1 TERMS & CONDITIONS OF RACE SERIES IMPORTANT PLEASE READ LADBROKES AUSTRALIAN PACING GOLD SERIES TWENTY-EIGHT $350,000 CLASSIC FINAL FOR TWO YEAR OLD COLTS & GELDINGS $350,000 CLASSIC FINAL FOR TWO YEAR OLD FILLIES TO BE CONDUCTED AT ALBION PARK, MELTON, MENANGLE AND PINJARRA IN THE 2017/18 SEASON OPEN TO ANY HORSE FOALED IN AUSTRALIA ONLY AND HAVING THE FREEZE BRAND OF THE AUSTRALIAN STATE OF REGISTRATION SUBJECT TO COMPLIANCE WITH AUSTRALIAN HARNESS RACING COUNCIL FUTURITY RACE RULES CONDITIONS OF ENTRY Ladbrokes Australian Pacing Gold Series Twenty-Eight for Two Year Old Pacers shall be a Mobile Start Classic conducted as a Series of Heats, Repechages and Finals; one Division being for Two Year-Old Colts and Geldings and one being for Two Year-Old Fillies which were foaled in Australia only and having the Freeze Brand of the Australian State of registration. 1.0 VENUES 1.1. Heats of each Division of the Two Year-Old Series shall be conducted at Albion Park, Queensland; Menangle, New South Wales,, Melton, Victoria and Pinjarra, Western Australia, subject to Condition A maximum of one repechage per sex will be conducted in each state, and Finals of the Two Year- Old Series shall be conducted at Melton, Victoria (Colts & Geldings) and Menangle, New South Wales (Fillies) Consolation Finals shall be conducted iat Albion Park, Brisbane, Melton, Victoria, Menangle, New South Wales, and Pinjarra, Western Australia. Albiuon Park and Pinjarra shall host mixed sex Consolation Finals, whilst Melton and Menangle shall each host two Consolation Finals (one for Colts & Geldings, and one for Fiillies). 2.0 TIMING 2.1. The Series shall be conducted in the 2017/18 Racing Season. AUSTRALIAN PACING GOLD 1

2 2.2. If for any reason it becomes impractical or undesirable, in the opinion of the Directors, to hold any or more of these races at the track designated, the Directors reserve the right to change the date and location of any or all races. 3.0 ELIGIBILITY AND ACCEPTANCE 3.1. Open to horses foaled in Australia only and having the Freeze Brand of the Australian State of registration, sold in accordance with the "Terms and Conditions of Sale" at Sales approved by the Directors as "Ladbrokes Australian Pacing Gold Sales", shall be eligible to compete in the Series subject to the following conditions set out in inclusive. A passed-in yearling shall be deemed to be sold Eligibility shall be maintained on the payment of either: Option One One-off Series Payment: Purchasers may choose to make a single Series Payment of $2,200 (including GST) to be paid by the purchaser on the day of the sale. This payment will make a horse fully eligible for both the Ladbrokes APG 2yo Race Series and Gold Bonus Scheme. No further payments are necessary. Option Two Four Step Sustaining Schedule: Purchasers may choose to keep their horses eligible for the Ladbrokes APG Race Series and Gold Bonus Scheme by making the following payments: a) A Sales Day Sustaining Payment of $550 (including GST) to be paid by the Purchaser on the day of the Sale. b) A Second Sustaining Payment of $550 (including GST) due by 1 June, c) A Third Sustaining Payment of $550 (including GST) due by 1 September, d) A Fourth Sustaining Payment of $1,100 (including GST) due by 1 December Failure to make any commitment required by the conditions constitutes an automatic withdrawal from the event. Note: Providing APG with a positive commitment to sustain a yearling by the due date (either by returning your sustaining form or by positive response to APG s SMS Text Service) shall be a binding and irrevokable commitment to pay, enforceable by a court of law. Where a commitment to sustain is received by the due date, but payment is not received within 7 days, a further administrative fee of $49.50 will apply In addition to 3.1 horses foaled in Australia only and having the Freeze Brand of the Australian State of registration, nominated as Non Sale Entries with Australian Pacing Gold at a cost of $3,850 on or before 31st October, 2016 NOT presented for sale at an Australian Pacing Gold Sale, shall be eligible to compete in the Series, provided that the horse is NOT ENTERED OR OFFERED as a yearling at any other Standardbred Sale, or any other auction which has horses for sale, where such sale takes place after 31st October Eligibility shall be maintained on the payment of all sustaining fees post the 2017 Sales as per Option Two above. 4.0 LATE ENTRY 4.1. There shall be no provision for late entry of horses or notification of Sustaining in the Series unless it is determined by the Board of Directors that the circumstances amount to exceptional. 