May 2013 Volume 8, Issue 3 John Day OSP Fish & Wildlife Trooper Receives 2012 "Fish & Wildlife Division Trooper of the Year" Award News Release from: Oregon State Police Posted: June 5th, :08 PM Recognized for his high level of initiative, strong work ethic and tenacity, a John Day-area Oregon State Police (OSP) Fish and Wildlife Division trooper received the Division's 2012 "Fish and Wildlife Division Trooper of the Year" award. Senior Trooper Marvin "Marv" Ritter was presented the award Friday, May 31, 2013, by Captain Jeff Samuels, OSP Fish and Wildlife Division Director, and his supervisors Sergeant Tim Brown and Lieutenant Don Wagner, during a presentation in front of his peers at the OSP Bend Area Command office. This was the Division's seventh annual presentation of the award which is based on criteria including professionalism, work ethic, and dedication to the citizens and natural resources of our State. Nominations were received from around the state and reviewed by Regional and General Headquarters staff before the recipient was selected and announced. Ritter, age 60, is a member of the Columbia Basin Team, consisting of a group of five sworn troopers and a sergeant stationed in Pendleton, Hermiston and John Day. Employed with OSP for 9 years, during the last seven years Ritter has been assigned in the Fish and Wildlife Division and is currently the only Fish and Wildlife trooper in the John Day area patrolling nearly 5,000 square miles. Photo credit: Jeff Samuels During the presentation Ritter was commended by Captain Samuels for his continued excellence in efforts towards the protection of Oregon's citizens and natural resources. "Marv has consistently risen to the top and is a very skilled and accomplished investigator, generally working by himself in a remote work site" said Samuels. East Region Fish and Wildlife Division Lieutenant Don Wagner praised Senior Trooper Ritter's ability to consistently maintain a high level of work while still finding time to mentor other officers. "Marv still finds time to mentor fellow officers and share information with them that may at some point in their career save their lives. He is a valued patrol tactics and Marine Board drift (whitewater) instructor, annually training officers from multiple agencies," said Wagner. During 2012 Senior Trooper Ritter was involved in many noteworthy wildlife investigations. In one such case, working from a tip regarding a potential unlawful elk hunting party in the Desolation Unit, Ritter investigated this large hunting group for loaning and borrowing elk tags. Through his tenacity and persistence Senior Trooper Ritter determined three members of the hunting party, who did not have elk tags, unlawfully hunted and killed three bull elk (a spike, a 3x5 and a 6x6 bull), while other members unlawfully loaned the hunters their elk tags to hide the illegal activity. Ritter cited three members for Taking Bull Elk without an Elk Tag and for Borrowing a Bull Elk Tag. The other three members were cited for Loaning a Bull Elk Tag, and the three bull elk and elk tags were seized as evidence. In 2010, Ritter saved a 90-year old man from his partially submerged car in the John Day River where he reportedly had been in the water for over 30 minutes. At significant risk to his personal safety, Ritter put on a life jacket, tied a line to himself and entered the river's swollen waters where he performed a swift water rescue. As a result of his heroic actions, Ritter received the OSP "Harold R. Berg Lifesaving Award" and an Honorable Mention "TOP COPS" award from the National Association of Police Organizations. During the award presentation, Ritter humbly accepted the award while his peers congratulated him; which goes to the character of this fine trooper. Page 1 May 2013

2 Wildlife / Hunting Aircraft Conducts Hunter Checks OSP Cessna. Photo credit: File Sgt. Culp and Sr. Tpr. Lalo flew into Reds Horse Ranch near La Grande and Lord Flat, east of Enterprise to conduct Hunter checks in an area accessible only by aircraft or horseback this time of year. Six bear hunters camped at Lord Flat expressed some surprise at seeing them. Bear Baiting Case Results in Citation Tpr. Baimbridge followed up on a bear baiting case and was assisted by Tpr. Stone. The bait station has been observed on camera by the troopers over the last month. The subjects admitted to baiting bears, shooting a turkey vulture and two crows. The suspects also admitted to a second bait site. Both subjects were cited and released. Raccoon Seized Tpr. Brandon and ODFW responded to a report of a raccoon being held in captivity. The raccoon was found to be comfortably domesticated and living inside of the residence. ODFW seized the raccoon, and the homeowner was warned for keeping the raccoon in captivity. Illegal Doe Kill at Vineyard Racoon. Photo credit: Wikipedia Sr. Tpr. Marchand received a complaint from a Deputy Sheriff who had seen a deer carcass hanging at a residence. Sr. Tpr. Marchand determined that the doe deer was shot and killed by an employee at a vineyard. He had done so at the direction of the vineyard owner. They did not have a permit for killing the deer. The deer was seized and follow-up on this case is being done. Quail Hunter Cited for Closed Season Tpr. Tague was informed of a subject who had just been arrested on several outstanding Warrants. The subject informed a deputy that he had shot a quail with his.22 rifle. Tpr. Tague contacted a witness who stated the suspect shot a quail and also had a duck with him a few days earlier. The witness also stated the suspect had admitted to him that he shot a deer but was unable to find it. Tpr. Tague interviewed the subject in jail and he admitted to killing the quail but denied any other hunting. Subject was cited and released for Taking Game Bird Closed Season. Illegal Activity Investigated Sr. Tpr. Coggins received a complaint regarding bear hunters hiking into the Hells Canyon area of the Snake River unit and conducting unlawful activities. Sr. Tpr. Coggins enlisted the help of Tpr. Miller and Sgt. Hawkins to patrol the area in an attempt to make contact with the hunters. Sgt. Hawkins operated the boat while Sr. Tpr. Coggins and Tpr. Miller conducted a foot patrol. Sr. Tpr. Coggins and Tpr. Miller covered eleven miles on their foot patrol in Hells Canyon. During the patrol three bear hunters were contacted, however, the suspect camp had already gone. One individual was cited for not having an angling license. Taking Cougar Without Valid Tag Sr. Tpr. Madison cited a subject for Taking Cougar Without a Valid Tag. The subject shot a cougar, and then bought a tag. ODFW discovered the violation as the subject was checking his animal in. Taking Deer Closed Season Sr. Tpr. Bennett responded to a complaint by a USFS employee who resides on the Illinois River. The employee called in to say two men in a gray Suburban had just shot and injured a doe deer at that location. A Josephine County Deputy observed the suspect vehicle and stopped it in Grants Pass. A consent search revealed a.357 magnum in the center console. The subjects stated they would like to talk to an attorney before the Trooper arrived on scene. The two were cited for Taking Deer Closed Season. 