A player s level is determined by his or her previous month s wagering activity. The more the player wagers, the more points he or she earns the following month. More points are earned for wagers made on New York Thoroughbred tracks and branch self-service, internet and Touch Tone wagering. 100 points can be redeemed for $1.00 in Player Rewards. 5 BetNowNY Players Card THE BETNOWNY PLAYERS CLUB RULES PRESENTED BY NASSAU OTB ENTERTAINMENT 1. BetNowNY Players Club members must be at least twenty-one (21) years old. 2. Members must have an active Nassau OTB Permanent Wagering Account ( wagering account ). 3. There is no membership fee. 4. All members must complete a BetNowNY Players Club application form including two forms of acceptable ID consistent with Federal standards contained in OMB No (pertaining to I-9 forms). 5. Membership is limited to one Players Club account per person. Only natural persons are eligible to participate in the program. Corporations, partnerships, trusts or other legal entities are not eligible to participate and earn points. 6. Membership is non-transferable and non-assignable. 7. Players Club cards may not be shared with or loaned to another player. Wrongful use of the card through deception, sharing, or partnership will result in loss of membership in the program and accumulated points as well as the forfeiture of all Nassau OTB Permanent Wagering Account balance sums attributable to Players Club rewards and deduction of the price of all goods and services attributable to Players Club rewards from the member s Nassau OTB Permanent Wagering Account. NROTB reserves the right to close the member s wagering account and refund any remaining balance. 8. Points earned by the player are not transferable and may not be combined with other players, their estates, successors or assigns. Accrued points shall not constitute property of the player. 9. Any applicable city, state and/or federal income tax is the responsibility of the Players Club member. 10. Player s Club Cards will be accepted at all Nassau OTB branches and on all account wagering platforms. 11. Only wagers accepted by the wagering system will earn Players Club points. Any wager resulting in a pari-mutuel price of $2.10 based on $2.00 wager ($2.20 where applicable, currently Tracks in AR, MA, IA, WV ) are not eligible for reward points. Nassau OTB reserves the right not to award Players Club points for wagers that result in a minus pool. 12. A Players Club Card must be inserted into the teller or self service wagering terminal reader prior to making wagers in order to earn points for those wagers. It is the member s responsibility to ensure that the card is accepted before making a wager. If a wagering account has an associated Players Club account, wagers made from the wagering account at any wagering terminal or platform will automatically accrue points. 13. Players Club points from different cards or accounts may not be combined for rewards. Points shall only be credited and available for use in the account of the individual who placed the wagers. Under no circumstances may accrued points be sold, bartered, or pledged. 14. Players Club points may be redeemed for rewards approved by the New York State Racing and Wagering Board ( Board ). The list of approved rewards will be available for inspection at all Nassau OTB branches and online at Rewards may include funds credited to the player s Nassau OTB Permanent Wagering Account, publications and other goods and services. Applicable taxes are the responsibility of the player. 15. Photo ID (valid driver s license, state ID or passport) must be presented by the Players Club member, if requested, in order to redeem points in person. 16. Only the Players Club account holder is entitled to obtain access to their account information. Nassau OTB will not share account information with third parties other than the Board unless required to do so by statute, court order, subpoena or other legal process. 17. Before the start of the first totalisator session of each month, the system will assign each member a Player Level for the upcoming month, based on the member s previous month s wagering activity; the member s Player Level determines the level at which the Player will earn points for the upcoming month, as per the attached schedules. A new member will not earn any points during the first month in which he becomes a member as the system has not tracked any wager activity for the previous month. For purposes of this program, a month shall be defined as a calendar month and shall include all wagering for which the pool that was wagered on is official during totalisator sessions that begin during that month. 