1 2016 RULES & REGULATIONS UNLIMITED GOLF: All golf grandfathered memberships include unlimited golf with use of a golf cart at no charge. Golf cart fees are optional for all new Dual Golf Club members. In 2016, golf grandfathered memberships include unlimited range privilege. New Dual Club members are required to pay an annual range fee. GOLF CATEGORIES: Grandfathered Non-Shared, Corporate and Non-resident golf membership categories are entitled to full unlimited and unrestricted golf privileges. Non-resident grandfathered memberships are available for Single, Couple or Family membership categories. Non-resident initiation fee and annual dues shall be ½ of the then published rates for Hawks Landing Golf Club (HLGC). Non-Resident members have the same golf privileges as regular members and are not allowed to participate in the shared membership program. Grandfathered shared golf membership categories are entitled to full unlimited golf privileges under shared membership restrictions. Please access our 2016 Shared Membership definition document for comprehensive guidelines regarding shared membership golf categories. USE OF FACILITIES: Each Member shall have available to them the golf shop, locker rooms, club storage, practice area and the restaurant & bar during the applicable hours of operation. Locker rooms and club storage are intended for individuals who have paid their yearly applicable fees. TEE TIMES: Hawks Landing s tee sheet operates on 10-minute intervals. If you arrive late for your tee time you will be placed in the next available tee-time. Members may reserve tee-times, subject to availability, up to 30 days in advance. Notwithstanding contracted groups of 16 or more or shotgun outings, the Golf Club may permit non-members, now referred to as Sponsored Guests to reserve tee-times, subject to availability, from 21 days to 48 hours in advance. Nearly all Sponsored Guests will be required to book reservations through a third-party provider, who will track all outside play between both HLGC and the Legend at Bergamont. Once a tee-time is reserved by anyone, it will not be released in favor of another person except with the consent of the person first having reserved the tee-time. For all memberships, except corporate, no more than two (2) tee-times may be reserved in advance for the same day by Members from the same membership, unless booking as a group or outing and approved by the Head Golf Professional. The Golf Club reserves the right to limit reservations for tee-times if the Golf Club determines it is necessary to stop an abuse of the tee-time reservation system. GOLF SHOP & PRICING: Members shall have the privilege of purchasing Golf Shop inventory at preferred prices. Additionally, all applicable members who have paid the Mill River Buying Club Fee, will receive further discount level pricing. For golf shop hours please call , as hours will change during the golf season and during the off-season. MILL RIVER PLAN: The Mill River Plan is a member s buying group designed to provide those members who opt in discounted pricing on goods purchased through the Golf Shop. Nearly every item in the Golf Shop will be marked accordingly and will have a Mill River price tagged at either 10 or 15% over cost. The 2016 Mill River charge will be $200, plus tax and is billed annually. Purchases shall be for personal use and gifts only. A member should not Revised 5/19/2016

2 use their privilege to purchase items for others outside the club or those who have decided to opt out of the Plan. Shipping and handling fees will apply on special orders and a 10% restocking fee may be charged for special orders made and returned by members. LESSONS: Members shall receive preferred pricing on golf lessons, including the Junior Golf Programming given by the Golf Professionals. PLAY: You and your guests must check in at the golf shop prior to starting all play. Starting play from #10 tee is only allowed with permission from the Golf Shop. General pace-of-play must be completed in 4 hours and 9 minutes or less. Members without guests are encouraged to play in 4 hours or less. We will be tracking all turn and finish times of golfer each day throughout the season. Players will be notified if over time. Consistent offenders over pace will be subject to further discipline. Please do your absolute best to stay on pace and not to confront the staff when they remind you of being off course established pace. Tracking will be done at both HLGC and The Legend at Bergamont. After a group has been warned twice for slow play, upon the third warning the group will be asked to either let the group behind them play through, be moved forward, or be removed from the course. Note: The Advisory Board has established this special rule to ensure pace-of-play on weekends and holidays. All players or groups teeing off prior to 8:30 am on weekends and holidays are required to finish their rounds in four hours or less. Players or groups teeing off during the above stated times that are unable to play within the required time limit may be subject to a warning letter. If additional warnings are necessary, then the Golf Shop will be instructed to not allow the parties to tee-off prior to 8:30 am on weekends and holidays until further notice. MEMBER GUEST RATES: The following preferred rates are extended to your guests when playing with the Member. Preferred rates apply to all guests and are subject to change. Please consult our website for current guest rates. You may bring a maximum of seven guests per day per membership. Your guests must play in your group or the group directly in front or behind you. Concessions will be made for member outings and/or groups contracted with HLGC. The same guest may play up to five (5) times each year excluding corporate and charity sponsored outings. This is five total plays between either HLGC or The Legend at Bergamont. 