1 Pointe West Country Club Rules and Regulations It is the intent of the Club to limit these Rules and Regulations to the minimum required for the enjoyment of the Club s facilities by all of its members and guests. The obligation of enforcing these Rules and Regulations for the good of all is placed in the hands of the management staff of the Club. The Club may, in its sole and absolute discretion, amend or revise these Rules and Regulations at any time, and in event the Club does amend or revise these Rules and Regulations, the Club will notify members and guests of any changes by posting revised Rules and Regulations of the Club in the Club s administrative office(s). GENERAL CLUB RULES 1. The Club shall be open on the days and hours established from time to time by the Club. Certain Club facilities may be closed from time to time for maintenance, repairs and other purposes deemed necessary by Club management. 2. MEMBERS AND THEIR GUESTS USE THE GOLF FACILITIES AND ALL OTHER FACILITIES PROVIDED AT THE CLUB AT THEIR OWN RISK. 3. Members and their guests must abide by all rules established by Club management as they may be amended from time to time, and members shall be responsible for ensuring that the member s spouse, family members and guests comply with all rules of the Club. 4. Performance by entertainers will be permitted on the property of the Club only with the permission of Club management. 5. Dining room activities for groups will be permitted only with the permission of Club management. 6. Alcoholic beverages will not be served or sold, nor permitted to be consumed, on the premises during hours prohibited by law. Alcoholic beverages will not be sold or served to any person not permitted to purchase the same under the laws of the State of Florida or sold for off-premises consumption. All alcoholic beverages consumed or otherwise possessed on the premises of the Club must be sold by and purchased at the Club. 7. Commercial advertisements and solicitations shall not be posted or circulated on or about the Club s premises without the prior approval of Club management. 8. The golf course and related facilities are for the use of members and their guests only. Any trespassers, which may include fishermen, bikers, walkers, runners and roller bladers are strictly forbidden from entering onto the golf course at all times. 9. Outside catering is not permitted; all food and beverages consumed on the Club s premises must be furnished by the Club. 10. Employees of the Club are not permitted to deliver food or alcoholic beverages to locations away from the immediate area of the clubhouse or other designated areas of the Club without the permission of Club management. 11. Children under the age of twelve are only permitted in the men s or women s locker rooms when accompanied by an adult. 12. With the exception of qualified service animals, dogs and other pets are not permitted on the Club s premises. 1

2 13. Members and their guests shall not abuse any of the Club s employees, verbally or otherwise. All employees of the Club are under the supervision of Club management and no member or guest shall reprimand or discipline any employee or send any employee off the Club s premises for any reason. Members and guests who abuse any of the Club s employees, whether verbally or otherwise, shall be subject to disciplinary action as described below. Members and their guests should report any issues or concerns regarding any employee to Club management. 14. Smoking is not permitted inside the clubhouse. 15. Firearms and all other weapons of any kind are not permitted on the Club s premises at any time. 16. All complaints, criticisms or suggestions of any kind relating to any of the operations of the Club must be in writing, signed and addressed to the Club s General Manager. 17. Violation of any of these rules or conduct in a manner prejudicial to the best interests of the Club will subject the person in violation to disciplinary action in accordance with the Club s Membership Bylaws. CLUB CHARGES AND MEMBER PAYMENTS 1. A membership/use account number will be assigned and a membership/use card issued to the member and designee and those members of the immediate family requested by the member and designee. 2. The opportunity to charge to a member s or designee s personal Club account is extended as a privilege of membership and/or use privileges at the Club and is subject to a continuing review and approval by the Club. The Club reserves the right to eliminate the use of Club accounts and monthly billings for members and designees and to require that all Club fees incurred at the Club be charged to a member s and designee s personal credit card or debit card or by automatic bank draft. 3. All charges must be signed legibly by the person making the charge and the member s or designee s last name and Club account number must be printed on the charge ticket. 4. Members and designees are responsible for the payment of all charges made by their spouse, immediate family members and guests. 