1 TERMS AND CONDITIONS PIRTEK FISHING CHALLENGE 1. The Pirtek Fishing Challenge ("the Competition") is an open fishing competition. 2. The Competition is conducted by National Fishing Challenge Pty Ltd. 3. The object of the Competition is the Capture, Measure, Photograph and Release of fish, with the exception of exotic fish species which have been declared noxious or pest fish. Please see Clause 36 for further details. 4. The Competition will take place on Sunday, 18 March, Registration fee will be AU$25.00, plus postage and handling per entry. 6. Registrations for the competition will open on Monday, 8 January, 2018 and close on Friday, 16 March, 2018 or until the stock of brag mats and caps are sold, whichever occurs first. 7. Pirtek Fishing Challenge Privacy Policy. a. PIRTEK FLUID SYSTEMS PTY LTD (ACN ), NATIONAL FISHING CHALLENGE PTY LTD (ABN ) and associated entities (PIRTEK) PRIVACY POLICY b. PIRTEK is covered by 10 National Privacy Principles (the NPP s) as set out in the Privacy Act 1988 (amended by the Privacy Agreement (Private Sector) Act 2000 The Privacy Act. c. To comply with our obligations under the NPP's, we have a Privacy Policy, which sets out how we manage privacy in our organisation. d. PIRTEK may collect and hold personal information for the primary purpose of allowing it to enter into business and marketing related transactions. The collection, use and disclosure of information are in compliance with the Privacy Act however we will not share or sell this information to third parties. e. Further details regarding the collection use and disclose of the information is available in our Collection, Use and Disclosure Statement, which is available on request. f. You are welcome to receive more information about the Policy by contacting the Privacy Officer on Registered anglers will be able to unsubscribe from Pirtek Fishing Challenge updates and event media releases. a. All registered anglers will receive the following compulsory s: i. confirmation of registration and welcome ii. angler number and species list iii. list of competition and prize draw winners 9. All paid and registered competitors are eligible to enter the On The Water Prize Draw. a. Please see Clause 61 for full details of the On The Water Prize Draw. i. The On The Water Prize Draw will open on Monday, 8 January, 2018 and close on Friday, 16 March, 2018 or until the stock of brag mats and caps are sold, whichever occurs first. Page 1
2 10. The Pirtek Fishing Challenge organisers reserve the right to refuse entry to past or present disruptive or abusive competitors. No dialogue or negotiation will be entered into with the Pirtek Fishing Challenge committee and their decision will be final. 11. Registered competitors will be eligible to compete in one category only. Either a State category or the Murray/Darling Basin category or the Great Dividing Range category or the East Coast category or the Top End category, not two or more categories. Please see Clause 49 for full details on the Murray/Darling Basin category, Clause 50 for full details on the Great Dividing Range category, Clause 51 for full details on the East Coast category and Clause 52 for full details on the Top End category. 12. All competitors must hold a valid fishing license as per State / Territory regulations. 13. Target species for each Australian State or Territory, Murray Darling Basin category, Great Dividing Range category, East Coast category and Top End category will be advised to competing anglers via the website at 1200 hours AEDST on Sunday, 25 February, Competitor angler numbers and a repeat list of target species will be available from the website and also via on Saturday, 17 March, 2018 after 6.00 pm AEDST. 15. If you do not receive your Pirtek Fishing Challenge 2018 brag mat in time for the competition you may use a previous year s Pirtek Fishing Challenge brag mat, a State Fisheries measuring sticker or a generic brag mat with your angler number clearly marked on a piece of white cardboard 100mm x 100mm in size. 16. Competing anglers will commence fishing 0600 hours on Sunday, 18 March, 2018 and cease fishing at 1800 hours on Sunday, 18 March, No lines in water prior to 0600 hours on Sunday, 18 March, 2018 and all lines out of the water at 1800 hours on Sunday, 18 March, All fish measured and photographed on the Pirtek Fishing Challenge brag mat must be positioned with the nose of the fish at the 0 marker. a. The dorsal fin must point towards the top of the brag mat. Any fish photographs submitted with the fish upside down (i.e. the dorsal fin to the bottom of the brag mat) will be excluded. b. Flat fish are to be positioned belly down on the brag mat. 19. Photographs must be of a live, non-mutilated fish (no exceptions). 20. Once the photograph has been taken the fish must be released as quickly as possible, carefully back into the water. a. Any evidence of fish being killed after the photograph has been taken will see that fish ineligible for the competition. Any fish deemed to be dead or unable to be released by the Pirtek Fishing Challenge Committee will be ineligible. With the exception of any noxious/pest species deemed by State Fisheries to be a pest and recommended not to be returned to the waterway. 21. Any digital manipulation of photographs is prohibited and will result in instant disqualification of the competing angler. 22. It is the responsibility of the competing angler to ensure photographs are uploaded to the website correctly. Page 2