3 5.0 REFUND OF FEES 5.1. Fees paid are non-refundable except that, should any circumstances prevent the running of the Series, all fees paid shall be refunded, less administrative and promotional costs incurred PACERS HEATS 5.2. Trainers must nominate for a Heat of the Ladbrokes APG Race Series with their relevant state racing authority in the same way that they would nominate for any normal race Any horse which accepts for a Heat must have completed all Qualifying Standards set by the respective Controlling Board or Authority of the State in which it will contest said Heat Every Final Acceptor to the Series shall be guaranteed a start in the Heats, subject to 6.2 and any other requirements of the Controlling Board or Authority of the state in which it will contest a Heat The number of Heats will be determined by the number of Acceptors Random Barrier Draw applies for all races in the Series, with the exception of any mixed sex Consolation Finals which will be PBD/Sex Horses owned in the same interests or trained by the same Trainer will be separated, if possible The number of horses contesting each Heat shall be limited to a maximum of ten starters. In the event that it becomes apparent that there will be a significant difference in field sizes between the States, then to the extent that APG believes that it is practical and possible to do so, APG will endeavour to contact trainers and offer them the option of transferring to an interstate heat to even up the heat numbers. The number of horses drawn in heats in Queensland or Western Australia will not be considered as the benchmark in such situations. Any decision to transfer will need to be made prior to fields being drawn, and connections will be responsible for any associated travel costs etc A minimum number of six (6) horses will be required to constitute a Heat so as to satisfy that each venue has a least one Heat, however, this Condition will not impact on Condition 6.9 and will be at the absolute discretion of the Directors. In the event that there are insufficient nominators or acceptors in a State to constitute a Heat, a Subsidy of $2,500 will be paid to the connections of horses required to travel to contest a Heat at a venue determined by the Directors. Horses that are normally trained and domiciled in another State, are not eligible for a Subsidy if they are required to contest a Heat in the State where they are normally trained and domiciled Should the number of Two Year Olds nominated to contest a Heat at a particular venue be insufficient to make up two (2) Heats of eight (8), the Directors have the absolute discretion to conduct a Ballot so as one Heat is conducted. The horses drawn by the Ballot will receive a Subsidy of $2,500 to contest a Heat at a venue determined by the Directors. However, horses that are normally trained and domiciled in another State, are not eligible for the Subsidy if they are required to contest a Heat in the State where they are normally trained and domiciled. 4 6.0 QUALIFICATION FOR THE FINALS VIA HEATS / REPECHAGES 6.1. In the event that there are no more than 10 heat winners for a particular sex (including dead heats), all heat winners will qualify for the Final, should connections wish to contest it Should the connections of heat winners wish to contest the Final, the managing owner/lessee is required to confirm this to APG within 48 hours of their heat win to enable APG to determine the number and venue for any repechages. Trainers of the heat winners are also required to nominate for the APG Final with the relevant state racing authority in the same way that they would nominate for any normal race In the event that fewer than 10 heat winners in a particular division advise APG that they wish to contest the $350,000 final,s APG will conduct repechages to determine the remaining qualifiers for the finals 6.4. APG will conduct up to a maximum of four repechages in each Division (one repechage per Division per state subject to a minimum field size of six runners),, depending upon the number of positions that remain available for each Final In the event that less than four positions remain available for a particular Final, preference will go to those states that hosted the most heat runners in the relevant Division (unless there is only enough positions available for a single repechage, in which case it will be conducted at the venue that is due to host the relevant Final).. Example: Assume that nine heats were contested in the Colts & Geldings Division. Victoria hosted 36 heat runners, NSW hosted 26 heat