6 Louisiana Department of Wildlife & Fisheries addressed the Gulf Council 1. Suggested a 3-year red snapper regional management Pilot Program 2. Council would set annual recreational & for-hire landings for LA 3. LA monitors recreational & for-hire landings in LA

7 LDWF wants to Establish: 1. A different season for recreational fishers including for-hire 2. A recreational offshore landing permit to indentify users 3. Tracking and reporting requirements 4. An LA allocation based on past-landings

8 Recreational Fishing Regulations Minimum Size Species Limit Season Daily Bag Limit Red Snapper 16" Total Length June 1 July 10* 2 per person *Actually July 16 in 2012 as 6 days were added to the season to account for several days of rough seas that prohibited fishing during the regular season

9 LDWF says this action will: 1. Increase flexibility for recreational fishers (e.g., weekends only for a longer season) 2. Increase accountability by states (LA) 3. Retain the size limits for red snapper

10 Gulf Council Concerns 1. Data tracking 2. Out-of-state fishers 3. Enforcement issues 4. Stock limits

11 State Authority in Federal Waters A state may regulate vessels that are registered in that state and fishing in federal waters for species for which there are no federal fishery management plans or applicable federal regulations, or for which the appropriate fishery management plan has delegated management of the state and the state rules are consistent with federal regulations. NOTE: Federally permitted for-hire reef fish vessels must comply with the more restrictive of federal or state reef fish regulations when fishing for reef fish in state waters.

12 Gulf Council Motions June 2012 Motion 1: To request Louisiana to provide the Council with the details of their proposed regional management plan for red snapper. Motion 2: To develop a plan amendment with alternatives for regional management of recreational harvest of red snapper. Motion 3: To request that staff develop a letter to LDWF Secretary Barham requesting that appropriate personnel (legal and others) come and explain the expansion of Louisiana s jurisdiction to a total of 10.3 miles for fishery management purposes.

14 LDWF wants the Gulf Council to: 1) Establish an annual allocation for recreationally caught red snapper in LA waters 2) Allow LA permitted recreational and for-hire vessels to harvest in its territorial waters under regional management regulations

15 Summary of Proposed Regional Recreational Red Snapper Management Pilot Proposal That the Gulf Council establish a 3-year red snapper regional management pilot study within LA waters Council-imposed, biologically-based regulations would remain in effect: Allocation of annual landings & size limit Harvest allocation regulations would fall under regional management: 1. Bag & possession limits 2. Seasons 3. Harvest tracking measures

16 Gulf Council Key Responsibilities Establish an annual recreational landings allocation for Louisiana in numbers of fish. Allow Louisiana s permitted recreational fishermen and for-hire vessels to harvest in federal waters under regional management regulations.

17 Key Responsibilities Louisiana Wildlife & Fisheries Commission Establish Recreational Fishing Season annual point of reference to begin counting landings allocation. Establish Recreational Offshore Landing Permit to identify fishery participants. Establish Harvest Tracking and/or Reporting Requirements. isnapper

18 Problems for the Council 1. Council does not have authority for pilot programs only plan amendments 2. Time Soonest will be Summer of Self-reporting requires validation 4. Territorial limit is out of Council hands. 5. Different fee for fishers not from LA is against Magnuson-Stevens Act provision

19 but the bottom Line is the concept of Regional Fishery Management in the Gulf of Mexico Allow regional (state?) control over recreationally caught and landed fish

20 Council Motions August 2012 Motion 1: That the Council instruct staff to develop a plan amendment scoping document for a regional management system in the Gulf of Mexico for recreational red snapper to be discussed at the October 2012 meeting. Motion 2: To instruct staff to develop some options including analysis on states going noncompliant for the 2013 red snapper fishing season.
