schools or Masters events Ensure that the athlete s time with them is a positive and rewarding experience Within the context of the activity, treat everyone equally regardless of age, gender, sexual orientation, ethnic origin, ability or religion Respect the right, dignity, and worth of every human being All athletes are deserving of equal attention and treatment, deal with athletes as the Cycling Commissaire would want to be treated him/herself in the same situation Treat each athlete as an individual Respect the viewpoint, development stage and state of temper of each athlete Help each athlete to learn about the rules and regulations through positive and relaxed interactions Be fair, considerate and honest with athletes All dealings with athletes must be handled tactfully, and all criticism delivered in the most constructive manner possible Be professional and accept responsibility for all actions Display a high standard of language, manner, punctuality, preparation and presentation Display control, respect and dignity to all involved in Cycling Encourage athletes to display the same qualities Commit to providing quality service to athletes Maintain or improve current level of accreditation Seek continual improvement through performance approval, updating courses and ongoing Cycling Commissaire education Maintain appropriate records. 4

5 Operate within the rules, guidelines and spirit of the sport of cycling Abide by the rules and regulations of Cycling South Africa and the UCI Educate athletes on all aspects of the rules and technical regulations of the sport Any physical contact with an athlete shall be, appropriate to the situation and necessary for the further development of the athlete s skill Endeavour to avoid physical contact altogether Explain the situation and reason for physical contact and ask the subject s permission Where contact absolutely cannot be avoided, minimize. Try to keep the contact as brief as possible, and maintain a clinical, professional attitude at all times Situations where physical contact may be necessary e.g. holding athlete and bicycle for starting In any of these situations ensure the presence of other parties to reinforce the execution of the above directives Refrain from any form of personal abuse towards athletes Includes verbal, physical and emotional abuse Be alert to any form of abuse being directed toward athletes while they are under your control Refrain from any form of harassment towards athletes Includes sexual and racial harassment, sledging, racial vilification and harassment on the grounds of disability Refrain from initiating a sexual relationship with an athlete and discourage any attempt by an athlete to initiate a sexual relationship with another athlete Provide a safe environment for training and competition and do not expose athletes to unnecessary risks Ensure equipment and facilities meet safety standards Ensure equipment, and the racing environment is appropriate to the age, level of fitness and skill of the athlete Show concern and caution towards sick and injured athletes Endeavour to gain and maintain appropriate qualifications to allow the safe treatment of athletes in an injured or ill condition. 5

6 Allow further athlete participation in training or competition only when appropriate and where appropriate, based on medical advice Encourage athletes to seek medical advice Be a positive role model for the sport of cycling and all athletes Cycling Commissaire example is to be considered very carefully as athletes will closely follow. Cycling Commissaire must be professional in appearance and approach and their behaviour exemplary Everyone should: Be treated with respect and openness Have access to professional development opportunities Athletes should demonstrate high standards of ethics and sportsmanship and promote the development of good character and other important life skills. The highest potential of sports is achieved when participants are committed to pursuing victory with honour using core values; integrity, respect, responsibility, fairness and good citizenship Athletes should: live up to high ideals of ethics and sportsmanship and always pursue victory with honour treat all people with respect all the time and require the same of others participate with class, be a good sport, be gracious in victory and accept defeat with dignity, give fallen opponents help, compliment extraordinary performance, show sincere respect pre- and post- event consistently exhibit good character and conduct oneself as a positive role model always remember that participation in sports is a privilege, not a right should not engage in disrespectful conduct of any sort including profanity, obscene gestures, offensive remarks of a sexual or racial nature, trash- talking, taunting, boastful celebrations, or other actions that demean individuals or the sport treat Commissaire with respect; don t complain about or argue with official calls or decisions during or after an event, never use any profanity towards anyone not fight or show excessive displays of anger or frustration; have the strength to overcome the temptation to retaliate, never intentionally injure any participant or engage in reckless behaviour that might cause injury to oneself or others protect the integrity of the sport; ride according to the rules, live up to high standards of fair play, honour the spirit and the letter of rules, avoid temptations to gain a competitive advantage through improper techniques. 6

