1 2003 Racing Legislation in the States Michael Livolsi Albany Law School Class of 2006 Public Act 340 of the Alabama 2003 Regular Session. Sponsor Buskey Greyhounds put to death by lethal injection. This Act provides that greyhounds bred, trained, or raced which are put to death must be put to death by lethal injection, and may not be removed from the state for the purpose of being destroyed. Violation of this Act is a Class C misdemeanor, repeated offenses become Class A misdemeanors. This Act was effective September 1, Act 363 of the 84 th General Assembly, of the Arkansas 2003 Regular Session. Sponsor Representatives Oglesby, Bolin, Mack, L. prater, Scroggin, Sullivan: Senator Jeffress Administering substance to a horse within 24 hours of sale illegal This is an Act to amend Arkansas Code Title 5, chapter 37, subchapter 5 to make unlawful the selling of any horse or mule that has, within 24 hours prior to sale, been treated with a behavior altering substance. A buyer of such an animal may rescind the sale within 24 hours of the sale, adjusted for weekends and holidays. Violation of this provision is a class A misdemeanor. This does not apply to any horse claimed in a claiming race as a licensed racetrack if the treatment is consists only of medications that do not violate any applicable rule of the commission. Chapter 8 of the Laws of 2003 of California. Sponsor - Liu Thoroughbred assoc. authorized to conduct racing program This Act permits the California Horse Racing Board to authorize a thoroughbred association in the central zone to conduct a racing program that includes Breeders cup prep races on September 28, and includes that the program shall not be counted against any limitation otherwise applicable to the number of racing days or weeks allocated by the board. This Act, approved April 30, 2003 was effective upon approval. Chapter 24 of the Laws of 2003 of California. Sponsor Karnette 1

2 Definition of CA bred standard-bred expanded. This is an act to amend of the Business and Professions Code to include stallions registered with the California Standardbred sires stakes program in the definition of California-bred standardbred horse. This bill became effective January 1, Chapter 174 of the laws of 2003 of California. Tax on Pari-mutuel pool This is an Act to add to the Business and Professions Code. The Horse Racing Board may set the total percentage deducted from the pari-mutuel pool for any new type of wager introduced after January 1, The deduction must be between 10% and 30% of the pool, 3% of the deduction being paid to the state as a license fee, and if the wager is placed at a location other than the host racing association, 8% shall be paid to the satellite wagering facility that processed the wager. With respect to thoroughbred racing, 3% of the amount remaining after payment of state license fees and satellite fees, if any, shall be deposited with the official registering agency and distributed. The remaining amount shall be split evenly between the association conducting the racing meeting and the horsemen participating. Chapter 372 of the Laws of 2003 of California. Sponsor Ashburn Kern or Shasta counties to operate extra satellite wagering facility This is a bill to amend of the Business and Professions Code to allow any fair in Kern or Shasta counties to operate one satellite wagering facility within the boundaries of the fair, subject to approval of the Department of Food and Agriculture and the authorization of the Horse Racing Board. This bill is effective January 1, Chapter 556 of the Laws of 2003 of California. Sponsor Horton, J. Fair authorized to operate additional facility This is an Act to amend and to enact of the Business and Professions Code. The California Exposition and State Fair is authorized upon approval of the Dept. of Food and Agriculture and the Horse Racing board, to operate one satellite wagering facility in addition to any satellite facility authorized at its fairgrounds. The official registering agency is granted designate stakes races for Qualifying races in Breeder awards, and for the purpose of determining eligible earnings. The terms qualifying race and eligible earnings are expanded to include; steaks races designated by an 2

