4 Welcome or Welcome Back!!! There was not much snow and it wasn t very cold these past few months. Winter and now Spring have gone by so quickly. We have come so far since opening in It is hard to believe this will be the 11th race meet at Presque Isle Downs (yes we do count the 25 day meet in 2007). The anticipation and excitement of the first season comes back every year. It may be a little easier getting ready each year, but there are always things that need to be done. We can t wait to greet returning friends. If this is your first season at, we are excited to meet you and make new friends. We enjoy working with you and we want you all to have a successful season. Accordingly, in the event the percentage of the purse to be distributed as listed above results in a distribution of less than $200 for Sixth place and below, then the sum of $200 shall be distributed to each such place in lieu of the percentage formula distribution. STEROID POLICY The Pennsylvania State Horse Racing Commission announces the following administrative policy for the period commencing October 1, 2008 with respect to four steroids: boldenone, stanozolol, nandrolone and testosterone. All other steroid use remains banned. 1. Voluntary out of competition testing will be available under the terms and conditions of Administrative Procedure Notice SHRC The following policy applies to boldenone, stanozolol, nandrolone and testosterone in females and gelded males. Testosterone and Nandrolone in intact males is treated separately in Paragraph 3. Any test result at plasma concentrations below 100 picograms per milliliter will be considered a negative test result. Any test result at plasma concentration levels at or above 100 picograms per milliliter will be sanctioned as an Offense as described in Paragraph With respect to testosterone and nandrolone levels in intact male horses: I. Testosterone: Any test result at plasma concentration levels below 2000 picograms per milliliter will be considered a negative test result. Any test result at plasma concentration levels of 2000 picograms per milliliter and above will be sanctioned as an Offense as described in Paragraph 4. II. Nandrolone: Any test result at plasma concentration levels below 500 picograms per milliliter will be considered a negative test result. Any test result at plasma concentration levels of 500 picograms per milliliter and above will be sanctioned as an Offense as described in Paragraph Sanctions: First Offense: The horse will be placed on the vet s list (i.e., the horse cannot race again until it tests below 100 picograms for Boldenone, Stanozolol, Nandrolone and Testosterone in females and gelded males; and 2000 picograms for Testosterone and 500 picograms for Nandrolone in intact male horses), any purse money for which the horse might have qualified will be forfeited, and the trainer will be assessed a $500 fine. Second Offense: The horse will be placed on the vet s list as indicated in Paragraph 4. A., any purse money for which the horse might have qualified will be forfeited, and the trainer will be assessed a $1000 fine and have his or her license suspended for 15 days. Third Offense: The horse will be placed on the vet s list as indicated in Paragraph 4. A., any purse money for which the horse might have qualified will be forfeited, and the trainer will be assessed a $2500 fine and have his or her license suspended for 30 days. 5. Should a horse be claimed out of a race in which it is found to have incurred a First, Second, or Third Offense, or any subsequent offense, the claimant will have the right to void the claim. Page 6

NON-LASIX HORSES SCHEDULE RACES 1-5 : MUST BE PRESENT 1 1 /2 HOURS BEFORE FIRST RACE POST TIME. RACES 6-8 : MUST BE PRESENT 1 1 /2 HOURS BEFORE FIFTH RACE POST TIME. THIRD PARTY LASIX At, Inc. (PIDI), race day administration of Lasix may only be administered in accordance with the Pennsylvania State Horse Racing Commission (PSHRC) directive by a third party service provider, at PIDI it will be Dr. Mel Beard. Dr. Beard ensures that the Lasix will be adminstered at all times consistent with the time frame, dosages, and other requirements of the PSHRC. Dr. Beard is licensed and in good standing with the Commission. Dr. Beard will prepare proper documentation on the daily administration of Lasix and provide a copy of such documentation to PIDI and the PSHRC as required. The cost is $25 per horse, with the payment billed directly out of the Horsemen Accounts. For horses stabled on the grounds, Lasix is administered at the horse s current stall location and the trainer or an agent of the trainer must be with the horse at the time of administration. In Today signage will be posted on the stall doors of horses once they are treated. Horses shipping in to race are required to arrive to the receiving barn 30 minutes prior to the treatment deadlines, and upon arrival, the trainer or an agent of the trainer must stay with the horse and be present at the time of treatment. No private practitioners are allowed in the horse s stalls after the administration of Lasix on race day. Procedures may be updated from time to time at the direction of the PSHRC. Page 7

