14 RACE SCHEDULE & CONDITIONS 1st Stage Pre-Entry Procedures, Closing Noon, October 23 Pre-Entry of Championships Breeders Cup Limited (BCL) reserves the right to refuse the pre-entry or subsequent entry of any horse, in BCL s sole discretion, for any reason, including, but not limited to, situations where any connection (e.g., owner, trainer, jockey) of such horse has engaged or may have engaged in conduct, or become the subject of a regulatory or law enforcement inquiry or action alleging conduct that is unlawful, unethical or which may otherwise compromise the integrity of the Breeders Cup World Championships. In addition, BCL may, in BCL s sole discretion, refuse the pre-entry or subsequent entry of any horse that has tested positive for any anabolic steroid or other ARCI prohibited substance in out of competition testing conducted in connection with BCL s Breeders Cup Challenge Series in the year of the Championships or similar testing conducted by Breeders Cup Limited. *See BC Condition of Entry (page 16). Pre-Entry Fee Requirements In order to be eligible for entry in the Breeders Cup World Championships, horses must pre-enter by 12 noon (local time at designated place of pre-entry) on Monday, October 23, A maximum of two races can be designated at the time of pre-entry. Pre-entry must be accompanied by payment of all applicable fees. All horses must be nominated to the Breeders Cup in order to participate. Non-nominated race horses may be nominated on or before the pre-entry deadline. For more information, see page 15 of this guide. 16 RACE SCHEDULE & CONDITIONS Non-Nominated Horses Horses of Racing Age Nomination Horses of Racing Age that in their year of conception were sired by stallions properly nominated to the Breeders Cup, European Breeders Fund or BCL/EBF Common Fund programs or sired by stallions nominated to the International Stallion program in 2011, may be nominated to the Breeders Cup program by payment of a fee of $100,000 (U.S.). Nominated Horses of Racing Age are eligible during their entire racing careers for Breeders Cup World Championships races, or any other Breeders Cup purses or awards programs for which they otherwise qualify. In such cases, the person nominating the horse would be eligible to receive the foal nominator award in respect of the Horse of Racing Age. Horses of Racing Age that in their year of conception were sired by stallions that were not properly nominated to the Breeders Cup, International Stallion, European Breeders Fund or BCL/EBF Common Fund programs, may be nominated to the Breeders Cup program by payment of a fee of $200,000 (U.S.). Nominated Horses of Racing Age are eligible during their entire racing careers for Breeders Cup World Championships races, or any other Breeders Cup purses or awards programs for which they otherwise qualify. In such cases, the person nominating the horse would be eligible to receive both the foal nominator award and stallion nominator award in respect of the Horse of Racing Age. 17 RACE SCHEDULE & CONDITIONS Refund of Horses of Racing Age Nomination Horses of Racing Age nomination fees are not refundable except in the event the nominated horse is scratched after pre-entry to a Breeders Cup World Championships race in the year the horse was nominated because of sickness or disability certified by the track or state veterinarian or pursuant to veterinary certification acceptable to Breeders Cup Limited, in BCL s sole discretion, and such determination shall be final. Notwithstanding the foregoing, Horses of Racing Age nomination fees made prior to August 1, 2017 are non-refundable for any reason. Travel Awards All Championships starters that are based outside of California will receive a $10,000 (US) travel award if stabled at a North American location or a $40,000 (US) travel award from outside of North America. Any determination of eligibility for receipt of travel awards shall be made by BCL in its sole discretion and such determination shall be final. After starting, the travel award will be deposited in the owner s horsemen s account at Del Mar. Breeders Cup Condition of Entry As a condition of entry for any BCWC race, no horse within six months of the BCWC shall test positive for any anabolic steroid or any other prohibited substance described under the ARCI prohibited substance list. Any horse testing positive for anabolic steroids or other ARCI prohibited substances in a BCL out-of-competition test sample during the six-months prior to the BCWC will be ineligible to participate in BCWC. Breeders Cup Out of Competition Testing Breeders Cup Limited will be conducting out of competition (OOC) testing on all 2017 Challenge winners and any other possible starters prior to the Breeders Cup World Championships. This testing is separate from what the California Horse Racing Board may perform. The Breeders Cup OOC testing will be performed by the The Kenneth L. Maddy Equine Analytical Chemistry Laboratory at UC Davis. Routine testing at the Maddy Lab meets or exceeds the protocols established by TOBA and required by Breeders Cup World Championships to ensure that the highest possible level of testing is performed on all samples. The primary focus of OOC testing for the Breeders Cup World Championships will be for Epogen, darb- EPO, and other blood doping agents including certain animal venoms, growth hormone and the beta-2 agonists ractopamine and zilpaterol, anabolic steroids and any other drugs or medications prohibited by CHRB regulations. Out of competition testing may be conducted at any time. Racing officials from other state jurisdictions and internationally will be asked to assist BCL in obtaining blood samples for OOC testing. Horses must be timely produced for testing if requested. A horse may be prevented from entering unless the owner and trainer comply with any pre-race testing request. Final Stage Entry Procedures, closing 10 am, October 30 Entries for all Breeders Cup World Championships races will close promptly at 10:00 am (PDT) on Monday, October 30, 2017, in the Breeders Cup Racing Office at Del Mar only. At the time of entry a maximum of fourteen horses and two also-eligibles may be accepted for entry in each race based on the order of preference in the rankings established at pre-entry, except for the Turf Sprint which will start twelve. A horse will be permitted to enter two Breeders Cup World Championships races under the following conditions: (i) the horse is eligible for both races; (ii) the races will be contested on different days; (iii) the pre-entry and entry fees are paid for both races; and (iv) neither race is oversubscribed. A horse may not double-enter Breeders Cup World Championships races if the effect of such double entry is to exclude another horse from competing. A horse entered in two Championships races on different days may not compete on both days. Pre-entry and entry fees will not be refunded for the race in which the owner of the double-entered horse elects not to compete. Scratch time for all Championships races to be contested on both Championships Friday and Championships Saturday will be 8:00 am (PDT) on Friday, November 3, Also-Eligible Horses There may be up to two (2) also-eligible horses for each Championships race. The also-eligible horses will be designated in accordance with the Breeders Cup Racing Directors/Secretaries Panel s order of preference for each Championships race that is oversubscribed at the time of preentry. See Field Selection System on page 32. Minimum Entry Qualifications for Breeders Cup World Championships Runners Breeders Cup World Championships Eligibility Rule: The following is for any 3-year-old and older horse that has broken its maiden. Any horse that has started for $15,000 or less and has not won for $20,000 or more in the previous two (2) years or has not finished second, third, fourth or fifth for $20,000 or more since running for $15,000 or less is not eligible to be pre-entered, to be entered or to run in a Breeders Cup World Championships race. The following is for any maiden 2-year-old or older, which has started in a Maiden Claiming race of $32,000 or less. Maidens that have started in a maiden race of $18,000 or less will not be eligible. Maidens that have started in a maiden race of $32,000 or less at ANY TIME and have not finished second, third, fourth or fifth in a maiden race greater than $18,000 within their last four starts will not be eligible. Refund of Pre-Entry or Entry Fees Pre-entry and entry fees for nominated horses are nonrefundable except in the event of sickness or disability certified by the track or state veterinarian, or by veterinary certification acceptable to Breeders Cup Limited, in BCL s sole discretion and such determination shall be final, or in the event a horse is not selected by the Racing Directors/Secretaries Panel to enter the race of first choice or in the event a horse does not draw into the body of the field at scratch time or the horse is scratched by an authorized racing official. Should a pre-entry fee be paid of greater amount than that required for a designated race, the excess balance will be refunded or may be applied to entry fee requirements for the race actually entered. (For example, if a pre-entry fee of $30,000 is paid in anticipation of entering the Breeders Cup Turf and the horse is actually entered in the Breeders Cup Mile instead requiring a $20,000 pre-entry fee then the excess $10,000 may be applied to the fees due at the time entries are taken.) All unpaid travel awards will remain the property of Breeders Cup Limited. Owner/nominator must ensure that BCL has current contact information for the owner/nominator. If BCL does not locate an owner/ nominator for the payment of an award and the