5. Membership cards must be presented upon request when charging to a Club account. Membership cards are not transferable and may not be used by any person other than the person to whom it is issued. 6. It is the responsibility of each user to retain receipts for charges incurred at the Club. Copies of the monthly charges will not be included in the monthly statement. Receipts will only be made available upon request in the event a charge is disputed within a reasonable amount of time. 7. The Club must be notified in writing immediately if a membership/use card is lost. Until written notification of card loss is received by the Club, the member and/or designee shall be responsible for all charges placed on the account. For each membership card replaced, a service charge will be automatically billed to the member s Club account. 8. All Club fees charged to the member s or designee s Club account will be billed monthly and shall be due upon receipt and shall be deemed delinquent if not paid by the last day of the month in which the statement is mailed. Past due bills will accrue each month an amount equal to a minimum late fee established by the Club and/or interest at the maximum non-usurious rate permitted by law from the date of the statement until paid in full. 2

3 9. If the Club account of any member or designee is delinquent, the Club may take whatever action it deems necessary to accomplish collection. If the Club commences any legal action to collect any amount owed by a member or designee, or to enforce any other liability of a member or designee to the Club, and if judgment is obtained by the Club, the member and designee shall also be liable for all costs and expenses of the legal action and reasonable attorneys fees (including fees required in connection with appellate proceedings). 10. The Club may suspend and/or terminate membership and/or use privileges for failure to pay Club fees or any other amount owed to the Club in a proper and timely manner. Membership and/or use privileges may be suspended if Club accounts are not paid in full by the last day of the month and are subject to termination if Club accounts are not paid in full within thirty days after suspension of membership and/or use privileges. The Club may, in its discretion, determine not to seek the termination of membership and/use privileges. Such determination shall not be deemed a waiver of its right to seek the termination of membership/use privileges at a later date or against any other member or designee of the Club. LOSS OR DESTRUCTION OF PROPERTY OR INSTANCES OR PERSONAL INJURY 1. Each member, as a condition of membership, and each guest, as a condition of invitation to use the Club s facilities, assumes sole responsibility for his or her personal property. The Club shall not be responsible for any loss or damage to any personal property used or stored on the Club s facilities. 2. Property or furniture belonging to the Club shall not be removed from the room in which it is placed or from the Club s premises without authorization from Club management. 3. Every member of the Club shall be liable for any property damage and/or personal injury occurring on the Club s premises, or at any activity or function operated, organized, arranged or sponsored by the Club, caused by the member or any guest of the member, and the Club shall not be responsible or liable for any property damage and/or personal injury occurring on the Club s premises, including, but not limited to, those resulting from the actions of others. 4. Any member, guest or other person who, in any manner, makes use of, or accepts the use of, any apparatus, facility, privilege or service whatsoever owned, leased or operated by the Club, including without limitation the use of golf carts, or who engages in any contest, game, function, exercise, competition or other activity operated, organized, arranged or sponsored by the Club, either on or off the Club s premises, shall do so at his or her own risk. The member shall hold the Club, its owner and its manager and each of their respective affiliates, officers, directors, shareholders, managers, members, agents and employees harmless from any and all loss, cost, claim, injury, damage or liability sustained or incurred by the member, resulting therefrom and/or from any act or omission of any employee or representative of the Club. Any member shall have, owe and perform the same obligation to the Club, its owner and its manager and each of their respective affiliates, officers, directors, shareholders, managers, members, agents and employees hereunder in respect to any such loss, cost, claim, injury, damage or liability sustained or incurred by any guest of the member. RESERVATIONS AND CANCELLATIONS 1. Dinner reservations may be required from time to time and shall be subject to availability. The Club shall have the right to determine reservation policies from time to time in its sole discretion. 2. Reservations are required for special events and activities and shall be taken on a first-come, firstserved basis by pre-registering with the appropriate personnel at the Club. 3