7 7.5. GRADING FOR ALL COMMISSAIRE WILL BE APPLICABLE AS FOLLOWS CYCLING SA Grade 1 Commissaire As a Grade 1 Commissaire you will be able to officiate at regional races but under the supervision of a qualified National Commissaire. An essential part of the practical training would be to gain experience as Time Keeper and Line Judge. This National Commissaire should act as the sponsor / mentor and submit to the Road Commissaire Manager recommendation any progress and motivation to upgrade to Grade The training will consist of the existing Line Judge, Time Keeper and Team Manager material plus an abbreviated version on the ethics and role/responsibility of a Commissiare. If possible a facilitator in the Province can supervise this initial course CYCLING SA Grade 2 Commissaire This grade will enable the Commissaire to officiate at Regional races but will not be allowed to enforce a disciplinary decision without the endorsement of the President Commissaire of the race. The President Commissaire must submit a report to the Road Commissaire Manager and should indicate where training or guidance is needed Training will consist of the following: The psychology of being a Commissaire Rules of the race open book exam Discussion and explanation of the responsibilities of a Commissaire closed book exam Convoy dynamics CYCLING SA Grade 3 Commissaire This Commissaire will be able to act as a President Commissaire at regional races Training will be the study of prepared lecture material as well as understanding and the study of the UCI regulations and rule guide. Should have worked at track races as well as all forms of road races Knowledge of the Practical Guides for Moto- Commissaire, Line Judges, Time Keepers and Road Commissaires as provided by the UCI and Cycling SA Understand the complexities of hosting a race and be able to communicate with the organisers Report writing course All theoretical training should by now be completed. 7

8 Application for upgrading is subject to experience. Cycle tour experience required CYCLING SA Grade 4 Commissaire The highest National Commissiare level This grade enables the Commissaire to officiate on a National level A National Commissaire can be independent Can be the President Commissaire at all races CYCLING SA Grade 5 Commissaire Allocated to a National Commissaire that has completed a UCI International Commissaires course successfully RACE REPORTS The President Commissaire and his/her panel have to complete and return a race report for all events within 5 days of an event National, A & B Category event reports will be sent to the Head of the Technical and Capacity Building Commission of Cycling SA and the Technical Manager for the discipline All smaller events will be submitted to the Technical Representative of the province The report to be completed: is attached. 8

10 Payments to Commissaires will only be made after: Full report has been submitted to Cycling SA or the provincial body Results have been confirmed and submitted to Cycling SA The Cycling SA Technical Manager of each discipline in conjunction with the Head of Technical and Capacity Building commission will: Appoint the President Commissaire for UCI events, National Championships, Category A and B events and all tours. The rest of the officials will be appointed by the Technical Manager of Cycling SA in conjunction with the President Commissaire A minimum of 1 (one) Commissaire will be contracted for every 70 (seventy) cyclists in National Events, Tours and Category A and B events At least 1 (one) Commissaire will be contracted for each age category event The Provincial Representatives will: Appoint officials for each Provincial, Inter- provincial and Category C and D event, and the provincial body has to reach its own regulations according to the safety aspects of these events All travel related costs (fuel, flights, accommodation, etc.) will be paid over and above the abovementioned fees proof of expenses need to be supplied All calculations will be done according to the standard Travel regulations of Cycling SA Organisers will pay for all meals from the eve of the event until the end of the event. 10

11 7.8. TECHNICAL CONSTITUTION Article 1 NAME The name shall be the Technical Commissaires of Cycling South Africa (hereinafter referred to as the TC) and it shall adopt the laws of the Union Cycliste Internationale (hereinafter referred to as the UCI) and Cycling South Africa (hereinafter referred to as Cycling SA). Article 2 RECOGNITION The TC shall be recognised as being the governing body for cycling Commissaires and Technical Regulations in South Africa. Article 3 OBJECTIVES The main objective of the TC shall be the control of cycling events throughout South Africa in accordance with the rules and regulations of the UCI and Cycling SA and to review all technical regulations and technical standards for competition. Ensure the application of these regulations and standards at all competitions. Compile a record of all Commissaires. Prepare and administer instructional and refresher courses. Article 4 MEMBERSHIP Membership of the TC shall be open to any Affiliate of Cycling SA. All registered Provincial Commissaire Bodies must be members of the TC. Each Commissaire Body will pay an affiliation fee every year. Members shall also forward an updated Constitution as amended from time to time. Article 5 JURISDICTION Area of jurisdiction shall be all areas, which fall under the jurisdiction of Cycling SA. The TC shall fall under the direct control of the Cycling SA Executive, through the Director Technical. The appointed authority of the provincial Associations responsible for Commissaires will provide feedback on the implementation of rule changes, complete Commissaire assignments for national events, which occur in their province. Recommend Commissaires for national upgrading to the TC and ensure the licensing of all Commissaires in the province. Article 6 COURT ACTION All registered Commissaires give up any right to any court action against the TC. Article 7 GOALS The goals of the TC shall be: To have a registered Commissaire Body in each province. To foster and train Commissaires for service to cycling. To attend to the interests of all officials whilst in the service of the sport of cycling. To arrange training and refresher courses for all Commissaire/trainees. To grade a Commissaire up and down, when and if necessary. To propose updates and amend rules and regulations of Cycling SA to bring in line with the rules and regulations of the UCI. To promote goodwill and fraternity amongst all cycling Commissaires. 11

