7 1. REGISTRATION OF PLAYERS 1.1. Player Registration It shall be the duty of all clubs to ensure that each of its playing members are registered with the BDCA on both an approved form and the MyCricket website Representative Cricket Availability All players shall indicate on an appropriate registration form, their availability for representative cricket in either the Opens or Under 21 district sides. Any player failing to indicate his/hers unavailability shall be deemed eligible for selection and shall be subject to all rules and rights that apply to representative players Unregistered Players Clubs playing unregistered players in competition matches shall forfeit such match or matches to their opponents and shall be liable to disqualification from taking part in any competition under the BDCA control. 8 2. TRANSFER AND CLEARANCES 2.1. Clearances and Transfers a) A player transferring within the BDCA must complete a BDCA Player Transfer Form. This form must be signed by three (3) parties. 1. The Player, 2. The club they are leaving Executive, 3. The Club he is joining Executive. This form must be in the possession of the BDCA Registrar no later than 8pm on the Friday before the player takes the field. b) A player transferring from outside the association, it is the responsibility of either the player or the club he is joining to gain written clearance from the club he is departing c) No clearances or transfers will be permitted on the MyCricket system alone Unfinancial Player List a) All clubs must submit to the Treasurer of the BDCA a list of all their current unfinancial players no later than the 31 st of August each year. b) If, after the 31 st of August, a player seeks a financial clearance from a club and he/she is not on the unfinancial players list then the club has no course of action and must release such player Limit on a Player Change of Clubs A player will be eligible to change clubs within the BDCA only once in any one season after initially being registered Complaint from External Clubs Where any proven complaint arises from a club outside the association regarding a player s clearance or registration, the player shall be stood down until that player submits written proof that all obligations have been fulfilled with that club or association Penalties Any club that fields a player in breach of any part of this By-Law shall forfeit such match or matches to their opponents and shall be liable to disqualification from taking part in any competition under the BDCA control Time Periods for Transfers between Clubs in the Association Transfers are allowed only between the 1 st of September and 31 st December if the player has registered and played for a club in current season. 9 3. DISCIPLINARY/DISPUTES/PROTEST 3.1. Match Review Committee (MRC) The MRC shall consist of members from either or both the BDCA Management Committee and the BDCA Judiciary and shall be elected at the first Committee Management Meeting Duties of the MRC The duties of the MRC shall be to adjudicate on all disciplinary matters, match disputes and protests, and to render a decision according to the facts placed before it. The MRC shall deal with all matters outlined in the BDCA Code of Conduct, BDCA Match Rules and BDCA By-Laws. All MRC meetings shall be open to the presence of all parties who shall state their respective case. (These cases do not include individual(s) Judiciary Hearings) 3.3. Breaches of the Code of Conduct For matters relating to breaches of the Code of Conduct the appropriate procedures are described in the BDCA Code of Conduct. Any appeal of a decision relating to the Code of Conduct breach must be accompanied by a fee of $25, which is nonrefundable BDCA Adjudication Required Any club that requires the BDCA s adjudication on any dispute or protest relating to a match under the control of the BDCA, shall forward a clear written statement of the matter in dispute or under protest to the BDCA Secretary by 5pm on the third working following the completion of the disputed match. The statement shall be signed by the Secretary of the affected Club and must be accompanied by a fee of $25, which is non-refundable Appeals against the Match review Committee Decision Appeals against the decision of the MRC, when convened for disputes and protests must be accompanied by a fee of $25, which is non-refundable. These appeals must be lodged by 5pm of the third working day following notification of the MRC decision. A meeting of the BDCA Management Committee will then be convened to consider such appeal. 10 3.6. Appeals against the BDCA Management Committee Decision Any subsequent appeal relating to By-Law 3.5 must be lodged with the Secretary of the Mitchell Cricket Council by 5pm on the third working day following notification of the decision of the BDCA Management Committee. Any fees charged by the Mitchell Cricket Council for this appeal will be forwarded to the relevant parties Report from an Umpire No fees are payable when an umpire is lodging in the course of a normal match Effect on Penalties Imposed Any penalties imposed are effective under the By Laws of NSWCA & NSWCCA for any match conducted under the auspices of the affiliate of the NSWCA & NSWCCA 3.9. Media Involvement The BDCA insists that there be no media involvement regarding matters before a judiciary, or subject to an appeal to a higher authority, until such matters are concluded and/or all avenues of appeal are exhausted. Any person/s or bodies breaching this By-Law will be charged with acting contrary to the interests of the game and/or bringing the game into disrepute Request for Information on Matters Any request for information or discussion regarding such matters is to be directed in writing to the BDCA Secretary or the appropriate governing body Power of the BDCA Management Committee The Management Committee of the BDCA, or such sub-committees, shall have power to: enquire into, and determine any alleged breach of the BDCA By-Laws & Match Rules, even though no appeal or protest has been lodged, and the time for lodging such appeals or protests has expired, and shall have the same powers in dealing with such alleged breach as if the appeal or protest had been lodged in accordance with such rules, and Impose a penalty for the breach of these By-Laws where no penalty has been provided therein. 