1 Boise State University Effective Date: March, 2011 BSU Policy #: 9010 PEDESTRIAN AND NON-MOTORIZED WHEELED-TRANSPORT SAFETY POLICY Purpose: To establish the policy and necessary standards for the safe use of non-motorized wheeled and pedestrian transportation on Boise State University Boise State owned and leased properties. Additional Authority: The Boise State University Bicycle/ Pedestrian Safety Master Plan: January 2010 Boise State University Statement of Shared Values Scope: Policy applies to all students, employees, contractors, volunteers, and visitors on universitycontrolled property. Responsible Party: Vice President for Finance and Administration, Transportation & Parking Services, Definitions: All Wheels Down When all wheels (or one foot in the case of rollerblades and roller-skates) are in contact with the ground, and only the ground, at all times. Pedestrian Any person afoot and any person operating a wheelchair or a motorized wheelchair or an electric personal assistive mobility device, as prescribed by a licensed physician. (Idaho Statutes Title 49, Chapter 1) A pedestrian may be accompanied by a wheeled device such as a bicycle, wheeled luggage, skateboard etc., as long as said device is being pushed, pulled, or carried. Rider - The users of bicycles, skateboards of any type, roller blades, and all other forms of wheeled transportation, whether human-powered or not. Dismount - The action required for a Rider to become a Pedestrian, as defined herein. A dismounted Rider is one who is afoot and accompanied by a wheeled transportation device which is being pushed, pulled or carried." Pedestrian Priority Zone A designated area where Riders are required to travel on foot. Bicycle Priority Route A designated area or designated routes where the primary mode of travel is intended to be by bicycle. Abandoned Bicycle Any bicycle that has been left unattended for a period greater than 30 calendar days. Page 1 of 5
2 Inoperable Bicycle Any bicycle with flat tires, broken members, or missing key components. I. Policy Statement POLICY It is the policy of Boise State University ( Boise State ) to maintain a healthy and safe environment conducive to learning for all students, faculty, staff, and visitors. Therefore, Boise State encourages the safe and responsible use of non-motorized transportation. Boise State is also dedicated to supporting sustainable forms of transportation as part of campus-wide effort to promote green living for the benefit of all. As part of this support, Boise State encourages the use of bicycles and other alternative forms of transportation including walking. This policy seeks to improve the pedestrian and cyclist experience on campus by setting a common foundation of rules, expectations and designating certain areas of campus as pedestrian or bicycle priority areas. II. Campus-Wide Safety Measures A. All Wheels Down Campus - For the purpose of preserving the health and safety of persons utilizing campus walkways, all university owned or leased buildings, facilities, and properties are designated as All Wheels Down Zones. B. Three Feet to Pass Riders shall not come within less than three (3) feet of pedestrians while riding. If Riders cannot pass pedestrians while maintaining the three foot minimum distance they shall dismount. The requirement is in effect throughout the university campus and at all hours of all days. C. Pedestrians and riders are required to be aware of and obey any campus signage for the safety of all. D. Traffic Flow - Pedestrians determine the rate of traffic flow. Riders must move through the flow of traffic without disrupting it, which may necessitate dismounting. III. Pedestrian Priority Zones (see map, Appendix A) A. Boise State designates the following areas as Pedestrian Priority Zones: the area commonly known as The Quad. The boundaries of this Pedestrian Priority Zone are as follows: The area abounded by Business, Memorial Plaza, Albertsons Library, Hemingway Center, Liberal Arts, Administration Building, and Mathematics/Geosciences. B. With the exception of wheelchair users and users of other mobility devices prescribed by licensed physicians, Boise State requires all riders to dismount Page 2 of 5
3 their transportation devices when within marked Pedestrian Priority Zones except where provided herein. C. The requirement to dismount while in the Pedestrian Priority Zone is limited to the hours of 7:30am to 6:00pm Monday through Friday. IV. Bicycle Priority Routes (see map, Appendix B) A. Boise State University will designate Bicycle Priority Zones. B. Bicycle Priority Zones-pedestrians will yield right of way to bicyclists when traveling on marked or signed Bicycle Priority Routes. Cyclists are expected to maintain appropriate speeds according to the specifications in this policy document while utilizing these routes. V. Bicycle Parking Bicycles must be parked in official, University-provided bicycle parking racks. Bicycles that create safety or environmental hazards or block access to handrails, ramps, parking meters, signage, or building entrances or bicycles which are locked to light poles, posts, landscaping features, handrails or any other object other than a bicycle rack may be issued citations and impounded at the owner s expense. VI. Abandoned and Inoperable Bicycles If a bicycle is deemed abandoned or inoperable it may be tagged immediately for pending impoundment and, if the bicycle is registered, an attempt to contact the owner will be made. If the owner has not made contact following a 72 hour period, the bicycle may be immobilized or impounded and an attempt to contact the owner will be made again. Once impounded, the bicycle will be securely stored for 30 calendar days. An owner may reclaim their bicycle within 30 calendar days from the date of impound by contacting Boise State Transportation & Parking Services with the bicycle serial number and bicycle description. Owners must also sign an affidavit of claim of ownership to reacquire an impounded bicycle. After the 30 calendar day waiting period, Boise State may dispose of the property at its sole discretion. Boise State is not responsible for replacing locks, chains, and/or cables destroyed during the impound procedure. VII. Failure to Comply Boise State University reserves the right to initiate disciplinary procedures to any individual found to be in violation of this policy. Page 3 of 5