runners, Perth hosted nine heat runners, and Brisbane hosted eight runers. Within 48 hours of the heats being completed, eight of the nine heat winners advised that they wished to contest the Final (one heat winner chose not to contest the Final because it suffered an injury in its heat). In the above scenario, APG will conduct two repechages, one in Victoria (which hosted the most heat runners) and one in NSW (which hosted the second most heat runners) Trainers of horses wishing to contest a repechage will be required to nominate their horses as per normal,. Preference in field selection will go to horses that placed best in their heat. A ballot will be conducted (if required) to determine which of two (or more) horses that finished in the same position in their heats gains preference for the repechage In the absence of any dead heats in the repechages, repechage winners will qualify for the Final (should they wish to contest). Should there be a dead heat in a particular repechage, then a ballot will be conducted between only the dead heating horses, to determine which of them qualifies for the final (the second horse drawn in the ballot will become the first emergency) In the event that additional places become available in the Final (either as a starter or emergency e.g. due to a heat winner withdrawing due to illness prior to the final field being drawn), the additional places will be made available to the second placed finishers from the repechages, with preference going to the repechage that was conducted in the state with the most heat runners. Example: Continuing the example above, if a further place became available in the final, preference would go to the second placegetter in the Victorian repechage, because Victoria had the most heat AUSTRALIAN PACING GOLD 4

5 runners. Should yet more positions in the final lbecome available, they would go to the second placegetter from the NSW repechage, then the third placegetter from the Victorian repechage etc In the unlikely event that there are more than 10 heat winners in a particular Division (e.g. because there was a dead heat, or more than 10 heats were conducted),, then the slowest heat winners from each state that had at least two winners will be paced in a ballot, to determine which of them will progress through to the Final, and which will miss out (or be emergency). 7.0 THE FINALS Example: Assume that in the Colts & Geldings Division, eleven heats were conducted. Victoria and NSW conducted four heats each, Western Australia conducted two heats and Queensland conducted one heat. In this scenario, the slowest heat winners from the Victorian, NSW and Western Australian heats would go into a Ballot to determine which two horses qualified for the Final, and which would be the first emergency. The Queensland horse was not included in the Ballot because Queensland only had a single heat winner The Finals shall comprise a maximum of ten (10) Starters plus Emergencies (subject to any restraints on field sizes impossed by the Controlling Board or Authority in the State where the Semi-Final and Final are to be conducted). 8.0 CONSOLATION FINALS 8.1. Consolation Finals shall be conducted iat Albion Park, Brisbane, Melton, Victoria, Menangle, New South Wales, and Pinjarra, Western Australia Albiuon Park and Pinjarra shall host mixed sex Consolation Finals, whilst Melton and Menangle shall each host two Consolation Finals (one for Colts & Geldings, and one for Fiillies) Horses may only contest one Consolation Final, and may only contest a Consolation Final in the state where they contest their heat and/or repechage Heat winners that do not contest the Final (either due to their own choice, or due to ballot) are eligible to contest a Consolation Final and get preference in field selection. Second preference goes to horses that contested the repechage in the relevant state (with higher placed finishers having preference over lower placed finishers), while third preference goes to horses that competed in the heats in the relevant state (with higher placed heat finishers gaining prefrence over lower placed finishers) Fully sustained horses that did not contest a heat will be eligible to nominate for the Consolation Finals, but will only be considered in the event that the number of nominations received from heat and repechage runners is insufficient to ensure full fields (including emergencies) for the Consolation Finals, 9.0 DISTANCES OF HEATS AND FINALS 9.1. All races comprising the Series shall be conducted over a distance of 1609 metres. If not practical, the races shall be conducted over a distance as near as possible to 1609 metres, but not less than 1609 metres. AUSTRALIAN PACING GOLD 5