3 official registering agency and for placing first, second, or third in such a race, respectively. Chapter 64 of the Laws of 2003 of Colorado. Race track employees excluded from workers compensation An Act to amend of the Colorado Revised Statutes by adding a new subsection which, for the purposes of workers compensation, excludes from the definition of employee any person who works for more than one employer at a race meet or horse track. This Act, approved March 20, 2003, was effective upon approval. Chapter 191 of the Laws of 2003 of Colorado. Sponsor Senators Chlouber, Hillman, Kester, Tapia and Taylor; Representatives Hefley, Butcher, Fragas, Fritz, Stengel, and Vigil. Regulation of simulcasting; time, location. An Act to amend (5) (a) of Colorado Revised Statutes. In-state Simulcast facilities located on the premises of a greyhound track conducting a live race meet may receive up to seven days of simulcast during any week in which they schedule to conduct five days of live racing with at least ten races per day. Two hundred fifty out of state simulcast race days shall be equally apportioned by the commission. In-state facilities not located on the premises of greyhounds tracks conducting live race meets may only receive simulcasts of out of state greyhound races through an instate simulcast facility located on the premises of a greyhound track conducting a live race meet. If more than one greyhound track is conducting a live race meet, the simulcast must be from a track within the same circuit. Five percent of gross receipts from in state pari-mutuel wagers are put into the purse at the host track. This Act took effect June 1, Chapter 338 of the Lawsof 2003 of Colorado. Sponsor Representatives Sinclair, King, Lee, Rippy, Staffor, Frangas, Vigil, Willismas, T., and Young. Senators Johnson S. and Lamborn. Creation and management of the Racing Cash Fund. This is an Act to amend of the Colorado Revised Statutes by adding a subsection authorizing the Commission to establish and adjust annual licensing fees to be credited to the Racing Cash Fund, established in this bill. The commission authorizes annually the takeout percentage of in state racing or simulcasting facilities, not to exceed thirty percent of any in state pari-mutuel wagering. Simulcast facilities receiving out of 3

4 state races may adopt an out of sate takeout percentage although that percentage be higher than 20% of win, place, and show wagering or 25% of all other pari-mutuel wagering. Public Act 53 of the 74 th Legislature of Delaware s 142 nd General Assembly. Sponsor Gilligan Limit on video lottery machines at racetracks This Act Allows video lottery machines that require additional license or proprietary fees to be placed at racetracks so long as those machines are 5% less of video lottery machines at the licensed racetrack property, unless otherwise stipulated by the director, and permits the director to authorize 500 additional lottery machines at each racetrack, with not more than thirty video lottery machines. Chapter of the Laws of 2003 of Florida. Sponsor Robaina Payment of special awards; operation of cardrooms This is an act to amend (1) and (2). This Act provides for the payment of special racing awards for certain races and provides for the rate, procedure and eligibility requirements of such awards. Procedures for renewal of card room licenses are amended and a license fee is set. Certain guidelines for operation of a card room are laid out. Chapter 312 of the Laws of 2003 of Idaho. Sponsor Ways and Means Committee. Advance deposit wagering allowed; regulated An Act to amend of the Idaho Code to make lawful advance deposit wagering on live and simulcast horse racing. No wager can be accepted that is greater than the amount in the account held by the licensee fore person placing the wager. Advance deposit wagering conducted outside of the state electronically is illegal, unless the provider is a licensee and provides a source market fee. This act also provides for the distribution of the source market fee. This Act was effective April 23, Public Act of the 93 rd General Assembly of Illinois. 4

5 Sponsor Smith Organization of the Equine Industry Research and Promotion Board. The Equine Research and Promotion Act, as it relates to horse racing, provides that the qualified industry organization shall select 12 people to be members of the Illinois Equine Industry Research and Promotion board, and provides that the board shall be representative of the harness racing industry, and the thoroughbred racing industry. This Act fixes terms on the board, and provides for officers and budgeting. This Act approved July 10, 2003, became effective upon approval. Public Act of the 93 rd General Assembly of Illinois Sponsor - Holbrook Fixing the age of minority An Act to amend 5 of the Illinois Horse Racing Act of 1975 by defining minor as any individual under the age of 18. Previously, minor had been defined as any individual under the age of 17. This Act became effective January 1, Chapter 104 of the Laws of 2003 of Kentucky. Sponsor Nesler Allowance of Simulcasts of quarter horse racing expanded. And Act to amend KRS , KRS , and KRS Thoroughbred and Harness tracks licensed to conduct racing, and tracks licensed to conduct horse racing may receive interstate simulcasts of quarter horse races. Tracks licensed to conduct quarter horse races may receive simulcasts and conduct interstate wagering on all quarter horse races designated as graded stakes without further consent or approval. This act provides for dispersing of commissions on interstate wagering. The definition of horse race meeting is expanded to include quarter horse racing, and Kentucy Quarter Horse Purse program is defined. Act 898 of the Laws of 2003 of Louisiana. Sponsor McPherson Equine sponsors and professionals relieved from liability R.S. 9: (A)(2) and (4) are reenacted and amended and R.S. 9:2795 and are enacted. Participant s injured or killed resulting from inherent risks of equine activities have no cause of action against equine activity sponsors, professionals or other persons, 5

