3 GENERAL RULES AND REGULATIONS Prior to entry, the owner of a horse is required to have on deposit with the Horsemen s Bookkeeper sufficient funds to cover the expense of starting that horse. No horse will be allowed to start unless this requirement is met. The owners are also requested to furnish the Horsemen s Bookkeeper with their Social Security number or equivalent. Any horse which is in a race or on the also-eligible list may not be sold or transferred until that obligation is completed, except with permission of the Board of Stewards. Trainers are advised that horses which are claimed and are back in on another race day may be required to fulfill that engagement despite the change of ownership. A horse s engagements follow the horse. No dogs will be permitted in the Stable Area or on the grounds. Allowing unlicensed personnel in the barn area will result in a fine. Trainers must have no unlicensed help in the barn area at any time. It shall be the trainer s responsibility to see that the win records are properly attached to each foal certificate. The Racing Secretary may refuse entry to any horse whose win record is missing until such time as proper determination of eligibility is made. Trainers placing horses in stalls other than those specifically assigned to them will be subject to a fine and removal of excess horses. Sunland Park Racetrack shall have the right to declare off any advertised stake or feature race which fails to satisfactorily fill. In such cases, all fees paid will be promptly refunded. The Stewards, Track Veterinarian, Racing Secretary or Director of Racing shall have the right to bar from racing, or exclude from the grounds, any horse which they deem unsafe or incapable of a respectable performance. The Racing Secretary shall have the right to choose from each days entries the races which allow him to present the best card to the public. While the Racing Secretary shall have provided every facility for the checking of eligibility and weights, owners and trainers are reminded that the responsibility in these matters lies strictly with them. Sunland Park Racetrack will provide colors for all owners who wish to use them. Should any owner wish to use stable colors, they must be registered with the Racing Secretary prior to their use. No colors will be used which do not appear on the official program. Horsemen are reminded that the final entry payment for trials must be on deposit with the Horsemen s Bookkeeper, or made at time of entry, in order for eligible horse(s) to be included in the draw for the post positions. For the safety of all, children are not permitted to ride pony horses at any time while in the stable area. Trainers are responsible for their guests. The track outriders are on duty every morning and are there for the protection of everyone. Their instructions are to be followed. Foul or

4 abusive language towards the outriders will result in a fine and/or removal of horses from grounds. No additions or improvements to the stalls or premises shall be made without prior written approval of Sunland Park Racetrack. Restrooms have been constructed in the barn area. Persons damaging or abusing these facilities will be subject to ejection and/or fine. RACING SECRETARY S OFFICE SPECIAL RULES AND REGULATIONS All foal certificates must be deposited with the Racing Secretary within seven (7) days after arrival. Foal certificates will not be accepted during entry hours, nor will transfers, bills of sale, etc., be done until after the draw. Non-tattooed foal certificates will not be accepted; trainers are advised to contact the tattooers for dates and times for tattooing. The purchase, claim or transfer of any horse stabled on the grounds whether by private sale or public auction does not guarantee the new owner a stall for such horse. Sunland Park Racetrack reserves the right to allot stalls. All horses must be completely qualified in all respects before being entered in any race. Non-compliance will result in horse(s) being denied entry and trainer subject to a fine. All parking will be in designated areas ONLY during training hours. There will be no driving through the barn area during morning workouts. WORKOUT AND QUALIFYING RULES ALL WORKOUTS MUST BE TURNED IN TO THE CLOCKERS A non-starter must have had within sixty (60) days prior to time of race (1) approved official schooling race or at least two (2) workouts recorded at a pari mutuel or commission recognized facility and posted with the racing secretary prior to time of race, one (1) of the two (2) workouts shall be from the starting gate and be gate approved. It shall be the trainer s responsibility to establish validity as to workouts and gate approvals. STARTERS Any horse which has started, but not within six (6) months, must have one (1) official workout from the starting gate or must have proof of standing the horse at least one (1) time within a sixty (60) day period. Any horse which has started, but not within sixty (60) days, must have at least one (1) workout within sixty (60) days prior to time of race. Horses that have not started within six (6) months of entry must have at least two (2) approved workouts within the sixty (60) days. Gate approvals at a licensed facility must be made by a licensed starter on a commission approved form.

Total earnings as determined by the information provided by Equibase Company, will be used in determining the order of preference of horses assigned equal weights in stakes. Preference dates will not supersede the conditions of the race (Derby eligibles preferred, high weights preferred, etc.) Horses will not be eligible to receive a date until the foal certificate is on file in the Racing Secretary s office, and will receive the date of filing. All papers received before the first day of entries will receive the same entry date. Entry dates will have preference over a running date of the same date. Trials are excluded from receiving running dates. Any horse which is scratched will keep the entry date for the race day the horse was scratched. (An exception may be made when in the opinion of the Stewards a horse would be unduly penalized). All horses placed on the Stewards, Veterinarians, Starters, Paddock or Identifiers lists will be posted on the official bulletin board and will not lose their date, but they must meet the necessary requirements for removal from a list. The Racing Secretary or Board of Stewards reserves the right to withdraw or scratch any horse, which in their opinion, will not qualify for the race in which it has been entered. Foal certificates removed from the Racing Office by the trainer for any reason will automatically cause the horse to lose its date. Also, a transfer will result in all horses in that file losing their date. When horses that leave return to Sunland Park, they will receive a new entry date which will correspond to the date of re-filing. Foal certificates sent off for correction, change of ownership, breeders stamp, etc., by the Racing Office will not constitute removal from the office and the date will not be lost. Trainers which enter two horses in the same race must prefer the horse that has the best chance of drawing into the race. In no way does the claiming, change of ownership or change of trainer affect the preference date of the horse involved.