11 4. GRADE AND COMPETITION STRUCTURE The purpose of this proposal is to Streamline the BDCA Competition and make each grade as competitive as possible First Grade a) To have a First Grade side, a club must have a minimum of one (1) other side in the lower grades. b) Each club will be limited to only one (1) side in First Grade. c) All First Grade games must be played on turf. d) The First Grade Competition will play a mixture of One (1) Day and Two (2) Day games. If so decided the BDCA may incorporate rounds of T20 matches into the competition. i. Points for a T20 victory will be half the value of a victory in the One Day format. ii. If a Draw occurs, there will be no Super Over, the match will be deemed a Draw. e) At the completion of the One (1) Day games, the top team on the competition ladder will be declared One Day Champions 4.2. Second Grade a) Second Grade sides firstly will be nominated by the clubs and then final grading by the BDCA Management Committee. b) Second Grade games will be played on turf, however if there are not enough turf grounds available then the balance of the round will be played on synthetic wickets. c) Second Grade will play a mixture of One (1) Day and Two (2) Day games. If so decided the BDCA may incorporate rounds of T20 matches into the competition. f) At the completion of the One (1) Day games,, the top team on the competition ladder will be declared One Day Champions 4.3. Presidents Cup a) Clubs may nominate no more than 2 sides in the Presidents Cup Competition. BDCA - BY-LAWS Page 11 of 27
12 b) Teams in this grade must include a minimum of four (4) players between the age of 13 and 17 (on the 1 st of October) and a minimum of four (4) players over the age of 17 (on 1 st of October). These restrictions also apply if a replacement player joins the team. Failure to meet either of these MINIMUM requirements will result in forfeiture of all points gained in that game. c) Presidents Cup will play a mixture of One (1) Day and Two (2) Day games. If so decided the BDCA may incorporate rounds of T20 matches into the competition. d) Presidents Cup when available will play games on turf with the balance of the round to be played on synthetic wickets. e) At the completion of the One (1) Day games, the top two (2) teams will compete in the One Day Final, which will be played on a Sunday determined by the BDCA Match Committee. f) A Two Day game in Presidents Cup will consist of 76-over days, with a compulsory close. g) A Grading Committee shall be appointed to review all Senior Cricketers playing in the Presidents Cup Grade, so as to determine whether said players would need to be restricted, and what their restrictions could be. i. If a Senior Cricketer drops down from Second Grade, they will automatically be required to retire their Batting at 50, and be allowed to return to the crease as the last Wicket BDCA One Day Third Grade Clubs may nominate no more than two (2) sides for the Third Grade Competition a) All Third Grade games are to be played on Synthetic wickets b) All Third Grade games are to be one day games c) All Third Grade games are to be a maximum of 35 overs. d) If more than ten (10) sides nominate for the Third Grade competition, then the BDCA Match Committee may determine that a new Grade be created. This Grade will be called Fourth Grade. BDCA - BY-LAWS Page 12 of 27
13 4.5. Extra Sides per Grade a) If clubs wish to nominate extra sides in a grade than outlined in the conditions above, they must do so in writing to the management committee at least 4 weeks prior to the season. BDCA - BY-LAWS Page 13 of 27
14 4.6. Monday Night T20 Competition a) Each side registering with the Monday Night T20 Competition must be affiliated with a registered club of the BDCA b) A club may enter as many teams as they desire. c) The competition will be split into two (2) pools d) Each pool will play on alternate Monday nights until the end of season e) The top two (2) teams in each pool will play in the Cup Final series and the 3 rd and 4 th ranked sides in each pool will play in the Plate final series. f) An individual may not play for two (2) teams in the same pool. g) An individual may play across two (2) pools, however they must nominate their first choice side before taking the field with their second side. The side chosen will be the only team they may play for in the final series. If the first choice side does not make finals then the player may not switch to their second choice side if they make finals. h) If a team is in breach of the above By-Law they may face disqualification and lose the semi-final. i) A sign on date will be set by the BDCA and this is the only way sides will be accepted into the competition Bathurst Premier League BPL The BDCA may run a BPL competition during season. The details of Captains, Player Auction, game format and dates to be worked out so it does not clash with Representative and BDCA controlled matches. Details to be forwarded to clubs by the BDCA Secretary Rights of the BDCA Management Committee All of the above competitions above are under the control of the BDCA and all players, club officials and spectators are bound by the BDCA Code of Conduct. The BDCA will supply draws for each of the competition in due time to clubs and umpires as well as displaying them on the BDCA Website. The BDCA has the right to change a draw and/or a ground but must supply sufficient notice to both clubs and umpires. The BDCA has the final decision on teams grading and the competition structure. 