1 HOW TO ENTER: Lindt You Could Win a Trip to Switzerland Contest Shoppers Drug Mart /Pharmaprix Account Specific Promotion ( Contest ) OFFICIAL CONTEST RULES The Lindt You Could Win a Trip to Switzerland Contest ( Contest ) is sponsored by Lindt & Sprüngli (Canada), Inc. ( Lindt ) and Shoppers Mart Inc. (collectively the Contest Sponsors ). NO PURCHASE NECESSARY. There are two ways to enter this Contest, as described below. There are two (2) Qualifying Prizes and one (1) Grand Prize available to be won, to be awarded nationally at the end of the Contest Period (defined below). Entries will be drawn from the eligible entries submitted by the Contest Closing Date (defined below). To enter the Contest and qualify for a chance to win a prize, you may enter in two (2) ways: (1) AUTOMATIC ENTRY: While supplies last, purchase any two (2) of the following participating Lindt products (150g Lindor bag, 100g Excellence bar, 100g Swiss Classic bar or 300g Swiss Classic bar) between June 22, 2013 and July 12, 2013 (the Contest Period ), at any participating Shoppers Drug Mart or Pharmaprix store (each store a licensed operator of Shoppers Drug Mart Inc. or its affiliates, collectively Shoppers Drug Mart/Pharmaprix ) and present your valid Shoppers Optimum Card /Pharmaprix Optimum Card, and your name will be automatically entered into the Contest for a chance to win a Qualifying Prize. (2) NO PURCHASE ENTRY: To enter the Contest without making a purchase, please write a 50- word essay about Why I love shopping for Lindt products at Shoppers Drug Mart/Pharmaprix. Each essay must be original to the entrant submitting the essay, and not mechanically reproduced. All essay entries must be postmarked by July 12, 2013 (the Contest Closing Date ) and be received by Shoppers Drug Mart/Pharmaprix at the aforesaid address no later than four (4) business days after the Contest Closing Date to be eligible for entry into the Qualifying Prize draw. 2 PRIZE DETAILS: Qualifying Prizes: A total of two (2) qualifying prizes will be awarded, each consisting of two (2) tickets to the Rogers Cup at the Jarry Park in Montreal, Quebec (Uniprix stadium) to watch an evening tennis match on August 7, 2013 (each, a Qualifying Prize ). Limit one (1) Qualifying Prize per person. Two (2) entries will be randomly selected from among all eligible entries received from all Shoppers Drug Mart/Pharmaprix stores together with all those submitted by the no- purchase entry method during the Contest Period. No purchase entries will be date stamped and included in the draw if postmarked by the Contest Closing Date and received no later than four (4) days after the Contest Closing Date. The draw will occur at the Shoppers Drug Mart central office in Toronto, Ontario on Thursday, July 18, 2013, at approximately 2:00 PM ET. Qualifying Prize winners will have access to all areas including the VIP lounge at the Rogers Cup for the afternoon session on the day of the match. The specific tennis match that tickets will be provided for will be determined by Lindt and prize must be accepted as awarded. If a winner of a Qualifying Prize is unable to personally attend the Rogers Cup, he/she may arrange for a representative to attend on his/her behalf. The approximate retail value for each pair of Rogers Cup tickets is $250 CDN. In the event a Qualifying Prize winner s residence (as recorded in the mail- in entry or in the Shoppers Optimum Card /Pharmaprix Optimum Card account) is 150km or more away from the Uniprix Stadium (as determined by Lindt), that winner s Qualifying Prize will also include (1) one night hotel (double occupancy) and return transportation from the city that winner is resident of to the Uniprix Stadium for both the Qualifying Prize winner and his/her guest. Lindt has discretion to choose the mode of transportation. Accommodation if provided shall be for the night of August 7, A Qualifying Prize winner whose residence is less than 150km from the Uniprix Stadium (as determined by Lindt) will not receive anything beyond the two Rogers Cup tickets to the August 7, 2013 game described earlier. Grand Prize: Both Qualifying Prize winners from this Contest, along with one (1) Qualifying Prize winner from one (1) other 2013 Lindt You Could Win a Trip to Switzerland account specific promotion (collectively, with this Contest, the Account Specific Contests ), will be entered into a draw for the Grand Prize consisting of a TRIP FOR TWO TO SWITZERLAND (the Grand Prize ). During the evening match on August 7, 2013, a random draw will be held to pick one (1) Qualifying Prize winner to be eligible for the Grand Prize from among all of the three (3) Qualifying Prize winners from both of the Account Specific Contests. The potential winner of the Grand Prize will be notified in person, by telephone or by . The Qualifying Prize winners do not have to be in attendance at the Rogers Cup to be eligible for the Grand Prize and can designate a representative to attend on their behalf. The Grand Prize of a TRIP FOR TWO TO SWITZERLAND includes return economy airfare for two people from the major commercial airport in Canada closest to the winner s residence to Zurich, Switzerland