owner/nominator does not claim the award within three (3) years from the date of the race upon which the award was determined, the owner/nominator forfeits all claims to the award and it reverts to BCL. Purse distributions noted on race conditions apply to races with five (5) or more starters. Nominator Awards Horses that finish first through fourth in any Breeders Cup World Championships race will earn a foal nominator award and it will be paid to the person who nominated the horse. A stallion nominator award will be paid to the person who nominated the sire of the horse to Breeders Cup. Stallion nominator awards will not be paid to EBF nominated stallions who are not BCL nominated. Stallion nominator awards will be paid to nominators under the International Breeders Cup program in accordance with the rules of that program and a copy of these rules may be obtained by calling Breeders Cup Limited at (859) The announced guaranteed purse of each Breeders Cup World Championships race will not be increased by pre-entry or entry fees collected prior to race day. 33 RACE SCHEDULE & CONDITIONS Breeders Cup Field Selection System (For Races That Oversubscribe) A maximum of 14 starters are allowed in each of the 13 Breeders Cup World Championships races with the exception of the Turf Sprint which will start twelve. Breeders Cup Limited has adopted a field selection system to select runners in the event fields are oversubscribed. This system ranks horses in order of preference based upon (i) wins in Breeders Cup Challenge races, (ii) a point system and (iii) the judgment of a panel of racing experts. The first two criteria will assign a maximum of seven horses (or all Challenge winners) for fields limited to 14 starters and a maximum of six horses (or all Challenge winners) for fields limited to twelve starters. The field selection system will be implemented, as necessary, following the taking of pre-entries on October 23, 2017 to officially rank the oversubscribed fields. The Racing Directors/Secretaries Panel (the Panel ) will rank all the horses pre-entered in the oversubscribed races as described below. After pre-entry, any vacancies in the fields will be filled by horses in order of panel preference. Breeders Cup Graded Stakes Points Specific point values are assigned to first-, second- and third-place finishes in stakes throughout the United States and/or Canada from January 1 through the pre-entry deadline date of October 23, 2017 that have been granted graded status by the American Graded Stakes Committee of the Thoroughbred Owners and Breeders Association and/or by the Jockey Club of Canada. International Group races outside of the U.S. and Canada have no point value. Based on this system, win, place and show horses in Grade I stakes earn ten, six and four points, respectively. The top three finishers in Grade II stakes earn six, four and two points, respectively, and in Grade III races the points earned are four, two and one, respectively. Breeders Cup Graded Stakes Points Win Place Show Grade I Grade II Grade III Except for the four two-year-old Championships races, Graded Stakes points for dirt races will be the only points considered for horses pre-entered in dirt Championships races and Graded Stakes points for turf races will be the only points considered for horses pre-entered in Turf Championships races. All Graded Stakes points will be considered for the four two-year-old Championships races. 34 RACE SCHEDULE & CONDITIONS Selection Procedures In the case of an oversubscribed 14- or 12- horse field, the first horse(s) selected will be the winner(s) of Breeders Cup Challenge races in the corresponding Breeders Cup division. If there are less than seven Challenge winners, the next horses will be ranked at pre-entry based on the total number of Graded Stakes points they have collected during the year until a maximum of seven or six horses have been ranked based on Breeders Cup Challenge races and Graded Stakes points. All horses will need to accumulate a minimum of six (6) points in American and/or Canadian Graded Stakes races to be considered to receive an automatic selection on points in any Championships race with the exception of the four Juvenile races. In the four Juvenile races, horses will need to accumulate a minimum of four (4) points in American and/or Canadian Graded Stakes races to be considered to receive an automatic selection on points. The horses remaining after the first seven or six (or all Challenge winners, whichever is greater) in oversubscribed fourteen or twelve horse fields at the time of pre-entry will be ranked in order of preference by the Panel. The Panel will be free to establish its own criteria or ranking so that highquality horses of demonstrated ability will have the opportunity to participate in Championships races regardless of earlier participation in graded events. Horses will be allowed to pre-enter a maximum of two races. The races in which the horse preenters must be designated in order of choice at the time of pre-entry on October 23, Performance in Breeders Cup Challenge races and points earned in American Graded Stakes races and/ or Canadian Graded Stakes races have no bearing on a given Championships race field unless the race is oversubscribed (more than fourteen or twelve pre-entered). Once a horse has been ranked among the first 14- or 12-horses in its race of first choice at preentry, its ranking in its race of second choice will be based first on whether it won a Breeders Cup Challenge race in the division of the second choice and then on the judgment of the Panel regardless of the number of points earned in American and/or Canadian Graded Stakes races. If a horse is not ranked among the first fourteen or twelve horses in its race of first choice and it did not win a Challenge race in its division of second choice, then its points earned in American and/or Canadian Graded Stakes races will be utilized for ranking in its race of second choice. Ties at Pre-Entry In the event more than fourteen or twelve horses are pre-entered in a particular Championships race and two or more horses are tied for the seventh or sixth highest number of American and/or Canadian Graded Stakes races points at the time of pre-entry, the Panel shall decide in its sole discretion which of those horses shall be the seventh or sixth highest point earner. Horses not selected shall then be ranked in order of preference by the Panel at its discretion. Pre-Entry Rankings The Panel will issue a list of all horses ranked in order of preference for each Championships race that is oversubscribed at the time of pre-entry. After pre-entry, any vacancies in the fields of oversubscribed races will be filled by horses in the Panel s order of preference as determined at pre-entry. members.breederscup.com 33

35 PAYMASTER OF PURSES Paymaster of Purses The Paymaster of Purses office will be open from 9:00 am until after the last race on racing days to transact business with horsemen. The office is located near the Del Mar Frontside Racing office. Contact Bridget Crawford, (858) or No purse money for any Breeders Cup World Championships races will be released until cleared by the CHRB after all post-race testing is complete. Any test results that result in a positive for non-permitted substances will cause purse distribution to be placed on hold for the affected race. The Paymaster of Purses will deduct from the owner s account and deposit into the trainer s account 10 percent (10%) of the purse earned on any horse that finishes first, second or third, subject to an opt-out provision made by the owner prior to the race. Purse earned means all amounts earned (excluding any applicable travel awards) less any nomination, entry or start fees paid by the owner. All owners have the right to opt out of this program if they so choose. To do so, file CHRB Form 134 located on page 114 of this Horsemen s Information Guide with the Paymaster of Purses at Del Mar. This form may be faxed to the Paymaster at Del Mar, fax (858) or by bridget@dmtc.com. Please note that if you file a CHRB Form 134 to opt out of this automatic payment, (a) it will apply to all horses you own any part of, (b) it will be binding on all partners on those horses, (c) it will apply to all trainers you employ and (d) it will remain in force until you submit a written revocation to the Paymaster at the race meeting where the form was submitted. Owners and trainers are required to file their complete address information and U.S. Tax Reporting Number. Owners must deposit jockey fees and all fees for stakes engagements prior to post-time of their race. In the event the parties reach an agreement with respect to the fee paid to the jockey, said agreement or contract must be signed by all parties and delivered to the Paymaster of Purses prior to the running of the race in question. If no contract or written agreement is submitted prior to the race in question, the Paymaster of Purses shall debit the owner s account in accordance with the fee scale set forth in Section 1632 of the Rules and Regulations of the California Horse Racing Board. 