6 SCREENING RULES: 1. Only two year olds (foals of 2017) that are registered New Mexico Bred or are nominated to a race at Sunland Park will be allowed to occupy stall space. 2. No maiden quarter horses older than four years old. No maiden thoroughbreds older than seven years old. 3. Any horse placed on the poor performance list twice during the meet will be ineligible to start and must be removed from the grounds. 4. Any horse (winners) that has started for a claiming price of less than $3000 for eligibility must have finished first, second, third or fourth for $3000 claiming or higher since last starting for less than $3000 claiming. Maidens that have started for a maiden claiming price of less than $5000 for eligibility must have finished first, second, third or fourth for maiden $5000 claiming or higher since last starting for less than maiden $5000 claiming. 5. Minimum claiming price is $5,000. CLAIMING RULE A claimed horse shall not race elsewhere, except within the state, or out of state stakes races for a period of thirty (30) days or the end of the meet, what ever occurs first. If a horse is claimed, it shall not be sold or transferred, wholly or in part, except in a selling or claiming race for a period of thirty (30) days from the date of the claim, nor shall it, unless reclaimed, remain in the same stable under the control or management of its former owner or trainer for a like period. SPECIAL NOTICES The Jockey shall be required to report any claim of foul to a designated Outrider (fast official) on the backstretch immediately following the running of a race. The Outrider shall be in constant communication with the Stewards following each race and shall immediately notify the Stewards of any claim of foul by a Jockey. An Owner or Trainer may advise the Clerk of Scales whom will notify the Stewards that a discussion with their Jockey is needed before a decision concerning a claim of foul is made, in which case the Stewards shall take no official action until a reasonable opportunity for such discussion and responsibility to be aware of the means available for timely communication with the Stewards following the race. 7 SCRATCH RULE In all overnight races and overnight stake races that are restricted to fewer than twelve (12) starters, up to two also eligible horses will be drawn in order of preference as the final two post positions. No horse may be scratched from an overnight race without approval of the stewards. Scratch time is 8:30 a.m. the day before the race, except for Friday and Holiday Cards, unless otherwise announced. No horse may be scratched from a race without approval of the stewards. Horses that are physically disabled or sick shall be permitted to scratch first. Should horses representing more than eight betting interests in the daily double or exotic wagering races, or horses representing more than eight betting interests in any other overnight race, remain in after horses with physical excuses have been scratched, then owners or trainers may be permitted at scratch time to scratch horses without physical excuses down to such respective minimum numbers for such races. This privilege shall be determined by lot if an excessive number of owners or trainers wish to scratch their horses. Horses in stakes or handicaps (including trials) must scratch no later than 45 minutes prior to post time of the race. PROCEDURES FOR SCRATCHING HORSES NOT STABLED ON THE GROUNDS: Verification in writing from a veterinarian that he/she has treated or attended to the horse will be required before the horse will be scratched. The horse will automatically go on the Track Vet List. To be taken off the Track Vet List the horse must be re-examined by the attending veterinarian with written recommendation to the Track Veterinarian of when the horse will be able to race. The Track Veterinarian may have additional requirements prior to removal from the Vet List. The horse will remain on the list pending completion of these requirements. Failure to comply may result in a penalty by the Stewards. CLENBUTEROL HAS BEEN DECLARED A CLASS 3 CONTROLLED SUBSTANCE IN NEW MEXICO. HORSEMEN FOUND ILLEGALLY IN POSSESSION OF THE DRUG WILL NOW BE SUBJECT TO BEING CRIMINALLY PROSECUTED UNDER THE CONTROLLED SUBSTANCE ACT OF THE STATE OF NEW MEXICO. PLEASE NOTE RULE MEDICATION RESTRICTIONS: There is no permissible concentration of clenbuterol that is allowed to appear in any official sample. Any horse that is the subject of a positive test report from the official laboratory for a drug in one of the following categories shall be placed IMMEDIATELY on the steward s list: a. Any drug categorized by the association of the racing commissioner s international uniform classification guidelines for foreign substances and recommended penalties and model rules incorporated by reference under NMAC as a penalty class A substance; b. Any prohibited anabolic androgenic steroid or any anabolic androgenic steroid in excess of the permitted concentrations listed in Subsection H of NMAC as a penalty class A substance; c. Clenbuterol or other beta-agonist drugs with significant anabolic effects that are not currently class A drugs. d. Other drugs designed to promote growth or muscle including, but not limited to, growth hormones, somatotropins, insulin growth factors and gene modifying agents; e. Cobalt in excess of the allowable concentration specified pursuant to Subsection N of NMAC