3 23. Photographs may ONLY be uploaded via the website. Any photographs received from competing anglers via or uploaded on Facebook will not be eligible for the target species photograph and release section of the Competition. 24. Only one (1) photograph per competing angler can be uploaded. 25. Only one (1) photograph will be accepted per competing angler. 26. Photographs may be uploaded to by participants from 0600 hours AESDT on Sunday, 18 March, 2018 until 0700 hours AESDT, Monday, 19 March, In the event of an angler not uploading their fish photograph prior to 0700 hours AEDST on Monday, 19 March, 2018 the angler will not be eligible for the target species photograph and release section of the Competition. 28. Any photographs sent to the Pirtek Fishing Challenge can be used for marketing or advertising purposes by Pirtek Fishing Challenge. 29. Participants, competitors and observers: a. acknowledge that fishing and boating are activities which contain elements of risk and danger; b. acknowledge that the decision to participate in the Competition and the decision to go to sea is theirs alone; c. accept full responsibility for their own safety and the risks and consequences of participating in the event; d. hold National Fishing Challenge Pty Ltd, Pirtek Fluid Systems Pty Ltd, its associated companies and franchisees blameless; e. release and discharge National Fishing Challenge Pty Ltd, Pirtek Fluid Systems Pty Ltd, its associated companies and franchisees from any liability; and f. indemnify National Fishing Challenge Pty Ltd, Pirtek Fluid Systems Pty Ltd, its associated companies and franchisees for any claims, actions, suits and court proceedings brought against it or any of them arising from the conduct of the event. 30. Junior anglers must be 16 years of age or under at the start of the calendar year. 31. Both junior and senior competing anglers may only enter fish caught by themselves. 32. All fish must comply with State Fisheries minimum lengths and bag limits. The Pirtek Fishing Challenge organizing committee strongly recommends for all anglers to avoid targeting spawning or pre-spawning aggregations of fish stocks, and to avoid interactions with threatened fish and other threatened aquatic species. 33. Anglers may fish a maximum of 2 lines in the water at any one time. 34. Netting with a hand held landing net or a set of lip grips is the only assistance permissible to a competitor (junior or senior) in the capture of a fish. a. Please remember when using lip grips to support the belly of the fish at all times. 35. We strongly recommend the use of knotless (i.e. Environet style) nets for landing of fish. 36. If a noxious/pest fish is chosen as a target species it can be photographed on the brag mat then dispatched as per State Fisheries guidelines and regulations. For example, NSW State Fisheries regulations recommend fish be dispatched by a sharp blow to the head or placed in an ice slurry. The fish should be disposed of in an appropriate waste bin. Page 3
4 37. Boats, canoes and kayaks must comply with Waterways safety requirements. Please ensure all boats, canoes, kayaks and trailers are free of noxious weeds, plants and their seeds before entering the waterway. 38. The organizers strongly recommend the use of Australian bait products only and discourage the use of imported baits such as frozen prawns. 39. Any noxious/pest fish species caught, i.e. carp or tilapia, should be disposed of according to State Fisheries regulations. 40. All competitors are strictly advised to remove all rubbish from campsites and waterways and place them in the correct disposal areas/bins. 41. Where possible the organizers recommend the use of kayaks, canoes or electric motors to minimize the carbon footprint of the competition. 42. The Competition is not open to commercial fishing vessels (recreation style charter vessels are permitted). 43. All fish must be caught on rod, reel or hand line with only one hook or one lure attached to the line. 44. Commercial fishing methods and techniques (nets, trawl, and longline) are not permitted. 45. Fishing inside marine parks and reserves may be prohibited in your State. Please check with your local authority to confirm areas permitted for recreational fishing. Any fish taken from these restricted areas will be ineligible for entry into the competition. 