36 PAYMASTER OF PURSES Note United States Non-Residents - The Internal Revenue Service requires that the racetrack withhold 30 percent on any gross purse earnings or travel awards to a non-resident of the United States in the absence of a Form W8BEN or W8ECI placed on file with the Paymaster of Purses. Forms are available through the Del Mar Paymaster, Breeders Cup Limited or the International Racing Bureau. Signed W-9 Forms must be in the office of the Paymaster of Purses prior to any purse money being distributed. If no form is present, 30 percent of the purse will be held until the form is completed. Non-California resident owners, trainers and jockeys will have seven percent of all purse money deducted for State of California taxes. Attention Owners: CHRB rule Wagering on Competing Horse. No owner, authorized agent or trainer having a horse entered in a race shall wager on, or include in any wager, any other horse competing in such races to finish first regardless of whether such wagers are exotic or conventional. No employee or representative of any owner, authorized agent or trainer having a horse entered in a race shall wager on, or include in any wager, any other horse competing in such race to finish first regardless of whether such wagers are exotic or conventional. Amendment to Rule 1467, Paymaster of Purses The amendment which became effective May 8, 2008, requires the Paymaster of Purses to deduct 0.3 percent of the net purse earned by any thoroughbred horse at a thoroughbred racing association or racing fair for deposit into the California Retirement Management Account (CARMA). A horse owner may opt-out of the CARMA deduction by submitting a form CHRB-206 Notification of Exclusion of CARMA contribution. (Form is located on page 115 of this guide.) With 81 races selected worldwide in every Championships division, owning a Breeders Cup nominated runner is more important than ever. In 2017, any nominated horse that wins a Challenge race will receive: An automatic starting position in the corresponding Championships race. Pre-entry and entry fees paid. A nominator award of $10,000 to the person nominating the foal or Horse of Racing Age. All Championships starters will receive: A travel allowance of $10,000 for North American runners and $40,000 for international runners when they start in the Breeders Cup World Championships will be awarded (if stabled outside of California). Breeders Cup Challenge Series: Win and You re In, presented by Lane s End Farm and America s Best Racing on NBC Sports This year s Breeders Cup Challenge Series, now in its fourth year on NBC and NBCSN, features a schedule of 11 live programs featuring 17 qualifying races and other major stakes on the road to the Breeders Cup World Championships. Del Mar is the home of this year s Breeders Cup World Championships, November 3-4, which will also be televised live by the NBC Sports Group. Breeders Cup World Championships offer 13 Championships races and $28 Million in purses and awards each year. When combined with the Challenge program benefits, it makes nearly $30 Million in purses and awards available for Breeders Cup nominated horses each year. All horses must be nominated in order to compete in the Championships. In the event a designated Breeders Cup Challenge turf race (Turf Sprint, Juvenile Turf, Juvenile Fillies Turf, Filly and Mare Turf Division, Turf Division or Mile Division) is taken off the turf, due to unsafe racing conditions, the horse that wins the off the turf race will NOT receive an automatic qualifying position and will NOT receive the starting fees (the total of pre-entry and entry fees) to enter the Breeders Cup World Championships in the applicable Turf Division race; provided, however, that Breeders Cup Limited may, at its option, reinstate the Win and You re In status of the off the turf race. The decision to take a Breeders Cup Challenge Division turf race off the turf course is under the sole discretion of the racetrack/racing association, not Breeders Cup Limited. All Challenge winners are subject to out-of-competition testing. All runners are subject to outof-competition testing by the CHRB and/or BCL. See rules on pages 83 and 84. No runners may compete if they have tested positive for anabolic steroids or other ARCI prohibited substances in the six months prior to the BCWC. 41 PARTICIPANT INFORMATION Step-by-Step Guide For Participants on Arrival at Del Mar Note Please provide the following information to Breeders Cup Limited and the Racing Secretary at Del Mar prior to your arrival. 1. To the Del Mar Racing Office: a. Foal certificate to be placed on file in the Del Mar Racing Office with the Horse Identifier showing complete and correct ownership no later than 48 hours after the arrival of the horse. b. Trainers complete and sign the Del Mar stall application form and return with complete list of owners and badge applicants before credentials can be issued. Ticket Distribution Horsemen s tickets may be picked up at the Breeders Cup Ticketing and Horsemen s Relations Office (859) located near the West End of the Grandstand at Del Mar Racetrack in Mission Tower (see map on page 123), beginning Wednesday, November 1, at 7:00 am, unless alternate arrangements are made. Participant Seating (see seating map on page 122) Friday, November 3 and Saturday, November 4: The day your horse competes you receive complimentary seating as described below. The balance of your seating request will be charged at the face value of the ticket. Participating Owners (a partnership, co-ownership or syndicate is considered one owner) may request six (6) complimentary seats per horse for the day the horse(s) compete(s). Owners have the option to purchase additional seats for both Championships Friday and Saturday based on availability. Every effort will be made to place complimentary and purchased seats together but it is not guaranteed. Participating Trainers may request up to two (2) complimentary seats per horse for the day the horse(s) compete(s) (up to a maximum of six (6) complimentary seats per day). 47 LICENSING/INSURANCE Important California Horse Racing Board Requirements and Pertinent Regulations The following guidelines are designed to help expedite your licensing and registration procedures on arrival in California. For a complete set of California Horse Racing Board Rules and Regulations, prior to October 25, contact the CHRB office at (626) , ext Internet: Licenses Owner and Employee Licensing All owners, trainers, jockeys, grooms and others acting in any capacity within the stable area, or anywhere at Del Mar, are required to procure the appropriate license or licenses and pay the fees required. All new applicants must be fingerprinted and photographed before licenses can be formally issued. Application can be in person, by mail, on-line and by fax. All licenses are issued at the office of the California Horse Racing Board (CHRB), located near the Stable Gate (3) (see stable area map on page 124), at Del Mar. Beginning October 25, the licensing office will be open Wednesday through Sunday, 8:00 am to 3:30 pm. daily. During Breeders Cup week the office will be open Monday, October 30 through Friday, November 3, 7:30 am to 4:30 pm. On Saturday, November 5, hours revert back to 8:00 am to 3:30 pm. If the legal owner of a horse is a corporation, the corporation shall appoint a responsible managing employee who may be granted a license as a horse owner. Said managing employee accepts and assumes all responsibilities of an owner. All general partners are required to be licensed, irrespective of the percentage of partnership held. Two Fingerprint Cards Every applicant for an original license shall provide two (2) complete sets of fingerprints on regulation forms. If you are renewing a current California license under normal circumstances, you will not need to resubmit fingerprint cards. The fingerprint requirement will be waived for an owner s license if the applicant holds an owner s license in good standing from a racing jurisdiction that requires fingerprints. If so, a fingerprint affidavit form CHRB-118 must be submitted. Special Consideration will be given to applicants for a temporary license to allow their horse(s) to run. These persons will have forty-five (45) days to submit all the required documents necessary to complete their applications. If the documents, including complete fingerprint cards, are not received during that 45-day period, their license will be terminated and no additional licenses will be issued until all the documents are received. If an individual had a temporary license in California in the past and did not complete the documentation, completed information including fingerprints must be submitted now. C. 49 LICENSING/INSURANCE Validation All licenses must be validated for the meet in the Del Mar Stable Office. All trainer licenses must be approved and signed by the Racing Secretary, State Veterinarian and Stewards. All assistant trainer and jockey licenses must be approved and signed by the Stewards. Insurance The California Horse Racing Board (CHRB) requires that a signed, written binder of Workers Compensation or a Certificate of Insurance verifying proper coverage be in its file before a trainer s, owner s and/or stable employee s license can be issued or a horse permitted to start. Important: This process for Worker s Compensation Insurance takes time to complete. Please begin your application at least three weeks prior to your arrival. All out-of-state policies must state covers all racing operations in California. If an international trainer has a policy in America that states this, they are covered. To be accepted all certificates must have the following racing codes: Racing Operations 8631, Jockeys There will be no exceptions. Non-compliance with the insurance requirement will result in the horse being scratched. No licenses will be issued without proof of insurance. Ownership Disclosure Licensed owners and licensed trainers shall be held jointly responsible for making full disclosure of the entire ownership of each horse in their care. Every certificate of registration or eligibility certificate filed with the association and its Racing Secretary to establish the eligibility of a horse to be entered for any race shall accurately reflect the correct and true ownership of such horse, and the name of the owner