1 Department of Agriculture, Food and the Marine An Roinn Talmhaíochta, Bia agus Mara Fisheries Management Notice No. 39 of 2018 (June Under 55ft Obligated Boats Demersal Quota Management Notice) I, Michael Creed, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 12 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 (S.I. No. 707 of 2007) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 (S.I. No. 455 of 2011)), hereby issue the following Notice: 1.1 This Notice is June Demersal Obligated boats under 55ft Quota Management Notice 2018 (Fisheries Management Notice No. 39 of 2018). 1.2 This Notice comes into force on 1 June 2018 and ceases to have effect on 1 July This Notice shall not apply to an Irish sea-fishing boat in respect of which a monkfish authorisation is extant 2. In this Notice: CECAF means the Committee for the Eastern Central Atlantic Fisheries; ICES means the International Council for the Exploration of the Sea; Union waters means European Union waters. Where this term is used in conjunction with an ICES or CECAF sub-area or division listed in Schedule 1, Schedule 2, Schedule 3 and Schedule 4, it means that only the European Union waters of that sub-area or division are included; length means, in relation to a sea-fishing boat, the overall length of the boat, or the distance from the forepart of the stem of the boat to the aft side of the head of the sternpost of the boat or to the foreside of the rudder stock; 1
2 fishing trip means any voyage of a fishing vessel during which fishing activities are conducted that starts at the moment when the fishing vessel leaves a port and ends on arrival in port; target species as provided for in Council Regulation (EC) No 850/98 of 30 March 1998 for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms, as amended; monkfish authorisation means an authorisation to fish for monkfish (family Lophiidae) granted under section 13 of the Sea-Fisheries and Maritime Jurisdiction Act 2006; catch retention and landing restrictions means the total quantity, in tonnes live weight, of that species of fish in column (1), a quantity of which, greater than that specified in column (3) and column (4), may not be retained onboard or landed by an Irish sea-fishing boat, dependant on the particular boat s length and/or fishing method during June 2018; fishing area means waters falling within the ICES sub-areas and divisions listed in Schedule 1, Schedule 2, Schedule 3 and Schedule 4 as defined in Annex III to Regulation (EC) No. 218/2009 of the European Parliament and of the Council of 11 March 2009, 1 as amended; obligated means a sea fishing boat which appears on any list of boats provided for under Article 6 of Commission Delegated Regulation (EU) 2018/46 of 20 October in respect of North Western waters; de minimis limit means the maximum amount of a particular stock which may be discarded in accordance with the conditions contained in Article 5 of Commission Delegated Regulation (EU) 2018/46 of 20 October 2017; 1 OJ L 87, , pp OJ L 7, , pp
3 stock means a species in a defined fishing area listed in columns (1) and (2) of Schedule 1, Schedule 2, Schedule 3 and Schedule 4; discard means not retaining on board a fish caught by a boat; Gadoids means Cod (Gadus morhua), Haddock (Melanogrammus aeglefinus), Whiting (Merlangius merlangus) and Saithe (Pollachius virens). By catch Limit 3 The By-Catch Limit which is listed in column (4) of Schedule 1, Schedule 2 and Schedule 4 opposite that fishing area where the fish were caught listed in column (1) shall only apply where the boat is obligated to land that stock in accordance with Article 6 of Commission Delegated Regulation (EU) 2018/46 of 20 October 2017 in respect of North Western waters. De Minimis 4 During June 2018, a person on board an Irish sea-fishing boat less than 55 feet in length, which is obligated to land Norway Lobster (Nephrops Norvegicus) in Area VI, Vb, Norway Lobster (Nephrops Norvegicus) in Area VII, or Norway Lobster (Nephrops Norvegicus) in Functional Unit 16 of ICES Subarea VII, or Whiting (Merlangius Merlangus) in Area VIIb, VIIc, VIId, VIIe, VIIf, VIIg, VIIh, VIIj and VIIk, shall not discard fish for these stocks, where an obligation exists to land that stock, greater than 6 per cent by weight of the quantity, which is listed in column (3) of Schedule 1 and Schedule 4 opposite that fishing area where the fish were caught listed in column (1) in June Boats fishing a stock which they are NOT obligated to land 5.1 Boats targeting Nephrops in ICES Areas VI & VII and Functional Unit 16 of ICES Subarea VII During June 2018, in any one fishing trip, a person on board an Irish seafishing boat, targeting Nephrops in ICES Areas VI and VII may only fish in either of 3