46. No farmed or commercially grown fish are permitted in the competition. 47. Hatchery fish and home aquarium fish are excluded from the competition. 48. Fish stocked in private dams are excluded from the competition, only impoundments open to the public are permitted. 49. The Murray Darling Basin category: a. The Murray Darling Basin (MDB) encompasses an area from south-western Queensland, western New South Wales, central western Victoria and the Murray catchment in South Australia. b. Fish eligible for the Murray Darling Basin category can be caught in any river or tributary flowing into either the Murray or Darling Rivers. To simplify, any public river, tributary or creek that flows west of the Great Dividing Range and eventually into the Murray or Darling rivers is permitted. c. An extension to the Murray Darling Basin boundaries will apply in Queensland north from Chinchilla to Emerald and west to Longreach. d. A detailed map of the Murray Darling Basin boundaries is available on the Pirtek Fishing Challenge website e. Competitors can be from Queensland, New South Wales / ACT, Victoria and South Australia. f. Competitors may only upload one photograph for the competition. If the fish entered is in the Murray Darling Basin category you may not enter a fish in your State category. g. Fish entered in this category are put down as Murray Darling Basin or MDB and not State specific. h. Public impoundments that are west of the Great Dividing Range and open to fishing for the target species selected are eligible for inclusion. Page 4
5 i. Private dams and impoundments are strictly excluded from the Pirtek Fishing Challenge. j. If Murray Cod is chosen as a target species it can only be caught on artificial lures. No bait of any description live, dead or synthetic can be used. k. If Murray Cod is chosen as a target species no South Australian waterways can be fished for this species. South Australia Fisheries regulations dictate Murray Cod must remain in the water and cannot be photographed on a brag mat. This excludes South Australian Murray Cod from the competition. l. Any angler found to be using bait to target Murray Cod will be excluded from the competition. No exceptions. m. It is also highly recommended to wet your brag mat before carefully supporting and placing the Murray Cod on the mat for the photograph, quickly releasing the fish carefully into the water. n. There will be three target species in the Murray Darling Basin category i. A $4000 mystery length cash prize for each target species will be awarded for the senior competition only. ii. Prizes will be awarded for senior first, second, third and junior first and second for the three target species. These prizes are for the fish measuring the longest, second longest and third longest in each category. 50. The Great Dividing Range category: a. The target species for the Great Dividing Range (GDR) category will be a freshwater fish which inhabits an area inside the GDR boundary from the southern Queensland border through New South Wales and Victoria finishing at the Grampians, including Ballarat. b. Fish eligible for the Great Dividing Range category can be caught in any public river, tributary or impoundment flowing or existing inside the GDR boundary as per the map available on the Pirtek Fishing Challenge website - pirtekfishingchallenge.com.au c. A detailed map of the Great Dividing Range boundaries is available on the Pirtek Fishing Challenge website d. Competitors can be from Queensland, ACT / New South Wales and Victoria. e. Competitors may only upload one photograph for the competition. If the fish entered is in the Great Dividing Range category you may not enter a fish in your State category. f. Fish entered in this category are nominated as Great Dividing Range (GDR) and not State specific. g. Public impoundments contained inside the Great Dividing Range boundary map and open to fishing for the target species selected are eligible for inclusion. h. Private dams and impoundments are strictly excluded from the Pirtek Fishing Challenge. i. There will be one (1) target species in the Great Dividing Range category i. A $4000 mystery length cash prize for the target species will be awarded for the senior competition only. ii. Prizes will be awarded for first, second, third and junior first and second for the target species. 