1 GENERAL BRANCH BY-LAWS (As amended 29/3/07) G1 A. All competitors, by the making of an entry in any Event conducted within Queensland under the Rules of The Equestrian Federation of Australia Incorporated or The Federation Equestre Internationale, acknowledge acceptance of the Rules of these two bodies. B. All Accredited Judges or Officials adjudicating at all Official Dressage competitions, Official One-Day, Two-Day or Three-Day Events, or Official Showjumping Events conducted within Queensland must adjudicate these events in accordance with the Rules of The Equestrian Federation of Australia Incorporated or The Federation Equestre Internationale. C. All Accredited Officials and Coaches of the Branch must be either a Senior Riding Member, a Senior Non-Riding Member, an Associate Member or an Honorary Member of Equestrian Queensland. G2 G3 G4 G5 G6 G7 G8 G9 All Event Organisers within Queensland, by using the Rules of The Equestrian Federation of Australia Incorporated or the Rules of The Federation Equestre Internationale, acknowledge acceptance of these Rules. All competitors and horses competing in any Official competition conducted within Queensland under the Rules of The Equestrian Federation of Australia Incorporated or the Rules of The Federation Equestre Internationale, shall be currently registered with a Branch of the Federation or shall be in possession of a Permit to Ride, if a competitor from overseas. All interstate or overseas competitors, by competing within the State of Queensland in Events conducted under the Rules of The Equestrian Federation of Australia Incorporated and / or the Rules of The Federation Equestre Internationale agree to be bound by the By-Laws of Equestrian Queensland. All requests for swabbing from any Organising Committee conducting an Official Equestrian Federation of Australia event must be directed through the General Manager. The collection and protocols of testing of samples taken from horses competing in competitions in Queensland shall be in accordance with the protocols set by the Racing Science Centre, a division of Racing Queensland as conducted under the Equestrian Federation of Australia Swabbing Policy. Any Member who has competed outside of Queensland with a Queensland registered horse is required to notify the Equestrian Queensland Office in writing within 14 Days of their return to Queensland of the events attended and the results gained. Any employee of Equestrian Queensland may not hold a voting position on the Board or its Sub-Committees. The Event Organising Committee for all events conducted pursuant to the Rules of the Equestrian Federation of Australia, excepting where those Rules specify that an event is required to have a higher standard of First Aid or Medical Attention (for example, the Cross Country Phase of Eventing competition), shall ensure that the event is supplied at all times with an approved standard of First Aid equipment (that is, First Aid Kit) and at least one qualified Red Cross, St Johns or Sports Medicine Australia First Aid provider or equivalent at a Level 2 Standard or higher. The Event Organising Committee for all events conducted pursuant to the Rules of the Equestrian Federation of Australia shall ensure that an appropriate Emergency Procedure and Emergency Contact Details are readily available in the event organisers office and are kept on
2 display in a suitable location, such as the Public Address point. The Event Organising Committee for all events conducted pursuant to the Rules of the Equestrian Federation of Australia shall ensure that an accurate record is kept of all incidents requiring First Aid treatment and that this record is kept by the Club for a minimum of five years as required by Federal Legislation. G10 All co-opted appointments to Sport Committees of Equestrian Queensland must be submitted to the Board for approval and may only be appointed for one (1) year at a time, that being from their time of appointment in any current year to the following AGM of Equestrian Queensland. The AGM of EQ is held in March of any year. BY-LAWS PERTAINING TO DRESSAGE D1 D2 D3 D4 D5 The Dressage Queensland Committee shall be the body to prepare the Official State Dressage Judge s Lists and calendar for all Official Dressage Competitions conducted within Queensland. No Official Dressage Competition, may be conducted in Queensland without the permission of Dressage Queensland. Any Dressage Competition called Official by the Organisers and conducted without the permission of Dressage Queensland shall be deemed Unofficial and any Points earned by Competitors shall be deleted from the records. All Official Dressage competitions conducted in Queensland at Preliminary, Novice, Elementary, Medium Advanced, Prix St. Georges, Intermediate I, Intermediate and Grand Prix Level shall be conducted in accordance with the Rules of the Equestrian Federation of Australia and shall consist of tests approved by the Federation. When the Rules of the Equestrian Federation of Australia are silent, the Rules of the Federation Equestre Internationale shall apply. All Dressage Competitors intending to compete in an Official interstate Dressage competition are required to notify the Chairman of Dressage Selectors fourteen (14) Days prior to their departure for such competition. In many cases, Teams Events are conducted at these events and Selectors need to know the names of intending competitors in order to select the best possible team. Please also note that travel subsidy is only payable on Teams Events. It is therefore in your interest to comply with this By-Law. The Judges Sub-committee has full responsibility for inviting and allocating judges for those events that Dressage Queensland conducts. This also includes events for which the Dressage Qld may be asked to invite and allocate judges. Judges for the above events may be chosen from any level on the Official Judges List and will be chosen for their suitability and competence, and this will be done solely at the discretion of the Judges Sub-committee. There will be no correspondence entered into with outside parties re the judges chosen. BY-LAWS PERTAINING TO EVENTING E1 E2 No Official Eventing Competition, that may be counted for grading points, may be conducted in Queensland without the permission of Equestrian Eventing Queensland. Any Eventing Competition called Official by the Organisers and conducted without the permission of Equestrian Eventing Queensland shall be deemed Unofficial and all Points earned by Competitors shall be deleted from the records. All Official One-Day and Two-Day Events conducted within Queensland shall be conducted in accordance with the Rules of The Equestrian Federation of Australia