18 Holes Monday Wednesday $50.00 Thursday Sunday $ Holes Anytime $ Holes Lineal Family Members $40.00 Additional New Dual Club Member Information: Annual Cart Pass (optional) Family $1,500 Single $1, Hole Cart Fee (per rider) $ Hole Cart Fee (per rider) $14.00 Weekday holidays will be subject to weekend rates. All rates above are subject to applicable taxes. SPONSORED GUEST PLAY: Sponsored Guests are welcome to reserve tee-times Monday-Sunday. All players may play up to five (5) total plays between either HLGC or The Legend at Bergamont each year excluding corporate and charity sponsored outings. 3 information. All regular bookings and limited Sponsored Guest play availability will be coordinated through a third party provider. NO SHOW POLICY: Failure to cancel a reserved tee-time up to three hours in advance from that time will result in your account being charged for the entire tee-time at the applicable rate. Notice of reduction in players from the reserved tee-time must also be received by the golf shop at least one hour prior to the tee-time, or the person who booked the tee-time will be charged for the spot(s) that were originally reserved and unused for the booking. This policy is for members and non-members. The only circumstance when the golf shop will not enforce this policy would be if an open tee-time exists immediately before or after the booking. Example 1: A tee-time was reserved but no one in your group shows up and the reservation was not canceled at least three hours in advance of the tee-time. As a result, your account will be charged for the cost of you and your guests. If the booking was for four people and the applicable rate was $54, then the rate that will be charged to your account or your onfile credit card will be $216.00, plus tax. You will then receive four rain checks for the total amount to use on a future booking. These rain checks will have an expiration date located on the ticket. Example 2: A tee-time was reserved for four players and your group shows up for the reservation with three, and the player number was not reduced at least one hour in advance of the tee-time. As a result, your account will be charged for the cost of one player. If the booking was for four people and the applicable rate was $54, then the rate that will be charged to your account or on-file credit card will be $54.00, plus tax. You will then receive a rain check for the total amount to use on a future booking. This rain check will have an expiration date located on the ticket. JUNIOR RATES AND PLAY TIMES: Children under the age of 14 must always be accompanied by a parent. They may play up to 15 rounds per year, except during scheduled Men's & Ladies' Day times, during most club events, all adult league times and before 2:00 pm on weekends and holidays. Juniors ages may play anytime except during scheduled Men's & Ladies' Day times, during several club events, all adult league times, and they must be accompanied by a parent before 2:00 pm on Saturdays, Sundays and Holidays. Additionally, all juniors under the age of 14 will receive complementary greens fees after 4:00 pm on weekends and holidays (cart fees apply, if applicable). Non-Member Children must adhere to the five play limitation. Exceptions to play times may be made at the discretion of the Head Golf Professional. Rates for Non-Member Children 17 and under are as follows: 18 holes riding 9 holes riding - $40, plus tax - $20, plus tax 18 holes walking - $30, plus tax 9 holes walking - $15, plus tax INCLEMENT WEATHER POLICY: Play is always at your own risk. The golf staff may sound an air horn if they believe bad weather is approaching, in which case golfers are advised to seek shelter immediately. There are restrooms/shelters near the back teeing locations on holes 6 and 14 or, if possible, golfers should come back to the Clubhouse. The Golf Shop will let golfers know when the golf course is open for the resumption of play. As always, however, each golfer is responsible for evaluating weather conditions and determining whether or not the conditions are safe for play, and each golfer assumes such responsibility by playing on the course. When rain checks are issued, they will be pro-rated by the amount of holes that have been completed. Based upon an eighteen (18) hole round of golf, the round is considered complete if fourteen (14) holes have been finished. A nine (9) hole round is considered complete if five (5) holes have been finished. Rain Check Example: Individual has paid for 18 holes and six holes were completed. As a result, a nine hole rain check will be presented. BLUE FLAGGED CARTS: Persons with significant medical disability that inhibits or limits their ability to walk may apply for the use of a blue flag. A blue flag on a cart allows a player with a medical disability to drive the cart in areas that typically are designated as no carts allowed as long as the areas are dry, not steeply sloped, and are farther than 10 feet away from a putting surface or teeing area. No cart should ever be driven across a tee or closer than 10 feet from a putting surface. All carts must also always remain out of all native grass areas. Special privileges come with a blue flag. Only the Golf Professionals or Course Superintendent shall grant this privilege. Revised 5/19/2016 3