6 unless; such injury was caused by faulty equipment negligently provided by such persons, such persons did not make reasonable efforts to ensure the ability and safety of the participant, such person controlled the land and knew or should have known of a latent condition that caused the injury, such person was recklessly caused the injury to the participant through an act or omission, or such person intentionally injured the participant. Equine professionals and activity sponsors must post warning signs, and every contract entered into wit a professional must contain a warning notice. Act 1009 of the Laws of 2003 of Louisiana. Sponsor Strain Establishment and management of the Equine Health Studies Program Fund An Act to amend R.S. 27:392(B)(2)(b), (3)(a) and (c), and (4) through (6), and to enact R.S. 27; 392(B)(7) and (8). As pertaining to horse racing and pari-mutuel wagering, this act establishes the Equine Health Studies Program Fund which shall have credited to it seven hundred fifty thousand dollars each fiscal year, reduced on a pro rata basis, contingent upon the revenue available from the Bossier Parrish Horse Racing Facility. This Act became effective January 1, Act 1155 of the Laws o f 200 3of Louisiana. Sponsor Wooton New basis for Civil Penalties. And Act to amend and reenact R.S. 27:15(B)10, (D), and (E) and 231 (B) by providing that the Louisiana Gaming Control Board may now impose upon a casino owner a civil penalty of, up to one hundred thousand dollars, and adopt a schedule of penalties, for each violation of the Louisiana Economic Development Gaming Corporation Act and the Louisiana Pari-Mutuel Live Racing Facility Economic Redevelopment and Gaming control Act, in addition to previously defined penalties pursuant to the Louisiana Riverboat Economic Development and Gaming Control Act. Corporations must be available for public inquiry during hours of operation, although they are not required to be present. Act 1287 of the Louisiana 2003 Regular Session. Sponsor Martiny Poker prohibited at racetracks An Act to amend and reenact R.S. 27:372. The game of Poker is prohibited in eligible racetracks where slot machine gaming is conducted, with a schedule for reduction and elimination. Act 1258 of the Louisiana 2003 Regular Session.. Sponsor - Montgomery 6

7 Use of St. Landry Parish Excellence Fund This act provides for the use and expenditure of the St. Landry Parish Excellence fund, which is to be put to use in funding the enhancement and expansion of certain educational programs and schools. Act 1291 of the Laws of 2003 of Louisiana. Sponsor Martiny Exception to the device owner licensing residency requirement. An act to reenact and amend R.S. 27:317(B) and 318 (A). Owner operators of over 10 years of pari-mutuel and off track wagering facilities need not meet residency requirements for device owner licensing applications, and must pay 20% of net device revenue to supplement purses for horsemen. Chapter 31 of the Laws of 2003 of Maine. Sponsor McKenney New foals eligible as Maine Standardbreds An Act to enact 8MRSA 281-A, that makes a foal resulting from insemination during the 2003, 2004, and 2005 breeding season eligible as a Maine Standardbred, subject to certain requirements regarding the stud. This Act, approved Aril 8, 2003 was effective upon approval. Chapter 401 of the Laws of 2003 of Maine. Sponsor Lundeen commission membership and duties; rights of licensees. An Act to amend 8 MRSA 263, 264, 272, 275, 279, 283, and 285, and to repeal 272- B. The department and commission will in conjunction develop policy regarding harness racing. The commissioner shall appoint an executive director. By the is Act the responsibility for making reports regarding harness racing and OTB operations to the governor AND legislature is in the executive director, having previously been in the department. Judges appointed by the commission are considered employees of the state. Persons conducting pari-mutuel betting wishing to hold a harness horse race shall apply to the commission for a license. Licensees may, in lieu of bond provide irrevocable letter of credit, and pay up to 1.5% of all amounts generated to supplement purses. The 7