18. Points are awarded based on the Players Club member s Player Level for that month, the amount wagered, track, wager type, and the wagering terminal or platform used to place the wager, as per the attached schedules 19. Players Club points will be credited to the Players Club account no later than one hour after the pool(s) the member wagered on are official and remain in the member s account until he chooses to redeem them or they expire; the Players Club member chooses when and how many points to redeem at designated sites for reward(s) the member selects from the list of Board approved rewards; Redemption sites and the list of available rewards will be posted at all Nassau OTB branches and on Available rewards may include funds credited to the Players Club member s associated Nassau OTB Permanent Wagering Account, publications and other goods and services; Players Club points expire when no wagers have been tracked by the system for that account during any calendar year. 20. Nassau OTB reserves the right to make point and level adjustments to any account and reserves the right to make adjustments due to computer error, machine malfunction, operator error, fraud or other misuse. Notification of such action will be provided to the Board. 21. Nassau OTB reserves the right to terminate, revise, modify or withdraw the Players Club at any time with or without prior notice, with the approval of the New York State Racing and Wagering Board, even though changes may affect the value of Players Club points already accumulated. Players Club rules, reward lists and point schedules will be available for inspection at all branches and on BetNowNY Players Club reward statements will be contained in Nassau OTB wagering account annual statement. 23. Any wagering account dormant for a period of three years will be distributed as per applicable New York State law. If a Player s Club account has no qualifying activity during any calendar year then all points credited to the account will expire. Qualifying activity shall be defined as wagers tracked by the system for that Players Club account. Purchases of food, beverage or other items shall not be deemed qualifying activity. 24. Nassau OTB reserves the right to exclude or remove anyone from participation in the Players Club program for cause. Officers and employees of Nassau OTB are not eligible to be Players Club members. 25. All decisions of Nassau OTB management will be final. 26. The receipt by Nassau OTB of an application to the Players Club signifies the applicant s acceptance of all rules and conditions. 27. Reward lists may be updated periodically with the approval of the New York State and Race and will be available for inspection at all branches and on Reward lists will be filed with the Board one month before they are offered to Players Club members. 28. Nassau OTB reserves the right to offer promotions for various tracks, wager types, locations or device types as part of the BetNowNY Players Club program with the approval of the Board. ho

6 NASSAU OTB PERMANENT WAGERING ACCOUNT RULES 1. NASSAU OTB PERMANENT WAGERING ACCOUNT HOLDERS MUST BE AT LEAST TWENTY-ONE (21) YEARS OLD. 2. There is no membership fee but a $10.00 minimum initial deposit must be made in order to open an account. 3. All applicants must complete a Nassau OTB Permanent Wagering Account application form including their name, age, address, mailing address (if different), telephone number, social security number and date of birth. Two forms of acceptable identification consistent with Federal standards contained in OMB No (pertaining to I-9 forms) must be provided. The account holder must sign the application to attest to its accuracy. 4. Only natural persons are eligible to be Nassau OTB Permanent Wagering Account holders. Corporations, partnerships, trusts or other legal entities are not eligible to be account holders. 5. OTB Nassau OTB Permanent Wagering Account are non-transferable and non-assignable. 6. All account wagering postal mailings, including notices, checks, withdrawal slips, account statements and other correspondence will be sent to the address listed on the account application. The account holder may request that no correspondence regarding the account be sent to the address listed. 7. Changes to the account holder s account identification number, PIN, name, age, address, social security number and date of birth can be made by contacting Customer Service in person or by mail and require the current account identification number, PIN and account holder s signature as well as two forms of acceptable identification that are subject to verification. 8. The account holder will be required to provide his account identification number and PIN before an account wager, deposit or withdrawal is accepted. The account holder will receive a Nassau OTB Money Card that must be used to access the account at Nassau OTB branch offices. If the account is opened through the mail, the Money Card will be mailed to the account holder within five (5) business days after the application has been processed. 9. Nassau OTB reserves the right to exclude anyone from opening an account based on its business judgment. Nassau OTB shall refuse to open an account to known or reputed book makers; any person who engages in any activity which is deemed to be a gambling offense as defined in Article 225 of the Penal Law of the State of New York; a known fugitive from justice; and persons on its self-exclusion list, as well as minors and residents of states which prohibit New York State wagering accounts. 