that is printed on the official program for such horse shall conform to the ownership as declared on the certificate of registration or eligibility certificate unless a stable name has been registered for such owner or ownership with the CHRB. Both seller and purchaser, or their agents or representatives, of a horse that is sold while within the enclosure of a racing association shall immediately notify the Stewards of such sale and transfer, and the Stewards may require a declaration under oath or under penalty of perjury of the facts of such sale or transfer. The CHRB Bill of Sale form must be completed and signed off by a Steward. No trainer transfers are allowed after entry Registration of Colors All racing colors carried in races shall be registered with the Clerk of the Course, located in the stable area racing office, and authority for the use of such colors must be sanctioned by the CHRB. 51 LICENSING/INSURANCE Registration of Stable Names (a) A licensed owner may register a stable name with the CHRB by filing an application and paying the fee for such stable name. A stable name is subject to the approval of the CHRB. No person may register more than one stable name at the same time. No person may use the real name of any owner of race horses as his stable name. No stable name registration may be used for advertising purposes. A stable name which has already been registered may not be registered by another owner. (b) The granting of a stable name registration by the CHRB shall not relieve any person from his obligation to file or register a fictitious name as provided by the laws of the State of California Registration to Disclose All Partners An application to register a stable name shall disclose the real names of all partnership or ownership interests participating in the stable and the percentage of ownership interest of each, including the interest owned by any corporation, limited liability company (Corporations Code section et seq.), general partnership, limited partnership, trust, estate, person or individual Change of Stable Name Registration or Ownership of Stable (a) A stable name may be changed at any time by registering a new stable name and paying the fee as set by the CHRB. (b) A stable name registration may be abandoned, or an expired stable name registration may be transferred to a new owner by giving written notice to the CHRB and to the Stewards. A stable name registration that has expired and has remained unregistered for at least three consecutive years shall be considered abandoned. (c) Any change in ownership, in whole or in part, of a currently registered stable name shall be immediately reported in writing to the CHRB and to the Stewards. If the stable consists of multiple owners, the notification must be signed by at least the designated person responsible for the stable s conduct as listed on the stable name registration form and the person whose name is being removed or added. A signature must be notarized if the person who signs is not present when the notification is presented to the CHRB Limitation of Use of Stable Name No owner may use his real name for racing purposes if he has a registered stable name, except with approval of the Stewards or the CHRB. 50 members.breederscup.com

Trainers are to submit a badge list of his/her owners to the CHRB and the Racing Secretary s Office. Mersant International, Ltd Rockaway Blvd. Jamaica, NY U.S.A. International Air Transportation Breeders Cup Limited in conjunction with Mersant International will help coordinate flight arrangements for horses pre-entered in the Championships. The aircraft will likely depart Saturday, October 28, from a city to be determined, depending on the location of the participants, and will arrive in California that evening at San Diego International Airport, which is approximately 30 minutes from Del Mar. After the mandatory 42 hours quarantine, the horses will be able to train Tuesday, October 31. Breeders Cup will provide a travel award of $40,000 (US) for each starter that travels to California to compete in a Breeders Cup World Championships race from a location outside of North America. This award will be distributed when purses are approved for payment and will be deposited into the owner s account at Del Mar. Horses pre-entered in a Breeders Cup World Championships race have first preference on the arranged flights over horses on the also-eligible list or horses nominated for undercard stakes at the host track. Due to space limitations on the arranged flights, trainers are not guaranteed passage for any grooms regardless of the numbers of runners. Professional grooms will accompany the runners. 56 INTERNATIONAL RUNNERS All required testing procedures will be expedited but horses will not be able to clear quarantine before 42 hours after arrival at the quarantine facility. The quarantine facility contains a walking area satisfactory for horses to utilize prior to being released from quarantine. After negative test results are received and a mandatory 42 hours have passed, the horses will remain in barns EE, FF & GG, which will then be dedicated as the isolation barns for purposes of permitting horses released from quarantine to meet re-entry requirements into their respective countries. All horses arriving on any chartered or commercial aircraft must be pre-blood tested for all United States import requirements at the National Veterinary Services Laboratories (NVSL) in Ames, Iowa prior to departure in order to be permitted access to the quarantine barns at Del Mar. Only those horses pre-entered in one of the Breeders Cup World Championships races or nominated for Del Mar s additional stakes races will be permitted in the quarantine barn. In addition, only those horses traveling with a groom will be permitted in the quarantine barn. Breeders Cup Limited and/or Del Mar Thoroughbred Club reserve the right, in their sole discretion, to refuse the shipping and/or entry of any horse into the private quarantine barns at Del Mar. Since the quarantine barns are established on a temporary basis and contain only five units, specific shipping dates will be established. 58 INTERNATIONAL RUNNERS Imported Horses Workout Requirement Any horse imported from a country that has no provisions for timed workouts and is entered in a stakes within 7 days of clearing USDA quarantine and runs within 9 days will not be required to have a published workout if they have not started in the past 30 days. Safety vests and helmets are required for all jockeys, trainers, exercise riders and pony persons while riding or exercising horses. Paddock Schooling There will be two schooling days during racing, Wednesday, November 1 and Thursday, November 2. Breeders Cup will implement a ranking system to award schooling spots during live racing. Breeders Cup Championships starters receive preference. During training hours, the paddock will be open every morning. 71 STABLING & TRAINING Stalls/Stabling Breeders Cup World Championships horses will be stabled in designated Breeders Cup barns throughout the stable area of Del Mar. Please contact Steve Hargrave, BC Stable Superintendent, (502) , at your earliest convenience for stall locations. A complete list will be available in the Breeders Cup Racing Office. The USDA Quarantine/Isolation facility will be barns EE, FF & GG. Stable Personnel Tack rooms, sleeping accommodations and bathroom facilities are available within the Del Mar barn area. Requests for stabling and accommodations for stable personnel should be made to Steve Hargrave, BC Stable Superintendent, (502) , as early as possible. Stable Equipment Horsemen shipping to Del Mar are reminded that they must provide stable equipment and utensils, including webbing, buckets, feed tubs, hay nets, pitchforks, screweyes, etc. Notice of Arrival At least 48 hours prior to arrival, horsemen shipping in to Del Mar should advise Steve Hargrave, BC Stable Superintendent, (502) , of estimated time of arrival and any requirements concerning special bedding, feed or bottled water, which he will arrange. Coggins (EIA) Test All horses originating from outside of California that will be stabled or intend to run at Del Mar will have to show evidence that they were tested for swamp fever (equine infectious anemia) using the Coggins test and found to be negative. This Coggins test will be valid for a twelve-month period. All Coggins certificates MUST be on file in the Del Mar Racing Office prior to the time of entry and shall remain valid through the running of the race. Horse Identification Foal certificates must be on file in the Del Mar Racing Office prior to entry time. Foal certificates must bear the names of the current owner(s). 72 STABLING & TRAINING 72 Hour Ship In Requirements All horses who have drawn into the body of a Friday Championships race must be on the grounds of Del Mar by 11:00 am (PDT), Tuesday, October 31, 72 hours prior to first post. All horses who have drawn into the body of a Saturday Championships race must be on the grounds of Del Mar by 10:00 am (PDT), Wednesday, November 1, 72 hours prior to first post. All also-eligibles for Friday or Saturday Championships races should be on the grounds by noon (PDT), Thursday, November 2, and will be subject to surveillance prior to arrival at Del Mar. Training Schedules The Del Mar barn area will open on Sunday, October 22 and training will begin on Monday, October 23. Main Track (during Breeders Cup World Championships week) The main track will be open for training each morning from 5:30 am to 9:30 am. The main track will break at 7:15 am each morning, with the exception of Friday, November 3, and Saturday, November 4. Training hours for the main track for Friday, November 3, will be 4:45 am to 6:45 am and Saturday, November 4, weather permitting, will be 4:45 am to 6:45 am. Horses galloping on the track at less than a two-minute gallop will be required to stay 25 feet from the inside rail. The outrider will give instructions as to the proper lane of traffic for entering and exiting the track. There will be outriders on the track every day to provide assistance; if at any time they can be of assistance, do not hesitate to call them. Please follow orders and directions of the outriders. Anyone observed to be excessively using their riding crop will be referred to the Board of Stewards for possible disciplinary action. Paramedic services will be parked at the 7/8s gap every day and at the 1/2 mile gap on the backside. Horse Ambulance will be parked in the maintenance yard near the 3/8s pole. Turf Course (during Breeders Cup World Championships week) The turf course will be open daily from 7:15 am to 7:45 am and again at 9:30 am during Breeders Cup World Championships week for training only for horses pre-entered in one of the six Breeders Cup turf events and Del Mar turf stakes. Trainers of all horses so qualified must request their slips from the Breeders Cup Racing Office, Del Mar Racing Secretary or the International members.breederscup.com 71