4 ICES Area VI and ICES Area VII, excluding Functional Unit 16 of ICES Subarea VII, or Functional Unit 16 of ICES Subarea VII 5.2 During June 2018, a person on board an Irish sea-fishing boat less than 55 feet in length, fishing a stock for which they are not obligated, in a fishing area listed in column (2) of Schedule 1, Schedule 2, Schedule 3 and Schedule 4, shall not fish for that stock when the quantity of a species of fish has been landed or retained on board, which is listed in column (1) of Schedule 1, Schedule 2, Schedule 3 and Schedule 4 opposite that fishing area where the fish were caught listed in column (2) that is greater than the corresponding quantities specified in column (3), either on a single occasion or when combined with previous landings by that boat of that species of fish caught in the specified area in June Boats fishing a stock which they ARE obligated to land 6.2 NEPHROPS Boats targeting Nephrops in ICES Areas VI & VII and Functional Unit 16 of ICES Subarea VII During June 2018, in any one fishing trip, a person on board an Irish seafishing boat, targeting Nephrops in ICES Areas VI and VII may only fish in either of ICES Area VI and ICES Area VII, excluding Functional Unit 16 of ICES Subarea VII, or Functional Unit 16 of ICES Subarea VII 6.2 During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length, fishing in ICES Zone VI, Vb, which is obligated to land Nephrops and by-catches of Haddock in Area VI, Vb, shall not fish for Nephrops when the quantity of Nephrops has been landed or retained on board, which is listed in column (3) of Schedule 4, is exceeded. In such instance, the boat may only fish with fishing gear in which the cod end is greater than 100mm when the quantity of Nephrops in Area VI, Vb has been 4
5 landed or retained on board, which exceeds the sum of column (3) and (4) then the boat may not fish in Area VI, Vb, for the remainder of the fishing period. 6.3 During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length, fishing in ICES Zone VII which is obligated to land Nephrops in Area VII, shall not fish for Nephrops when the quantity of Nephrops has been landed or retained on board, which is listed in column (3) of Schedule 4, is exceeded. In such instance, the boat may only fish with fishing gear in which the cod end in greater than 100mm when the quantity of Nephrops in Area VII has been landed or retained on board, which exceeds the sum of column (3) and (4), then the boat may not fish in Area VII for the remainder of the fishing period. 6.4 During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land Nephrops when fishing in ICES Zone Functional Unit 16 of VII, shall cease fishing for Nephrops when the quantity of Nephrops retained on board exceeds the quantity in column (3) of Schedule 4. Furthermore, when the quantity of Nephrops landed exceeds the quantity in column (3) then the boat may not fish in ICES Zone Functional Unit 16 of VII for the remainder of the fishing period. 6.5 WHITING During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land whiting when fishing in ICES Zone VIIb-k, shall not fish for Whiting when the quantity of Whiting has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded. In such instance, the boat may only target Non-Gadoid species in Area VIIb-k. When the quantity of Whiting in Area VIIb-k has been landed or retained on board, which exceeds the sum of column (3) and (4) of Schedule 1, then the boat may not fish in Area VIIb-k for the remainder of the fishing period. 6.6 HADDOCK During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land haddock and by-catches of 5
