1 STUDENT DRESS CODE AND APPEARANCE Policy Code: 4305 A. Standard Dress Code (Required for all schools) The Wayne County Public Schools Board of Education respects a student s right to choose his or her style of dress or appearance. However, the Board of Education will require that students adhere to standards of dress that are compatible with the requirement of a good school environment. All students are expected to be groomed and dressed appropriately for school and school activities. In the opinion of the principal or his/her designee, if a student s dress or appearance is such that it (1) disrupts the learning environment, (2) constitutes a threat to health or safety, (3) is construed as provocative or obscene, or (4) is lacking in cleanliness, the principal or the principal s designee may require the student and student s parent or guardian to take appropriate action to remedy the situation. The principal shall have the authority to implement the school dress code and appearance policy in a manner that is age appropriate, and reasonable consideration will be made for those students who, because of a sincerely held religious belief or medical reason, request a waiver of a particular guideline for dress or appearance. The waiver request must be in writing from the parent or guardian and must be approved by the principal or his/her designee. Reasonable accommodations shall be made by the principal to accommodate students involved in special duties, activities, or projects approved by the school. This would include but not be limited to: athletics, vocational classes and projects, P.E. classes, special events, or other activities that would allow for non-conforming dress on a school campus or during a school sponsored event. Disciplinary action will be taken for any violation of the dress code in accordance with AR 4305 and Policy 4300 (Discipline: Responsibility of School Personnel and Students for School and Bus Conduct). Students who do not comply with the school dress code and appearance policy may be excluded from participating in certain school programs, including graduation ceremonies. (Fowler vs. Williamson, 39 N.C. App. 715, 251 S.E.2d 889 [1979].) Copies of the Student Dress Code and Appearance Policy will be made available to students and parents annually. Specific guidelines listed below will apply to all students: 1. Shorts, Skirts, dresses, or other clothing cannot be more than three inches above the top of the knee. 2. Shirts, tops, and dresses must cover the top of the shoulder and the armpits and have sleeves or be worn with a top that does have sleeves or an undergarment that covers the armpits. 3. Shirts and tops should be long enough to cover the midriff when sitting or standing; and shirts, tops and dresses must be buttoned high enough to cover the chest and the back of the body cannot be exposed. 4. No sagging pants allowed and pants cannot be worn with the waistband below the hipbone. 5. Underwear cannot be visible at any time.

Oversized clothing or too-tight clothing such as spandex bicycle/biker shorts, etc. will not be allowed. 8. Any form of attire which is indicative of gang affiliation is prohibited. 9. No headwear (hats, caps, hoods, kerchiefs, curlers, sweatbands,etc.) or sunglasses can be worn inside school buildings. 10. No bandannas. 11. Clothing will not be allowed that promotes alcoholic beverages, tobacco, the use of controlled substances, depicts violence, is of a sexual nature, or is of a disruptive nature. 12. Shoes must be worn at all times and in accordance with special requirements such as P.E. classes, ROTC, science labs, etc. Shoes that have laces must be laced and tied. 13. Clothing must be worn appropriately (nothing inside-out, backwards, rolled up pants leg, unfastened bib overalls, etc.) and belts must be buckled and worn at the waistline. 14. There will be no jewelry affixed to a student s nose, tongue, lips, cheek or eyebrow. 15. Clothing designed for school athletic events, i.e. cheerleader outfits, etc. that do not meet the above guidelines cannot be worn during the instructional day unless appropriate outer garments are worn over the outfit. 16. Students in grade 4 through 12 must wear a belt if the garment has belt loops. 17. For security reasons, coats may not be worn inside the school building during the school day. Coats may be worn during class changes if the student is exiting the building. Coats may be worn to school and placed in the student s locker or hung in the classroom.

Higher Standard Dress Code (adopted by school) With many schools across the country moving toward more restrictive student dress codes, the Wayne County Board of Education allows the opportunity for individual Wayne County schools to implement a higher standard dress code. If the higher standard dress code is implemented in a school, the clothing requirements in the code are in addition to the requirements already in effect as specified earlier in this policy. The requirements of the higher standard dress code include: Pants, Skirt, Shorts, Jumper, Dresses, Skorts Colors: Solid tan khaki, solid navy blue, solid black, solid dark green, solid pink Must be free of labels, graphics and embroidery of any kind Must have no more than six pockets, including coin pocket No overalls and coveralls Approved shirt or top required when wearing a jumper Shirts Colors: Solid white, solid red, solid light blue, solid navy blue, solid dark green, solid pink Must be free of labels, graphics, and embroidery of any kind Long or short sleeve (sleeveless shirts are not permitted) Must have collars Must be tucked in at all times Other Approved Tops Must be free of labels, graphics, and embroidery of any kind (except school spirit wear as approved by principal) Principal approved spirit wear School letter jackets Oxford button down collar dress shirts in approved solid colors Mock turtlenecks/turtlenecks in approved solid shirt colors Crew neck sweaters, vests, sweatshirts, and hoodies in approved solid shirt colors worn over the collared shirt (do not have to be tucked in, but can not hang past the straddle of the pants) T-shirts in approved solid shirt colors worn under the collared shirt The following procedures are to be followed before a school may implement the higher standard dress code. 1. Upon the initial adoption of this policy by the Wayne County Board of Education, all schools will survey parents to determine the level of support for the higher standard dress code. 2. The survey instrument will be provided by the central administration and sent home with each student. Parents with more than one child in a school will have more than one vote.

At any school, 70% of survey respondents must be in support of the higher standard dress code in order for the policy to be implemented in the school. 4. The school may survey the parents again, in a subsequent year, by re-administering the survey. The decision to re-administer the survey is to be made by a majority vote of the school s Parent Advisory Council. A criterion of 70% of survey respondents must be met to accept to the higher standard dress code in a school that has not implemented it or to reject the higher standard dress code in a school that has implemented it. The survey may be administered only one time per school year. 5. A minimum of two months must elapse between the adoption of the higher standard dress code policy at a school and implementation of the policy to provide parents with ample time to secure appropriate clothing for their child(ren). 5 AR 4305 SUBJECT: STUDENT DRESS CODE AND APPEARANCE Student violations of Policy 4305 Student Dress Code and Appearance shall be handled by the principal or the principal s designee and in accordance with Policy 4300 (Discipline: Responsibility of School Personnel and Students for School and Bus Conduct); Policy 4301 (Due Process); and Policy 4303 (Student Behavior Policies). Appropriate disciplinary action for violations of Policy 4305 will include the following: 1st Offense: Inform the student that they have violated Policy Give the student an opportunity to change into acceptable clothing by using available clothes at school or by calling a parent to bring clothes. If neither of these options is used, the student may be placed in ISS or isolation for the remainder of the day. Notify parents informing them that the student has violated the Student Dress Code and Appearance Policy and that a repeat infraction will result in ISS, suspension or out of school suspension. 2nd Offense: A second infraction of Policy 4305 will be considered as defiance. The student will be sent to ISS, to school isolation or may be suspended for one day. 3rd Offense (and additional): A third infraction of Policy 4305 will result in the student being suspended out of school for three days and not being allowed to return to school until a conference is held with the parents and the student. Disciplinary action may vary if a student has a cumulative record of other student conduct violations. Issued: June 4, 2001; Revised: August 7, 2002