8 definition of Commercial Track is expanded to include racetracks operated by the owner of a separate race track that ceased operation, which is considered the same racetrack as that which ceased operation subject to certain conditions. Persons licensed to conduct harness horse racing may sell common pari-mutuel pools if such person is present at the racetrack where the race is conducted. For the purpose of sending notice of an application for an OTB license to commercial racetracks, The Market area is a 50 mile radius from the racetrack center along the most commonly used roadway. For the purpose of sending such notice to OTB facilities, the market area is a 35 mile radius from the OTB facility long the most commonly used roadway adjacent to the facility. Applicants for an owner s licensed must provide proof of liability insurance of at least three hundred thousand dollars. Persons denied licenses in other racing jurisdictions shall not obtain licenses in Maine until they are eligible e for licensing in the jurisdiction in question. The board and its employees are considered a state agency. Chapter 359 of the Laws of 2003 of Maryland. Sponsor Green Thoroughbred horse is the state horse. An Act to amend of the Laws of Maryland to designate that the thoroughbred horse is the state horse. This act was effective October 1, Act 22 of the Acts of 2003 of Michigan. Sponsor O Neil Enforcement of pari-mutuel tax on out of state winners And Act to amend MCL Racing meeting licensees or track licensees must withhold a tax on payoff prices on winning tickets of nonresidents reportable by the race meeting licensee or track licensee that is a result of pari-mutuel wagering at a licensed race meeting. Taxes withheld by employers casinos licensees, flow through entities, or race or track licensees race held in trust for the state, and they must provide to the department a copy of any exemption certificate on which the person with taxes withheld claims more than 9 personal or dependency exemptions, subject to other conditions. This Act, approved on June 24, 2003, takes effect immediately. Act 47 of the Acts of 2003 of Michigan. Sponsor Farrah Provisions to ensure the payment of taxes An Act requiring every employer, flow through entity, casino licensee, and race meeting licensee and track licensee to provide to each recipient of money from that entity with a 8

9 statement in duplicate of the total compensation, share of income available for distribution, winnings, or payoff on a winning ticket paid during the tax year and amount deducted or withheld, subject to certain other conditions if employment is terminated or the entity goes out of business. A duplicate statement shall be filed with the department on February 28 of the succeeding year, subject to certain other conditions should the entity go out of business. Employees, nonresident members, or persons with winnings or payoff subject to withholding must provide certain information to his or her employer, flow-through entity, casino licensee, and race meeting and track licensee, and other information regarding exemptions, residency zones, and changes in residency status. Such information must be also provided to the department. This act, approved on July 14, 2003, took immediate effect. Act 48 of the Acts of 2003 of Michigan. Sponsor Zelenko Safeguard payment of taxes And act to amend1967 PA 281. This act enables the department to ensure by certain measures to ensure that licensees required to hold taxes will pay such taxes to the state. This Act, approved on July 14, 2003, went into immediate effect. This Act, approved Jul 4, 2003 took effect upon approval. Legislative bill 243 of the 98 th legislature of Nebraska. Sponsor Janssen Disposal of funds received pursuant to fines An Act to amend of the revised statutes of 2002, requiring that all fines collected to rules of the state racing commission be disposed of according to article VIII section 5 of the constitution of Nebraska. Chapter 2 of the Laws of 2003 of Nevada. Sponsor Committee of the whole Restrictions on purchase of options. Granting options to purchase; any security issued by a corporation not publicly traded, any interest in a limited partnership, any interest in a limited liability company, which holds a state gaming license is void unless administratively approved in advance, such advance approval not to be unreasonably withheld. A finding of suitability might be necessary. The methods, process, and requirements for approval are amended and 9

10 enumerated. In order to be a gaming employee, or serve as an independent agent, employees must be registered or temporarily registered as a gaming employee. Process, methods, and requirements of registration and renewal are enumerated and amended. The Commission is empowered to adopt regulations regarding procedures of resignation and criteria for objection, and shall provide for record keeping of employees. This Bill provides for methods of objection, suspension, and reinstatement of employees and applicants for registration, and summary orders are allowed for suspension. The commission may authorize by regulation a person who owns home or antique gaming devices to sell such devices without a license. Chapter 504 of the Laws of 203 of Nevada. Sponsor Rhoads Allocation of funds gained from license fee An Act to amend NRS This Act allocates pro rata among certain counties funds gained under the license fee of NRS by persons licensed to conduct off track pari-mutuel wagering after the deduction of costs of administration, and governs the deposit and expenditure by such funds by the recipient counties. This Act clarifies that licensees may accept off track pari-mutuel wagers from other states and places outside the United States in which such wagering is legal. The Nevada Gaming Commission is given the discretion to prescribe permissible technology to ensure that wagers are not placed from states in which such wagers are illegal. The Gaming commission is given the discretion, subject to certain conditions, to exempt certain wages from license fees. This Act went into effect on July 1, Chapter 32 of the Laws of 2003 of New Jersey. Sponsor Bark Reorganization of the NJ Racing Commission An Act to amend 2 of Public Law 1940 c.17 (C.5:5-23) to reorganize the membership of the NJ racing commission, requiring knowledge of thoroughbred and standard bred horses from, and imposing residency requirements on certain commissioners, instituting political party requirements, changing certain methods of obtaining membership, and doing away with ownership requirements. Terms of office are set at six years for each commissioner, and successors shall be appointed by the governor subject to certain conditions. A task force for the study of horse racing is established. This act took effect on May 23 of Chapter 103 of the Laws of 2003 of New Jersey. Sponsor Kyrillos Disbursement of the pari-mutuel handle 10