73 STABLING & TRAINING Racing Bureau. TURF SLIPS MUST BE REQUESTED 24 HOURS IN ADVANCE. Horses enter the turf course just past the finish line on the main track. On Friday, November 3, the turf course will be open from 6:45 am to 7:15 am only to Breeders Cup entrants. Shoe Policy Turf Only Queen s Plate or Queen s Plate XT shoes will be allowed on the front and hind. Main Track Del Mar has implemented a house rule for the Breeders Cup World Championships races regarding the following main track shoe policy: Only shoes with Toe Grabs with a height of up to 4 millimeters will be permitted on the front shoes and no protrusions greater than 5/8 inches on the rear shoes. Trainers have the option of racing their horses with or without racing plates. Any change from the previous start, which includes a trainer s decision to run with or without racing plates, must be noted at the time of entry. Workout Identification All Breeders Cup World Championships horses entering the track for training shall be identified by name, type of workout, distance, name of trainer and shall wear the Breeders Cup-provided saddle towels. Failure to report this information to the gap attendant will be referred to the Stewards. Breeders Cup World Championships horses are required to wear their personalized workout towels when training with no exceptions. Trainers who fail to send their runner to the track in the Breeders Cup-provided workout towel will forfeit their complimentary seating on the days of the Championships. Workout Requirements A horse that has not started in the past thirty (30) days shall not be permitted to start unless it has at least one (1) published workout within thirty (30) days of the race at a distance satisfactory to the Stewards of the meeting. Any horse imported from a country that has no provisions for timed workouts and is entered in a stakes within 7 days of clearing USDA quarantine and runs within 9 days will not be required to have a published workout if they have not started in the past 30 days. 72 members.breederscup.com

74 STABLING & TRAINING Paddock Schooling There will be two schooling days during racing, Wednesday, November 1 and Thursday, November 2. Breeders Cup will implement a ranking system to award schooling spots during live racing. Breeders Cup Championships starters receive preference. Submit your requests via to bcracing@breederscup.com or by calling the Paddock Judge, Karen Denovel at (858) by Tuesday, October 31 by Noon (PT). During training hours, the paddock will be open every morning. Horses wanting to go into the paddock after training hours will be allowed between 10:00 10:30 am daily by entering through the paddock gap. No paddock schooling on Friday, November 3, or Saturday, November 4. Starting Gate Schooling The Starter, Jay Slender, (714) , and his assistants will school every day during Breeders Cup week from 7:00 am to 9:00 am from the gate located in the quarter chute. There will be no gate schooling on Championships Friday and Championships Saturday. Prior to Breeders Cup week, gate schooling is every day from 7:30 am to 9:30 am except Tuesday. Security Security for the stable area will be provided on a 24-hour basis by Del Mar. Any special security needs should be addressed to the Breeders Cup Racing Office. Breeders Cup World Championships horses will be under Breeders Cup Equine Security Team surveillance 72 hours out from first post time on November 3-4. Stable Area Guest Pass Admittance to the stable area is restricted to owners, their guests, trainers and their employees, racing officials and the working press upon presentation of proper credentials. No visitors are permitted except with authorized passes issued by the Stable Gate Office. The Breeders Cup Racing Office will issue stable area guest passes upon request to the guests of Breeders Cup World Championships owners and trainers. Equipment Bandages Only bandages approved by the official veterinarian shall be used on a horse during a race, and all other leg coverings shall be removed as soon as the horse arrives in the saddling paddock. Safety Helmet Rule Safety Helmets Required. A racing association may not permit any person to be mounted on a horse on a racetrack unless the person is wearing a properly fastened safety helmet. members.breederscup.com 73

75 STABLING & TRAINING Safety Vest Rule Safety Vest Required (see complete rule on page 78 of this guide). (a) No jockey or apprentice jockey shall ride in a race unless wearing a safety vest, nor shall a jockey, apprentice jockey, or exercise rider, train or exercise any horse on the grounds of a racing association unless wearing a safety vest. Such safety vest shall: (1) Provide a minimum of shock absorbing protection to the upper body of a level 1 as defined by the British Equestrian Trade Association (BETA); (2) Cover the entire torso from the collar bone to a line level with the hip bone allowing a vee opening in the front neckline; (3) Weigh no more than 2 pounds. (b) The weight of a safety vest shall not be included in the weight of a jockey or apprentice jockey when weighing out or weighing in or when adding weight to make up a weight assignment. Rule1690. Prohibited Equipment. No spurs or steels, twitches, war bridles or any other appliances other than regular approved racing equipment shall be used on any horse except with express permission of the Stewards, who shall report any such permitted use to the Board with the reasons therefor. Rule Equipment Requirement. (a) No bridle shall weigh more than two (2) pounds. (b) Riding crops allowed for use in flat racing shall be unaltered from the original manufacturer; shall have shaft and flap (popper); shall weigh no more than 8 ounces and shall not be more than 30 inches in length. (1) The minimum diameter of the shaft shall be 0.5 inches, with a smooth, padded contact area that has no protrusions or raised surface. (c) The only allowed attachment to the shaft is the flap (popper), which shall not extend more than 1 inch beyond the end of the shaft. (1) The flap (popper) shall have a width of not less than 1 inch, or more than 1.5 inches; shall have a minimum length of 7 inches; and a minimum circumference of 3 inches measured around the width. The flap (popper) shall have no reinforcements or additions beyond the end of the shaft, and no binding within 7 inches of the end of the shaft. (2) The flap (popper) shall be folded over and sewn down each side. It shall have an inner layer consisting of memory foam, closed cell foam, or a similar shock-absorbing material, and an outer layer that is dark in color and made of a material that does not harden over time. (d) All riding crops are subject to inspection and approval by the Stewards. This includes administration of any substance by nebulization or other means. There are few exceptions. Only water may be administered on race day to wash a horse s mouth. Throat flushes, no matter how innocuous their ingredients are not excepted. This includes old-time remedies containing menthol, oil of wintergreen, oil of eucalyptus, camphor or any similar products, natural or otherwise, including peppermint. 