6 51. The East Coast category: a. The target species for the East Coast (EC) category will be a freshwater fish which inhabits an area in coastal rivers, lakes and estuaries of Eastern Australia from Fraser Island, Queensland, to Wilson Promontory, Victoria. b. This fish is also found in many public impoundments within Queensland, New South Wales and Victoria due to artificial stocking programs. c. Fish eligible for the East Coast category can be caught in any public river, tributary or public impoundment within the area outlined in Clause 51a and b. d. Competitors can be from Queensland, Australian Capital Territory, New South Wales and Victoria. e. Competitors may only upload one photograph for the competition. If the fish entered is in the East Coast category you may not enter a fish in your State category. f. Fish entered in this category are nominated as East Coast (EC) and not State specific. g. Private dams and impoundments are strictly excluded from the Pirtek Fishing Challenge. h. There will be one (1) target species in the East Coast category: 52. The Top End category: i. A $4000 mystery length cash prize for the target species will be awarded for the senior competition only. ii. Prizes will be awarded for first, second, third and junior first and second for the target species. These prizes are for the fish measuring the longest, second longest and third longest in each category. a. The target species for the Top End (TE) category encompasses all of the Northern Territory including the major off shore islands and Western Australia from the Northern Territory / West Australian corner border, heading west in a straight line to Kalbarri and north. Please see attached map. b. Fish eligible for the Top End category can be caught in any river, tributary, estuary or Australian open waters. Fishing is permitted in public impoundments. c. Competitors may only upload one photograph for the competition. If the fish entered is in the Top End category you may not enter a fish in your State category. d. Fish entered in this category are nominated as Top End (TE) and not State specific. e. Private dams and impoundments are strictly excluded from the Pirtek Fishing Challenge. f. There will be two (2) target species in the Top End category: 53. The Open category: i. A $4000 mystery length cash prize for each target species will be awarded for the senior competition only. ii. Prizes will be awarded for first, second, third and junior first and second for the target species. These prizes are for the fish measuring the longest, second longest and third longest in each category. a. The target species for the Open category will be fish located in waters south of the Tropic of Capricorn. Page 6
7 b. Fish eligible for the Open category can be caught in any public river, estuary or Australian open waters. c. Competitors may only upload one photograph for the competition. If the fish entered is in the Open category you may not enter a fish in your State category. d. Fish entered in this category are nominated as Open and not State specific. e. Private dams and impoundments are strictly excluded from the Pirtek Fishing Challenge. f. There will be two (2) target species in the Open category: i. A $4000 mystery length cash prize for each target species will be awarded for the senior competition only. ii. Prizes will be awarded for first, second, third and junior first and second for the target species. These prizes are for the fish measuring the longest, second longest and third longest in each category. 54. Southern Western Australia: a. This area encompasses the southern half of Western Australia from Kalbarri in a straight line to the Western Australia / Northern Territory corner border and south. 55. Mystery length prizes: a. $4000 cash will be awarded to nineteen (19) target species that are closest to the mystery length for the senior competition only in New South Wales, Queensland, Victoria, Murray Darling Basin, Great Dividing Range, East Coast, Top End and Open categories. Please see Clause 59 (a) for individual State, Territory and category allotment of prizes. b. $2000 cash will be awarded to six (6) target species that are closest to the mystery length for the senior competition only in Tasmania, South Australia and Southern Western Australia. Please see Clause 59 (b) for individual State, Territory and category allotment of prizes. c. The mystery lengths and target species will be forwarded to a Justice of the Peace by the Committee on Thursday, 15 March, d. The mystery lengths will not be disclosed until the winners are announced on Saturday, 24 March, e. In the event of a tie (i.e. two or more fish of the same mystery length or of the same metric distance away from the mystery length) a count-back will apply. The first fish photograph uploaded to the Pirtek Fishing Challenge website will be awarded the prize. (For example, a photo uploaded at 4.55pm will win over a fish sent at 4.56pm and measuring the identical length.) f. All mystery length winners will be ineligible to win either first, second or third prizes for their target species. g. All mystery lengths will be longer than the minimum legal length as per State or Territory Fisheries regulations. h. Example of mystery length calculation: Target fish is bream and mystery length is 46.4mm. Two photos are submitted of bream, one at 46.2mm and one at 46.7mm. If these two fish were the closest to the mystery length the winner would be 46.2mm. Page 7