4 GOLF CART POLICY: Electric carts are an important part of golf for many players and essential for some of our older or disabled players. The use of golf carts, however, can affect the conditions of the course that everybody plays. If driven improperly and/or in prohibited areas, golf cart drivers can cause extensive damage to our course. Each driver of a golf cart assumes full responsibility for damage to property or the golf cart from collision and/or liability of any injury occurring while they operate a golf cart on the premises of HLGC or the community of Hawks Landing. The Golf Club has full authority to suspend the privilege to use a golf cart by any Member or guest who disregards these rules. Use of a cart is a privilege; the privilege can be lost if rules are disobeyed. Golf carts are not allowed in the parking lots or off golf course property. Two people maximum per cart. The driver must have either a probationary, occupational or regular driver s license. Any driver over the age of 15 years and 6 months with an instructional permit may operate as a driver of a golf cart provided they have an accompanying cart passenger who currently holds a valid regular (non-probationary or occupational) license and be one of the following; A qualified instructor age 19 or older, or A parent, guardian or spouse, age 19 or older, or A person 21 years of age or older. If the permit holder is under 18 years old, the accompanying licensed person is required to have written authorization from the minor's parent or guardian prior to the operation of the vehicle. Obey signs at all times (unless you have the privilege of a blue flag.) Keep carts a minimum of 10 feet from all bunkers. Avoid driving and parking carts on slopes. Carts should be parked with all wheels completely on the cart paths and to the side or back of a green in order to facilitate a timely exit after completing each hole. The Greens Superintendent has a final say about use of carts when conditions make it likely they will damage the course. Cart path only means cart path only, including blue flagged carts, unless the Greens Superintendent has approved this exception. ETIQUETTE OF GOLF: The following rules are intended to improve the use and enjoyment of our course. Any infraction of the rules should be reported to the Golf Shop for appropriate action. Golfers playing in 4 hours and 9 minutes or less are considered playing at an acceptable pace-of- play. Faster golfers are encouraged to play through but should also respect their fellow members and guests experiences when they are playing within the required time expectations. Players looking for a lost ball should allow other players coming up to pass through, and have signaled them to pass, must not continue play until they have passed and are out of range. No player shall play from the tee until players in front are well out of range. Players also shall not play up to the green until the players in front have holed-out and have moved away from the green. Bunkers shall be entered from the low side and left from the same point, being sure to rake the bunker upon leaving it and leaving bunker rakes completely inside the bunker. Ball marks on greens should be repaired and divots in the fairway should be replaced or filled with sand from the bottles on the carts. Divots in the rough should be replaced. LOCKER ROOMS: Guests must be accompanied by Members in the locker rooms and lounges. Members/Guests must be robed (covered up) upon exiting the locker rooms. Children 14 years and younger must be accompanied by an adult. Please try to assist in keeping the locker rooms and lounge areas clean. The club is not responsible to members or guests for the loss, theft or damage of property. A replacement fee of $5.00 may be charged to members who lose their locker combination. 5 A $15.00 locker room usage fee will be charged to individuals who have not purchased an annual locker room membership. GOLF DRESS CODE: All golfers are expected to wear appropriate golf clothing at all times. Tank tops, tee-shirts, crew neck shirts, halter tops, cut-offs, jams, sweat pants, bathing suits, tennis or other athletic shorts, and denim are not acceptable. Untucked Tommy Bahama or button down style camp shirts are deemed acceptable. Gentlemen must wear shirts with collars or golf mock necks which must be tucked in. Slacks & golf shorts are acceptable provided they are not ripped or torn. Golf shorts must have zippers and pockets and must cover at least one half of the thighs. Cargo style shorts are not acceptable attire. Ladies must wear shirts with either sleeves or a collar, appropriate dresses, skirts, slacks, golf shorts or blouses. Appropriate footwear should also be worn. Metal spikes are NOT allowed. Members are responsible for making sure their guests abide by the Club s dress code. CLUB/BAG STORAGE: Members are not allowed in the Club/Bag Storage area. It is an employee only area and is always locked! Bags will be available at your request. Your bag will be retrieved and on a golf cart before your tee-time. If practicing only, please call the Golf Shop at least ten minutes prior to your arrival to have your bag brought up and prepped. If needing a pick up only, please