I. Why This Issue Requires Bord Considertion: In ccordnce with Chpter 133, Streets And Sidewlks of the Township Code, the Bord of Commissioners must pprove ny chnges to the code. II. Current Policy Or Prctice (If Applicble): N/A III. Other Relevnt Bckground Informtion: The Township s sidewlk repir criteri hve been in plce since 1979 nd do not tke into considertion the requirements estblished by the federl ADA lws. One exmple is our requirement for one-inch elevtion difference before sidewlk requires repir. The current building code nd the ADA lws only llow for one qurter inch elevtion difference. Any elevtion difference lrger thn one qurter inch must be replced or sloped rmp must be provided to ccommodte the elevtion difference. The ttched ordinnce mends Section A by reducing the elevtion difference in our sidewlk stndrds from one inch to one qurter inch to reduce the potentil for tripping condition nd to comply with ADA lws. 1 3

4 Section B hs lso been mended to reduce crck with horizontl opening from greter thn one inch down to one hlf inch. This is lso n ADA requirement. The finl mendment to Section C is new requirement to ddress concrete blocks tht re crumbling cusing tripping or slipping condition. The current regultions do not ddress crumbling concrete blocks nd this condition cn result in flls nd trip hzrds. IV. Impct On Township Finnces: This will hve no impct on Township finnces. V. Stff Recommendtion: Stff recommends dvertisement nd doption of n Ordinnce to mend the Code of the Township of Lower Merion, Chpter 133, Streets nd Sidewlks. 2 4

AN ORDINANCE To Amend The Code Of The Township Of Lower Merion, Chpter 133, Streets And Sidewlks, to require tht sidewlks be repired when the difference between sidewlk blocks is more thn one-qurter of n inch, or when sidewlk crck is more thn one-hlf inch, or when sidewlk block displys splling or flking condition. The Bord of Commissioners of the Township of Lower Merion hereby ordins: Section 1 The Code of the Township of Lower Merion, Chpter 133, Streets nd Sidewlks, Article IV, Defective Sidewlks nd Curbs, Section , Duty of Owners shll be mended to provide s follows: Article IV. Defective Sidewlks nd Curbs Duty of Owners. * * * * * * The owner of the butting property shll keep the djcent sidewlk nd curb, together with ny portion of such owner's property pved nd used s sidewlk or public wlk, in good order nd repir nd t ll times free nd cler of ll obstructions to sfe nd convenient pssge. Sidewlks with one or more of the following conditions shll be deemed to present n obstruction to sfe nd convenient pssge: A. A difference in elevtion of more thn one qurter inch between blocks or the result of crck within block; or B. A crck within block tht is one-hlf inch or more in width; or C. A block where the concrete finish hs crumbled cusing slipping or tripping condition, s determined by the Public Works or Building & Plnning Deprtment inspector. Section 2. Nothing in this Ordinnce or in Chpter 133 of the Code of the Township of Lower Merion, s hereby mended, shll be construed to ffect ny suit or proceedings in ny Court, ny rights cquired or libility incurred, ny permit issued, or ny cuse or cuses of ction existing under the sid Chpters 133 prior to the doption of this mendment. 1 5

The provisions of this Ordinnce re severble, nd if ny section, sentence, cluse, prt, or provision thereof shll be held illegl, invlid, or unconstitutionl by ny Court of competent jurisdiction, such decision of this court shll not ffect or impir the remining sections, sentences, cluses, prts or provisions of this ordinnce. It is hereby declred to be the intent of the Bord tht this ordinnce would hve been dopted if such illegl, invlid, or unconstitutionl section, sentence, cluse, prt, or provision hd not been included herein. Section 4. This Ordinnce shll tke effect nd be in force from nd fter its pprovl s required by lw. Why This Issue Requires Bord Considertion: Bord pprovl is needed to move portion of project listed in the current Cpitl Improvement Pln for 2022 up to this current yer nd to utilize Sewer Fund reserve. III. Current Policy Or Prctice (If Applicble): IV. Other Relevnt Bckground Informtion: While instlling the new snitry sewer lterl tht would service One Ardmore Plce the developer encountered severl unidentified utility bnks tht obstructed the lterl nd its potentil tie in to the Mill Creek Pump Sttion vi Lncster Avenue s originlly proposed. Stff long with the Township Engineer evluted severl options to ddress the issue. At the completion of tht review it ws determined tht rerouting of the outflow sewge to the County Line Rod Pump Sttion fcility vi Cricket Avenue ws the most vible option. In reviewing the County Line Rod Pump Sttion to verify if dequte cpcity ws vilble for the dditionl outflow from One Ardmore Plce it ws determined tht dequte cpcity existed but tht the sttion during wet wether conditions lredy opertes t ner cpcity of the current pumps. 1 8

9 The developer of one Ardmore Plce contributed $20,000 to offset the cost to rebuild the lrger of the three pumps in the sttion which would hve helped the wet wether performnce. Subsequent nlysis indictes it would be more prudent to instll one new lrge pump rther thn rebuild the existing lrge pump. This will give the sttion improved wet wether cpcity but will lso provide the sttion with redundncy. In 2022 the pln would remin to upgrde the older lrge pump s well s the smller uxiliry pump so the totl pump sttion upgrde would be completed in two phses. The Township Engineer concurs tht it would be prudent to move forwrd in the design nd instlltion of the new lrge pump t this time to ensure performnce nd cpcity t ll times. V. Impct On Township Finnces: The Sewer Fund would incur drwdown of pproximtely $150,000 of its fund reserves in rther thn funding the entire project in 2022 t n estimted cost of $450,000. VI. Stff Recommendtion: Stff recommends dvncing this prtil project to 2019 to better ddress the pump sttion performnce utilizing Sewer Fund blnce. 2 9