15 4.9 Team Declaration of More than one side in a grade If a club nominates more than one side in a grade they must comply with the following guidelines. 1. They must submit a minimum of six (6) core players to the BDCA before the commencement of Round 1 2. The 6 core players may not switch between sides in that grade. 3. A player cannot play more than 6 games for 2 sides in that grade. 4. Before finals clubs must submit teams to BDCA management committee for review. BDCA - BY-LAWS Page 15 of 27
16 5. CLUB AFFLIATION AND TEAM NOMINATION REQUIREMENTS 5.1. Club Affiliation All clubs wishing to participate in any game controlled by the BDCA must be affiliated with the BDCA and be registered on the MyCricket website and also provide the BDCA with a Certificate of Currency prior to the commencement of the start of the first round of the competition. Failure to do so may result in the forfeit of match or matches to their opponents and the possible disqualification from taking part in any competition under the BDCA control Club Nomination Fees The BDCA does not accept any monies for clubs affiliation or nominations. BDCA - BY-LAWS Page 16 of 27
17 6. FEES AND LEVYS 6.1. Team Registration Fees a) The levy imposed on clubs to cover the estimated overheads of the Association. b) The registration fees shall be determined by the BDCA Committee of Management. c) Levies shall be paid in Three (3) instalments, dates to be determined by management committee. d) BDCA Treasurer to distribute invoices to each club prior to Round Discounts on Fees A club that provides the BDCA with use of their own ground shall receive a discount in its registration fees. This fee will be set prior to the start of each season in the 1 st meeting of the Management Committee after the AGM 6.3. New Clubs New clubs must provide payments of their registration fees in two (2) payments. The 1 st shall be on the last day of November and the 2 nd on the last day of January Withdraw of Clubs/Teams a) If a club withdraws from the BDCA Competition they remain liable for all remaining fees and their players will be bound by By-Law 7.2. b) If a club withdraws a team from a BDCA competition before the start of the season no fees will be charged however if the season has commenced the BDCA Management Committee reserve the right to impose a fee on the withdrawn team Umpire Fees Umpire fees will be payable in accordance with the fees set by the Bathurst branch of the Mitchell Cricket Umpires Association Inc. The Umpires Association will invoice the BDCA for all umpire fees and the BDCA will recover these fees from the clubs concerned. All grand final umpire fees will be paid for by the BDCA. 18 7. UNFINANCIAL CLUBS 7.1. Definition A club shall be deemed unfinancial if it has not paid its monies Thirty (30) days after the date of the account. An unfinancial club shall be automatically suspended until the full amount of monies owing is paid Liabilities for Monies Owed Extended to Players A player from a club that is deemed unfinancial and no longer participating in the BDCA competition/s will be liable for the amount owing by the unfinancial club on a pro-rata basis. The player must pay the pro-rata amount to the BDCA before their clearance and registration with their new club will be accepted Ineligible for Awards Any Club or member of a club that is unfinancial at the completion of the regular season competition rounds of the BDCA shall be deemed ineligible for any BDCA awards and Premiership grants. 19 8. REPRESENTATIVE TEAMS 8.1. Selection Committee A selection committee shall be elected annually by the Management Committee. Nominees may be nominated by any delegate or member of the Association. The selection committee will be made up of four (4) individuals, one (1) being elected as Chairman of Selectors. The captain shall also be part of the selection Committee Player Availability All players competing in the BDCA 1 st Grade Competition will be deemed available for selection in representative teams, unless they have been provided with an exemption by the BDCA Management Committee Player Exemptions a) First Grade players seeking exemption from representative selection must complete a BDCA representative form (available from BDCA Website) to be submitted to the BDCA Secretary prior to the 15 th September each year (secretary@bathurstdca.com). b) An exception meeting will be held between the BDCA Selectors and the BDCA Management Committee to determine player s availability for Representative Cricket. c) Ten (10) days prior to the first representative match, a list of exempt players will be handed to the Chairman of Selectors by the BDCA Secretary Team Selection and Notification Teams will be selected and players individually notified, either in person, by telephone or by SMS, five (5) days prior to any match. The selected team will be published on the BDCA website and when possible will be published in The Western Advocate. BDCA - BY-LAWS Page 19 of 27
