3 Task Force to Combat IUU Fishing and Seafood Fraud Driving Factors for U.S. Action Illegal, Unreported and Unregulated (IUU) fishing and seafood fraud threaten valuable natural resources that are critical to global food security and put law-abiding fishers and seafood producers, here in the U.S. and abroad, at a disadvantage. December Recommendations released Recommendation #14 & 15 - first phase of a risk-based traceability program to track seafood from point of harvest to entry into U.S. commerce. February 2016 Proposed Rule for a Seafood Import Monitoring Program released Ongoing public engagement through public meetings, webinars, Federal Register notices, and demarches January 2018 January 1, 2018 is the mandatory compliance date for most priority species included in the rule June 2014 Presidential Memorandum NOAA and its U.S. Government partner agencies are directed to report on recommendations for the implementation of a comprehensive framework of integrated programs to combat IUU fishing and seafood fraud that emphasizes areas of greatest need. 4 About the Seafood Import Monitoring Program The Seafood Import Monitoring Program establishes permitting, data reporting and recordkeeping requirements for the importation of certain priority fish and fish products that have been identified as being particularly vulnerable to IUU fishing and/or seafood fraud. Key Points You Should Know : 1. The rule establishing the Seafood Import Monitoring Program applies only to seafood entering the U.S. from a foreign country. The importer of record will be required to keep records regarding the chain of custody of the fish or fish product from harvest to point of entry into U.S. 2. The data collected will allow these priority species of seafood to be traced from the point of entry into U.S. commerce back to the point of harvest or production to verify that it was lawfully harvested or produced. 3. The collection of harvest and landing information for these priority seafood species will be accomplished through International Trade Data System (ITDS) reporting. 4. The information collected under this program is confidential. 5. The rule also applies to re-imported product of priority species originally harvested in the U.S.

6 Information You Should Know January 1, 2018 is the mandatory compliance date for most priority species listed in the rule, with *shrimp and abalone compliance phased in at a later date. 11 SIMP Message Set Scientific Species Code (PG05) -3 Alpha code Mandatory The United Nations Food and Agricultural Organization s Aquatic Sciences and Fisheries Information System (ASFIS) provides a comprehensive reference list of species names, scientific names and the 3 Alpha codes for them ** Must transmit the 3 Alpha code that is not mandatory of the priority species to specify full message set is not required 3 character Species Code NMFS Seafood Import Monitoring Program - Species that Require the full set of the SIM Program Records: odes.pdf

12 SIMP Message Set Harvest Description Code (PG06) HCF = Harvest Capture Fisheries / Wild Caught - Animals harvested, with or without appropriate licenses. (This includes pen matured (PMH) animals, those animals captured alive before they are penned for feeding and growth until actual/final harvest) HBA = Hatchery based aquaculture - Harvested animals that have been owned by individuals or corporate bodies throughout their entire life cycle from spawning to harvest SVH = Small Vessel Harvest Wild Capture aggregated harvests involving multiple small-scale fishing vessels (20 measured gross tons or less or 12 meters length overall or less) landed at shore (Not used for situations where the fish were transferred to a larger collecting vessel)

13 SIMP Message Set Country Code (PG06) A two-letter code from Appendix B that shows from what Country or what Country s territorial waters the harvest took place or, if it was harvested on the high seas in international waters, code ZZ Geographic Location (PG06) Enter the geographical location (for example: North Atlantic Sea) that is the source where the harvest, growth, production, sale, or catch took place. For ocean geographic area locations, see the CBP Appendix PGA for valid codes Processing Start Date (PG06) = Landing Date / Off Load Date

14 SIMP Message Set Harvest Gear Processing Description (PG06) Fishing vessel s harvesting gear type for wild capture harvest. For example: Code Name BB Baitboat BBF Baitboat: Freezer BBI Baitboat: Ice-well BLL Longline: Bottom or Deep longliners Product Form Processing Description (PG06) Provide the 3-letter code indicating the product form at the time of transshipment or initial landing. Valid codes are: NDR- Dressed; NFL- Fillet; NGG- Gilled and gutted; NOT- Other; NRD-Round (whole); NST- Steak; NRS Radiation sterilized.

