5 COLONIAL HERITAGE HOMEOWNERS ASSOCIATION GOLF COURSE POLICY AND RULES The Board of Directors of Colonial Heritage Homeowners Association hereby enacts and adopts the following on this the _nn_ day of August, A. PREAMBLE 1. are enacted and adopted to ensure enjoyment by all residents and golfers of the golf course at the Colonial Heritage Golf Club. 2. The Obligation of Enforcing the Rules, for the general welfare of all residents and golfers, is placed in a Golf Professional. One of the responsibilities of the Golf Professional is to assure that all residents and golfers receive courtesy, comfort and services to which they are entitled consistent with these regulations. 3. Residents and Golfers are Expected to Know and Understand the and to cooperate with the Golf Professional in enforcement of these regulations. An annual supplement to this document entitled The Colonial Heritage Golf Experience will be made available to all homeowners. It will include information concerning golf memberships, advance tee time privileges, dues and fees for that year. B. DEFINITIONS Terms used in the have the meaning defined below. If a term is not defined below, the term shall have the meaning set out in The Rules of Golf of the United States Golf Association, and if not defined in those Rules, then the conventionally recognized meaning of the term. 1. Board: The Board of Directors of the Colonial Heritage Homeowners Association. 2. Club: Colonial Heritage Golf Club. 3. Developer: Lennar Corporation or its successors in interest. 5

6 4. Golf Professional: The Golf Professional of the Colonial Heritage Golf Club or any individual designated by the Golf Professional to act on behalf of the Golf Professional. 5. Golf Superintendent: The Golf Superintendent of the Colonial Heritage Golf Club or any individual designated by the Golf Superintendent to act on behalf of the Golf Superintendent. 6. Golf Course: That part of Colonial Heritage Homeowners Association property (1) maintained by the operator of the golf course and (2) normally used for practicing and playing golf, including the tees, fairways, rough, greens, hazards, golf cart paths and practice areas. 7. GCMC Golf Course Management Contractor See Operator of the Golf Course. 8. Golf Clubs and Bag: A bag including a set of golf clubs and other items normally used for playing golf. 9. Golfer: Any member, guest or daily fee player authorized to play golf on the golf course. In addition, any person authorized to be a passenger in a golf cart will be considered to be a golfer for the purposes of these rules. 10. Group of Golfers: Several golfers, including a twosome, threesome, foursome, or more golfers. 11. Guest and/or Daily Fee Player: A golfer who is not a member but is authorized to play on the golf course. 12. HOA: Colonial Heritage Homeowners Association. 13. Member: A person who is a Golf Member. 14. Operator of the Golf Course (GCMC Golf Course Management Contractor): The entity selected by the Board to operate the golf course. 15. Practice Area: The area of the golf course consisting of the practice range and the practice putting green, chipping area and two bunkers adjacent to the practice range, and the practice putting green next to the Clubhouse. 6

7 16. Pro Shop: The area of the clubhouse where members and guests transact business associated with playing golf. The Golf Professional shall post the operating hours of the Pro Shop on a bulletin board. 17. Resident: A person who is a member of the HOA or a resident of Colonial Heritage. 18. Social Members: All Class A members who are not Golf Members. The privileges, duties and obligations of Social Members are set forth in the Membership Plan. 19. Tee Time: A time for starting a round of golf on the golf course. 20. USGA: United States Golf Association. C. RULES 1. Applicability of Rules These rules apply to all residents and golfers. 2. The Golf Professional is authorized to take such action as the Association Manager deems appropriate to enforce these rules. Appropriate action includes suspension of playing privileges (before, during or after a round), removal from the golf course and for violations of golf cart rules, suspension of golf cart privileges. In addition, the Golf Professional may take similar action against any resident, member, or guest who, in the opinion of the Golf Professional, is guilty of conduct that is unbecoming a gentleman or lady, or that tends to be against the best interest of the Club. 3. Any adverse action by the Golf Professional enforcing these rules may be reviewed by the Association Manager and may be reviewed by the Board of Directors of the Colonial Heritage HOA as deemed necessary by the Association Manager. 4. Availability of Golf Course The golf course is available to all Members, Guests, and Daily Fee Players under the terms set out in these regulations. 5. Tee Time, Check-in and Loss of Tee Time Tee time. All golfers must be assigned a tee time. Tee times are assigned through the Pro Shop. Tee times may be reserved by phone, on line or in person. (a) The GCMC or staff thereof is authorized to make advance reservations for events. 6. Check-in prior to playing golf. All golfers shall check-in and register at the Pro Shop at least fifteen (15) minutes prior to their reserved tee time. Failure to check-in and register in a timely manner may result in loss of the tee time. 7

