7 EXECUTIVE SUMMARY This report on greyhound racing in Arizona includes information on humane and economic issues. All information is specific to Arizona, recent, and was obtained from credible sources such as state records or mainstream news reports. 9 SECTION 1. Historical Overview Greyhound racing exists today in Arizona at one operational racetrack, Tucson Greyhound Park. This track opened in 1944, and is owned by Joseph Zappala and Robert Consolo Jr. 1 At one time, there were four other greyhound racetracks in the state, all of which have closed. 2 Phoenix Greyhound Park opened in 1954, and operated for decades before finally closing permanently in Apache Greyhound Park, which had opened in 1959, ended live racing in 2004 but remains open for simulcast wagering. 4 Two other tracks, Yuma and Black Canyon City, have been closed for over a decade. 5 Yuma Greyhound Park, located in a remote area of the state near the Mexican border, operated for 28 years before its closure in Arizona s dog tracks have a long history of seeking legislative assistance. Some of these efforts have been successful while others have failed. Confinement At Tucson Greyhound Park, hundreds of greyhounds are kept confined in warehouse-style kennels in rows of stacked cages. 9 Carpet remnants are used as bedding. 10 In 2010, investigators retained by GREY2K USA gained access to Kennel #4 at the track. 11 In that kennel, greyhounds were kept in darkness and most of the dogs were muzzled in their cages. 12 Still from a video investigation of Tucson Greyhound Park, 2010 This system of confined housing is used because commercial greyhound racetracks require a large number of dogs in order to operate. According to former Tucson Greyhound Park General Manager Chris McConnell, the track kennel compound can hold as many as 700 dogs. 13 In 2008, the Arizona Department of Racing counted 493 racing greyhounds that were being kept in seven of the kennels at the Tucson track. 14 Greyhounds at Tucson Greyhound Park are confined for up to 23 hours per day Greyhounds are confined perpetually in their cages with two exceptions: 1. A few times per month, greyhounds are removed from their cages and taken to the racetrack to compete, where they are similarly confined before racing. 2. Confinement Large greyhounds cannot fully stand erect in their cages The Arizona Department of Racing requires that greyhound cages be 32 inches high, by 31 inches wide, by 42 inches deep. 19 A South Tucson city ordinance requires cages that are slightly larger, 20 although it is unclear whether this requirement is being followed by the track. According to the American Greyhound Council, greyhounds stand between 23 inches and 30 inches tall at the shoulder, and weigh between 50 and 85 pounds. 21 Large greyhounds cannot stand fully erect in the cages that are used at Tucson Greyhound Park. Still from a video investigation of Tucson Greyhound Park, 2010 Kennels at Tucson Greyhound Park are ignoring a city ordinance that prohibits confinement Even though a South Tucson City Ordinance requires that greyhounds be confined for no more than 18 hours per day, there is clear evidence that kennels at Tucson Greyhound Park are ignoring this law. In December 2010 track General Manager and CEO Tom Taylor told a local television station that the track does not ensure the confinement law is followed: We don t make sure. There is no way we can. Confinement Track executive states that he would not allow his pet dog to live in a greyhound kennel In December 2010 Tucson Greyhound Park CEO and General Manager Tom Taylor was asked in a news interview if he would keep his own dog confined in similar conditions. He responded by stating that he would not keep a pet dog confined in a greyhound kennel: If it was a racing dog yes, if it was a pet no. 26 When he was asked to differentiate between greyhounds and other dogs, he indicated that one has to stay in shape the other doesn t. 27 When he was pushed further on the subject, Taylor stated that greyhounds don t want to be outside. 28 Some greyhounds at Tucson Greyhound Park may not receive four daily turn-outs. After greyhound trainer Joel Hubka tested positive for marijuana in 2007, he stated that some trainers were not turning out their greyhounds until very late in the day: Things were going on here, people turning out very late in the afternoon for the first time of the day, so I can understand why they re doing what they re doing that s sick, that s not taking care of your animals. 29 Because greyhounds have been confined, they require socialization before being adopted Because greyhounds have been extensively confined, they often require socialization before being adopted as pets. This was publicly acknowledged by Arizona Greyhound Rescue volunteer Angy Shearer in October 2009: The dogs we get are between the ages of 2 and 4 and they have never been in a house before. They don t know how to be a dog. Most of their lives an average of 22 hours a day are spent in a cage. 30 Similar public comments were made by Arizona Greyhound Rescue President Bill Nunn in 2010: These dogs have never been in a house before they don t know what a ringing phone is. They don t know what a sliding-glass door is. Greyhounds Suffer Serious Injuries Nearly 1,000 greyhound injuries have been reported since 2007 Between January 1, 2007 and November 3, 2009, 923 greyhound injuries were reported at Arizona racetracks. 