DEPOSIT & PAYMENT: A deposit of 50% of the membership fee is required before membership privileges begin. The remaining membership balance of the total membership fee, must be paid in full within 60 days of the initial purchase date. If these terms are not met, Jack Frost National Golf Club is released from any and all obligations under this agreement and the member forfeits any fees paid. 6 Jack Frost National Golf Club GENERAL MEMBERSHIP AGREEMENT TERMS AND CONDITIONS GENERAL All memberships are nontransferable and all memberships are nonrefundable. Jack Frost National Golf Club reserves the right to change membership program and pricing at any time. Membership does not convey any ownership rights and/or privileges beyond what is outlined in this package. Member access to the golf course is subject to availability. REFUSAL OF PRIVILEGE Jack Frost National Golf Club shall have the right to refuse golf course privileges to anyone who is judged to be in violation of the established rules and regulations herein. See rules and policies attachment. CHARGING PRIVILEGES All members are entitled to charging privileges for Golf, Food and Beverage, Merchandise and any other services provided by Jack Frost National Golf Club. Charging privileges will begin once 50% membership deposit is received. If you are 30 days late in payment, member charging privileges are immediately revoked. If you are 60 days late in payment, your membership privileges will be suspended until account is paid in full. By signing this terms and conditions sheet, the member agrees to be responsible for all charges including Golf, Food and Beverage, Merchandise, and other services provided by Jack Frost National Golf Club. Membership statements are sent the first week of each month for prior months charges and are due in full by the end of the month. NO SHOW AND CANCELLATION POLICY All members, regardless of member category, must provide notice to the golf shop at least 24 hours in advance if they cannot make their scheduled tee time. If a member does not attend a reserved tee time, and does not cancel their tee time at least 24 hours in advance, the member will be charged a $20 no-show fee. The charge will be posted to the account of the members who made the tee time. Groups or members that habitually no-show (more than 3 times), will be subject to member suspension. Jack Frost National Golf Club reserves the right to pair all singles, twosomes and threesomes. When reserving tee times, Members are responsible for the number of players booked. GUARANTEED TEE-TIME POLICY All Guaranteed Tee Times must fall with the following time frames: Saturday mornings: Open 8am. Sunday mornings: Open 8am. Guaranteed tee times start March 29, 2018 and end October 26, Jack Frost reserves the right to move guaranteed tee times up to 45 minutes earlier or later based on sunrise schedules with 15 days notice. LIMITATION OF LIABILITY Jack Frost National Golf Club will not be liable for any lost profits or for any indirect, incidental, consequential, punitive or other special damages suffered by the player arising out of or related to this Agreement even if Jack Frost National Golf Club has been advised of the possibility of such damages. In no event shall the total cumulative liability of Jack Frost National Golf Club in connection with the Agreement from all causes of action of any kind (including tort, contract negligence, strict liability, breach warranty and fundamental breach) exceed the total amount paid by the player to Jack Frost National Golf Club under this Agreement. INDEMNIFICATION The player will defend, indemnify and hold Jack Frost National Golf Club, together with the parent companies, subsidiaries and/or affiliated companies and the shareholders, officers, directors, partners, members, manager, employees, agents, consultants, representatives and attorneys of all foregoing and their respective heirs, executors, administrator successors and assigns (collectively, Jack Frost National Golf Club ) harmless from and against any or all losses, damages, claims, costs, suits, actions, judgments, liability and expenses including responsible counsel fees and expense resulting from or arising out of any claim to personal injury or death resulting from services. Jack Frost National Golf Club shall render. This indemnity shall survive any termination of the agreement.