8 7. Cancellation of tee time. A golfer shall notify the Pro Shop at least twenty-four (24) hours in advance that a tee time needs to be cancelled. Failure to cancel a tee time in a timely manner may result in a cancellation fee being charged to the golfer who made the reservation for the tee time. 8. Timely tee off: Golfers shall be on the assigned tee at the reserved tee time. Failure to do so may result in loss of the tee time. 9. Closing or Limiting Use of the Golf Course The Golf Superintendent is authorized to close or limit use of the golf course (in whole or in part) when in the opinion of the Golf Superintendent use of the golf course would be unsafe or result in damage to all or part of the golf course. Included within the Golf Superintendent s authority is a determination whether golf carts may be driven on roughs and fairways. 10. Conditions which the Golf Superintendent may consider in determining whether to close or otherwise limit use of the golf course include: (a) Weather conditions; (b) Conditions on the course (in whole or in part), including maintenance, such as aerating one or more holes, minimizing wear on tee grounds or environmental concerns; and (c) Any safety condition. 11. Finality of Golf Superintendent s decision. A decision by the Golf Superintendent to close or limit use of the golf course is final. 12. Prohibited Activities - All golfers are prohibited from using that portion of the golf course which is closed. 13. Walking on the golf course, which includes the golf cart paths, is prohibited except for golfers. This means that residents and their guests are not permitted to be on or use the golf course for any activity, including but not limited to: practicing golf in other than a designated practice area, walking dogs, bike riding, skate boarding, flying kites, playing Frisbee, or any other activity other than playing golf. 14. Fishing, swimming, boating or any other activities in the ponds, lakes or other water on the golf course is prohibited. These areas are not recreational areas; they are part of the golf course. 8

9 15. Payment of Fees All golfers are responsible for payment of all fees, including golf course fees, commonly known as greens fees, golf cart fees, merchandise and food & beverage purchases. 16. Guests Any Golf Member may invite a guest to play on the golf course. The member is responsible for making sure that the guest is familiar with, and follows the. 17. Members do not have to accompany their guests on the golf course, but must sign them in at the Pro Shop. 18. Memberships A document titled The Colonial Heritage Golf Experience will be prepared annually and kept in the Pro Shop. This document will contain types of memberships to include their respective costs and a table of greens fees for residents who are not golf members. A copy of this document will also be available in the golf section of the Colonialheritageclub.org website. 19. Golf Member A Golf Member shall pay the annual golf membership dues established by the Board in January of each year. The annual dues may be paid at one time or on a monthly basis. In order to be eligible to become a Golf Member, a nonrefundable initiation fee established by the Board may be required. 20. The original agreement for resident golf membership shall be made available to the Association Manager s Office. A copy will be held in the Pro Shop. 21. Termination Special Circumstance When a Member has a terminal illness, as certified by a Physician in writing or by fax, the Member will have the option of terminating the membership prior to the end of the membership period. In addition, under extenuating circumstances as approved by the GCMC, a Member will have the option of terminating the membership prior to the end of the membership. 22. Annual Dues Dues that were paid on a one time basis are non-refundable except in the case of death, or if the Member elects to terminate the membership under Paragraph 21 above. In these two situations, a prorated refund may be issued. 23. Annual memberships are non-transferable. 24. Additional membership programs for residents and non-residents may be adopted by the Board of Directors. 25. Social Members A Social Member shall pay greens fees established by the GCMC. 9