32 Of these, 628 were reported at Phoenix Greyhound Park and 295 were reported at Tucson Greyhound Park. 33 At Phoenix, injuries were reported per month on average. At Tucson, 8.4 injuries were reported on average each month. Since November 2009, the Arizona Department of Racing has denied multiple public information requests for additional injury data. The most common injury was a broken leg The most common reported injury was a broken leg. Specifically, 249 or 27% of all reported injuries involved fractured legs, while 93 or 10% were sprained legs. 34 Dislocations, muscle tears and strains, lacerations were also frequently reported. Other dogs suffered a cracked skull, broken backs, heat stroke, puncture wounds and paralysis. Where estimated recovery times were given, following the classification system of the industry s American Greyhound Council, the majority of injuries were serious. 36 Only 13 reports, representing one-tenth of one-percent of all injuries, were classified as minor. Greyhounds Suffer Serious Injuries Adoption groups often receive greyhounds that have been injured In a 2009 news report, then-president John Clark of Arizona Greyhound Rescue indicated that his group often received injured dogs: Some come off the track with injuries last year we took in four dogs with broken legs at $3,000 each. 67 In another news report, Arizona Greyhound Rescue communications director Patti Pate indicated that in 2009 the group spent $63,000 on medical expenses. 68 Some greyhounds are euthanized due to injuries that are not life threatening There is evidence that greyhounds are euthanized after suffering injuries which are not life-threatening. In 2007 a greyhound trainer was suspended for two weeks and fined $500 after he tried to save the life of a greyhound that had suffered a broken leg. 69 After the dog was hurt, greyhound trainer David Blair, who was intoxicated at the time, offered to take the greyhound for rehabilitation and adoption, but the owner of the dog refused. 70 At a public hearing several days later, a track veterinarian testified that she had previously sent other greyhounds home with Blair who had suffered far more severe injuries than Pa s Mismakamess. 71 On May 26, 2009 a two-year-old black greyhound named Bella Kingnarmer suffered a broken leg after he was bumped by other dogs during a race at Tucson Greyhound Park. Greyhound Racing is a Dying Industry Gambling on greyhound racing has declined significantly over the past decade Since 2001, gambling on live greyhound racing in Arizona has declined by 75%. 72 While this decline is partly due to the closure of Phoenix Greyhound Park, Tucson Greyhound Park also experienced a significant drop in wagering during this period. Between 2001 and 2010, gambling on live dog racing at the Tucson track declined by 34%. 73 Dog track owner, lobbyist, greyhound trainer publicly state that greyhound racing is a dying industry Various members of the dog racing industry have publicly acknowledged that greyhound racing is a dying industry. For example, in a 2011 news report Tucson Greyhound Park lobbyist Michael Racy stated that the environment for greyhound racing continues to deteriorate: The competitive environment out there is amazingly difficult for this industry and continues to get more challenging. 74 Similarly, when Phoenix Greyhound Park announced its permanent closure in September 2009, greyhound trainer Clifton Gray indicated that he was not surprised by the news: It s not much of a shock. 19 SECTION 4. Greyhound Racing is a Dying Industry One track owner has also acknowledged the decline of the industry. In a 2000 news report, Tucson Greyhound Park owner Joseph Zappala referred to the track as the worst investment we ve ever made. 76 The state of Arizona is losing money on greyhound racing Because regulatory costs exceed the amount generated in revenue, the state is now losing money on live greyhound racing. According to a 2009 news report, the Department of Racing spends more than $3 million per year regulating the racing industry, of which more than $2.6 million comes from the general fund. 77 Arizona racetracks seek legislative approval for other forms of gambling As a result of the continuing decline in gambling on dog races, track owners have pushed for the legalization of other forms of gambling at their facilities. Other Issues Attempts to address humane issues with stronger regulatory efforts have failed According to Geoffrey Gonsher, former Director of the Arizona Department of Racing, the department has not had the funds necessary to effectively regulate the racing industry. 80 This assessment was included in a 2007 review of the agency by the state Auditor General, and cited extensive tax breaks Arizona racetracks received in the 1990 s as a cause for the problem. 81 In the review, Gonsher outlined his concern: The department does not have sufficient funding to regulate the parimutuel industry in a safe manner. 82 Additionally, Tucson Greyhound Park has ignored attempts to improve the lives of dogs living at their facility through stronger animal welfare regulations. For example, when voters in South Tucson passed an ordinance mandating stronger welfare regulations in 2008, Tucson Greyhound Park simply refused to follow the law. 83 Only ten weeks after the law was approved by voters, veterinarian Joe Robinson wrote to the Arizona State Veterinary Medical Examining Board to tell them that he intended to violate a provision of the ordinance that prohibited the use of anabolic steroids in racing greyhounds: This letter is to inform you that I will be providing testosterone shots at Tucson Greyhound Park. 84 There is evidence that the track never intended to follow the law. Even before the measure was approved, track officials stated publicly that they would seek to be grandfathered to ensure the ordinance did not apply to them. 85 Greyhounds suffer from various illnesses while racing in Arizona According to records obtained from the Arizona Department of Racing, many greyhounds have suffered from health issues while competing at racetracks in the state. Other Issues Greyhounds from Tucson Greyhound Park disappear, are presumed dead In 2006 a greyhound hauler was banned for life and ordered to pay $140,000 after he refused to account for more than 100 dogs. 89 In total, he removed more than 140 greyhounds from Tucson Greyhound Park between November 2005 and July 2006, claiming that the dogs would be hauled to his farm in Colorado and distributed to adoption organizations. 