3 and standard hotel accommodations for 3 nights (based on double occupancy). Trip is currently scheduled for October 2013 but date is subject to change at Lindt s sole discretion. Winner and his/her guest will be able to participate in a chocolate making class at the Lindt Chocolateria and attend a meet and greet with Roger Federer in Kilchberg, Switzerland. Grand Prize winner will also receive a $200 chocolate gift basket or gift card to use at a Lindt Outlet Boutique in Canada. The total approximate value of the Grand Prize is $7,000 CDN based on departure from Toronto. CHANCES OF WINNING: The odds of winning a Qualifying Prize depend on the total number of eligible entries received from all Shoppers Drug Mart/Pharmaprix stores during the Contest Period and no purchase entries postmarked by the Contest Closing Date and received no later than four (4) days after the Contest Closing Date. A Qualifying Prize winner has a 1 in 3 chance of winning the Grand Prize. GENERAL PRIZE INFORMATION: No substitutions or cash redemptions allowed. Prizes are non- transferable, may not be substituted or extended, may not be redeemed for cash or credit and must be accepted as awarded, with the exception that each Qualifying Prize winner may send a representative to attend the Rogers Cup on his/her behalf. Contest Sponsors reserve the right to substitute any part of a prize with another prize of equal or greater approximate value (based on the retail value of the prizes as stated in these Official Contest Rules). Should a prize (or any part of a prize), including the Rogers Cup match, the meet and greet with Roger Federer, or any other aspect of the prize be postponed or unavailable for any reason, the balance of the prize will be awarded in full satisfaction of that prize, and the Sponsors shall not be required to replace the unavailable or postponed component. Any unused portion of a prize is forfeited and has no cash value. Refusal by a selected entrant to accept the prize as described and according to the conditions of these Contest Rules will release the Sponsors of all obligations relating to this prize for this entrant. For both the Qualifying Prizes and the Grand Prize, the winners and guests shall assume full responsibility for any expense not specifically mentioned in these Rules as being included in the prize, including (as applicable, depending on the prize) the following: travel to and from airports, ground transportation, personal expenses incurred at the hotel, gratuities, meals and beverages, taxes, insurance (including for medical fees, accidents or lost luggage) and any other personal expenses. Trips are subject to space/flight availability. For any prize involving a trip, the winner and guest must have the identical travel itinerary and the winner s guest must be the same person for the duration of the trip. All travel arrangements must be made through Lindt and the travel arrangements are at Lindt s sole discretion. Once the tickets are issued, the name of the traveler cannot be changed. The winner and guest are solely responsible for obtaining any required travel documents. The right to a prize will be forfeited if, as applicable, (a) for any reason, travel documentation cannot be obtained within the time limit set by the Contest organizers; (b) the winner cannot or does not wish to travel during the specified period; (c) the winner does not have the right, at the time he/she is selected or at the time of the trip, to return to Canada upon departing; or (d) any immigration problem whatsoever arises preventing the winner or guest from entering Switzerland. In such case, the winner or guest barred from destination will be held solely responsible for
4 arranging and paying for any required return transportation. Upon the sole discretion of Lindt, forfeited prizes may be allocated to another eligible entrant. All entries become the property of the Contest Sponsors and will not be returned. No responsibility is assumed by the Contest Group (as defined below) for any inability for a potential entrant to successfully enter the Contest for any reason. A representative of the Contest Sponsors will notify each selected entrant by telephone or by within seven (7) days of each draw, with the exception of the Grand Prize potential winner who may also be notified in person. In order to be eligible to claim a prize, each selected entrant must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question to be