11 An Act to amend 46 of P.L 1940, c.17 (C.5:5-66) and 7 of PL 1971, c. 137 (C.5:10-7). When the amount derived from the pari-mutuel handle is both less than and greater than one million dollars, disbursement requirements have been amended to be distributed to the Horsemen s Association in lieu of the Horsemen s benevolent association, and the amount deposited in the special trust account is raised to 1.29% under certain conditions. There will be new uses for the trust. In the case of running races the disposition of the remaining funds in the special trust account by the authority is subject to new conditions, for both deposit and expenditure. This act, approved on November 22, 2002, took effect immediately. Chapter 151 of the laws of 2003 of New Jersey. Sponsor Bark Limits on opposition to agency post termination An Act to amend, supplement and repeal P.L. 1981, c.137; P.L c.17 (C.5:5-22 et seq.), and 2 of P.L c.24 (C.5:5-43.1), respectively. The period of time after the termination of employment with the commission during which a terminated employee cannot hold an interest in or represent any licensee, permit holder or applicant thereof is decreased to two years. Chapter 455 of the Laws of 2003 of New York. Sponsor Committee on Rules Funds given to NY Bred winners in non restricted races An Act to amend 247 (2)(d) authorizing the fund to direct a portion of revenues to parimutuel races at tracks not restricted to New York-Breds, subject to the conditions that the revenues will only be used to enrich any purses awarded to New York-Breds finishing first through fifth in such non-restricted races. This act, enacted August 26, 2003, took effect immediately. Chapter 452 of Laws of 2003 of North Dakota. Sponsor Senators Heitkamp and Grindberg; Representatives R. Kelsch and Nelson Taxes on certain live race meets and pari-mutuel pools An Act to amend and reenact of the North Dakota Century Code, adjusting the tax levied for: each day of live race meet or an in state simulcast day on win, place, and show pari-mutuel pools, and for each daily double, quinella, exacta, trifecta or other wager combining two or more horses for winning payoffs. 11

12 Chapter 48 of the Laws of 2003 of Oklahoma. Sponsor Stanley of the House; Shruden of the Senate. Oklahoma allows furosemide before race time. An Act to amend 3A O.S , to permit all horses participating in a race to be administered furosemide not less than four hours prior to post time, in an amount from 150 Mgs to 250 Mgs. This Act, approved on April 7, 2003, was effective upon approval. Chapter 299 of the Laws of 2003 of Oklahoma. Sponsor Mitchell and bonny of the House; Morgan and Robinson of the Senate Budgeting of funds appropriated to the ORC. An Act to enact sections relating to making appropriations to the Horse Racing Commission, and to amend 3A O.S. 2001, From any monies not otherwise appropriated from the General Revenue Fund for the fiscal year ending June 30, 2003, a certain amount will be appropriated to the Oklahoma Horse Racing Commission. This bill budgets such funds, fixes the director s salary per anum, and sets budgetary and compensatory limitations on full-time-equivalent employees and on Oklahoma Breeding Development Revolving Fund, subject to certain exceptions. The amendatory authorizes the Commission, to provide for the administration of the Breeding Development Program, to utilize 10% of the prior years receipts, as opposed the prior 5% authorized. This act stipulates the budgeting of funds appropriated under the act. This act, approved May 29, 2003, became effective upon approval. House Bill 3646 of the 72 nd Legislative Assembly of Oregon. Sponsor House Committee on Rules and public affairs Allocation of race days An Act to amend ORS The manner in which race days are allocated is amended to prevent greyhound racing from occurring in more than seven months in a calendar year, and exempting certain race days from the 350 day limit, and subjecting them to other limits. The grant of a license to a licensee that is subject to to conduct a race met that conflicts with a race date granted to a licensee subject to ORS , unless the consent of the latter is obtained, such consent not to be unreasonably withheld. This Act, approved on September 17, 2003, was effective immediately. Bill 5540 of the 72nd Legislative Assembly of Oregon. Sponsor Courtney 12