3 Continued From Page 2 Wildlife / Hunting The pistol and a spent.38 special casing were seized. Sgt. Meyer assisted by locating and euthanizing the wounded doe deer. Sr. Tpr. Bennett arrived on scene. Sr. Tpr. Bennett located a bullet in the right front leg of the deer. The bullet is believed to be from the.357. Taking Protected Birds Ravens Sr. Tpr. Bean received a complaint from a subject who observed an unidentified male in a vacation rental house in Christmas Valley killing several ravens. On contact the subject told Sr. Tpr. Bean that he was intoxicated the day before and proceeded to climb a large Ponderosa pine tree to get two juvenile ravens that were in a nest in the tree. The subject reached Common raven. Photo credit: Wikipedia the nest and threw both birds from the nest causing the death of the birds. The subject was cited for Taking Protected Birds - to wit Ravens. Illegal Geese Taken in Salem Tpr. Glaser received a tip from an ODFW employee about some suspected illegal goose hunting that went on during the last day of the 2013 Northwest goose permit zone season. Tpr. Glaser contacted the suspect at his residence in Turner. During the interview the suspect admitted to shooting approximately 30 geese in the permit zone, never reporting any geese to the check station during the season. The suspect also admitted to taking his son out hunting and never checking in any of the geese his son shot. The suspect was cited and released for Fail to Check in Geese - NW Permit Zone and Aiding in a Wildlife Violation. Aggressive Bear Shot & Killed W. of Klamath Falls Sgt. Randy Hand. Photo credit: File A Klamath County resident killed a bear Tuesday morning on his property after the bear tried to attack his family's dogs and then turned toward the man's home before being shot. Oregon State Police Fish (OSP) & Wildlife Division investigated and concluded no crime was committed. According to Sgt. Randy Hand, on May 28, 2013 at approximately 4:45 a.m., OSP was contacted by the adult male resident reporting he shot and killed a large bear near his house after it allegedly chased his dogs, then, aggressively turned toward him after he opened his back door to check on the commotion. The investigation indicated during the early morning hours, the man let his dogs out of the house on his property west of Klamath Falls. Moments later, the man said he heard his dogs barking and a roaring sound so he looked outside and saw a large bear chasing his dogs. The man retrieved a rifle and opened the back door where he saw the bear about 25 feet away immediately turn toward him in an aggressive manner. Fearing for the safety of his family and dogs, he shot at the bear twice. The bear ran off and was found dead about a hundred yards from his home. According to Sgt. Hand, the man was quite shaken by the encounter but neither he nor his dogs were hurt. The investigation found evidence matching the man's description of the encounter and killing. The bear was first taken to Oregon Department of Fish & Wildlife (ODFW) biologists who took biological samples from the 350 pound bear. It was then taken to the Klamath Tribes for dispersal to tribal members. *Oregon law (ORS ) allows a landowner or landowner agent to use lethal means to address damage, public nuisance, or public health risk on land that a person owns or lawfully occupies involving bears without obtaining an ODFW permit. Taking/Attempt to Take Protected Wildlife Sr. Tpr. Urbigkeit was dispatched to a shot Osprey in a river near HWY 34 milepost The reporting party advised he was at his residence and had been watching an Osprey that was living around the area when some campers, who had set up tents on their property across the river from him, shot the Osprey. The reporting party said he heard what sounded like a single shotgun blast and he observed the Osprey fall to the river near his residence. The Osprey could not fly and it used its wings to "paddle" across the river where it stopped at the river bank near the campers. The reporting party told the campers they had just shot an Osprey and told them he was going to call the police. With the assistance of the Linn County SO, Sr. Tpr. Osprey. 4 Continued From Page 3 Wildlife / Hunting / Sport Angling Urbigkeit contacted the campers and one of the individuals admitted to shooting the bird, telling Sr. Tpr. Urbigkeit that he did not know what kind of a bird it was when he shot it. Sr. Tpr. Urbigkeit, along with assistance of the reporting party, retrieved the bird from along the bank just below the campsite. Sr. Tpr. Urbigkeit arranged to have the injured Osprey transported to the raptor rehabilitation facility in Astoria by two OSP volunteers. Sr. Tpr. Urbigkeit contacted the suspect the following day and cited him criminally for Taking / Attempt to Take Protected Wildlife and seized the shotgun related to the incident. Unlawful Possession of Beaver Sr. Tpr. Gardner received an anonymous complainant and called the Southern Command Center reporting that a Subject was in unlawful possession of a beaver pelt. The Subject complained that he had hit the beaver in July of 2006 on US 730 with his car. The beaver caused extensive damage to his car, so he and his girlfriend skinned it Beaver. The beaver was seized and Subject was warned for Unlawful Possession Of Beaver. SPORT ANGLING Tribal Salmon Illegally Sold Sr. Tpr. Routson observed a subject illegally selling tribal subsistence caught salmon. Intertribal officers contacted the subject and confirmed the fish were illegal. The intertribal officers cited the subject into Warm Springs tribal court and seized the fish. Daily Trout Limit Exceeded Sr. Tpr. Gunderson contacted an angler and his three kids at Clear Lake. When asked how many fish they had caught thus far, the man replied "18". All were still angling. 