A negative coggins certificate must be on file with all horse papers prior to the papers being submitted to the racing office. All out of state quarter horses may be required to have a negative Equine Piroplasmosis test within the past twelve months attached to a CVI issued within 30 days prior to entry into New Mexico. Quarter horses racing only in New Mexico may elect to have the Equine Piroplasmosis test conducted every twenty-four months. Please refer to Horsemen s guide for current requirements or contact the racing department at or the New Mexico Livestock Board at prior to shipping. Please check with the racing office and NMRC in regards to any changes of requirements to enter Sunland Park. 2) TOE GRABS - TB (2mm) Thoroughbred front toe grabs with a height greater than two (2) millimeters are prohibited. Any THOROUGHBRED with toe grabs higher than stated above WILL BE SCRATCHED in the Paddock prior to the race that he/she is entered to run.

9 3) TCO2 TESTING- -ALKALINIZING SUBSTANCES * NO SPLIT SAMPLES WILL BE COLLECTED FOR DETERMINATON OF TCO2 LEVELS The use of agents that elevate the horse s TCO2 above those existing naturally in the untreated horse at normal physiological concentration is prohibited. The following levels also apply to blood gas analysis: 1. The regulatory threshold for TCO2 is 37.0 millimoles per liter of plasma/serum plus the measurement uncertainty of the laboratory analyzing the sample. 2. The decision level to be used for the regulation of TCO2 is 37.0 millimoles per liter of plasma/serum plus the measurement uncertainty of the laboratory analyzing the sample. 3. Such violation is that of a penalty class B drug. 4) SAFETY HELMETS AND SAFETY VESTS Any licensee mounted on a horse or stable pony on association grounds must wear a properly fastened NMRC approved safety helmet and safety vest. 5) SAFETY REINS All horses with a jockey or exercise rider mounted that are racing, parading or warming up prior to racing; or jogging or exercising at any time must be equipped with a type of safety reins approved by the commission. Reins to be approved must originally be designed and constructed to provide reinforcement material to prevent failure due to the breakage of the rein, or breakage or inadvertent loss of the primary connection to the bit. 6) ADDITIONAL TESTING For any horse entered as a participant in a competition to be held by SPRC, said association reserves the right to set the appearance and arrival time for said horse. SPRC, further reserves the right to do additional testing on all horses at any time while they are on the grounds of SPRC, as well as any other rights said association has as a private property owner. 48 NEW MEXICO BRED INCENTIVE FUND This program will permit a horse entering an open overnight race and finishing first, second or third to receive a 20% increase of the original purse. The money generated from this program will come from the gaming portion of the overnight purses. The money also is excluded from the 10% Breeders Awards monies. The incentive money will be distributed as follows: First place will get 63% of the incentive money and the original first place purse. Second place will get 24% of the incentive money and the original second place purse. Third place will get 13% of the incentive money plus the original third place purse. Money will be wired on a bi-weekly basis and this schedule may be adjusted if necessary. All undistributed incentive money will be carried over to the next meet, if applicable. This program will be monitored by the New Mexico Horse Breeders Association and track management to ensure that this is beneficial to the Program. Reports on this program will be given at the monthly Commission meetings and any changes to the program must be approved by the Racing Commission. 51 NEW MEXICO HORSEMEN S ASSOCIATION REPRESENTING HORSEMEN RACING ACROSS NEW MEXICO The NMHA is an incorporated non-profit organization; the New Mexico Horsemen s Association was formed in 1966 for the purpose of promoting the welfare and health of licensed owners, trainers, and grooms connected with horse racing in New Mexico. NMHA FUNDING: The NMHA receives one percent of all purse monies and $5.00 starter fee, except for monies from nomination fees which are owner generated. New Mexico is the only state, which has 50% of net retainage going to purse structure, as mandated by state statue. The Association keeps daily records of handle and amounts to be distributed to purses at each track. Gaming monies are all kept in separate bank accounts for each track, with the Breeders portion wire transferred to them weekly and the balance going back to track purses as needed. Complete records are kept and furnished to the Racing Commission. Money from gaming has increased purses significantly. ACTIVITIES AND ACCOMPLISHMENTS The NMHA was successful in getting legislation mandated where ½ of one percent wagered on simulcast goes to the Association at the track where it was generated; to be used for medical benefits for owners, trainers, and back-side personnel. The NMHA medical benefits are one reason the state has not imposed Workmen s compensation on owners and trainers in the state, saving them approximately $20 million in the past 18 years. (In California, this fee paid by trainers, amounts to approximately 46 percent of the employee s weekly salary.) The NMHA was instrumental in getting laws exempting owners and trainers from gross receipts tax. Each year the NMHA lobbyist in Santa Fe tracks all legislative bills which could impact racing. The NMHA assisted in getting the gaming bill passed in the 1997 legislative session. The NMHA, through mediation, has agreed with track managements that they will no longer take 5 percent simulcast expense adjustment fee, but will settle on a flat cash fee for their expenses for out-of-state simulcast wagering, which means less money taken away from purses. The NMHA has representation at all New Mexico State Racing Commission meetings to address the concerns of horsemen.