4 3. For all functions of the Club held in the dining rooms of the Club, tables will be assigned on a firstcall, first-choice basis. A fee may be charged by the Club for cancellation of special functions. 4. Reservations for dining will be held for only fifteen minutes after the reserved time. The Club may change its policy at any time in its sole discretion. 5. Reservations for banquets should be made at least three weeks in advance. A nonrefundable deposit may be required for a banquet reservation. SERVICE CHARGES 1. For the convenience of members, an automatic service charge (which is not a tip or gratuity), in a percentage as determined from time to time by the Club, shall be automatically added to all food and beverage charges for the convenience of all members, all or a portion of which may be distributed by the Club to its food and beverage service employees. 2. In November, Club management may send a letter to the members providing an opportunity for the members to contribute to a Holiday Fund for employees of the Club, and a suggested contribution, of which payment will be voluntary, may be charged on each member s statement. The Club employs many people, and the Holiday Fund provides the members with an opportunity to show appreciation. The Club shall be responsible for the distribution of these funds. ATTIRE 1. Members shall always dress in a fashion befitting the surroundings and atmosphere provided in the setting of the Club. Members shall advise their guests of the Club s dress requirements. 2. Members must dress in a fashion compatible with the appropriate occasion. For breakfast or luncheon in the dining rooms, appropriate informal, casual sports attire may be worn. Gentlemen must remove their hats in the dining room. Members should consult with Club management regarding any questions or concerns regarding attire. 3. The dress standards of the Club may be waived by Club management from time to time for special activities and functions. 4. Shirts and shoes must be worn at all times when on the Club s premises. CLUB SERVICES AND ACTIVITIES 1. The Club provides a variety of social, cultural and recreational events in which all members are encouraged to participate. 2. The Club desires to encourage the use of the clubhouse facilities by members and guests for private parties, on any day or evening, provided it does not interfere with the normal operation of the Club or with the services regularly available to the members. Members are requested to make reservations with the appropriate Club personnel for available dates and arrangements. 3. Private parties are permitted on the Club s premises only with prior approval from Club management. The person sponsoring the private party, whether a Member or sponsored guest, shall be fully 4

5 responsible for the conduct of the guests in accordance with these rules, for any damage caused by the guests and/or the installation of party decor and shall be responsible for the removal of all such party décor following the event. The person sponsoring the private party shall be responsible for payment in full for the use of the Club s facilities and any outstanding charges immediately upon receipt of the Club s invoice. 4. Special event functions will be scheduled from time to time at the sole discretion of the Club. GUESTS Guests of members may be extended guest use privileges subject to applicable guest fees, charges and compliance with the rules and regulations established from time to time by the Club. Guest privileges may be limited, denied, withdrawn or revoked at any time for reasons considered sufficient by Club management in its sole and absolute discretion. All guests shall be either houseguests or day guests. A houseguest is defined as a guest temporarily residing in a member s residence. All other guests of a member shall be considered day guests, or guests. DAY GUESTS 1. The Club reserves the right to limit the number of times a particular day guest may use the golf facilities of the Club during each membership year. The current limit is 6 times total per year by the same guest, regardless of which member brings the particular day guest to the Club. 2. A particular individual using the Club s facilities as a day guest must be registered by the sponsoring member with the Club. The Club reserves the right to acquire identification by each day guest. Day guests must be accompanied by the member at all times when using any facility of the Club, unless otherwise determined by the Club from time to time. Day guests will be charged guest fees for use of the Club s facilities as determined from time to time by the Club. 3. Day guests will be allowed to use the Club s facilities only in accordance with the privileges of the membership of the sponsoring member upon payment of any required and applicable fees. 4. Day guest charges for any services will be charged against the sponsoring member s club account or paid with a major credit card at the time of service. 