13 Budgeting for Oregon Racing Commission An Act relating to the financial administration of the Oregon racing commission. The amount of $4,770,614 is set as the maximum limit for payment of expenses, excluding lottery funds and federal funds, collected or received by the Oregon Racing Commission. This Act took effect July 1, Chapter 444 of the Laws of 2003 of Texas. Sponsor Crownover Restrictions on how can test or treat an animal An Act amending Texas Racing Act 3.07(d),directing that testing on a race animal be conducted by the Texas Veterinary Medical Diagnostic Lab, or an alternate lab subject to conditions. The commission shall determine the reasonableness of Lab charges by surveying comparable facilities on a national scale. This Act took effect on September 1, Chapter 392 of the Laws of 2003 of Texas. Sponsor Crownover Re-organization of the Texas Racing Commission An Act to amend Texas Racing Act 2.02(a), increasing the number of appointed members of the commission from six to seven. Texas Racing Act 2.03(a) is amended to required five of the appointed members to be representatives of the general public and have a general knowledge of business, and at least one of those five may be a veterinarian, being so licensed, to satisfy the requirement of having a general business knowledge. This Act takes effect Sept 1, 2003 Chapter 852 of the Laws of 2003 of Virginia. Sponsor Wagner New use for VA Breeder s Fund Owners of Virginia bred horses that win or earn purse money in non-restricted races in Virginia, that win races at meetings designated by the commission and earn purses for races restricted to Virginia bred or sired horses or both at meetings designated by the commission will have disbursed to them by the commissions a share of the balance of the Virginia Breeders Fund. This Act approved April 4, 2002, was effective upon approval. 13

Sponsor McDougle Racing commission exempt from Government Data Collect ion An Act to amend of the Code of Virginia, to exempt from the requirements of of the Code of Virginia, for the purpose of government data collection, the personal information systems maintained by the Virginia Racing Commission. Chapter 682 of the Laws of 2003 of Virginia. Sponsor: Stolle Virginia Racing commission, scope of power broadened. This Act reenacts and amends , , and of the Code of Virginia. The VA Racing Commission is empowered to alter, beyond the year 2005, the required number of live racing days for the holder of an unlimited license, and vests the power in the commission to regulate the method of pari-mutuel wagering whereby an individual creates an account, either in person or electronically, with an approved agency to place pari-mutuel wagers. Pari-mutuel wagers are prohibited on or with any computers owned or leased by the commonwealth, a subdivision thereof, or any public school, college, or university. The commission is made responsible for ensuring that all wagering; excepting electronic methods, on simulcast horse racing shall take place only at a licensed racetrack or satellite facility. The commission may grant provisional licenses prior to, but only effective upon, approval through local referendum, local referendums now being required from towns with a population greater than 5,000. Failure to comply with these regulations is a class four felony. Chapter 722 of the Laws of 2003 of Virginia. Sponsor Suit Racing Compact given discretion over pari-mutuel wagering licenses; representation, investigative practices changed. This is an act to reenact and amend of the Code of Virginia. The definition of official is amended so as to exclude the requirement of membership on the racing commission or its equivalent. 15 Equine sponsors and professionals relieved of liability This is an Act to reenact and amend , , and of the Code of Virginia to relieve from liability any equine sponsor, professional or other person for an injury or death resulting from intrinsic dangers of equine activity and to allow for enforceable exculpatory agreements so long as they give notice of the intrinsic dangers, such agreement being valid unless revoked in writing by the participant. Liability is not relieved if faulty equipment, provided by the sponsor or professional, was the causation of the injury. The definition of engages in equine activity is expanded to include mounted and unmounted persons who handle and assist in medical treatment of the animal, not to include a spectator unless in an unauthorized area. The definition of equine activity is expanded to include hoofcare and assisting in breeding or therapeutic veterinary treatment.