77 RACE DAY PROCEDURES Race Day Assembly Barn Policy In order to expedite the transit of horses from the barn area to the paddock for saddling and to draw blood for TCO2 testing, the California Horse Racing Board requires that all horses report 45 minutes prior to post in the Assembly Barn (Barn Z). Upon arrival at the Assembly Barn, the horse identifier will verify each horse s identity and the association farrier will examine each horse s shoes and the CHRB veterinarian will supervise the blood draw for TCO2 testing. At approximately 25 minutes to post, horses shall proceed to the paddock (in program number order). Change of Equipment Trainers must be consistent in the use of equipment (e.g., blinkers, screens, closed cups). Permission to change that equipment must be obtained from the Stewards and must be obtained before entry time. All equipment changes must be declared at entry. All articles of equipment in which a horse races must be in proper position when the horse leaves the paddock for the post. All horses will carry their equipment to post. Blinkers Permission for a horse to add blinkers to his equipment or to discontinue the use of them must be approved by the Starter/Paddock Judge before being granted by the Stewards. Pony Persons and Grooms All grooms and handlers should be neatly dressed when taking horses to the paddock. Jackets will be provided by the Breeders Cup Racing Office prior to the Breeders Cup World Championships and must be worn by the groom, hotwalker and exercise rider when bringing the horse to paddock on race day. Pony riders taking horses to the post in the public parade on Championships days must wear saddle towels, cap covers and jackets provided from the Breeders Cup Racing Office and must keep themselves and their mounts well-groomed and their tack clean. It is requested that pony riders wear khakis and white shirts on each Championships day. Ponies will not be allowed on the turf course. A Breeders Cup Best Turned Out Award Presented by Adequan, will be decided before each Championship race and awarded to the groom of the Best Turned Out horse prior to the running of their race. 78 RACE DAY PROCEDURES Scratches Scratch time for Breeders Cup World Championships Friday and Breeders Cup World Championships Saturday will be 8:00 am (PDT) on Friday, November 3. Please see section on Refunds of Horses of Racing Age Nominations, page 16, and refunds of pre-entry and entry fees on page 18. Pre-entry, entry and Horses of Racing Age nominations will not be refunded for the race in which the owner of a double-entered horse elects not to compete. Any horse scratched after scratch time must file, in writing, such intention with the Stewards. Upon receiving a scratch from a stakes race, the Stewards shall promptly notify the pari-mutuel manager and shall cause a public announcement of the same to be made. Paddock Passes Individual paddock passes will be required for all 13 of the Breeders Cup World Championships races. Championship Paddock passes will be issued only through the Breeders Cup Racing Office located near the west end of the Grandstand at Del Mar beginning Wednesday, November 1, 7:00 am (PDT) at (859) All persons accompanying a horse to the paddock must be issued a paddock pass. Jockeys Duty to Fulfill Engagements Every rider shall fulfill his duly scheduled riding engagements, unless excused by the Stewards. A rider shall not be required to ride a horse he believes to be unsound, nor over a racing strip he believes to be unsafe, but if the Stewards find a rider s refusal to fulfill a riding engagement is based on a personal belief unwarranted by the facts and circumstances, the rider may be subject to disciplinary action. Jockey Appearance and Attire In riding, a jockey must be neat in appearance. He or she must wear conventional attire and the racing colors of the owner for whom he or she is riding. Rule Safety Helmets Required. (a) A racing association, fair, or authorized training facility may not permit any person to be mounted on a horse on the racetrack, be mounted in or riding on a sulky, or work as a member of the gate crew unless the person is wearing a properly fastened safety helmet. (1) For purposes of this regulation, a member of the gate crew means any person licensed as an assistant starter or any person who handles a horse at the starting gate. (2) For purposes of this regulation, racetrack means the surface of the racing or training track. (b) Safety helmets required under subsection (a) of this rule shall comply with one of the following product standards: (1) American Society for Testing Materials (ASTM) standard F a, or (2) European Standard (EN) 1384:1996, or (3) members.breederscup.com 77

79 RACE DAY PROCEDURES Australian and New Zealand Racing Boards (AS/NZS) standard 3838:2006, or (4) Snell Memorial Foundation (Snell) Standard for Protective Headgear H2000. Rule Safety Vest Required. (a) No jockey or apprentice jockey shall ride in a race unless wearing a safety vest, nor shall a jockey, apprentice jockey, or exercise rider, train or exercise any horse on the grounds of a racing association, racing fair, or authorized training facility unless wearing a safety vest. (b) No driver shall be mounted in or riding on a sulky, nor shall an assistant starter handle any horse on the grounds of a racing association, racing fair, or authorized training facility unless wearing a safety vest. (c) Safety vests required to be worn in accordance with this regulation shall: (1) Provide a minimum of shock absorbing protection to the upper body, as evidenced by a label indicating that the safety vest meets one of the following standards: (A) Level 1 under the British Equestrian Trade Association (BETA) 2009 Standard for Horse Riders Body and Shoulder Protectors, or (B) American Society for Testing Materials (ASTM) standard F , or (C) Shoe and Allied Trades Research Association (SATRA) (1999) Jockey Vest Standard, Document M6 Issue 3, Australian Racing Board (ARB) 3. (2) Cover the entire torso from the collarbone to a line level with the hip bone allowing a vee opening in the front neckline; (3) Weigh no more than 2 pounds. (4) No vest shall be altered from its original manufactured design. This includes, but is not limited to: (A) Cutting the vest to customize fit. (B) Removal of manufacturer s labels. (C) Removal of protective padding. (d) The weight of a safety vest shall not be included in the weight of a jockey or apprentice jockey when weighing out or weighing in or when adding weight to make up a weight assignment. Rule Weighing Out. All jockeys taking part in a race must be weighed out by the clerk of scales no more than one hour preceding the time fixed for the race. Any overweight in excess of one pound shall be declared by the jockey to the clerk of scales, who shall have such overweight and any change to jockeys posted immediately for public information and announced over the public address system. Rule Weighing In. A jockey shall weigh in after the finish of the race and he shall not weigh less than one pound of his proper weight nor two pounds over his proper weight except that the Stewards may take into account any excess weight caused by rain or mud. The Stewards may disqualify any horse whose jockey weighs in at less than one pound of his proper weight, and shall discipline the persons responsible therefor. Rule Maximum Overweight. No horse shall carry more than two pounds overweight without consent of its owner, his agent, or his representative, but shall not carry more than seven pounds overweight in any race. 78 members.breederscup.com

80 RACE DAY PROCEDURES Rule Items Included in Weight. A jockey s weight includes his riding clothing, saddle and pad. It shall not include the jockey s safety helmet, safety vest, whip or the horse s bridle. Rule Responsibility for Weight. The trainer and owner shall be responsible for the weight carried by the horse after the jockey has been weighed out for the race by the clerk of scales. The trainer or owner may substitute a jockey when the engaged jockey reports an overweight in excess of two pounds. Rule Deposit of Jockey Fee. The minimum jockey mount fee (currently $177) for a losing mount in the race must be on deposit with the paymaster of purses, except for a jockey riding for his contract employer, prior to the time for weighing out, and failure to have such minimum fee on deposit is cause for disciplinary action and cause for the Stewards to declare the horse for which such fee is to be deposited. The association assumes the obligation to advance the minimum jockey fee to the engaged jockey in the absence of a declaration of the horse from the race, and any such advanced fee is a lien upon the horse. Rule Use of Riding Crops. (a) In all races where a jockey will not ride with a riding crop, an announcement shall be made over the public address system of such fact. (b) Although the use of a riding crop is not required, any jockey who uses a riding crop during a race is prohibited from using a riding crop: (1) on the head, flanks, or on any part of its body other than the shoulders or hind quarters; (2) during the post parade except when necessary to control the horse; (3) excessively or brutally causing welts or breaks in the skin; (4) when the horse is clearly out of the race or has obtained its maximum placing; or (5) persistently even though the horse is showing no response under the riding crop. (6) more than three times in succession without giving the horse a chance to respond before using the riding crop again. (c) Correct uses of the riding crop are: (1) showing horses the riding crop before hitting them; (2) using the riding crop in rhythm with the horse s stride; and (3) using the riding crop as an aid to maintain a horse running straight. Rule Wagering by Jockey or Driver. No jockeys or drivers shall make any wagers, or have any wagers made in their behalf, in any race in which they participate, except through the owners or trainers on the horses which they ride or drive. Any owners or trainers wagering for such jockeys or drivers shall maintain records of all such wagers and all other presents or other gratuities given any jockeys or drivers. 81 RACE DAY PROCEDURES Jockey Advertising Rule Colors, Number, and Advertising. (a) A jockey shall be properly attired for riding in a race, wearing the colors of the owner of the horse he or she is riding, and exhibiting a number on the saddlecloth that corresponds to the number of the horse on the official program. (b) Advertising, including logos, labels, or product endorsements shall be permitted on jockey attire, owner silks, and track saddlecloths from the point of weighing out for a race to weighing in after its conclusion. (c) A copy of the advertisement signage must be submitted for review, for compliance with the provisions of this rule, to the Stewards at the track where the advertisement will be worn before the horse is entered to race. (d) Advertisement on jockey clothing is limited to: (1) A maximum of 32 square inches on each thigh of the pants on the outer sides between the hip and knee and 10 square inches on the rear at the base of the spine. (2) A maximum of 24 square inches on boots and leggings on the outside of each nearest the top of the boot. (3) A maximum of 6 square inches on the front center in the neck area. (e) Advertisement on owner silks is limited to: (1) A maximum of 32 square inches on the chest area. (2) A maximum of 1.5 inches by 4 inches on each collar. 