24 trout were located in his cooler. Four trout were seized and the suspect was cited for Exceeding Daily Bag Limit of Trout. Another couple on the other side of the lake were contacted just as they were packing up to leave. They were found to be one trout over their combined limit. The extra trout was seized and they were warned. The five trout were taken to Rowena Wildlife clinic where they are currently nursing an osprey and an eagle back to health. Boat Patrol on Columbia River Tpr. Warwick and Tpr. Shimer conducted a boat patrol on the Columbia River and Multnomah Channel out of St. Helens. During the patrol they issued citations for Unlawful Possession of Jack Salmon Closed Season x1, Unlawful Take of Sturgeon Closed Area x1, Angling for Salmon Closed Season x1, Angling Prohibited Method - Two Poles x2, and Angling Prohibited Method - Barbed Hooks for Salmon. Numerous warnings were given and two jack salmon and a 48 inch sturgeon were seized and donated to the local food bank. Sturgeon Release Violation Tpr. Shimer received information that subjects were possibly keeping sturgeon on the Gilbert River (closed to all sturgeon retention). Tpr. Shimer arrived at the location, hid in the brush and observed the subjects. The four subjects caught a large sturgeon, dragged it up the river bank by its tail, threw it on the ground, used a towel to completely dry off the fish and then posed with it for pictures. After having the sturgeon out of the water for approximately 10 minutes the subjects picked the fish up by the tail and swung it back into the river. When Tpr. Shimer contacted and interviewed the subjects it was determined they had caught and handled multiple sturgeon that day in the same manner. Citations were issued for Fail to Immediately Release Sturgeon and warnings were issued for Offensive Littering. Closed Stream Violation on Nestucca Tpr. Peterson was working anglers on the upper Nestucca River. This section is closed for the protection of spawning steelhead and smolts. Upon arriving in the area, Tpr. Peterson found two subjects that were angling in the closure. One subject told Tpr. Peterson that he had the regulations in his vehicle but had not checked them. Both subjects were cited for Angling Closed Stream. Unlawful Salmon Possession at Fish Ladder Sr. Tpr. Merritt and Tpr. Baimbridge responded to the Winchester Fish Ladder regarding a complaint of two subjects in the water of the ladder trying to get fish. The troopers responded and observed the subjects in the water retrieving a Chinook salmon. When the subjects were contacted they stated they saw the Chinook already dead in the ladder and were just retrieving it. The subjects were cited and released for Unlawful Possession of Chinook Salmon and Criminal Trespass II and the Chinook was seized. Suspended Angler Cited White sturgeon. Photo credit: Randy L. 5 Continued From Page resident angling license (2010 changed to 2012). The angler finally admitted he was suspended from angling for nonpayment of child support. An Outdoor Central records check revealed his angling privileges are lifetime suspended. The angler was cited (criminally) for Angling While Suspended. Angling Citations and Warnings Sr. Tpr. Marshall Maher teamed up with Sr. Tpr. Martin Maher and they conducted a jet boat patrol on the Willamette and MF Willamette River from D street landing in Springfield to Dexter Dam. During the patrol they checked 40 anglers and inspected 7 boats for safety compliance. While working the river in the Springfield area a boat was observed with two steelhead anglers that had three lines out. The boat was contacted and the angler with the extra rod was issued a citation for Angling Prohibited Method Two Lines. Sr. Tpr. Marshall Maher and Sr. Tpr. Martin Maher conducted a 10.5 hour jet boat patrol on the main stem of the Willamette River from Eugene to the mouth of the Santiam River. By GPS the patrol covered a total of 159 miles. The focus of the patrol was Spring Chinook Salmon angler enforcement. During the patrol 29 anglers were contacted and 21 boats were checked for safety compliance. Four angling and two boating safety citations were issued during the patrol. The following is a list of the citations; (1) No Angling License, (1) No Combined Angling Harvest Barbed hook. The troopers also gave (7) warnings for various minor angling violations and (3) warnings for boating violations. Sr. Tpr. Marshall Maher worked salmon / steelhead anglers on the Middle Fork of the Willamette River below Dexter Dam. During the patrol 24 anglers were contacted. One angler was cited at the Pengra Boat Landing for Fail to Immediately Validate Combined Angling Harvest Tag. This was also the first day of working the leader length action plan below Dexter Dam. Martin Maher worked the Middle Fork Willamette River below Dexter Dam for Salmon / Steelhead anglers again focusing on the leader length action plan. Numerous anglers were checked and two angling citations Sport Angling were issued. One citation was for No Combined Angling Harvest Tag and the other was for Fail to Properly Validate Combined Angling Harvest Tag. Sr. Tpr. Marshall Maher worked morning and evening salmon and steelhead anglers on the Middle Fork of the Willamette River below Dexter Dam focusing effort directed toward the ongoing leader length action plan. Sixteen anglers were contacted during the patrols. Two anglers at the Dexter Hatchery pipes were cited for Angling Prohibited Method Attached Weight More Than 6 Above the Hook. One warning was also given for the same violation. Lighter than normal angling pressure was noted for the Memorial Day holiday weekend. Hike Into Erma Bell Lakes Nets Violators Due to an early spring snow melt this year the Erma Bell Lakes and other high Cascade Lakes have become accessible earlier than normal. The Erma Bell Lakes do not open for angling until May 25, Sr. Tpr. Marshall Maher found vehicles parked at the trailhead and hiked into the area to check for closed season anglers. No closed season anglers were found at either the lower or middle Erma Bell Lakes. Sr. Tpr. Maher checked