15 National Marine Fisheries Service (NMFS) (PG14) The NMFS International Fisheries Trade Permit (IFTP) is used and required for any of NMFS programs This is a continuous use permit which can be used repeatedly and is the same permit number for all import transactions for all NMFS programs. Annual Renewal 12 months from issuance. $30.00 Annual Fee Permit number may change upon renewal Enter the license type as NM4 the code for the NMFS International Fisheries Trade Permit (IFTP) This number is an alpha numeric 14 digit number with the letter P followed by 13 numbers

16 SIMP Message Set Trade may submit additional PG14 records if reporting Other Authorization to Fish License Type (NM6) LPCO under which the product in the shipment was legally harvested seafood/product Such authorizations may include, but are not limited to, Regional Fisheries Management Organization (RFMO) membership number, flag/country license or similar documentation This is reported in addition to the IFTP Permit

17 SIMP Message Set Entity Name and Role Code (PG19/20/21) - Provide code that most accurately identifies the role of the entity. Due to the nature of the requirements of this program, the party may represent one of a number of acceptable entity roles. Provide Telephone Number or in addition to name and location Harvest Capture Fisheries (HCF), wild capture fish/product, or those captured and thereafter pen raised until harvest; name and location of the entity to which the product was provided at the time of the initial/first landing or delivery For products designated as Hatchery Based Aquaculture (HBA); provide the name and location of the aquaculture facility where the fish was harvested. (AQF) If the fish/product was collected from multiple sites and documented as an aggregated harvest through an aggregated harvest report, provide the name of the person or entity responsible for the collection For product designated as Small Vessel Harvest (SVH), provide the name and location where the fish was landed at shore and the name of the person or entity responsible for the collection of the fish

EXE Exporting Establishment The establishment where the export originated. PRE Preparer Person who prepared the form. GD Producer Party or person who has produced the product.

19 SIMP Message Set PG24 Required if SVH designating the product as harvested under the aggregated harvest by small vessels Free form text listing the number of small vessels used to conduct the harvest if the aggregated harvest by small vessels exception was used.

20 SIMP Message Set Unit of Measure (PG29) Pertaining to the net unit of measure of the commodity weight at the time of harvest, excluding all packing and packaging. Two decimals Pertaining to the overall PGA Line Number

21 SIMP Message Set PG31 If the product was identified as anything other than aquaculture product or a small vessel aggregated harvest that was landed at the shore and not transferred to another vessel Data pertaining to the vessel used to harvest the commodity or the larger vessel used to aggregate and transport the harvest of multiple smaller vessels under 12 meters or under 20 gross tons. Vessel Country of Registry (VCR) (Flag Country of Registry of the Harvest Vessel or transshipment vessel) Vessel Name (VNM) Harvested Commodity Net Weight The following additional codes are allowed: IMO - International Maritime Organization VCS = Vessel Call Sign PMT = flag state permit number RFO = Regional Fishery Organization authorized vessel number OTH = Other

22 SIMP Message Set At least one (PG32) record is mandatory if the product was identified as anything other than aquaculture product to provide data pertaining to the commodity routing information For each vessel provided, there should be a corresponding PG32 to indicate the offload location Code indicating the Place of Transshipment from original harvest vessel to transshipment vessel using the Place of Transshipment Code - Code = 13 or the Country of First Landing from original harvest vessel to shore using the Place of Discharge Code Code = 11

23 If trade provides a 3 Alpha code that is on the NMFS 3 Alpha code list which requires the submission of the complete set of records, then depending on the scenario, the following additional records are required: If an aquaculture scenario: PG06 HBA PG14 PG19 - AQF PG20 PG21 PG29 - quantity If wild caught harvest (including small vessel harvests transferred to a larger vessel at sea) scenario: PG06 HCF PG14 PG19 PG20 PG21 PG31, VCR, ISO, UOM, weight PG31 VNM PG32 11 or 13 (routing code), ISO (In the scenario directly above, there could be multiple PG31 and 32)