83 MEDICATION, TESTING & SAFETY Breeders Cup Prohibited Substances Rule For any horse participating in a Breeders Cup World Championships race that is found by the racing regulatory agency in the jurisdiction where the race is conducted to have tested positive for any substance listed under Class 1 or Class 2 in the Association of Racing Commissioners International Uniform Classification Guidelines for Foreign Substances or to have violated the anabolic steroid rule in effect where the race is conducted, in addition to any penalties imposed by the racing regulatory agency in the jurisdiction, the following sanctions shall be imposed: (i) the horse shall be disqualified to last in the race and any purse earned by the horse shall be forfeited and redistributed in accordance with the revised order of finish; (ii) in the event of a first violation of the prohibited substance rule in a Breeders Cup World Championships race, the horse s trainer and all horses directly or indirectly in such trainer s care shall be ineligible to participate in the Breeders Cup World Championships races conducted in the year immediately following the final determination that such trainer s horse violated the prohibited substance rule; (iii) in the event of a second violation of the prohibited substance rule by a trainer in a Breeders Cup World Championships race, the trainer and all horses directly or indirectly in such trainer s care shall be ineligible to participate in the Breeders Cup World Championships races conducted in the two years immediately following the final determination that such trainer s horse violated the prohibited substance rule a second time; (iv) in the event of a third violation of the prohibited substance rule by a trainer in a Breeders Cup World Championships race, the trainer and all horses directly or indirectly in such trainer s care shall be ineligible to participate in all Breeders Cup World Championships races conducted for the remainder of such trainer s life following the final determination that such trainer s horse violated the prohibited substance rule a third time. Convicted Trainers Rule No person may participate as a trainer of a horse pre-entered or entered in a Breeders Cup World Championships race if that person, during the twelve months preceding the World Championships, has been found by any racing regulatory agency, whether a governmental agency or a non-governmental regulatory body, to have violated a racing regulation prohibiting or involving the possession or use of any substance listed under Class 1, carrying Category A or B penalties, or Class 2, carrying a Category A penalty, in the Association of Racing Commissioners International Uniform Classification Guidelines for Foreign Substances or a racing regulation prohibiting the possession or use of steroids and the appeal periods for such finding shall have expired or all appeals, if any, will have received final disposition (a Drug Conviction ). A person associated with a trainer who has a Drug Conviction in the twelve months preceding the World Championships may not participate as a trainer of a horse that was in the care, custody and control of the convicted trainer at the time of the Drug Conviction and that is pre-entered or entered in a race during the next World Championships. 84 MEDICATION, TESTING & SAFETY was an assistant to, or employee of, the trainer or related to the trainer by blood, or by marriage or domestic partnership, or who is related by blood to the spouse or domestic partner of such trainer at the time of the Drug Conviction and has assumed the responsibility of the care, custody and control of all or any of the horses that were in the care, custody and control of the trainer at the time of the Drug Conviction. A horse that has a positive test result for any substance listed under Class 1, carrying Category A or B penalties, or Class 2, carrying a Category A penalty, in the Association of Racing Commissioners International Uniform Classification Guidelines for Foreign Substances or a racing regulation prohibiting the possession or use of steroids that leads to a Drug Conviction shall not be eligible to participate in the Breeders Cup World Championships races immediately following the Drug Conviction. In the event a trainer has two Drug Convictions after May 1, 2012, such trainer may not participate as a trainer of a horse pre-entered or entered in a World Championships race during the next two Breeders Cup World Championships following the second of the two Drug Convictions. In the event a trainer has three or more Drug Convictions after May 1, 2012, such trainer may not participate as a trainer of a horse pre-entered or entered in a World Championships race during any Breeders Cup World Championships following the date of the third Drug Conviction. Drug Testing Out of Competition Testing CHRB The CHRB conducts out of competition (OOC) testing of horses under the CHRB s jurisdiction and entered to race. The primary focus of OOC testing for the Breeders Cup World Championships will be for Epogen, darb-epo, and other blood doping agents but the CHRB may also test and prosecute for other drugs and substances including certain animal venoms, growth hormone and the beta-2 agonists ractopamine and zilpaterol under Rule 1867 and any other drugs or medications restricted by CHRB regulations including anabolic steroids. Out of competition testing may be conducted at any time. Rules 1858 and/or 1863 provide that every horse nominated, pre-entered or entered in a race is subject to testing and no owner, trainer or other person having the care of a horse shall refuse to submit it for testing when directed by the Stewards or the Official Veterinarian. Breeders Cup pre-entry is considered entry under this regulation. Racing officials from other state jurisdictions and internationally will assist the CHRB in obtaining blood samples for OOC testing. Horses must be timely produced for testing if requested. A horse is not eligible to start unless the owner and trainer comply with any pre-race testing request. A horse testing positive for Epogen, darbepo or other blood doping agents or other prohibited substance will initiate regulatory action. 85 MEDICATION, TESTING & SAFETY Breeders Cup Out of Competition Testing Breeders Cup Limited will be conducting out of competition (OOC) testing on all 2017 Challenge winners and any other possible starters prior to the Breeders Cup World Championships, this testing is separate from what the California Horse Racing Board may perform. The Breeders Cup OOC testing will be performed by the The Kenneth L. Maddy Equine Analytical Chemistry Laboratory at UC Davis. Routine testing at the Maddy Lab meets or exceeds the protocols established by TOBA and required by Breeders Cup World Championships to ensure that the highest possible level of testing is performed on all samples. The primary focus of OOC testing for the Breeders Cup World Championships will be for Epogen, darb-epo, and other blood doping agents including certain animal venoms, growth hormone and the beta-2 agonists ractopamine and zilpaterol, anabolic steroids and any other drugs or medications restricted by CHRB regulations. A horse testing positive in the six months prior to the BCWC for anabolic steroids, Epogen, darbepo or other blood doping agents or other ARCI prohibited substance will be prohibited from entering the BCWC races in the same calendar year. Breeders Cup Condition of Entry As a condition of entry for any BCWC race, no horse within six months of the BCWC shall test positive for any anabolic steroid or any other prohibited substance described under the ARCI prohibited substance list. Any horse testing positive for anabolic steroids or other ARCI prohibited substances in a BCL out-of-competition test sample during the six-months prior to the BCWC will be ineligible to participate in BCWC. CHRB Medication Rules & Regulations The Breeders Cup World Championships will be run in accordance with the rules of racing of the State of California and as promulgated by the California Horse Racing Board (CHRB). 