Otter Lake which is in the area and is Oregon wilderness. Photo credit: File open year round. Three anglers were contacted and two were found to have exceeded the daily bag limit of trout. Sr. Tpr. Maher cited both anglers for Exceed the Daily Bag Limit of Trout. The hike in and out of the lakes was a 5.74 mile round trip by GPS. Snagger Located at Hatchery Hole In addressing salmon snagging complaints at the Hatchery Hole, Sr. Tpr. Collom did surveillance on the hole one evening. He observed one angler fishing at the deadline and snagging. The subject that netted the salmon was also observed smoking marijuana up near a picnic table by the parking lot about 30 minutes earlier. Sr. Tpr. Cushman cited the repeat customer for PCS Marijuana - Less Than One Ounce and Sr. Tpr. Collom cited the angler for Keeping a Foul-Hooked Salmon. The angler denied it was foul-hooked, but then admitted to it when he was told by the troopers that they would see a snagging gouge mark on the left side in front of the dorsal fin. When the fish was checked it revealed same. Additional Citations at Hatchery Hole Sr. Tpr. Collom sat in the brush above the Rogue River at the Hatchery Hole late afternoon Friday, May 24 th and watched Page 5 May 2013

6 Continued From Page 5 Sport Angling one angler keep a foul hooked salmon. Sr. Tpr. Collom radioed Sr. Tpr. Cushman to have him walk around the far side of the hatchery and sneak up on the dike right next to where another angler was attempting to snag salmon. Cushman cited that angler for Angling Prohibited Method - Leader Length over 6 Feet Long. He then cited the first angler for Keeping a Foul- Hooked Salmon. Baker Valley Anglers Exceed Limit While checking ponds in the Baker Valley, Sgt. Cyr of Baker City contacted two individuals that had exceeded on the daily bag limit of trout and were continuing to angle for trout after retaining a limit. Both subjects were cited for Exceeding the Daily Bag Limit Trout and both were warned for Continuing to Angle for Trout after Retaining a Daily Bag Limit. Illegal Gill Net on Young's River Tpr. O'Connor received a call during the evening hours that someone had a gill net laid out on Young's River after the season had closed approximately two hours prior. The boat was contacted as it arrived at a nearby boat ramp, and the fisherman was subsequently cited for Fishing Closed Season - Young's River. No fish were seized. Smith River Angling Violations Tpr. Brandon cited one subject at a lake for Continuing to Angle After Retaining 5 Trout. Tpr. Brandon checked numerous anglers during the streams trout opener. Two juveniles were warned for using bait while angling in Smith River. Winchester Creek Illegal Harvests Trout. Photo credit: National Park Service Foul Hooked Salmon Seized Tpr. Keeler investigated a complaint regarding a subject fishing in Winchester Creek. The subject was located and subsequently cited for Angling for Trout Closed Season and warned for angling with two poles. A trout on a stringer line was released unharmed. Sr. Tpr. Frerichs worked the anti-snagging area of the North Umpqua River and the following violations were observed: Sr. Tpr. Frerichs observed a male subject catch and keep a foul hooked salmon on the North Umpqua River. The subject first attempted to deny foul hooking it, but thought better of it and confessed to the crime. He was cited at the scene for Unlawful Keeping Foul Hooked Salmon and the 25 lb. chinook salmon was seized. Columbia River Citations Issued Tpr. Herman and Tpr. O'Connor conducted boat patrols on the Columbia River in Clatsop and Columbia counties. The Troopers issued 3 citations for Angling Prohibited Method - Barbed Hooks for Steelhead, 2 citations for Angling With More Than One Rod / Line, 1 citation for Angling Prohibited Method - 2 Hooks for Sturgeon, and 1 Marine Board citation. During the patrol, the Troopers contacted a boat anchored behind an island on the Columbia River in Oregon. The two anglers on board were using 3 fishing poles. Tpr. Herman boarded the boat, and a consent search Marijuana. Photo credit: File of the boat revealed that one of the anglers was in possession of 4.5 ounces of marijuana. That angler was cited and released for PCS Marijuana, and the other angler was cited for Angling With More Than One Rod / Line. Unlawful Take of Sturgeon on Willamette River Sturgeon. Ferguson received a tip that a fisherman had just caught and retained a sturgeon on the Willamette River along the shore in Clackamette Park, located within Oregon City. Upon their arrival they observed an individual standing at the back of his vehicle with the trunk open and an undersized sturgeon lying on the ground next to the vehicle. Tpr. Borchers attempted to revive the fish for approximately 10 minutes but was unsuccessful. While doing so he noticed a large cut across the fish s gills. It was later determined that the fisherman s fishing partner had cut the gills on the fish. The fisherman was issued a citation for the Unlawful Take of Sturgeon and his friend was issued a citation for Aiding in a Wildlife Violation. A wants check was run on both subjects and revealed an active felony parole violation warrant for the arrest of the fisherman s friend. The subject was arrested and lodged in the Clackamas County Jail on the outstanding warrant and the sturgeon was seized and donated to charity. Citations Issued to Fishing Guide and Clients Tpr. Borchers and Tpr. Ferguson contacted the owner/operator of a fishing guide service and two of his clients at the boat ramp in Clackamette Park, which is located within Oregon City. Tpr. Schoenborn had observed and advised Tpr. Borchers and Tpr. Ferguson that one of the fishermen had caught two Page 6 May 2013