The judging committee will be supplied with the complete list of mystery lengths at the close of photo uploads AEDST 0700, Monday, 19 March, The winning fish for each target species will be judged by overall length. That is from the front of the mouth to the tip of the tail. a. First place for each target species will be awarded to the longest fish overall; second place to the second longest fish; third place to the third longest fish. b. Junior prizes will be first place to the longest fish overall for each target species; and second place to the second longest fish for each target species. c. In the event of a tie (i.e. two or more fish of the same length) a countback will apply. The first fish photograph uploaded to the Pirtek Fishing Challenge website will be awarded the prize. (For example, a photo uploaded at 4.55pm will win over a fish sent at 4.56pm and measuring the identical length.) 57. The winners and runners-up for each Australian State, Territory and category will be posted on on Saturday, 24 March, They will also be contacted via telephone and mail. 58. Prize money will be paid within 28 days from Saturday, 24 March, The national prize pool is as follows: a. For New South Wales, Queensland, Victoria, Murray Darling Basin, Great Dividing Range, East Coast, Top End and Open categories: i. Mystery Length: Nineteen (19) x $ cash ii. The Committee s decision is final and no correspondence will be entered into. 61. On The Water Prize Draw: a. Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with these terms and conditions is invalid. b. Entry is open to residents of Australia. c. All paid and registered Pirtek Fishing Challenge competitors are eligible and automatically entered into the On The Water Prize Draw. d. The competition will open on Monday, 8 January, 2018 and close on Friday, 16 March, 2018 or until the stocks of brag mats and caps are sold, whichever occurs first. e. There are seven (7) prizes only in the competition. f. Entrants may only enter the competition once. Page 9
10 g. List of seven draw prizes: i. The first entry drawn will win one (1) Stacer 469 Outlaw tiller steer boat motor trailer package including Evinrude E-tec 75hp outboard engine. RRP $29, ii. The second entry drawn will win a Snap-On Tools tool kit. RRP $5, iii. The third entry drawn will win a Snap-On Tools tool kit. RRP $5, iv. The fourth entry drawn will win a Lowrance Hook 2 12 inch FishFinder. RRP$2, v. The fifth entry drawn will win a Berkley Fishing Pack. RRP $2000. vi. The sixth entry drawn will win a $1700 BCF spending spree gift card. vii. The seventh entry drawn will win a Valvoline product pack. RRP $ viii. It is the responsibility of the Stacer Evinrude 469 Outlaw tiller steer boat motor trailer package winner to have insurance in place at time of collection. ix. The boat and trailer will have current registration certificates. x. The winner of the Stacer Evinrude 469 Outlaw tiller steer boat motor trailer package is responsible for collection of the prize from Pirtek Fluid Systems, 3-7 Garling Road, Kings Park, NSW, xi. Temporary insurance cover of the Stacer Evinrude 469 Outlaw tiller steer boat motor trailer package will be cancelled upon collection by the winner. xii. All prizes will be available for collection within 28 days from the date of the prize draw. xiii. All prizes are not transferable. xiv. All prizes are not redeemable for cash. xv. The $1700 BCF spending spree card will be mailed within 28 days from the date of the prize draw or collected from the nearest Pirtek Fluid Systems outlet. xvi. The $1700 BCF spending spree is redeemable in store only. xvii. The winner must make their own way to a BCF store of their choosing to spend their $1700 gift card. h. Total prize pool for the On The Water Prize Draw is $45, i. The draw will be conducted on Thursday, 22 March, 2018 at am AEDST via a barrel draw and witnessed by a Justice of the Peace at Pirtek Fluid Systems Pty Ltd, 3-7 Garling Road, Kings Park, NSW, j. The prize winners will be notified from Saturday, 24 March, 2018 via They will also be contacted via telephone and mail. k. The names of prize winners along with their town and State location will be published in The Australian on Tuesday, 3 April, 2018 and also on the website. l. The Promoter may conduct an unclaimed prize draw at the same place as the original draw on Thursday, 21 June, 2018 at am AEST to distribute any prizes unclaimed by that date. The first valid entry drawn will win the unclaimed prize and the draw will continue until all unclaimed prizes have been distributed. Any winners Page 10
11 of an unclaimed prize will be notified in writing and have their name, town and State location published in The Australian on Tuesday, 3 July, 2018 and also on the website. m. Entries are deemed to be received at the time of receipt into the Promoter s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. n.
