A. Club Owner is the owner B. C. This Club Membership Fee Schedule affects the real property described on Exhibit 1 attached hereto and made a part hereof (the "Affected Land"). NOW, THEREFORE, Club Owner hereby declares that the Affected Land shall hereinafter be subject to this Club Membership Fee Schedule, which shall be a covenant running with the title to the Affected Land. I. Definitions. All of the initially capitalized terms not defined herein shall have the meanings assigned to such terms in the Club Plan. 2. Affected Land. It is anticipated, but not guaranteed, that the Affected Land will contain up to 2,280 Homes. The Affected Land is subject to the Club Plan. Club Membership Fees arc payable to Club Owner as provided in the Club Plan. 3. Capital Contribution. A Capital Contribution of $ per Home (or, in the case of a Builder, $ per Home that may be constructed on a Parcel) shall be paid to Club Owner as provided in the Club Plan. 4. Conflicts. In the event of any conflict between this Club Membership Fee Schedule and the Club Plan, this Club Membership Fee Schedule shall control. Club Owner may amend this Club Membership Fee Schedule at any time with respect to any portion of the Affected Land owned by Club Owner. 6. Scvcrabilitv. Invalidation of any of the provisions of this Club Membership Fee Schedule by judgment or court order shall in no way affect any other provision, and the remainder of the Club Plan and this Club Membership Fee Schedule shall remain in full force and effect. 7.