7 Sport Angling / Shellfish Continued From Page 6 steelhead and failed to validate his harvest card. Tpr. Schoenborn also observed the same fisherman continue to angle after retaining his two fish. Upon contact, the Troopers learned the fisherman who had caught the two fish did not have his harvest card with him and had left it in his vehicle. Waterloo Falls Attempt to Snag Salmon/Steelhead Sr. Tpr. Halsey, Tpr. Andrews, and Tpr. Freitag conducted an operation at Waterloo Falls to address issues with anglers attempting to snag Spring Chinook. Troopers observed an angler attempting to snag at the end of nearly every one of his drifts. Galusha were working Halibut anglers at the Garibaldi dock when they learned that subjects in a boat on Tillamook Bay were keeping illegal crabs and putting them in the engine compartment. When the suspect boat arrived a search was conducted, which resulted in the troopers finding a cooler located under the engine cover. Inside the cooler the troopers found 21 short Dungeness crab and one female Dungeness crab. Also during the contact it was found that one of the passengers had a misdemeanor warrant for his arrest issued out of Municipal Court Salem. The boat operator was cited for Unlawful Possession Undersized Dungeness Crab and the passenger was lodged in the Tillamook County Jail on the warrant. Tillamook Bay Clammers Exceed Limit Sgt. Todd Hoodenpyl was working clammers on Tillamook Bay when he saw two subjects that were carrying buckets and were hurrying to their vehicle. Upon contact it was found that one subject was 21 bay clams over his daily limit. This subject was cited for Exceeding Daily Bag Limit Bay Clams and the 21 clams were returned to the bay. Warned for Exceeding Bag Limit of Clams Sgt. Hoodenpyl was working clam diggers on Tillamook Bay with a volunteer when he contacted a subject who was perch fishing and had a bucket of clams next to him. The subject told Sgt. Hoodenpyl that the clams did not belong to him and that they belonged to two anglers down the bank. When Sgt. Hoodenpyl turned his back, the volunteer watched the subject while he took handfuls of clams and threw them back in the bay. Investigation revealed that the Clam. The clam digger was warned for Exceeding The Daily Bag Limit Bay Clams and the male subject was cited for Aiding In A Game Violation. Clam Diggers Receive Multiple Citations Tpr. Smith and Tpr. Peterson were working plain clothes patrol on the clamming area in Netarts Bay. When the Troopers arrived, they saw an unattended vehicle that was parked halfway in the roadway. This is an ongoing issue in this area, so the Troopers cited the vehicle for Unlawful Parking On Roadway and proceeded to the clamming area. While there, the Troopers located a male and a female subject digging clams noting both were well over their limits. The male subject was cited for Exceeding The Bag Limit Bay Clams and the female was cited for No Shellfish License. It turned out that these were the same subjects who were cited for parking their car illegally. MARINE FISH Illegal Possession of Cabezon and Rockfish Sr. Tpr. Kehr contacted an angler in Depoe Bay who was in possession of a Canary Rockfish and a Cabezon. Canary Rockfish are illegal to possess and the Cabezon season is currently closed. 9 Marine Fish / OSMB / Environment / General Law Illegal Salmon Sale at Hillsdale Farmers Market Tpr. Ferguson, Tpr. Borchers and Tpr. Reel responded to the Hillsdale Farmers Market in Portland to investigate an illegal Chinook Salmon sale. The reporting party said that a tribal member was selling fresh caught Chinook Salmon. Tpr. Ferguson, working in plain clothes, contacted the booth and confirmed there were several whole, fresh, salmon for sale. Tpr. Reel and Tpr. Borchers contacted the booth and observed the fish and the offering of fish for sale. There were multiple signs stating fresh caught Columbia salmon for sale. Upon contact the suspect stated that his nephew caught the fish the day prior in the John Day pool. The suspect also stated that he was a tribal member and per the treaty was allowed to sell the fish. Currently there is no open season for the sale of fish. The troopers seized six whole chinook salmon and cited the suspect for Unlawful Sale of Fish. Charleston RHI Patrol Sr. Tpr. Harris and Tpr. Keeler conducted an ocean patrol with the RHI out of Charleston. They cited two subjects for Taking Rockfish Closed Area, and the subject s catch was seized. Three other subjects were contacted during their patrol and cited for Failure to Validate Halibut Tag. Citation Issued for No AIS Permit Sr. Tpr. Stinnett and Tpr. Smithers conducted two ocean boat patrols over the Memorial Day weekend. More than 50 boats and 130 anglers were contacted during this time. One citation was issued for No AIS Permit, and a few various warnings were given. OSMB Boat Checks on the John Day Tpr. Mayer and Sr. Tpr. Gunderson assisted Wasco County SO with scheduled OSMB boat inspection days at The Dalles Marina. Numerous courtesy safety inspections were done and one jet-ski was seized due to an altered HIN. A secondary HIN had also been removed. ENVIRONMENT Waterway Complaint Along S. Myrtle Creek Sr. Tpr. Merritt and Tpr. Stone responded to a waterway complaint along South Myrtle Creek in the Myrtle Creek area. They located an area along the creek where someone had created a dam by using the gravel to block up the water flow. Landowner Cited in Toledo Area Tpr. Van Meter received information from ODFW employees regarding a fill and removal complaint in the Toledo area. Tpr. Van Meter and Sgt. Thompson responded and upon their arrival discovered the landowner was in the process of putting in a culvert in an EFH stream. The landowner, the owner of a local construction company, had removed approximately 20 feet of culvert, re-installed 60 feet of culvert, deposited several hundred yards of concrete rubble in the flood plain and had logged several acres of land. The landowner did not have permits from DSL or ODF and he was working outside the in-water work period. The landowner was cited for Unlawful Fill and Removal and Water Pollution II. DSL and ODFW are following up with the landowner for restoration of the site. GENERAL LAW Citations Issued and Items Seized on Sauvie Island Tpr. Shimer observed several anglers on Sauvie Island dump garbage in a parking lot and drive away while one of the passengers was consuming an open container of alcohol. Tprs. Warwick and Shimer stopped the vehicle for the observed violations. Tpr. Warwick recognized the driver of the vehicle as a subject he and Sgt. Schwartz had cited two weeks prior for PCS Marijuana - Less Than An Ounce in the same location. A consent search of the vehicle and its contents turned up a jar of marijuana with a pipe and an unlawfully taken sturgeon that had been cut up and hidden in the bottom of a backpack. The driver was again cited for PCS Marijuana - Less Than An Ounce, as well as issued criminal citations for Unlawful Possession of Sturgeon Closed Area and Unlawful Mutilation of Game Fish. Two other subjects were cited for Violation of Open Container Law and Offensive Littering. The sturgeon, marijuana, and pipe were seized. 