5. Day guest privileges may be limited by the Club, from time to time, in its sole discretion. Notice of such limitation will be given by the Club. 6. The sponsoring member shall be responsible for all charges incurred by the guest. The sponsoring member is also responsible for the conduct of a day guest while at the Club. If the manner, behavior or appearance of any day guest is deemed to be unsatisfactory, the sponsoring member shall, at the request of the Club, cause such day guest to leave the Club s premises. HOUSE GUESTS 1. Houseguests must be registered by the sponsoring member with the Club s Membership Office prior to the arrival of the guests. Application forms requesting houseguest privileges may be obtained from the Membership Office. Houseguest privileges may be extended to guests of a member while that guest is residing in a member s residence. To provide membership privileges for a houseguest, the sponsoring member must initiate the application for houseguest membership at least five (5) business days prior to the arrival date of the houseguest. 5

6 2. Guest cards will be issued for the length of the stay, up to a maximum of four (4) weeks. At the expiration of the 4-week term, renewals of houseguest privileges will be granted at the discretion of the Club. 3. Houseguests will be allowed to use the Club s facilities only in accordance with the privileges of the membership of the sponsoring member upon payment of any required and applicable fees. 4. Houseguests are permitted to use the Club s facilities unaccompanied by the member in accordance with the rules and regulations set by the Club from time to time. 5. Houseguests may be charged any required and applicable fees as determined from time to time by the Club. 6. The sponsoring member does not have to give up membership rights for the period of time the houseguest is in residence. 7. The houseguest, upon approval of the member and the Club, may be issued temporary charge privileges to the sponsoring member s membership account. The houseguest will have the opportunity to pay his or her charges at the Club by major credit card at the time of service. 8. The sponsoring member is responsible for all unpaid charges made by his or her houseguests that are unpaid after the customary billing and collection procedure of the Club. 9. Houseguests must have their guest card with them at all times while using the Club s facilities. The Club reserves the right to require identification by each houseguest. 10. Houseguest privileges may be limited by the Club, from time to time, in the sole and absolute discretion of the Club. Notice of such limitation will be given by the Club. 11. The sponsoring member shall be responsible for the conduct of a houseguest while at the Club. If the manner, behavior or appearance of any houseguest is deemed to be unsatisfactory, the sponsoring member shall, at the request of the Club, cause such houseguest to surrender the guest card and leave the Club s premises. CHILDREN 1. Parents are responsible for and must control their children with due regard to the wishes and comfort of other members. 2. Children under the age of twelve (12) years of age are permitted on the Club s premises only if supervised or accompanied by an adult, unless otherwise approved by the Club in its sole and absolute discretion. 3. Children under the lawful drinking age are not permitted in any bar or lounge area in accordance with applicable Florida law. 4. Children under twelve (12) years of age are permitted in the men s and women s locker rooms only if supervised by an adult. LOCKER ROOMS 1. Lockers are provided for rental on a monthly or annual basis, as determined by the Club from time to time, payable in advance and as required by the Club at the applicable fee(s) established by the Club from time to time. No refund on locker rentals will be made by the Club. 6

7 2. The Club is not responsible for any articles placed in the lockers or left unattended in the locker rooms. 3. All clothing must be kept in lockers. Clothing left out will be collected and put in a storage room and if not reclaimed within sixty (60) days will be disposed of by management of the Club. 4. Anyone responsible for undue carelessness in keeping the locker rooms cleans and orderly will be subject to disciplinary action by the Club. GENERAL GOLF RULES GOLF RULES 1. The Rules of Golf of the United States Golf Association ( U.S.G.A. ) together with the Rules of Etiquette as adopted by the U.S.G.A. shall govern all play except when in conflict with local rules. 2. All persons must register inside the golf shop prior to the beginning of play, and all play will originate from the first tee unless otherwise approved or instructed by the golf shop. Cutting-in is not permitted at any time. 3. Single players, twosomes and threesomes may be grouped with other players. Single players and twosomes should not expect to pass through foursomes who are holding their place on the course and should pace their play as to not exert pressure on players ahead. 4. Neither practice nor practice balls are allowed on the course. The practice facilities must be used for all practice. 