12 To provide a full complement of officials for all National and International cycling events in Road, MTB, BMX, Para or Track. Article 8 GRADING AND TRAINING Grading and Training of Commissaire: The TC will be responsible for the upgrading of Commissiares and for presenting of courses to improve levels of competence of all Commissaires. The setting of advanced courses so as to make this possible from time to time. The TC will introduce a proper grading system for Commissaire. The TC will be responsible for holding National training courses for Commissiare. The TC will set examination papers and supervise examination for Commissiare from time to time. Article 9 CLOTHS The colours to be worn by Commissaire at National and International meetings will be as follows: Road and Track: As approved by TC and Cycling SA. MTB: As approved by TC and Cycling SA. BMX: As approved by TC and Cycling SA. PARA: As approved by TC and Cycling SA. U.C.I. Commissaire: As specified by Cycling SA or the UCI. At provincial level, a province may decide on their own dress code. Article 10 ANNUAL GENERAL MEETING a) Meeting The AGM of the TC shall be held annually and will take place at the same time as National Congress. All Provincial Associations will be given at least 6 (six) weeks notice of the date, place and agenda of the AGM. Any notices of motion for the AGM shall be in possession of the secretary not later that 4 (four) weeks before the AGM. It shall be the duty of the committee to submit at such meeting a report and financial statement covering the past year s work. Any proposals passed shall have immediate effect. b) Quorum No business shall be transacted at any meeting unless at least two thirds of the Affiliates are represented. Should there be no quorum of a meeting duly convened, the meeting shall automatically stand adjourned until the next Cycling SA gathering. Notice again being given in due manner by the secretary to all members and at the subsequent meeting those present shall constitute a sufficient quorum. c) Procedure at AGM The AGM shall devote itself mainly to the following activities: Reading of notice convening the meeting Confirming payment of subscription fees Reading and confirming the minutes of the previous AGM Reading and considering the report of the committee 12

13 Changes to constitution (have immediate effect) Reading and confirming the revenue and expenditure account and balance sheet for the previous year, and of thought fit, adopting it. The selection of the Management Committee (must consist of at least 6 (six) members) Confirming the appointment of the disciplinary board per discipline (3 (three) members) Dealing with any special business of which notice shall have been given Correspondence General business d) Voting at AGM All questions submitted to a meeting shall be decided by the meeting. Each paid- up Commissaire Association shall have one vote, with the chairperson having the casting vote. Voting shall be by show of hands or ballot. A majority vote shall prevail at all meetings except for amendments to the constitution, where a two- thirds majority is required. No proxy votes will be excepted, only Associations present at meetings shall have a vote. All members shall be bound by the decision taken and voted upon. Article 11 COMMITTEE a) Management Committee The TC shall be controlled by the Management Committee, which shall consist of 6 (six) elected members (who will be elected from the elected representative from each active Provincial Cycling Commissaire Body). The election of the Management Committee will take place every 2 (two) years. a) Chairperson (Director Technical Cycling SA) b) Manager: a) Road b) Track c) Mountain Bike d) BMX e) Para- cycling c) Secretary who shall be appointed by the Chairperson and who will have no voting powers. They shall have the powers to sit in all cases of urgency. Minutes of all the meetings of the management Committee shall be kept and be submitted at each succeeding meeting for confirmation. b) Powers of Management Committee To run a banking account in the name of the TC and to draw, accept and endorse cheques, bills of exchange and promissory notes in connection with the TC. The account will be under the control of Cycling SA. The Management Committee has the power (in consultation with all members) to submit a recommendation to the Cycling SA to withdraw any Commissaire card if such a Commissaire is non- active for no valid reason or if the official discredits the TC or any other affiliated body. 13