10 General Law Endangering Welfare of Minor Sr. Tpr. Hayes received an Attempt To Locate from CHP for a suspect in a child sexual assault and attempted abduction. The vehicle was located and contact made with a male and two children in the vehicle. Potted marijuana plants were located in the vehicle as well as marijuana and hashish. A subsequent investigation revealed that the subject was not the suspect in the attempted child abduction. The subject was cited and released for UMCS - Marijuana and Endangering the Welfare of a Minor. DHS was notified and responded to the scene. DUII on Highway 97 Sr. Tpr. Hayes received a complaint of a DUII driver on Hwy 97 and stopped the vehicle. The subject refused to exit the vehicle and was taken into custody with the aide of Sr. Tpr. Love and Sr. Tpr. Young for DUII Felony, Driving While Suspended Misdemeanor, Resisting Arrest, and Reckless Driving. The subject was lodged at the Deschutes County Jail after a blood draw was obtained with a search warrant. Animal Abuse Tpr. Tague received a report of a house cat that was shot in Paisley. Tpr. Tague determined the subject had shot a cat inside city limits with a.22 rifle. The cat survived the shot and the subject was cited and released for Animal Abuse II. The subject was warned for Unlawful Use of Firearm and Attempted Theft I. Stolen Vehicle Recovered Sr. Tpr. Bennett responded to a complaint of a suspicious vehicle parked on an old BLM mine road off of State Route 260 (Riverbanks Rd.) and found the vehicle to be reported stolen. The registered owner was contacted and recovered their vehicle. Weapon Used in Stabbing Found Sr. Tpr. Bennett assisted the Patrol and Criminal Divisions in a stabbing case in the Williams area on Sunday. The victim was stabbed numerous times by the suspect who reportedly threw the knife in the roadside ditch. The ditch was very overgrown and was full of water. Sr. Tpr. Bennett responded with a metal detector and helped locate the mentioned weapon. Stolen Property Recovered Sr. Tpr. Salisbury assisted Florence Patrol and Lane County SO with a burglary investigation of a residence that resulted in three suspects arrested and all stolen property recovered. Habitual Offender Stopped on I-5 Lt. Gifford stopped at vehicle on I-5 north of Grants Pass going 94 mph and changing lanes to cut the corners. The subject advised that she didn t have a valid operator s license. DMV showed the subject was revoked as a habitual offender. She was cited for Driving While Revoked Misdemeanor and Exceeding the Interstate Speed. The vehicle was towed on a 780 Impound. Offensive Littering Sr. Tpr. Bean was notified of a large amount of household trash associated with an old hunting camp near Fort Rock. It appeared that the garbage had been buried when the subjects left deer camp last October. Throughout the winter the animals and weather had scattered the garbage around the camp. Sr. Tpr. Bean located a prescription bottle with a name on it. Investigation revealed the same subject had a Silver Lake Deer Tag. After several phone calls, Sr. Tpr. Bean located a male subject who admitted digging a deep hole and burying the garbage. He told Sr. Tpr. Bean that when they went to leave the camp after deer hunting that they didn't have room for the garbage and left it. He agreed to pick it up and sent a relative out to clean it up. He was later cited and released for Offensive Littering. Stolen SUV Recovered Tpr. Imholt was conducting BER s and angler checks at Armitage Park on the McKenzie River when he observed an SUV parked unlawfully in the parking lot. The SUV was parked in a parking space designated for vehicles with boat trailers only and had been cited by county park rangers for the Illegal parking earlier in the day. The driver s side door lock had been punched in with a screwdriver and the vehicle had been stolen several hours earlier from a nearby local motel. While checking the VIN on the SUV, Tpr. Imholt noticed that a $3.00 park permit had been purchased for the SUV at around 6:00am that morning. Apparently the car thieves stole the SUV and drove to the park to go through the vehicle and clean it out. They bought a parking permit so as to not arouse suspicion, but parked in the wrong spot. The Lane County Park ranger removed the citation for the illegal parking. The owners reported a gun, laptop, and purse with car keys were stolen out of the SUV. No suspects. ATV Accidents on USFS Road 18 Sr. Tpr. Marshall Maher assisted Sr. Tpr. Ron Martin with a fatal Class III ATV (dirt bike) crash on USFS Road 18 (Big Fall Creek Road). The operator was rounding a right curve and creek bridge crossing when he lost control and crashed. The operator was thrown from the motorcycle down a steep embankment and landed partially in the creek. The victim was life-flighted from the scene but died as a result of his injuries. 11 Continued From Page 10 Huckleberry Flats OHV area. A female Class I ATV rider crashed and landed over an embankment on a side spur road within the OHV area. The rider had a juvenile passenger. Both were wearing helmets. The juvenile passenger was not injured but the female operator suffered a leg injury and was transported by Oakridge Fire Department Ambulance to McKenzie / Willamette Hospital in Springfield for treatment. False Report of Deer in Carport Deer. Photo credit: U.S. Fish and Wildlife Service Sgt. Allori and Lt. Shugart responded to an Oregon City address regarding a complaint of a deer hanging in the carport. A search of the residence revealed no sign of any deer ever being at the residence. An investigation into a False Report was initiated and a suspect was identified. Sgt. Allori and Lt. Shugart contacted an adult male neighbor of the victim. The male initially lied about his identity and Sgt. Allori and Lt. Shugart determined the suspect was mentally handicapped. The suspect s mother (primary caregiver) was contacted and advised of the situation resulting in the suspect s cell phone rights being revoked for an undetermined period of time. Methamphetamine and Marijuana Near Dibblee Beach Tpr. Warwick and Volunteer Burch contacted a male and female parked off of the main road on Dibblee Beach near Rainier for Unlawful Off Roading. Both