(3) The test level of oxyphenbutazone under this section may not be in excess of two micrograms (mcg) per milliliter (ml) of plasma. (1) Only one approved nonsteroidal anti-inflammatory drug (NSAID) may be present in the body of a horse while it is participating in a race. The presence of more than one NSAID at any test level is forbidden. (2) The test level of phenylbutazone under this section may not be in excess of two micrograms (mcg) per milliliter (ml) of plasma. (3) The test level of oxyphenbutazone under this section may not be in excess of two micrograms (mcg) per milliliter (ml) of plasma. Code, Relating to Rules : Docket No. Horse For Claiming Races for Thoroughbred : Race Horses. : FINAL ORDER WHEREAS, on August 20, 2015, the PTHA/HBPA filed a Verified Petition pursuant to 1 Pa. Code seeking an amendment, wavier and/or deletion of 58 Pa. Code, (a) relating to the condition of a horse in the event of a successful claim and; WHEREAS, on August 26, 2015, the Commission issued a Rule to Show Cause to the Executive Secretary as to why the interim relief requested by the Verified Petition should not be granted and; WHEREAS, on August 26, 2015, the Executive Secretary did not object to the special interim relief request by the PTHA/HBPA and on August 27, 2015, this Commission issued its Order Scheduling Hearing and Request for Special Interim Relief in the above matter and; WHEREAS, on September 22, 2015, the Commission conducted a hearing on the Verified Petition at which it received testimony and a presentation from various entities regarding above Verified Petition. The Commission held the record open for two weeks thereafter to receive any further comments or documents from any interested person. No comments or documents were received; WHEREAS, based upon the averments in the Verified Petition, the oral and documentary presentation, the Commission finds that the equities and public interest and the best interests of animal welfare, horsemen and the integrity of thoroughbred racing weigh heavily in favor of granting the final/permanent relief and: AND NOW THEREFORE, this 17 th day of November 2015, upon consideration of the Verified Petition and subsequent administrative record in this matter before this Commission, Petitioners request for relief in the form of a waiver and amendment of the Commission regulation at 58 Pa. If a horse is placed on the Veterinarian s List within one hour of post-time of the race after having been taken to the test barn under its own power or otherwise without assistance for evaluation by the Commission veterinarian, the successful claimant may declare the claim null and void at his or her election. Except that, the claim may not be declared null and void if the horse is placed on the Veterinarian s List due solely to heat stroke or bleeding from the nostrils, as determined by the Commission veterinarian. In the event the successful claimant exercises his/her discretion to declare the claim void, the horse will be returned to the custody of the original owner who entered the horse in the claiming race. 58 POLICIES & REGULATIONS All trainers will cooperate with the Racing Secretary and/or the Stall Superintendent in the moving of horses for consolidation purposes of the backside in order to utilize the stabling facilities to the fullest extent. Positively NO DOGS or OTHER ANIMALS are permitted on grounds. No bedding other than straw is permitted. No yearlings are permitted on the grounds at any time. Substitute races will be used at the discretion of the Racing Secretary. Owners and Trainers are advised that unless delinquent Jocks mounts are satisfied, Foal Papers will not be released. The Pennsylvania Racing Commission has prohibited the use of turned down or any bent shoe at all Pennsylvania tracks. Trainers and authorized agents, when entering horses, are solely responsible for claiming Registered PA-Bred Preference. In the event such preference is not declared at time of entry, such preference shall be forfeited. Registered PA-Breds will have preferred starter status in all non-restricted overnight races. Except a maiden is not preferred in a winners race. & Casino will not be responsible for Foal Papers left in the Racing Office at the close of the meet. Only the Trainer will be allowed to sign out Foal Papers from his/her file. All horsemen are reminded to dress in appropriate attire in the paddock. No shorts or tank tops. Once a race has been chosen, NO entries will be pulled. No entries will be taken or pulled once the entries have been closed - regardless of the size of the field. At the discretion of the Stewards or the Racing Association and without notice, the entries of any person or transfer of any horse may be refused. This rule will be strictly enforced. There will be no exceptions. The Pennsylvania State Horse racing Commission requires all owners and trainers to be licensed before they can start a horse. All horses must be tattooed