3 One Day A Week Golfer $800.00* (Must be a new member that has not been affiliated with TRCC within the last three years) Member may play a round or rounds of golf on one day of his/her choice each week of the 2012 season on Monday through Friday. Play is limited to only one day per week and there is no carryover for missed or unused days of golf. Member may bring guests three (3) times during the season with a Maximum of three (3) guests per day. Appropriate guest fees and conditions apply for each round played. Play dates may be restricted due to weather, course maintenance or scheduled events. It is the golfers responsible to confirm course availability and tee time. 9 TOMS RIVER COUNTRY CLUB MEMBERSHIP AGREEMENT 2012 I, the undersigned Applicant, hereby agree to pay to the Club the Membership Joining Fee (as such term is defined in the Membership Plan), together with any applicable sales tax, or other taxes, and the membership dues for the category of membership selected. The amount of dues for each membership category is described on a separate Schedule of Dues and Charges, and is subject to change from time to time as set forth in the Membership Plan. PAYMENT OF DUES, FEES AND CHARGES I, the undersigned Applicant, understand that I am obligated to keep a valid approved credit card on file with the Club at all times. I hereby acknowledge that all dues, fees and charges for food, beverage, merchandise and services of the Club incurred by me, my family and/or my guests will be charged to my credit card if not paid in cash, and that I am responsible for all amounts that are not paid by the credit card company. 10 TOMS RIVER COUNTRY CLUB MEMBERSHIP AGREEMENT 2012 I hereby acknowledge that my account with the club shall be considered delinquent if not paid in full within thirty (30) days after the date of the monthly statement and will be subject to the lesser of (i) a one and one-half percent (1.5%) late charge per month, or (ii) the maximum amount that may be contracted for, taken, reserved, charted or received under law. This late charge shall accrue thirty (30) days from the date of the monthly statement until the account is paid in full. I acknowledge that the Club may take whatever action it deems necessary to effect collection, including, without limitation, suspension or termination of my membership or legal action. I acknowledge that I shall be liable for all costs and for any expenses of such legal action and reasonable attorney s fees, including any fees required in connection with appellate proceedings. I, the undersigned Applicant, further agree that the following provisions will be applicable to my membership in the Club and hereby agree with the Club as follows: Membership Approval. Membership in the club is contingent upon approval by the Club, which approval shall be at the Club s sole and absolute discretion. Membership Privileges. Membership in the Club permits the member to use the Club Facilities in accordance with the Membership Documents. Rights Reserved by the Club. The Club reserves the right, in its sole and absolute discretion, to perform any and/or all of the following actions: Modify the Membership Documents; Reserve memberships; Issue, add or modify any type, category or class of membership; Make any other changes in the terms and conditions of membership or in the Club Facilities available for use by members. Express Authorization. Upon signing this Agreement, the Applicant expressly authorizes the disclosure and release of information requested by the Club for investigating his or her qualifications for membership, including without limitation my credit history. Assumption of Risk. The Applicant hereby acknowledges and agrees that the use of the Club Facilities and any privilege or service incident to membership is undertaken with knowledge of risk of possible injury. Applicant accepts any and all risk of injury, whether the injury is sustained by himself or herself, his or her spouse, his or her family members and/or his or her guests while using the Club Facilities or involved in any event or activity incident to membership in the club. In accepting the risk o injury, the Applicant understands that he or she is expressly relieving Toms River Country Club, and its directors, officers, members and employees from any and all loss, cost, claims, injury, damages or liability sustained or incurred by the Applicant, the Applicant s spouse, family members and/or guests resulting from or arising out of any conduct or event connected with membership in the club and/or use of any of the Club Facilities. Miscellaneous. This Membership Agreement may not be amended or modified, nor shall any waiver of any provision hereof be effective, except by an instrument in writing executed by the undersigned and the Club. This Membership Agreement shall be governed by and construed and enforced in accordance with, the laws of the State of New Jersey. Pursuant to the Club s By-Laws the Board of Directors may declare operational assessments to cover shortfalls in the annual operating budget which assessments are applicable to all members and shall be due and payable as and when billed. I, THE UNDERSIGNED APPLICANT, HEREBY ACKNOWLEDGE RECEIPT OF THE TOMS RIVER COUNTRY CLUB EMBERSHIP DOCUMENTS AND THAT I HAVE READ AND UNDERSTAND THEM, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS THEREOF AS THE SAME MAY BE AMENDED FROM TIME TO TIME BY THE CLUB.