20 8.5. Selected Player Withdrawing from Team a) Any player who is selected and wishes to withdraw, must notify either The Chairman of Selectors and/or The Captain of the side no later than forty-eight (48) hours before the commencement of the match. b) At the discretion of the Selection Committee, a player may be made ineligible to take the field for their club side on that weekend for breaches of By-Law 8.5a Player Non-Attendance at Match a) Any selected player who does not present him/herself for the match and did not notify either the Chairman of Selectors of their unavailability shall be issued with a breech notice by the Match Review Committee. b) At the discretion of the Match Review Committee, a two (2) Club Match suspension penalty may be issued for the first breech of By-Law 8.6a. Further Breaches of By-Law 8.6a may result in heavier penalties. BDCA - BY-LAWS Page 20 of 27
21 9. BDCA AWARDS 9.1. Batting and Bowling To qualify for individual averages for a season, a player shall achieve the following in the season as a minimum. Batting- Score 200 runs in any one grade in no less than 5 innings Bowling- Take 20 wickets in any one grade and bowl a minimum of 300 balls. If the above criteria are not met then the qualification shall be reduced by 25% Bathurst Cricketer of the Year BDCA will set criteria for the Bathurst Cricketer of the Year.* The Bathurst Cricketer of the Year will primarily be awarded to those who have completed a successful season in First grade. The Bathurst Cricketer of the Year will be determined by the amount of Champion Player Points they have accumulated via the MyCricket database Umpire Awards The Bathurst Umpires will decide on two (2) awards. Best and Fairest Club and Best and Fairest Player. These awards are based on a point system and are for 1 st Grade only Best Junior in Senior Cricket To be eligible for this award the junior player must be competing in the BDCA competition Club Championship The Club Championship shall be awarded to the leading club who has a first grade side plus two (2) other teams based on the following formula: An average of all the clubs sides points at the end of the round robin fixtures. All BDCA statistical awards will be awarded based on results entered in the MyCricket website. It is the responsibility of all Clubs to have their results/scores entered in MyCricket. If a player happens to have the best statistics for an individual BDCA award, but their Club has not entered their scores, then said player will not be eligible for said award. 22 9.6. Grand Final Player of the Match The officiating umpires will adjudicate who they believe is the Grand Final Player of the Match Hall of Fame The successful candidates for the Bathurst & District Cricket Hall of Fame will be awarded at the BDCA Annual Presentation Night. a) For someone to be considered for the Hall of Fame, a Club/individual/group must put forward a nomination to the BDCA Secretary via . b) The successful candidate shall have met the following: i. Minimum total of 10 years playing Bathurst First Grade (BOIDC applies). ii. iii. Player who was respected by players and officials. Must no longer be playing First Grade in Bathurst. c) Full details for nominations can be retrieved from the BDCA Secretary (secretary@bathurstdca.com) Roll of Honour The successful inductees into the Bathurst & District Cricket Roll of Honour will be awarded at the BDCA Annual Presentation Night. a) For someone to be considered for the Hall of Fame, a Club/individual/group must put forward a nomination to the BDCA Secretary via . b) The successful candidate shall have met the following: i. Minimum of 10 years of service on the BDCA Committee. ii. iii. Provided a recognised service which has been beneficiary to Bathurst Cricket. Must no longer be sitting on a BDCA Committee. c) Full details for nominations can be retrieved from the BDCA Secretary (secretary@bathurstdca.com). BDCA - BY-LAWS Page 22 of 27
23 10. PREMIERSHIP WINNING TEAM Premiership Cups The BDCA will allow Premiership winning side to take their Perpetual Cup and/or Plate back to their home venue until the 31 st January, it then has to be returned to the BDCA Management Committee in the same condition it was taken. Failure to return Cups and Plates will incur a $300 fee which will be added to the clubs season fees. A form signed by a club official is required prior to the cup/plate being released to the club Prize Money On an annual basis the BDCA Management Committee may decide to award prize money or any other form of acknowledgement to Premiership winning sides to be presented at the Presentation Night Clubs to be Financial All Clubs must be financial to receive any prize money Joint Premierships In the instance of a joint Premiership then the prize money will be divided evenly between the two (2) winning sides. 24 11. HONORARIA BDCA will pay the following Honorarium to the following Executive Members President -$300 Secretary-$300 Treasurer-$300 BDCA - BY-LAWS Page 24 of 27
25 12. ALCOHOL & ILLICIT SUBSTANCES a) In any match controlled by the BDCA no person is permitted to: Take alcohol or illicit substances onto the playing field, or Take the field under the influence of alcohol or an illicit substance. b) Persons may be cited by the BDCA Secretary to appear before the BDCA Judiciary Committee. c) If a breach of By-Law 12a is proven against any person, team or club the BDCA Judiciary Committee may impose one or more of the following penalties: a fine of $150 a suspensión loss of all competition points expulsion from the competition BDCA - BY-LAWS Page 25 of 27
26 13. TIDINESS OF GROUNDS a) All grounds need to be left in a clean and tidy state at the completion of the days play b) Any fines issued by Bathurst Regional Council or any other ground owner for excesssive rubbish will be passed on to the club/s responsible. BDCA - BY-LAWS Page 26 of 27