before starting. Horses to be checked by tattoo number. If any doubt arises as to the tattoo number and the identity of any horse, said horse must be removed immediately. All horses must have proof of a current Health Certificate dated within thirty (30) days, in order to enter the grounds of. NO EXCEPTIONS! All horses entering the grounds MUST be accompanied by a negative Coggons Test certificate, IN HAND, issued within the past twelve (12) months and a Health Certificate issued within thirty (30) days prior to date of arrival at & Casino. The State Veterinarian s Office requires original Coggins Test ONLY. However, faxed copies that include the lab s name and phone number will be accepted as evidence that a horse has a negative test. Coggins papers in the Racing Office will not allow you to Stable Gate access. Horsemen will be allotted stalls with the understanding that their horses are ready to run. & Casino reserves the right to ask horsemen to leave the property, after a period of inactivity, if they do not enter their horses in races that are available. Prior approval must be obtained from the Racing Secretary or Stall Superintendent for any trainer requesting additional stall space for any horse or horses purchased through private sales, claims or trainer transfers. This must be done before and NOT after, to receive any consideration. Each trainer shall register with the Racing Secretary all horses in his charge giving the name, age, sex, breeding and ownership of each. Any horse stabled on the grounds of the association without having been so registered, or occupying a stall not assigned to him, unless by special permission, will be cause for disciplinary action. Foal Papers for all horses stabled on grounds must be registered with the Racing Secretary s Office. & Casino reserves the right to refuse any entry based upon poor performance. & Casino also reserves the right to refuse admittance to or reject anyone whose presence it considers not to be in the best interest of racing (undesirable) in accordance with regulations of the Pennsylvania Horse Racing Commission. Owners and trainers will be held responsible for the conduct of their employees while on the premises. All trainers and their employees must be fingerprinted and shall at all times have their picture ID Badges visibly displayed at all times in all restricted areas, including while in the Test Barn. Failure to comply shall result in a hearing with potential of a fine and suspension. Page 58

59 POLICIES & REGULATIONS CONTINUED It is hereby agreed that & Casino shall NOT be liable for, and that the owner and/or lessees of the horse will indemnify and hold harmless & Casino against all responsibility, liability or claim of injury or damage to any person, horse or other property of the undersigned, or of any other person, or his or their agents, employees or associates, caused by the horse, or agent of the employees of the undersigned, or by any other person, including employees, agents of Presque Isle Downs & Casino, whether by negligence or otherwise, on the premises of & Casino. All trainers shall carry compensation insurance covering all of their employees. This paragraph is intended to include all individuals employed by trainers in the training and racing of horses. All concessionaires shall carry compensation insurance covering all their employees. All common areas and shedrows to the middle of roads will be subject to inspection by management or Stall Superintendent. All areas are to be raked and cleaned. All first time starters must have a minimum of three (3) satisfactory published workouts, one being within the last thirty (30) days, and be approved from the starting gate. An O.K. Card from the Starter must be on file in the Racing Secretary s Office before an entry is accepted. Any horse which has not raced for a period of thirty (30) days must show one (1) credible workout before they are allowed to start. Trainers are responsible for notifying the clocker when working a horse. The clocker must be notified of the distance which the horse will work, and the correct spelling of the horse s name. The Clockers phone number is Ext# Eligibility, penalties and allowances of weights for all races, along with preference to the highest earners, will be determined after considering the reports, records and statistics published by Equibase and other racing statistical publications, but responsibility for weight carried and eligibility still remain with the owner and trainer as prescribed by the Rules of Racing. When a race is in dispute, both the horse that finished first and any other horse involved in the dispute are subject to all penalties attached to the winner of that race until the matter is decided. If any applicant has in his charge any horse whose name appears on any barred list (veterinarian, starter, steward s or any other barred list at any track), such applicant shall report the name of such horses and the fact that he has been so barred to the Racing Secretary at any meeting within Pennsylvania at which he proposes to