administered by phone at a mutually convenient time and must then sign a standard declaration/ liability release and consent to publicity form ( Declaration and Release ) confirming compliance with the Contest Rules, and releasing the Contest Sponsors and each of their respective shareholders, employees, parents, directors, officers, affiliates, subsidiaries, franchisees, representatives, agents, advertising and promotional agencies, fulfillment house, successors and assigns (collectively, the Contest Group ) from all liability with respect to the entrant s participation in this Contest and the awarding, use and/or misuse of any prize or for matters that inhibit, reduce or prevent enjoyment of a prize. To be confirmed a winner, each selected entrant will be required to sign and return the Declaration and Release within five (5) days of its receipt or the prize may be forfeited, and awarded to an alternate entrant. If a selected entrant cannot be contacted within seven (7) days of each draw, does not correctly answer the skill- testing question, or otherwise does not meet all of the Contest conditions, the selected entrant will be disqualified and shall forfeit any rights to a prize, and the prize may be awarded to an alternate entrant upon confirmation. Each selected entrant may be required to show proof of identification as part of the confirmation process. In case of a dispute concerning the identity of the individual who submitted an entry, the entrant will be deemed to be the account holder of the Shoppers Optimum/Pharmaprix Optimum account under which the entry was submitted. Selected entrants will be contacted once their eligibility has been confirmed and they have been informed of prize claim modalities. The Sponsors will not be responsible for failed attempts at contacting a selected entrant. Aside from the Account Specific Contests, Lindt is also sponsoring three (3) other You Could Win a Trip to Switzerland Contests in 2013, each of which will also include Grand Prize trip(s) for 2 to Switzerland and may include Qualifying Prize(s) (collectively, along with the Account Specific Contests, the You Could Win a Trip to Switzerland Contests ). A winner of any prize in any of these You Could Win a Trip to Switzerland Contests is ineligible to win another prize in any other You Could Win a Trip to Switzerland Contest this year, with the exception that all three (3) Qualifying Prize winners from the Account Specific Contests are eligible for the Grand Prize for the Account Specific Contests. GENERAL RULES: This Contest is conducted by the Contest Sponsors and is open to all Shoppers Optimum Members /Pharmaprix Optimum Members who are residents of Canada and who have reached the age of majority or older in their province/territory of residence at the time of entry. Groups, clubs, organizations, businesses and commercial and non- commercial entities cannot participate. All decisions of the Contest Sponsors are final. This Contest is subject to all applicable federal, provincial/territorial and municipal laws. Void wherever prohibited by law. Entries obtained through fraudulent means or through an abuse of the Shoppers Optimum Program /Pharmaprix Optimum Program or are in any way tampered with, forged, mutilated, illegible, incomplete or mechanically reproduced essays may, at the sole discretion of the Contest Sponsors, be disqualified. All entries are subject to verification by the Contest Sponsors and the Contest Sponsors reserve the right to cancel and revoke any entries if they are found to be improper or if the entrant is subsequently found to be ineligible pursuant to the Contest Rules. The Contest Group is not responsible for entries lost, late, misdirected, containing inaccurate information or delayed for any reason. Mailed in, no- purchase entries must bear sufficient postage, which is the sole responsibility of the entrant. For Quebec residents: Any litigation regarding the conduct or organization of this Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. In no event will the number of prizes awarded exceed the available number of prizes as specified in these Contest Rules. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest- related materials, including, but not limited to: the French version of these Rules, and/or point of sale, television, print or online advertising, the terms and conditions of these English Rules shall prevail, govern and control. Except where prohibited by law: (i) all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of entrant and Contest Sponsors in connection with the Contest shall be governed by and construed in accordance with the substantive laws of the Province of Ontario without regard to Ontario conflict of law principles; and (ii) all entrants consent to the jurisdiction and venue of the Province of Ontario.