5. Members may make starting time reservations seven (7) days in advance of play. 6. Members failing to cancel advance reservations on more than one occasion may lose their advance reservation privileges in the sole discretion of the Club. 7. The Club reserves the right to allow unaccompanied guest play in its sole and absolute discretion. Club management also reserves the right to reserve starting times for tournaments, outings and special occasions as necessary in advance of the starting time reservation policy as stated above. All efforts will be made to communicate to the membership any special events well in advance and to maximize members use of the course at all times. 8. Proper golf attire must be worn at all times, including using the practice facilities. Men: Shirts with collars and sleeves, mock turtleneck shirts, slacks or Bermuda shorts are considered proper attire. Tank tops, tee shirts, mesh shirts, sweat pants, warm-up suits, jeans, swim wear, tennis shorts, cutoffs, gym shorts, or other athletic shorts are not permitted. Women: Dresses, collared shirts, sleeveless collared shirts, skirts, slacks, mid-length shorts and blouses are considered proper attire. Halter tops, tee shirts, cut-offs, jeans, sweat pants, warm-up suits, swim wear, tennis apparel, short shorts, or other athletic wear is not permitted. This dress code is mandatory for all players, improperly dressed golfers will be asked to change prior to play. 9. The Club requires the use of spikeless golf shoes for all golfers. 7

8 10. If a match fails to keep its place on the course and loses one clear hole on the players ahead, it should allow the following match to pass. Players unable to keep proper pace may be asked to stop play and return to the clubhouse. An 18-hole round should be completed in no more than four (4) hours. 11. Ball Hawking is strictly prohibited at all times; furthermore, golfers shall refrain from entering any environmentally sensitive areas to search for golf balls. These areas are to be played as lateral hazards. 12. Players who stop after the 9 th hole for any reason relinquish their position on the course and are expected to give way to the following match in order to maintain continuity of play. HOURS OF PLAY The hours of play and Pro Shop hours will be posted in the Pro Shop. The Golf Course Superintendent is authorized to determine when the golf course is fit for play. His decision shall be final. In his absence, the Golf Professional on duty shall make this decision. GOLF STARTING TIMES 1. All players must have a starting time reserved through the Pro Shop. The staff will assign the starting time depending on availability. 2. Starting times may be made in person or by phone during Pro Shop hours. 3. Group captains must give their name and the names of their fellow members at time of reservation. The Club, at the discretion of the Golf Pro, reserves the right to limit the amount of tee times available to a group in order to ensure adequate times for other members. 4. Starting time changes must be approved by the Pro Shop. 5. Groups of five or more players shall only be permitted on the golf course with the permission of the Pro Shop. 6. Failure to check in and register ten minutes prior to a reserved starting time may cause cancellation or set back. 7. Players late for their starting time lose their right to the starting time and shall begin play only at the discretion of the starter. GENERAL GOLF CART RULES 1. Members operating their own golf cart must have on file with the Club a completed Annual Trail Fee Agreement and have paid all applicable trail fees. 2. Golf carts shall not be used by a member or a guest on the Club s facilities without proper assignment and registration in the Pro Shop. 3. Each operator of a golf cart must be at least sixteen (16) years of age and have a valid automobile driver s license. 4. Only two persons and two sets of golf clubs are permitted per golf cart. 5. All golfers operating golf carts must obey all golf cart traffic signs. 6. Golf carts cause tremendous damage to fairways. Golfers operating golf carts shall always use golf cart paths where provided, especially near tees and greens. Golfers operating golf carts shall use the 8

9 ninety-degree rule and cross fairways only at right angles. Golf carts are required to remain on golf cart paths, without exception, on Par 3 holes. 7. Except on cart paths, golfers must not drive a golf cart within thirty (30) feet of a green, a tee or a bunker. 8. Blue cart flags are available for qualifying golfers with physical or medical problems and they must be registered with the Pro Shop. The Club reserves the right to request documentation to qualify for red flag. Carts with blue flags may be driven within thirty (30) feet of tees and greens; carts are to be parked behind greens while putting. Under no circumstances are carts to be driven between bunkers and greens and must be kept below green slopes. 9. The Club reserves the right to restrict the number of carts per foursome. 10. Golfers must never drive a golf cart through a hazard. 