enter such horse to race. All changes in trainers must be reported to the Pennsylvania Horse Racing Commission and the Racing Secretary immediately along with the owner s and previous trainers authorization. & Casino reserves the right to decline stall space to any owner or trainer. The removal of any dead horse is at the expense of the HBPA. Although the Racing Office will assist by all means possible, Trainers are responsible for Eligibility, Weight Allowances, Preference Dates, Coggins and Workouts. In addition, Trainers must make sure that the name of the correct owner is written on Foal Papers. Entries and declarations shall be made in writing and signed by the trainer of the horse, or his authorized agent, or some person deputized by him. In all races except handicaps and races where the conditions expressly state to the contrary, fillies two (2) years old are allowed three (3) pounds, and fillies and mares three (3) years old and upward are allowed five (5) pounds before the 1st of September and three (3) pounds afterwards. If a race is declared off, the Racing Secretary may split or divide any overnight race which may have closed and cause a new drawing for post positions. Horse penalized in a race shall not be entitled to any allowances in that race. Horses not entitled to the first allowance in a race shall not be entitled to the second, and if not the second to no subsequent allowances. Winner or non-winner of a stated sum means winner or non-winner of a single race of that value to first horse. Page 59

60 RECEIVING BARN RULES 1. No Trainer competing on consecutive days may bring more horses than those which are for that day s race card, unless prior arrangements have been made with the Stall Superintendent. 2. Trainers competing on consecutive days are responsible for additional bedding, and cleaning of stalls assigned to them (authorized bedding only). 3. Horses in for work & go must be out of the Receiving Barn by Noon (12:00 p.m.) Saturday thru Thursday. No training on Friday. 4. Once a stall has been assigned, and a horse has occupied the stall, no changing/switching of stalls will be permitted. 5. There will be no lending of Receiving Barn Tools, unless Receiving Barn personnel are present while tools are being used. 6. Only Receiving Barn personnel are permitted in the Barn Office, and no loitering around Barn Office. 7. No on loading / off loading of horses in front of, or around Receiving Barn during training hours (7:00a.m. 11:00a.m. Saturday Thursday). 8. Trainers if there are any problems with the stalls please notify the Barn personnel. 9. Trainers, when arriving at the Receiving Barn (report in) to the Barn Guard for stall allotments during Racing Days and the Stable Gate for Non - Race Days. 10. No Ponies in the Receiving Barn unless prior arrangements have been made. 11. Trainers while assigned stalls in the Receiving Barn, the stalls and area around the stalls are to be policed of trash at all times. 12. No dumping of ice/water buckets inside the stalls, contents are to be deposed of properly. RULES Eligible to Claim: 1. An owner who has a thoroughbred(s) stabled in Pennsylvania: or, 2. An owner who has started a horse at this meet, 3. A new owner who has not held an Owner s License in a racing jurisdiction during the prior year to claim by obtaining an Open Claiming License from the Commission and must comply with certain other procedures (See Rule ). All claims must be made in writing on forms and in envelopes furnished by the Association and approved by the Commission. Both forms and envelopes must be filed out completely, and must be substantially accurate, otherwise the claim will be void. The determination of what is substantially accurate is within the sole discretion of the Stewards. Notwithstanding and designation of sex or age on the racing program or any racing publication, claimant is solely responsible for determining the age or sex of a horse claimed, prior to depositing the claim form. All claims must be deposited in the Claiming Box at least ten (10) minutes before post time of the race with respect to which the claim is made Number of claim. When a stable consists of horses owned by more than one person, trained by the same trainer, not more than one claim may be entered on behalf of such stable in any race Starting of a claimed horse. For a period of 30 days after the claim, a claimed horse shall not start in a race in which determined eligibility price is less the 25% more than the price at which it was claimed. The claimed shall not count, but the following calendar day shall be the first day and the horse shall be entitled to enter whenever necessary so the horse may start on the 31 st calendar day following the claim for any claiming price. This provision shall not apply to starter handicaps in which the weight to be carried is assigned by the handicapper Sale or transfer of a claimed horse. When a horse is claimed, it shall not be sold or transferred to anyone wholly or in part except in a claiming race, for a period of 30 days from the date of