1. (1) The title of these regulations is the Enforcement of Sea Fishing Conventions Order, 2011.

1 B 2736 L.N. 209 of 2011 FISHERIES CONSERVATION AND MANAGEMENT ACT (CAP. 425) Enforcement of Sea Fishing Conventions Order, 2011 BY VIRTUE of the powers conferred by article 32 of the Fisheries Conservation and Management Act, the Minister for Resources and Rural Affairs, has made the following Order:- Title and scope. Interpretation. 1. (1) The title of these regulations is the Enforcement of Sea Fishing Conventions Order, (2) The scope of this Order is the enforcement of restrictions and obligations relating to sea fishing in conventions to which Malta is a party, to provide for infringements of such conventions to constitute an offence against the Act and to establish the applicable penalties. 2. In this Order, unless the context otherwise requires: Cap the Act means the Fisheries Management and Conservation Act; convention shall have the same meaning as that assigned to it in the Act. Applicability. Offences and penalties. 3. These regulations apply to the conventions related to sea fishing listed in the Schedule to this Order and any amendments thereto. 4. (1) Any person who does not comply with any restriction or obligation relating to sea fishing contained in any of the conventions to which this Order applies shall be guilty of an offence against the Act, and shall be liable to a fine (multa) not exceeding fifty-eight thousand two hundred thirty-four euro and thirty-three cents (58,234.33): Provided that where any such convention provides for a further or more specific penalty in respect of a violation of any of its provisions, such penalty shall be applicable in respect of violations to such provisions.

2 B 2737 (2) The provisions of article 33 of the Act shall apply in the case of a second or subsequent conviction to a convention listed in the Schedule to this Order. 5. The provisions of articles 31 to 35 contained in Part XI of the Act relating to Court Proceedings, Administrative Proceedings and Penalties shall apply mutatis mutandis to offences to the conventions listed in the Schedule to this Order.