86 MEDICATION, TESTING & SAFETY Bleeder Registration All horses must be registered with the California Horse Racing Board (CHRB) by entry time to receive Lasix even if they have run elsewhere as a bleeder. This is a required process for a horse to be treated with Lasix in California and is simply accomplished by submitting form CHRB-194 to the official veterinarian. The form CHRB-194 is available at the Receiving/Assembly Barn and on page 116 of this guide. Race Day Lasix Administration for Breeders Cup Races Bleeder medication is limited to Lasix and only Breeders Cup authorized veterinarians will be allowed to administer Lasix on race day in Breeders Cup races. The standard Lasix dose will be 5cc (250mg). The CHRB allows a single IV dose of Lasix of between 150mg (3cc) and 500mg (10cc). Trainers must consult with the Breeders Cup or CHRB racing official veterinarians concerning Lasix administration. A Breeders Cup Lasix veterinarian will be in the stable area on the Wednesday and Thursday before Breeders Cup for consultation concerning Lasix dosages. Trainers are reminded that higher Lasix dosages may affect TCO2 levels. Lasix will be administered between 4 and 4 ½ hours prior to race time. Lasix cannot be administered within 4 hours of post time. By regulation, an attendant must be present at the time the Lasix is administered. The attendant will be required to sign CHRB Bleeder Treatment form (CHRB-36) after the Lasix is administered. Horses receiving Lasix on race day are assigned to a pre-race security stall by regulation which is designated by a yellow detention stall placard available at the Assembly Barn. The CHRB detention signage for Lasix horses is in addition to the Breeders Cup signage. Race Day Bleeder Medication Administration for Non-Breeders Cup Races Non-Breeders Cup races will be run under standard CHRB policies. The attending veterinarians will be responsible for authorized bleeder medications for those races. TCO2 Testing All horses in every race will be sampled and tested for TCO2. The CHRB has a very tight regulation for TCO2. The permitted level is 37mmol/l whether a horse receives furosemide or not. All horses will be tested as they enter the Assembly Barn for their race, about 45 minutes pre-race. Exceeding 37mmol/l is a Class 3 violation requiring purse redistribution and is a Category B penalty for the trainer. While not specifically prohibited under CHRB regulations until 24 hours prior to post time, electrolytes with or without alkalizing agents-bicarbonate or otherwise, should be used with caution especially if a horse is on the bleeder s list. Regardless, electrolytes cannot be administered by nasogastric tube within 48 hours of post time of the race. Nasogastric Tubing of Electrolytes Nasogastric (tubing) administration of any substance or medication is prohibited within 48 hours of post time of the race in which a horse is entered. members.breederscup.com 85

87 MEDICATION, TESTING & SAFETY Water Only on Race Day This is a very strict and clear rule. Nothing other than water can be used to flush a horse s mouth on race day. Wind Aid, glycerin or anything other than water will result in a scratch. Horses have been scratched from Grade I events for this violation and the policy will be the same for the Breeders Cup World Championships. NSAID Medications One of three NSAIDs are allowed as long as they are administered outside of 24 hours prior to post time and do not exceed permitted threshold levels in post race testing. The permitted NSAIDs are phenylbutazone, flunixin (Banamine) or ketoprofen. Only one approved NSAID may be present in the post race blood test. Phenylbutazone cannot exceed 2micrograms/ml; flunixin cannot exceed 20 nanograms/ml and ketoprofen cannot exceed 2 nanograms/ml. For phenylbutazone, a 2gm (10 cc) dose of phenylbutazone at hours prior to racing or a 1.5gm (7 cc) at 24 hours prior to racing will avoid an inadvertent phenylbutazone violation. The RMTC recommendation for flunixin is 32 hours at a 1.1mg/kg (1 gm/10cc) to safely avoid an inadvertent violation. A 2.2mg/kg dose 100mg/ml) IV dose will not exceed the 2ng/ml threshold at 24 hours. ONLY one of these three NSAIDs can be present in the post-race blood sample. Contact your private veterinarian, CHRB official veterinarian Dr. Grande or CHRB equine medical director Dr. Arthur if you have any questions. No Medications Allowed after Entry No medication may be administered after entry except as specifically authorized in the rules and there are few exceptions. The relevant CHRB rules are 1843, 1844 & They are available at go to Horse Racing Rules. Entry for the purposes of this rule is defined as 48 hours prior to the post time of the race the horse is entered to race. Authorized (Controlled) Medications The CHRB adopted the National Uniform Medication program for therapeutic medications as of October 1, Those regulations can be found on the CHRB website ( rules_law.html; go to Rule Number ; go to > 1844). The RMTC s recommended withdrawal times for the controlled therapeutic medications is listed on page 88 of this guide and can be found at Trainers are advised to consult their veterinarians on the use of all medications or CHRB official veterinarian Dr. Grande or CHRB equine medical director Dr. Arthur if there are any questions. Prescription Medications The only prescription medications allowed at CHRB racing enclosures are prescriptions by CHRB licensed veterinarians that have been labeled according to CHRB regulations and properly reported to the official veterinarian. All other prescription drugs are contraband. 88 MEDICATION, TESTING & SAFETY Procaine Penicillin The CHRB offers free testing for procaine in horses treated with procaine penicillin and has done so for years. Any horse treated with procaine penicillin in the last 30 days should be tested. The CHRB has a provision which allows a horse treated with procaine penicillin to participate in races under certain conditions. Contact CHRB official veterinarian Dr. Grande or CHRB equine medical director Dr. Arthur if there are any questions. Geldings Even though highly unlikely in Breeders Cup races, trainers are reminded a first-time gelding must be reported to the racing office and Horse Identifier when entered. Clenbuterol California has adopted the national uniform medication program threshold for clenbuterol in urine at 140 picograms/ml as of October 1, The RMTC recommends a 14 day withdrawal time at the typical 0.8mcg/kg (5cc) twice a day oral dose of Ventipulmin. Horsemen are reminded clenbuterol is a Class 3 drug requiring a purse redistribution in the event of a violation. The CHRB offers pre-race testing for clenbuterol. There are time constraints related to this program in terms of shipping and testing the samples. Horses will be inspected on multiple occasions in the days preceding their Championships races. The cooperation of the horsemen in scheduling and having horses available and prepared (no bandages) will aid these team members in their task. 92 MEDICATION, TESTING & SAFETY Race Day Inspections The Horse Identifier and the Horseshoe Inspector shall examine each horse immediately prior to its race at the Race Day Assembly Barn (Barn Z). No horse shall be eligible to start in a race and shall be declared (scratched) by the Stewards if it is found not to be in serviceable, sound racing condition, not properly identified or improperly shod. Racing Soundness Examination On race day each horse shall be examined by a CHRB Veterinarian for racing soundness at some time during the morning. This examination will include observing the horse move at a trot. An attendant must remain with the horse until the examination has been completed. The Stewards may exclude the horse from racing if the CHRB Veterinarian finds the horse is not in serviceable, sound racing condition. Additional information regarding this exam will be provided to each trainer. Post-Race Drug Testing The Kenneth L. Maddy Equine Analytical Chemistry Laboratory at UC Davis is the official lab of the California Horse Racing Board. Routine testing at the Maddy Lab meets or exceeds the protocols established by TOBA and required by Breeders Cup World Championships to ensure that the highest possible level of post-race testing is performed on all samples. The Maddy Lab is one of 10 laboratories accredited to RMTC racing laboratory standards and the only racing lab in the US certified by the IFHA. Blood and/or urine test samples shall be taken from the first four finishers in each Breeders Cup World Championships race and any horse whose performance in a race, in the opinion of the Stewards, official veterinarian or equine medical director, warrants a post-race test. Every horse within the enclosure or entered in any race is subject to such tests, and no owner, trainer or other person having the care of a horse shall refuse to submit such horse for testing when directed by the Stewards or the Official Veterinarian. For each horse tested, one portion of the test sample, called the split sample (aka B sample), shall be preserved by the CHRB. In the event of a positive test, the split sample shall be available for testing in accordance to CHRB Rule The CHRB retains frozen official samples for up to two years for retrospective testing. 98 GENERAL INFORMATION The Breeders Cup World Championships Trophy The Breeders Cup World Championships Trophy is an authentic bronze reproduction of the original Torrie horse that was created in Florence by Giovanni da Bologna in the late 1580s. The horse is an ecorche, showing the muscles of the animal in detail. Its original purpose is unknown, though it may have been made as a study for the equestrian statue of Duke Cosimo I of Florence, cast in It reveals the influence and example of Leonardo da Vinci. The most recent monumental equestrian sculpture in Florence, before that of Duke Cosimo I, had been da Vinci s never-completed monument to Giangiacomo Trivulzio. The Torrie horse bears a close relationship to several drawings by da Vinci related to this project in the collection of Her Majesty the Queen at Windsor. Other artists, too, knew and learned from da Vinci s study of the horse, but none came so close as Giovanni da Bologna to his vision of the beauty of the animal celebrated by art and science together. The original ecorche bronze horse of Giovanni da Bologna is in the Museum of Fine Arts at the University of Edinburgh in Scotland. The Edinburgh horse was acquired by Sir James Erskine of Torrie from the Villa Mattei in Rome, probably in He bequeathed it to the University of Edinburgh with the rest of his collection of old master paintings and bronzes, and it came into the possession of the University in The Breeders Cup Trophy was cast from the original and was directly supervised and approved by the University of Edinburgh for the use of Breeders Cup Limited. The largest version of the trophy is permanently owned by the Breeders Cup and will be displayed at Del Mar this year.