14 The Management Committee has the power to enter into negotiations or correspondence with any body or organisation with regard to sponsorships or any funds as it sees fit under the TC banner. The Management Committee shall be the sole body through which requests for Commissaires to officiate at events shall come through in writing. The Commissaire will be drawn from paid- up cycling associations and must be active in their province. c) Duties of Management Committee Director Technical: Road: Track: Mountain Biking: BMX: Para- cycling: Secretary: It shall be the duty of the Chairperson to preside at all meetings of the association. The Chairperson shall be a member of all Committees. The Chairperson must sign any correspondence from the association or be aware of any documents signed by the secretary on his/her behalf. It will be his/her responsibility to make decisions on all technical matters and report directly to the Cycling SA Management Committee. To assist and advise on all aspects of Road To assist and advise on all aspects of Track To assist and advise on all aspects of Mountain Biking To assist and advise on all aspects of BMX To assist and advise on all aspects of Para- cycling It shall be the duty of the Secretary to take minutes of all meetings, and to receive and dispatch all correspondence to and from the TC. In general, all such other duties as usually devolved upon a secretary. The name, address and phone number of the newly elected Committee shall be forwarded to Cycling SA. d) Management Committee Responsibility to Cycling SA The TC shall at the Cycling SA Congress submit a summary of the work for the past 12 (twelve) months. e) Vacancies in Management Committee Any vacancies may be filled at either a special meeting or if less than 3 (three) months to go at the AGM. Article 12 FINANCE a) Accounts and Money s All the money of the TC shall be lodged in such a bank convenient to Cycling SA. b) Subscriptions The subscription fees for affiliates shall be the sum as decided upon at the AGM, payable per annum on 31 st December of each year. All new Affiliates to pay a full fee for any part of a year when joining. 14

15 All Affiliates failing to pay their subscription on due date without a reason satisfactory to the Management Committee shall forfeit all voting powers at meetings. c) Funds Funds for running the day- to- day operations and extra ordinary expenses for the TC to operate successfully will be raised in the following manners: Grants received from Cycling SA Fines Donations received from sponsors Levies raised against National Tours and events Affiliation fees paid by Provincial Commissaire Bodies each year Levies will be set annually by the TC and may change from event to event. d) Expenses/Income The Management Committee must approve all Income and Expenses. e) Assets Register An assets register must be kept by the Secretary, which should be available at meetings and audited annually. Article 13 DISSOLUTION CLAUSE In the event of the dissolution of the TC, all assets shall be handed over to Cycling SA and no financial gain shall accrue to any individual whether a member of the TC or otherwise. The dissolution can only be affected with the unanimous consent of all Commissaire Body Affiliates. Article 14 DISCIPLINE The TC will appoint a disciplinary committee who will be responsible for dealing with any disciplinary matters regarding Commissaire of the TC within the Constitution of the Cycling SA (3 (three) members). Affiliates have the right to discipline their own Commissaire. Article 15 ALLOCATION OF NATIONAL CYCLING COMMISSAIRE COLOURS A NATIONAL COMMISSAIRES COLOURS 1. The allocation of National Commissaires Colours to officials will be done under the following conditions: The Commissaire name must be forwarded to the Executive of the TC by the Affiliate. The Commissaire must have at least worked at 5 (five) International events as a qualified Commissaire. The Commissaire behaviour and character must be such that they are worthy of the colours and do not conflict with the TC or the Cycling SA constitution. 15

16 B COLOURS FOR SERVICE 1. The allocation of National Colours to officials will be done under the following conditions: The Commissaire name must be forwarded to the Executive of the TC by the Affiliate. The Commissaire must have at least 10 (ten) years consecutive service as a qualified Commissaire. The Commissaire behaviour and character must be such that they are worthy of the colours and do not conflict with the TC or the Cycling SA constitution. The TC shall take everything relevant into consideration regarding every proposed case. The affiliated Associations together with a curriculum vita of the nominee shall submit nominations to the Secretary of the TC, at least 6 (six) weeks before the AGM. The awarding of colours will be ratified at the AGM each year. C LIFE MEMBERSHIP a) Life Membership may be granted at the AGM to persons who have rendered exceptional service to cycling for at least 20 (twenty) years. b) The number of Life Members shall be limited to 22 (twenty- two) at any one time: Road and Track, 10 (ten); Mountain Bike and BMX, 5 (five) each; Para- cycling 2 (two) members. c) The affiliated Associations together with a curriculum vita of the nominee shall submit nominations to the Secretary of the TC, at least 6 (six) weeks before the AGM. d) The voting of Life Membership at the AGM shall be by secret ballot. The majority of votes shall be binding. e) Life Members shall not, by virtue of their membership, be entitled to vote at any meeting of the TC. Article 16 AMENDMENT a) Alterations and additions of Constitution No alterations or additions shall be made to the Constitution except at the AGM or at a special meeting convened for that purpose by a majority of at least two thirds of the votes of members present. Notice of motion for any such alterations or additions must be sent to the Secretary of the TC at least 6 (six) weeks prior to the date of the AGM or special meeting. Such amendments to be posted to all members within 14 (fourteen) days. 16