6 sole, plaice and megrim when fishing in ICES Zone VI, Vb, shall not fish for Haddock when the quantity of Haddock has been landed or retained on board, which is listed in column (3), is exceeded. In such instance, the boat may only target Non-Gadoid species in Area VI, Vb. When the quantity of Haddock in ICES Zone VI, Vb has been landed or retained on board, which exceeds the sum of column (3) and (4) of Schedule 1, then the boat may not fish in Area VI, Vb for the remainder of the fishing period. 6.7 During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land Haddock when fishing in ICES Zone VIIa shall not fish for Haddock when the quantity of haddock has been landed or retained on board, which is listed in column (3) of Schedule 1 is exceeded. In such instance the boat may only target Non-Gadoid species in Area VIIa when the quantity of Haddock Area VIIa has been landed or retained on board, which exceeds the sum of column (3) and (4) of Schedule 1, then the boat may not fish in Area VIIa for the remainder of the fishing period. 6.8 HAKE During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land Hake when fishing in ICES Zone VI, VII and Vb, shall not fish for Hake when the quantity of Hake has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded. In such instance the boat, may not target Hake in Area VI, VII and Vb when the quantity of Hake in Area VI, VII and Vb has been landed or retained on board, which exceeds the sum of column (3) and (4), then the boat may not fish in Area VI, VII and Vb for the remainder of the fishing period. Boats Fishing Haddock exclusively with Danish/Scottish Fly Seines 7.1 During June 2018, a person on board an Irish sea-fishing boat fishing exclusively by means of Danish/Scottish Fly Seines shall not, in ICES division VIIa or ICES divisions VIIb-k, sub areas VIII, IX and X: Union waters of CECAF , have or retain on board that boat or land, a quantity of Haddock greater than the quantity that is specified in column (3) of 6
7 Schedule 2 opposite mention of the relevant ICES area if the haddock was caught either on a single occasion or when combined with previous landings of that species of fish caught in the specified area in June During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length fishing exclusively by means of Danish/Scottish Fly Seines and fishing in ICES Zone VI, Vb shall not fish Haddock when the quantity of Haddock has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded. In such instance, the boat may only target Non-Gadoid species in Area VI, Vb when the quantity of a species of fish has been landed or retained on board, which exceeds the sum of column (3) and (4) of Schedule 1, then the boat may not fish in Area VI, Vb for the remainder of the fishing period. 7.3 During June 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length, which is obligated to land Haddock when fishing in ICES Zone VIIa and exclusively by means of Danish/Scottish Fly Seines and fishing in ICES Zone VIIa, shall not fish for Haddock when the quantity of haddock has been landed or retained on board, which is listed in column (3) of Schedule 2, is exceeded. In such instance, the boat may only target Non- Gadoid species in Area VIIa when the quantity of a species of fish has been landed or retained on board, which exceeds the sum of (3) and (4) of Schedule 2, then the boat may not fish in Area VIIa for the remainder of the fishing period Boats Fishing Hake using Gillnets or Longlines 8.1 The master of a sea fishing boat which has caught Hake using Gill Nets or Long Lines in ICES Sub Areas VI, VII and Vb shall comply with Article 15(1), (4), (8), (11) and (12) of the Council Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December and with Article 6 of Commission Delegated Regulation (EU) 2018/46 of 20 October 2017 and may not discard catches of Hake taken in ICES Sub Areas VI, VII 3 OJ L 354, , pp
8 and Vb. A boat fishing exclusively by means of gillnets or longlines may not target Hake using any other means. 8.2 During June 2018, a person on board an Irish sea-fishing boat less than 55 feet in length, fishing for Hake using gillnets or longlines in ICES Zones VI, VII and Vb, shall not fish for Hake when the quantity of Hake has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded, if the Hake was caught either on a single occasion or when combined with previous landings of Hake caught in ICES Zones VI, VII and Vb in June When the quantity of Hake which has been landed or retained on board, exceeds the sum of column (3) and (4) of Schedule 1, the boat must cease fishing in ICES Zones VI, VII and Vb for the remainder of the fishing period. Boats Fishing Sole using Trammel nets or Gillnets 10 The master of an Irish sea-fishing boat which has caught Sole using Trammel nets or Gill Nets in ICES Sub Areas VIIhjk shall comply with Article 15(1), (4), (8), (11) and (12) of the Council Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 and with Article 6 of Commission Delegated Regulation (EU) 2018/46 of 20 October 2017 and may not discard catches of Sole in ICES Sub Areas VIIhjk. 8