10 26. Daily Fee Players are considered day guests at Colonial Heritage and will be expected to adhere to these rules. 27. Golf Carts Only Golf carts provided by the HOA and registered privately owned resident golf carts may be used on the golf course. 28. Only certain levels of Golf Members are authorized to walk on the golf course when they play golf. All other golfers are required to use a golf cart when they play golf, unless authorized to walk by the Golf Professional. 29. No golf cart shall be removed from the golf course without prior approval of the Golf Professional. 30. Personal coolers, beverage containers and similar items are prohibited unless provided by the golf course or tournament staff. 31. A golfer operating a golf cart shall have a valid driver s license 32. The Golf Professional may authorize a non-golfer to be a passenger in a golf cart. When a non-golfer is authorized to be a passenger in a golf cart, the standard golf cart fee will apply to the passenger. No more than two (2) people and two (2) sets of golf clubs and bags shall be permitted on a golf cart. 33. Golf carts may be used on the golf course as follows: (a) Unless on a cart path, no golf cart shall be driven closer than (5) yards to any tee ground, hazard or bunker or closer than (30) yards to a green. Further guidance may be provided by golf cart traffic and directional signs, increasing the distance from a green, except that golf carts with handicap flags may be driven to within (30) yards of a green. (b) Handicap Flags. Except when prohibited under C9, and upon request, handicap flags may be issued to golfers under the following conditions: (1) The golfer has an obvious physical disability that affects mobility. (2) The golfer has a temporary disability that affects mobility which is supported by a current physician s statement. (3) The golfer possesses a handicap parking sticker granted by a state or federal agency, or applicable state license plate registration number. Such sticker or plate must be registered under the individual's name. (4) They also may be issued, upon request, to any golfer who is at least 80 years old. (5)The Golf Professional will be responsible for determining eligibility for, maintaining and issuing handicap flags. 10

11 (c) All golf carts, including those with handicap flags, shall remain on the golf cart path on all par 3 holes. (d) When the Golf Superintendent directs that the 90 degree rule is in effect, golf carts shall be driven from the golf cart path across the rough to the fairway at a (90 degree) angle and remain in the fairway until exiting across the rough back to the golf cart path at a (90 degree) angle. (e) The Golf Superintendent may prohibit the use of handicap flags due to course conditions. 34. Golf Cart Agreement Golf carts are used at the risk of the user. Any person, who is either the operator or passenger in a golf cart, by virtue of having rented and been authorized to operate or to be a passenger in a golf cart, agrees to the following: For and in consideration of a rental or authority to use a golf cart by any person, the person promises and agrees to return the golf cart immediately following completion of each round of golf and in as good a condition as the golf cart was received (normal wear being expected). The person further promises and agrees to pay for any damages that are sustained to the golf cart or the golf course while being used by the person. The person still further promises and agrees to hold the HOA and the operator of the golf course (GCMC) free and harmless from any damages or claims of any nature whatsoever that may arise from or through the person s use of the golf cart. The person still further promises and agrees that the person, if authorized to operate the golf cart, is familiar with (1) the operation and use of the golf cart, (2) with instructions on how to operate and use the golf cart and (3) can operate, control and use the golf cart in accordance with those instructions. 35. Tournaments The Golf Professional is authorized to make the golf course available for group play and tournaments. Members not participating in group play or tournaments wishing to play golf during group play or the tournament may be accommodated on a space available basis only. 36. Lessons Unless otherwise authorized by the Golf Professional only golf professionals employed by the operator (GCMC) of the golf course may give lessons or otherwise render golf instruction on the golf course and practice areas. 37. Lessons and golf instruction should be scheduled directly with the Golf Professional. 11

12 38. USGA Handicap A USGA handicap may be necessary to participate in tournaments and events. Members are encouraged to obtain and maintain a USGA approved handicap. 32. Members may obtain a USGA approved handicap through the Pro Shop upon payment of any necessary fee and recording of an appropriate number of scores. Scores may be recorded in the Pro Shop. 39. Equipment Every golfer must have a set of golf clubs and bag. Golfers may not share clubs. 40. Attire Proper attire is required on the golf course at all times for all golfers. (a) Golf shirts or blouses, golf or walking shorts of appropriate length, and slacks and skirts (for women) are considered proper attire. (b) T-shirts, tank tops, jeans/denims and jean/denim shorts, cutoffs, sweat pants and bathing suits are not proper attire. (c) Only golf shoes with non-metal alternative cleats or other soft-soled shoes shall be worn on the golf course. (d) The Golf Course Management Contractor may alter and approve footwear requirements as technological improvements occur in the industry. (e) No bare feet permitted. 41. Golf Course Play A round of golf shall start only at the number one tee ground unless otherwise authorized by the Golf Professional or his/her designated agent. 42. Golfers shall not start a round of golf from a residence. 43. Unless authorized by the Golf Professional, a group of more than four (4) golfers is not permitted. 44. Golfers are encouraged, but not required, to put a ball in play ( tee off ) from the tee ground that best suits their ability. 45. Rain Checks There will be no rain checks issued if play is voluntarily discontinued due to the weather. In the event that play is involuntarily discontinued due to closing of the golf course, golfers may be issued a credit for greens fees and golf cart fees paid for the discontinued round as follows: (a) One (1) to (6) holes: full credit. 12