7 12.0 GOLD BONUS SCHEME CONDITIONS To be eligible for the APG Gold Bonus Scheme a horse must be fully sustained for the Two Year Old Series (Refer to Clause 3.2) Owners (or registered lessee(s) in the case of a leased horse) of an eligible horse will receive an APG Gold Bonus Certificate upon their horses first 2yo win in any officially sanctioned race offering minimum stakes of over $1, The registered owner(s) (or registered lessee(s) in the case of a leased horse) at the time when a horse wins its eligible two year old race will be the recipient of the APG Gold Bonus Certificate; Gold Bonus Certificates may be redeemed at the APG yearling sales for any one of the following options: a) Receive $4,000 off the purchase price of a filly; b) Receive $2,000 off the purchase price of a colt; or c) Receive full APG Race Series eligibility for a new yearling purchase (i.e. as per Option One in Clause 3.2) Gold Bonus Certificates are non-transferrable and remain valid for a period of two years from the date when the Certificate was earned. In the event that a Gold Bonus Certificate is won by a horse that has more than one owner, the certificate may be redeemed by any one of the individuals listed as owner on the Gold Bonus Certificate Gold Bonus Certificates that are not redeemed within two years of the date when they are earned will expire Australian Pacing Gold will endeavour to identify and contact the Manager of all Gold Bonus winning horses within 28 days of their horse s win and issue the Gold Bonus directly to the nominated Manager. However, in the event that Australian Pacing Gold fails to contact the nominated Manager within 42 days, the Manager should contact APG to arrange for the Gold Bonus Certificate to be issued GENERAL CONDITIONS The Controlling Board or Authority of the State in which races of the Series are being conducted, shall guarantee that these Rules (or in the principle or intention thereof) will be adhered to Every Club conducting such races shall comply with all directions of Australian Pacing Gold Limited as to the conduct of or any matter relating to the Series The races conducted in a Series shall be run under the Rules of Harness Racing of the Controlling Board or Authority of the State in which such races are conducted All horses nominated for and or starting in the Series and their Owners, Trainers and Drivers, in addition to being bound by the Rules of Harness Racing of the State in which the races are conducted, shall be deemed to be bound by the Conditions of the Series and any decision made thereunder. 8 14.0 BOARD OF DIRECTORS The Board of Directors of Australian Pacing Gold shall have the utmost power to deal with any matter arising from these conditions and any such decision by the Board of Directors shall be final and binding on all parties. The Board of Directors, shall have power to, however, not limited to: - administer the Series; - determine any fees payable; - determine dates on which any fees will fall due; - determine what amounts to exceptional circumstances as provided by in Clause 4.0 hereof; - determine dates on which races comprising the Series will be conducted; - determine venues of races comprising the Series; - determine Prizemoney and the distribution thereof; - authorise sales as " Australian Pacing Gold Sales" under such conditions as it prescribes; - determine any alteration to the number of Heats and Repechages to be conducted; - determine eligibility of any horse which does not contest a Heat; - determine any alteration to the choice of venue if required to produce adequate field sizes in Heats; - adjudicate on the eligibility of any horse to contest a Heat, Semi-Final, Consolation or Final of the Series; - conduct a Ballot to have horses contest Heats at another venue other than the venue nominated; - abandon the Series for whatever reason with all nomination, first and final acceptance payments and sustaining fees being refunded less any administrative or promotional charges THE BOARD OF DIRECTORS: Club Name HRV Messrs P Bourke & P Watkinson NSWHRC Messrs R Marshall & P Sullivan ALBION PARK HRC Messrs P Ellis & T O Reilly GENERAL MANAGER Mr David Boydell - Tel (03) Fax (03) SECRETARY Mr Shane Gloury - Tel (03) Fax (03) DISCLAIMER The Controlling Boards or Authorities will not accept any liability whatsoever in the failure by Australian Pacing Gold Limited ACN to comply with conditions for the event, including conditions in relation to nominations, acceptances and eligibility.