10. Account wagers will be accepted at TELBETT, TELBETS, at self-service wagering terminals at Nassau OTB branches and Fast Track locations, and personal account terminals at the Race Palace, and for account holders who are residents of New York State, on-line at A current list of Nassau OTB branches and Fast Track locations is available at and at all Nassau OTB branches. 11. Only wagers validated and accepted by the wagering system, for which there are sufficient available funds in the wagering account, are deemed to be valid wagers. All account wagers are deemed to be pari-mutuel tickets and are subject to the rules and laws governing pari-mutuel tickets. 12. All account wagers will be read back or displayed for the account holder to confirm that the wager is correct, before it is sold. OTB assumes no responsibility for errors in wagers the account holder has confirmed. 13. Any wagers made or attempted after the official close of betting on a race are invalid. 14. Wagers may be canceled or changed only prior to the close of betting for that race. Cancellations made thirty (30) minutes or less before the scheduled post time for the race must be made through an operator at TELBETS. Cancellations of large wagers are subject to management approval as per New York State Racing and Wagering Board. 15. Funds from winning wagers will be credited to the account immediately after the race is official. Funds subject to Internal Revenue Service reporting requirements shall be held and not available for use until compliance with applicable Internal Revenue Service reporting requirements. Any applicable city, state and/or federal income tax is the responsibility of the account holder. 16. Winning wagers placed at the Race Palace, on-line at Nassau OTB s internet wagering site and from Nassau OTB Account Wagering accounts with a Three hundred dollar ($300) or more account balance at the beginning of the wagering session are not subject to surcharge; all other winning wagers are subject to surcharge. 17. Deposits to the account may be made by cash, check, or money order. Cash deposits may be made at Nassau OTB branches and Fast Track locations. Deposits by check or money order maybe made in person at Nassau OTB branch locations and at Customer Service or by mail to Customer Service as the per the attached check and money order cashing policies. Deposits can be made to accounts open for 90 days or more by calling Cash Call and using the account holders credit card; Service charges will be assessed and there are limits on the amount which can be deposited within a 24 hour period using Cash Call. 18. Withdrawals may be made by using the Money Card and PIN at self-service terminals at Nassau OTB branches and Fast Track locations or by signed written request, which includes the account identification number, PIN and withdrawal amount, in person or by mail to Customer Service; checks will only be mailed to the official address on record for the account. 19. Nassau OTB Permanent Wagering Accounts may be closed at the request of the account holder in person or by mail at Customer Service and require the account identification number, PIN and account holder s signature as well as two forms of acceptable identification that are subject to verification. 20. Nassau OTB Permanent Wagering Account annual statements will be mailed to all account holders, unless they have requested no mail on their account application, in which case their annual statement can be obtained by contacting Nassau OTB Customer Service. Nassau OTB Account Wagering monthly and detailed statements are available online at or by contacting Nassau OTB Customer Service. 21. Any account with no account wagering activity during a period of 36 consecutive months will be deactivated and distributed in accordance with Section 1012 of the New York State Racing law. 22. Only one account may be open per person at any one time. Nassau OTB Permanent Wagering Accounts may not be shared with or loaned to another player. Wrongful use of the account through deception, sharing, or partnership will result in closure of the account and refund of any non-disputed balance. 23. Nassau OTB Permanent Wagering Accounts are restricted for wagering purposes only. 24. Nassau OTB assumes no responsibility or liability for errors or omissions in programs or profiles. 25. Only the Nassau OTB Permanent Wagering Account holder is entitled to obtain access to their account information. Nassau OTB will not share account information with third parties, other than the New York State Racing and Wagering Board, unless required to do so by statute, court order, subpoena or other legal process or without express written permission from the account holder. 26. Nassau OTB reserves the right to make adjustments to any account due to computer error, machine malfunction, operator error, fraud or other misuse. 27.