90 For this service, track managers paid him $150 per dog. 91 After investigating the incident, the Arizona Department of Racing ruled that the animals may have been killed for profit. 92 The agency ruling also criticized Tucson Greyhound Park for failing to meet its responsibilities to the dogs and not keeping complete and accurate records. 93 Cases of greyhound neglect have occurred in Arizona In 2010 a greyhound breeder and owner was fined $1,000 and had his license revoked by the Arizona Department of Racing after an inspection of his farm documented severe neglect. 94 When investigators arrived at the farm, they found one dead greyhound lying on the ground, and observed several greyhounds that were in poor physical condition and all appeared to weigh between fifteen (15) and twenty (20) pounds. 95 Other greyhounds showed signs of neglect, including one greyhound observed with a large laceration to the left front leg and a second greyhound that appeared to be physically weak and immobile. 96 Both greyhounds were subsequently euthanized. 97 In July 2005 Pima County Animal Care officers confiscated nearly 90 greyhounds from a kennel in Tucson after citizens complained that the dogs were suffering from severe neglect. 98 Of the approximately 100 greyhounds found at the kennel, only a dozen were in good health. 99 The rest were suffering from severe hair loss, flea and tick infestations, possible internal parasites, and mange. 100 The flea infestation was so severe that officers wore full body biohazard suits when entering the kennel buildings. 101 A greyhound trainer who was leasing many of the dogs told investigators that some of the greyhounds were current racers while others were waiting to be adopted. 102 Greyhound adoption advocates have also claimed to have received neglected racing dogs. Other Issues Greyhounds have died while being transported Two greyhound haulers were suspended for 30 days and fined $500 each in 2010 after eight greyhounds died while being transported to Arizona. 104 At least some of the dogs were being sent to race at Tucson Greyhound Park. 105 The haulers claimed that they were unable to check on the dogs for part of the trip due to bad weather, but a state report of the incident found that the evidence does not support that they drove through severe rainstorms. 106 In 2005 a greyhound trainer from Tucson was fined $500 and had his state license suspended for 60 days after eight dogs died while being transported to a racetrack in Mexico. 107 As many as four greyhounds had been loaded in each crate inside the hauler, despite a state law only allowing two dogs per crate. 108 The dogs died after the hauler was delayed for more than six hours at the border due to a paperwork error. 109 Because Tucson Greyhound Park is a low-end track, many greyhounds need homes According to adoption advocates, the number of dogs seeking adoption after having raced at Tucson Greyhound Park frequently exceeds the number of available homes. Other Issues Female greyhounds at Tucson Greyhound Park are given anabolic steroids to prevent estrus At Tucson Greyhound Park, female greyhounds are given anabolic steroids to prevent estrus. Other Issues According to statements made by a greyhound trainer for Tucson Greyhound Park Kennel #4 in 2010, this meat is delivered to individual kennels by the track, costs 46 cents per pound, and the cost is deducted from the kennels purse payments. 125 This meat is being used despite the fact that it was prohibited by a local vote in Unsanitary conditions have been documented at Tucson Greyhound Park In 2008 inspectors with the Arizona Department of Racing documented unsanitary conditions inside Kennel #1 at Tucson Greyhound Park. 127 The kennel, which had recently been used to house 58 greyhounds, contained urine, blood, and fecal stains on floors and walls, filth-splattered walls, and a severe infestation of fleas. 128 The flea infestation was so severe that inspectors documented thousands of dead fleas on the floor. 129 In an official report, they also stated that when we arrived to the rear of the kennel, our shoes and pants were completely covered in fleas up to our knees, and they were still climbing. 130 When asked to comment about the Arizona Department of Racing inspection reports on Kennel #1, track CEO and General Manager Tom Taylor claimed that the kennels were so clean he could eat off their floor. 131 He refused, however, to allow a reporter to see the kennel conditions and make an independent assessment. 132 In December 2010, Taylor again refused a media request to see the kennel compound, stating: I am not going to let the press in because you are going to show it to thousands of people and we don t know how they are going to take it. 133 When he was then asked if people should be allowed to draw their own conclusions, Taylor responded by saying, No. They won t.