subjects were very nervous and the female showed obvious signs of drug use. A consent search of the vehicle turned up methamphetamine and marijuana in a bag claimed by the female. She was subsequently cited and released for PCS Methamphetamine General Law and PCS Less than One Ounce of Marijuana. Marijuana and Criminal Trespass Tpr. Freitag contacted multiple subjects at some private ponds near Independence, which are posted with large signs stating "DO NOT ENTER". The subjects admitted they had walked between the signs, but said many other people fish there so they thought it would be ok. Upon contact, Tpr. Freitag noticed a marijuana pipe sitting on the ground near one of the subjects. Citations were issued for Criminal Trespass II X3, PCS - Less One Ounce of Marijuana, and Frequenting Less One Ounce of Marijuana. Driver Charged with Heroin Tpr. Freitag and Tpr. Adams were returning from an MRT detail when they stopped at a stoplight in Salem. Tpr. Freitag looked at the passenger of the vehicle stopped next to them and noticed he had a panicked look on his face. The passenger then began frantically talking to the driver. Tpr. Freitag could see the driver was smoking heroin through a pen tube off a piece of tin foil. The vehicle quickly entered a parking lot and the occupants exited the vehicle leaving the foil and pen tube in open view on top of the center console. They were contacted, interviewed, and a PC search of the vehicle revealed a small amount of tar heroin in the glove compartment. The driver was charged with PCS - Heroin. Driver with Expired Tabs Cited for Marijuana Sr. Tpr. Thomas stopped a vehicle after observing expired registration tags. While the driver was looking for insurance documents, Sr. Tpr. Thomas observed a marijuana pipe in the middle console. The driver was subsequently cited for DWS -Violation, Driving Uninsured and PCS Less Than 1 Ounce of Marijuana. I-205 DUII Arrest Tpr. Borchers was traveling north on I- 205 when a grey Jeep Cherokee passed him on the right at a very high rate of speed and exited near Gladstone. Tpr. Borchers stopped the vehicle for several traffic offenses. Upon contact with the driver, Tpr. Borchers observed signs of impairment and the driver was subsequently arrested for DUII. Additionally, suspect s driving privileges were criminally suspended. The driver was lodged in the Clackamas County Jail for DUII - BAC 0.11% and DWS - Misdemeanor. Angling Violation Results in DUII Arrest, BAC 0.20% While working in plain clothes, Tpr. Schoenborn advised Tpr. Borchers of a subject who had just committed an angling violation and was driving his vehicle towards Tpr. Borchers' location on the Westside of Sauvie Island. The subject stopped just prior to Tpr. Borchers' location at a popular fishing spot. Tpr. Borchers located the subject and during a subsequent interview discovered the subject was impaired. The subject consented to and failed SFST's and was lodged at Columbia County Jail for DUII - BAC 0.20%. Suicide Subject Flown to Hospital Sr. Tpr. Mark Knapp assisted the Wallowa County Sheriff s Office on a suicidal subject. Two hunter s located a man on the ground next to a vehicle with a gunshot wound to the head. The man was alive but unresponsive. The location was very remote and Sr. Tpr. Knapp assisted deputies to the location. Life flight was activated and transported the man to the hospital prior to officers arriving on scene. Sr. Tpr. Knapp assisted deputy s investigating the scene and it was discovered the man had attempted to commit suicide. The man is currently at the hospital and expected to survive the incident. DUII Arrest, BAC 0.21% Sr. Tpr. Kristopher Davis stopped a vehicle for illegal use of cellphone. Operator showed signs of impairment, consented to and performed poorly on Page 11 May 2013

Subject was taken into custody for DUII and transported to Baker County Jail where she provided a breath sample of 0.21% BAC. Subject released to custody of jail staff. Vehicle secured on scene. INTERAGENCY COOPERATION Fred Meyer Marine Event Sr. Tpr. Turnbo worked with the Yamhill County Sheriff's Office Marine Patrol and the United States Coast Guard Auxiliary Officers in conducting boat inspections at the First Annual Fred Meyer's Marine Event in Newberg, Oregon. Numerous boats were given inland and offshore inspections. Forest Fire Threat Assist Sr. Tprs. Hayes and Love, and Tpr. Young assisted with a forest fire threatening homes in the La Pine area. ATV Crash Assist with USFS Sr. Tpr. Merritt assisted the USFS with an ATV crash investigation. The female driver lost control coming down a Forest Service gravel road, rolling the ATV and injuring herself. She was transported to Mercy Hospital, then to Eugene where she was in ICU as of 5/26/13. Her companions were warned for no ATV safety card. Joint Patrol with Coast Guard for 2nd Halibut Opener The Coast Guard Cutter Orcas was present for the 2 nd Halibut opener. Sr. Tpr. Urbigkeit conducted a joint patrol aboard the Orcas on May 16 and 18. During the two patrols several boats were contacted. Several warnings were issued and the seas were rough, so the fishing was slow both days. Burglary Suspect Apprehended Near Dibblee Beach Tpr. Shimer was driving on the Dike Road in Rainier returning from angler checks on Dibblee Beach when he observed a man covered in mud and blood walking through a field. Tpr. Shimer notified a nearby deputy that the man may have been the suspect involved in a pursuit the night before. The Deputy and Tpr. Shimer ultimately found the man hiding and trespassing in a nearby yard. When the man was told to stop by the officers he ran off on foot. Tpr. Shimer chased the man on foot and apprehended him a short time later. The man was in possession of a ski mask, screw drivers and other burglary tools. An investigation conducted by CCSO Deputies connected the man to several burglaries in the area. C.A.P.E. Operation Results in Multiple Citations, Warnings and an Arrest Six Troopers from the Tillamook Worksite and one member from the C.A.P.E. team assisted with a C.A.P.E. operation in Tillamook County. The mission of the operation was to conduct high visibility/ high frequency patrol efforts targeting vehicles involved in the taking of Natural Resources on Hwy 6 and Hwy 101. During the operation 32 warnings were given, 3 citations were issued, and 1 arrest was made. On one of the traffic stops, Tpr. Galusha stopped a subject who immediately told him that he was suspended. During the stop Tpr. Galusha located a small amount of Marijuana and obtained consent to search. The driver asked Tpr. Galusha why he was not trying to get the people using Meth, since those were the people hurting our children. Shortly after that comment Tpr. Galusha located Methamphetamine and more Marijuana in the subject s possession. The subject was lodged in the Tillamook County Jail on charges of PCS - Methamphetamine. PUBLIC RELATIONS Dungeness Crab Summit Tprs. Brandon and Keeler attended a commercial Dungeness crab summit meeting with Lt. Anderson. There were approximately 35 members from the commercial fishing industry who attended and actively participated in discussions. A wide range of topics were discussed, including resource management and sustainability options. Hunter Safety Education Sr. Tpr. Gunderson taught a hunter's safety class. 