call at least ten minutes prior to your arrival and your bag(s) will be brought to the bag drop area. Clubs will be washed each evening after a played round or after practicing. They will then promptly be brought back down to the club/bag storage area. The club is not responsible to members or guests for the loss, theft or damage of property. Members leaving their clubs in bag storage without purchasing an annual membership may be charged up to $15.00 per night to house their clubs. Storage will be available April 1 November 1 of each year. HANDICAP AND ON-LINE BOOKING SERVICE: HLGC charges all members ages 18 and older $40.00 annually on April 1 of each season (optional). The fee is for membership in the WSGA in order to maintain a golf handicap, which is necessary to play in leagues and in most HLGC or Dual Club events. The Golf Club may also charge all membership categories $20.00 annually for the use and maintenance fees affiliated with the golf course online tee-time booking system. These two items may be combined and billed as one unit each year. CAPITAL IMPROVEMENT FUND FEES: This fund will be used directly towards any future capital improvements or a possible deficit accrued for that year. All current and future memberships are generally required to pay this fee regardless of enrollment date. Each member who commits to the hole-in-one club will be automatically billed $10 for each successfully validated hole-in-one. A successful validation is contingent upon the following criteria: A minimum of two witnesses, one of which who is a non-family member. Hole-in-one(s) must be within active WSGA handicap posting season, or April 1 through October 31. Revised 5/19/2016 5

6 If made during a round of at least nine holes, except that a hole-in-one made during a match should be acceptable even if the match ends before the stipulated round is completed. Tee-box placement must not be temporary in-nature and must have at the least, an accompanied minimum affiliated golf course rating. If made in a "scramble" competition, which is generally played as follows: A side comprises four players. Each member of a side plays from the teeing ground, the best drive is selected, and each member plays a second shot from where the best drive is located, and so on. A stipulated round in a scramble competition will be constituted as 18 holes. After all hole-in-one members have been billed and validation has been confirmed, the member shall then be compensated. Compensation to the validated hole-in-one shall be in combined form of 50% Golf Shop credit and 50% company check. All members who are currently active club members in good standing and in the hole-in-one club shall comprise the total monies paid out. Every individual in the hole-in-one club will automatically be included from year-to-year, until the individual golf member informs the golf shop of their intention to be removed from the hole-inone club. ASSESSMENTS: Assessment Cap. The Golf Club may, from time to time, assess Members for capital improvements and Revenue Shortage (the Assessments ). The maximum Assessment will be based upon Membership category level. The numbers below show the possible Assessment for every Membership based on total club members. The membership amount will be the highest number of members reached regardless of when it happens. Membership Numbers: 253 or less $1,000 $645 $415 $100 $0.00 Assessments shall be due and payable by members within thirty (30) days of receipt of an invoice for an Assessment, unless a later date or payment plan is otherwise specified by the Golf Club. GENERAL CLUB RULES: Private golf carts are allowed on the course only after cart has been approved by HLGC ownership. Trespassing or play from home site properties is prohibited. Members or guests are not permitted behind golf shop counter. Property belonging to the club shall not be removed from the golf course or golf shop. The club is not responsible to members or guests for the loss or damage of property. Automobiles must be parked in designated areas only. Golf carts are not allowed in the parking lot or off golf course property. Walking, running or biking on golf course or golf course cart paths is prohibited. Each player must have his or her own clubs and bag. All players shall observe the golf rules, dress code and the etiquette of golf at all times. Tee-times and rules shall be determined by the Golf Club based upon membership levels. The maximum number of golfers for each tee-time is four. Permission for fivesomes may only be granted by the Golf Professionals and only prior to April 15 and on or after October 15 of each season. All approved fivesomes must continue to adhere to all pace-of-play and etiquette requirements. Intoxicated golfers may be asked to leave by the Golf Shop. No carry-ons are allowed. The golf course and practice range will officially close each season on the Monday following Thanksgiving, unless weather conditions have dictated an earlier closing date. The clubhouse is closed on Thanksgiving Day, Christmas Day and New Years Day, or any other ownership approved date(s). Hawks Landing personnel should not be reprimanded or interfered with by members. Any lack of satisfactory service or discourteous treatment should be reported to the Head Golf Professional. Complaints of a serious nature should be reported in writing to the Golf Advisory Board and/or Course Owner, Jeff Haen and will receive prompt attention. Revised 5/19/2016 6