claim, nor shall it, unless reclaimed, remain in the same stable or under control or management of its former owner or trainer for a like period. Further, it shall not race elsewhere until the end of the race season in progress or for period of 60 days, whichever shall first occur. The Commission shall have the authority to waive this rule upon application and demonstration that such waiver is in the best interest of horse racing in the Commonwealth of Pennsylvania. Nothing in this rule shall preclude any claimed horse from entering in any non-claiming stake race Applicability of other rules. When a horse is claimed at a recognized meeting under provisions which are at variance with the provisions of this section, title to such horse shall be recognized in Pennsylvania to follow the rules of the meeting in which the claim was made, however, while racing in Pennsylvania, shall adhere to Rule XII. 61 & Casino FOAL PAPER / DATE PREFERENCE SYSTEM The Foal Paper/Date Preference System will be used at & Casino as described below. Trainers are responsible for Dates - Preference Dates must be claimed at time of entry. A horse can have only one (1) Preference Date (Except for Z-Dates or where mentioned in Race Headings). 1. Dates assigned will be of three types: 0-DATE: An 0 Date will be assigned to a horse whose foal papers are submitted to the racing office prior to the first day that entries are taken. Thereafter, an E-Date will be assigned when foal papers are deposited with the Racing Office. Foal Papers MUST BE TURNED IN TO THE RACING OFFICE BY 3:00 P.M. MONDAY, MAY 15, 2017, to receive an 0 DATE. E-DATE: Foal papers turned into the Racing Secretary s Office will receive an entry date for that day, if not coming off a scratch. Also, an E-Date (the day that you re entering for) will be given to any horse entered into any Condition Book race. And, any horse running elsewhere after obtaining this date will lose their Preference Date. It is the trainer s responsibility to notify the Racing Office in such instances. R-DATE: Horses which are drawn into races, and horses on the ALSO ELIGIBLE LIST which draw in to races, will receive a RUNNING DATE corresponding to the date on which they are to run. 2. In over-filled races, preference will be given to horses in the order of their assigned preference dates, earliest date first. Horses having identical dates will be chosen by lot, however, where ENTRY and RUNNING DATES are the same, the horse with the ENTRY DATE will have preference. 3. Horse with dates established which re-enter, but do not get in, will keep the date previously established. 4. Horse on the ALSO ELIGIBLE LIST shall be permitted to draw into races in the order of their dates. 5. Horses in the body of a race which scratch will lose their DATE, and must reenter to receive an E-DATE or draw into the body of a race for an R-DATE. 6. A horse on the ALSO ELIGIBLE LIST will lose its date if a scratch card is submitted and its number drawn. 7. Any horse which has drawn or obtained a position in a race and enters again on the next day that entries are taken shall be termed an in-today horse and if the race in which the horse is entered overfills, the horse shall be given no consideration whatsoever with the exception of participation in a stakes race. 8. A horse which is a scheduled starter in a cancelled race will receive a Z-DATE, and will have preference the next time it is re-entered, unless the foal papers are signed out or the horse runs at another track. 9. Not more than one horse owned by the same person shall be drawn into any overnight race to the exclusion of a single interest. Any trainer entering two horses in an overnight race must prefer the horse with the best date. 10. Horse on the VET S, STEWARD S, STARTER S or PADDOCK JUDGE S LIST cannot re-enter until removed from such list. 11. Preference dates are transferred through changes in ownership and changes in trainer only after the proper transfer procedures have been completed through the Steward s Office and delivered to the Racing Secretary s Office. 12. Preference dates are good for any type of race or distance with the exception of Stakes and Handicaps, or where superseded by Z-Dates or Preference Clauses in race headings. Preference clauses in race headings will supersede Z-Dates. (In instance of office error, Preference will be determined at the discretion of the Racing Secretary. 13. Preference dates will not Supercede race conditions or Preference on any race such as; condition eligibility, winner s preference, PA bred preference or any other race condition or preference written for any race. 14. Foal Papers must be turned into the Racing Secretary s Office no later than 11:00 A.M. on the mornings that entries are being taken, to receive any consideration for E-DATES for that day s draw of entries. 15. Should a horse s papers be withdrawn from the Racing Office for just cause (i.e., tattooing, corrections, change of ownership or clarification, etc.), the Racing Secretary may determine the status of the Preference Date established. 16.