16 students and 12 parents were in attendance. Sr. Tpr. Hayes was the guest speaker at a hunter safety class with approximately 18 students in attendance. Sr. Tpr. Madison gave a short presentation to the annual ODFW Hunter Safety conference. Sr. Tpr. Marshall Maher participated in the Oakridge Outdoor School. He gave five presentations about the Oregon State Police Fish and Wildlife Division to sixth grade students from Oakridge, Lowell and Creswell Christian Schools. Sr. Tpr. Maher has participated in this program since Sr. Tpr. Reid instructed a two day outdoor event in McMinnville with the Yamhill County Sheriff's Office. During the event Sr. Tpr. Reid was able to instruct over 650 children about fish and wildlife enforcement issues. Sr. Tpr. Hayes was the guest speaker at a hunter safety class with approximately 18 students in attendance. Brandon attended the Oregon Hunters, Association Youth Day, which was held in Myrtle Point. The Trailer of Shame and a deer WED were used for educational purposes. Tpr. Brandon talked to a large group of children (145) about the importance of firearms safety, hunting ethics, respecting private property owners, and hunting rules and regulations. ODFW wildlife biologist, Stuart Love, worked with Tpr. Brandon at the Trailer of Shame and discussed with the children the importance of wildlife management, and he provided some insight into some of ODFW s methods of conducting surveys. Efforts to Stop Snagging Outlined Spring chinook salmon are showing up at the top of the run on the Rogue River. Many snagging complaints have already been received from the Hatchery Hole even though it is early in the run. Some things to help reduce snagging this year include: A new regulation changing the legal angling time from the hatchery down to the Hwy 62 Bridge from 1 hour before sunrise to 7:00PM to ½ hour before sunrise to 8:00PM; a fence is about be installed on a wall where many of the worst snaggers, snag fish at the very top of the deadline just below the hatchery intake (this is also a safety issue as well). Troopers are working Public Relations / Dispositions surveillance using spotting scopes to observe snaggers during legal fishing hours and working varying shifts, including late nights and very early mornings to address snagging after legal fishing hours as well. Stuck Motorist Assisted Sgt. Hand was on his way into Fourmile Lake when he encountered some left over snow drifts crossing the road. There were fresh tracks going through the snow so Sgt. Hand continued only to find the preceding vehicle had become stuck in the snow five miles from the highway. They had no shovel and had been attempting to free their vehicle by using boat oars as shovels. Sgt. Hand pulled the vehicle free. Klamath Water Issue Meetings Sgt. Hand attended a waterissues meeting with several local government agencies and the governor s staff to discuss the impending drought and issues related to water adjudication in the Klamath Basin. Sgt. Hand and Lt. Westfall met with Klamath Tribal Chair, Don Gentry, and several others with the Klamath Tribe to discuss multiple issues, primarily the safety of Klamath Tribal employees while they are conducting their work in and around the Klamath Basin. Sgt Lea attended the Lower Deschutes Managers Meeting and the Deschutes River Club annual meeting. Oakridge Elementary Sr. Tpr. Marshall Maher and Sr. Tpr. Martin Maher gave a water safety presentation at Oakridge Elementary School. Students from grades Kindergarten through 6 th participated in the program. The Troopers talked to the students about the importance of wearing a properly fitted life jacket and had life jackets on display for students to try on. Students were also given the opportunity to use a type IV throwable device in a lesson about throwing something to a person in distress in the water. The U.S. Army Corps of Engineers provided Bobber the Water Safety Dog work books that were handed out to each participating student. A total of 242 students participated in the program. An OSP patrol boat was also on display during the presentation. Kids Fishing Event at Middle Fork Irrigation Pond On Saturday May 18 th, the USFS and ODFW hosted a kids fishing event at Middle Fork Irrigation Pond near Laurence Lake. There was a large turnout of kids from the Mid-Columbia area. Sr. Tpr. Routson assisted with the event. Fun was had by all. DISPOSITONS Lifetime Hunting Suspension Handed Down Sr. Tpr. Halsey, Tpr. Clement and Tpr. Burkholder received the following disposition in Linn County on a suspended hunter that they caught hunting on private property during the 2012 archery season. Multiple Wildlife Crimes Result in Probation and Fines A subject pled guilty in the Lincoln County Circuit Court to one count of Unlawful Take of Black Bear in City Limits. The guilty plea is the result of an investigation by Sr. Tpr. Canfield and Sr. Tpr. Kehr in the fall of During the fall of 2012, the troopers learned that the suspect had shot a bear on the Newport Airport Property while performing his duties as a Wildlife Control Operator. As a result of the Investigation, the suspect was cited for multiple Wildlife Crimes. On , the defendant was sentenced to the following: 3 years Probation $1000 Restitution $1500 Fine Forfeiture of his rifle Additionally, as a result of the conviction, he is barred from applying for a Wildlife Control Operator License for a period of 5 years Page 14 May 2013