11. Golfers must be careful to avoid soft areas on fairways, especially after rains. 12. Operation of a golf cart is at the risk of the operator. Cost of repair to a golf cart which is damaged by a member or guest will be charged to the member or, in the case of damage by a guest, to the sponsoring member. Members using a golf cart will be held fully responsible for any and all damages, including damages to the golf cart, that are caused by the misuse of the golf cart by the members or their guests, and the members shall reimburse the Club, its owner and/or its manager for any and all damages the Club may sustain by reason of misuse. 13. The member using a golf cart accepts and assumes all responsibility for liability connected with operation of the golf cart. The member also expressly indemnifies and agrees to hold harmless the Club, its owner and its manager and each of their respective affiliates, officers, directors, shareholders, managers, members, agents and employees from any and all damages, whether direct or consequential, arising from or related to the member s use and operation of the golf cart. 14. Golfers must strictly follow the policies when the cart in rough only - no crossovers or carts on path only signs are posted. 15. When a carts in rough only (without no crossover restriction) sign is posted, crossover may be made once by a golfer and once only on any one hole. 16. Course closed or hole closed signs must be adhered to without exception. 17. Golf carts shall be driven on the golf course only when the course is open for play. 18. The use of golf carts is mandatory by all players, except as otherwise permitted by the Club. 19. Violations of the golf cart rules may result in loss of golf cart privileges and/or playing privileges in the sole discretion of the Club. HANDICAPS 1. Handicaps shall be computed under the supervision of the Club s Golf Professional in accordance with the current U.S.G.A. Handicap System. 2. All members with a U.S.G.A. approved handicap may participate in Club tournaments. All handicaps submitted may be reviewed by the Golf Professional or Tournament Committee. 3. To establish a handicap, a member must have turned in a minimum of five (5) scores. Members shall be responsible for turning in all their scores on a daily basis. Any member failing to turn in a score will result in a score being posted that is equal to the member s lowest score on record. 9

10 4. Accurate records shall be kept of scores turned in and recorded for all full rounds played. The Club s Golf Professional will determine if there are violations by members in turning in their scores. GOLF COURSE ETIQUETTE For the mutual enjoyment of the game, all players should abide by Section 1 of the Rules of Golf as approved by the USGA and the R&A. The game relies upon the integrity of the individual to show consideration for other players and to conduct themselves in a disciplined manner. Persons using the Club s golf course should do their part to make a round of golf at the Club a pleasant experience for everyone. 1. Players should not waste time. Players should anticipate the club or clubs they may need and should go directly to their ball. Players should always be near their ball to play promptly when it is their turn. If a player is delayed in making his shot, it would be courteous for such player to indicate to another player to play. 2. The time required to hole out on and around the green is a chief cause of slow play. Players should study and clear the line of their putt while others are doing the same. Players should be ready to putt when it is their turn. 3. Players should be sociable but should reserve their extended conversations for the 19 th hole. 4. When approaching a green, players should park their golf carts on the cart path on the best direct line to the next tee. This can save about one-half hour per round. Players should never leave the golf cart in front of the green where they will have to go back to get it while the following players wait for them to get out of the way. 5. When play of a hole is completed, players should leave the green promptly and proceed to the next tee without delay. Players should do the scoring for the completed hole while the others in their group are playing from the next tee. 6. A player s position on the golf course is behind the group in front of him or her, not in front of the group behind him or her. Course Marshalls have full discretion to help accommodate pace of play not to exceed a 4-hour round. If players are not holding their places on the course, those players should allow the players behind to play through. Players should do the same if they stop to search for a lost ball. 7. Players should repair their own ball marks as well as the ball marks of three others on the greens. 8. Players should carefully rake sand bunkers after use and place the rake back IN the bunker. 9. Excessive use of cell phones on the course is distracting to everyone. Players should always have their phones on vibrate or silent mode and should keep calls to an absolute minimum. 10