13 (b) Seven (7) to twelve (12) holes: fifty percent (50%) credit. (c) Thirteen (13) holes or more: no credit. 46. Unless otherwise authorized by the Golf Professional, practice is limited to the practice area. Practice range balls may only be used in the practice areas 47. Ball Hawking Ball hawking is not permitted on the golf course at any time unless approved by the GCMC Golf Course Management Contractor when such ball hawking is for charitable purposes. 48. Wading into ponds, lakes, streams or water within water hazards is not permitted. Balls may be retrieved only from banks of ponds, lakes, streams or water within water hazards. 49. A golfer shall not have more than one (1) ball in play at any time where so doing might impact on the pace of play on the golf course. 50. A golfer shall not play or attempt to play a golf ball that is out-of-bounds. 51. All golfers are prohibited from entering Homeowner property to retrieve golf balls. 52. Release of Liability By virtue of playing on a golf course, a golfer agrees to a Release of Liability as follows: (a) Each golfer acknowledges and assumes the golfer s own risk in using the golf course. (b) Each golfer assumes responsibility and is liable for personal injury which occurs on the golf course or damage to property which occurs on the golf course that results from the golfer s action on the golf course. (c) Each golfer acknowledges that the developer, the HOA and the operator of the golf course (CGMC) do not provide insurance for golfers and accept no responsibility for personal injury or damage to personal property caused by a golfer s action on the golf course. (d) Each golfer acknowledges that in the event the developer, the HOA or the operator of the golf course (CGMC) is subject to a lawsuit arising from an injury to the golfer, which injury is determined to be directly or proximately caused by the acts or negligence of a third party, the golfer agrees to indemnify and hold harmless the developer, the HOA and the operator of the golf course (CGMC). 13

14 53. Repair of Golf Course Golfers shall: (a) Repair ball marks on greens; (b) Not replace divots, but use sand to fill divots; and (c) Rake bunkers (sand traps) when completing play out of a bunker, and replace the rake in the bunker. 54. Etiquette and Rules of Golf Golfers shall observe at all times the Etiquette adopted by the USGA. 55. The rules of golf adopted by the USGA shall govern all play on the golf course, except as modified by local rules, or as modified by the Golf Professional. 56. Pace of Play The pace of play policy is as follows: (a) A round of golf shall not exceed 4 hours and 20 minutes when golf carts are allowed off the golf cart paths. (b) A round of golf shall not exceed 4 hours and 40 minutes when golf carts are required to remain on golf cart paths. (c) Golfers with early morning tee times may be expected to play at a pace faster than that set out above. (d) Warnings and enforcement of pace of play policy is as follows: (1) A first slow play warning may be issued by the Golf Professional or the Golf Professional s authorized representative (i.e., a marshal) when a golfer or group of golfers has fallen out of position. (2) A second slow play warning may be issued by the Golf Professional or the Golf Professional s authorized representative and such second warning will require the golfer or group of golfers to pick up their respective balls and move back in position. (3) A third slow play warning may be issued by the Golf Professional or the Golf Professional s authorized representative and means that the golfer or group of golfers may be required to (a) leave the course, (b) report to the Pro Shop where (c) a rain check may be issued to the golfer or group of golfers as an invitation to play at some other time when the golf course is less busy. 14

15 57. Miscellaneous Nothing herein should be construed as modifying or attempting to modify obligations established by relevant legal documents, including (1) sales contracts, (2) deeds, (3) DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS AND PRESERVATION OF EASMENTS. The Golf Course Policy and Rules should be construed to be consistent with relevant legal documents. 58. If a particular rule is determined to be invalid, invalidity of that rule shall not affect the validity of other rules. 15