3 Incorporated. When the Rules of The Equestrian Federation of Australia Incorporated are silent, the Rules of The Federation Equestre Internationale shall apply. E3 E4 E5 E6 E7 E8 E9 All Official Three-Day Events conducted within Queensland shall be conducted under the Rules of The Federation Equestre Internationale. All competitors, including Juniors, competing in any event under the control of Eventing Queensland shall be financial members of a Branch of the Federation, unless otherwise stated on the Program of Entry. All horses, including those ridden by Juniors, competing in any event under the control of Eventing Queensland shall be currently registered with a Branch of the Federation and shall carry a current Performance Card, unless otherwise stated on the Program of Entry. Any competitor found to have schooled their horse or horses over obstacles comprising a Cross-Country Course during the previous Six Weeks immediately prior to a Three- Day Event being held on that Cross-Country Course, or during the previous Three Weeks immediately prior to a One-Day Event being held on that Cross-Country Course, shall be eliminated from that competition. (Amended by the Branch Committee Decision BC on 14 September 1999) E10 The eligible age for Junior Riders for competition in Eventing competitions should be amended as follows: Introductory Class: As a Junior Rider, from the day on which the rider turns Eleven (11) Preliminary Class: As a Junior Rider, from the day on which the rider turns Twelve (12). (Amended by the Branch Committee Decision BC on 11 May 1999) E11 All Eventing Competitors intending to compete in an Official interstate Eventing event are required to notify the Chairman of the Eventing Selectors fourteen (14) Days prior to their departure for such competition. BY-LAWS PERTAINING TO NCAS N1 N2 The NCAS Advisory Panel shall be the body appointed by the Board of Equestrian Queensland (EQ) to support and advise the Board and the Sports Development Officer as required, in the management and conduct of coach education in Queensland. The NCAS Advisory Panel may submit to the Board any recommendations pertaining to the education, updating, professional development, or associated matters related to coaching in this State as they see fit.
4 N3 N4 N5 N6 N7 N8 The NCAS Advisory Panel may recommend to the Board a nominee for appointment to the National Coach Accreditation Committee as the Equestrian Queensland Representative to this Committee, as required. The NCAS Advisory Panel shall consist of five(5) appointed representatives that shall be drawn from across all levels of coach accreditation. Such appointments shall be the responsibility of the Board of EQ. Appointments to the NCAS Advisory Panel shall be for two(2) year periods on a rotating basis, with two(2) appointees being required to step down every two(2) years. Incumbent appointees may be reappointed for a further period should the Board so desire. The timing of appointments to the Panel shall be from the AGM of any particular year to the AGM two(2) years hence, or any part thereof. There is no requirement for the NCAS Advisory Panel to meet face to face on a regular basis, unless they so decide. The Panel may communicate electronically should this prove to be the most effective and efficient means available. There is no quorum requirement for NCAS Advisory Panel meetings or discussions, but all outcomes or items of importance that may arise, shall be forwarded to those not present at that time for further comment and resolution. All communications of the NCAS Advisory Panel where required, should be recorded or include the Sports Development Officer to ensure accurate records of discussions and recommendations are maintained. BY-LAWS PERTAINING TO SHOW HORSE SH1 All Official Show Horse Events conducted by Equestrian Queensland shall be conducted under the Rules of The Equestrian Federation of Australia Incorporated. When the Rules of The Equestrian Federation of Australia Incorporated are silent, the Rules of The Federation Equestre Internationale shall apply. SH2 (1) All Pony Hacks over 12.2 Hands, competing in events conducted in Queensland by Show Horse Queensland may be ridden by a Rider of any age. (2) All Pony Hacks of 12.2 Hands and under, competing in events conducted in Queensland by Show Horse Queensland must be ridden by a Junior Rider aged 14 Years and under, in accordance with the EFA National Rules. SH3 A Galloway Hack competing in events conducted in Queensland by Show Horse Queensland shall be over fourteen (14) Hands and not exceeding fifteen (15) Hands high. SH4 An exhibit is ineligible to compete if the Horse has been agisted with the competition Judge or the competition Judge s family, employee or business partner within the Six (6) Months immediately prior to the event, in accordance with the EFA National Rules. SH5 False Tails are permitted in Hack Classes, Led Classes and Riding Classes in events conducted in Queensland by Show Horse Queensland. SH6 The Equestrian Queensland event known as the EQ Newcomer Horse Of The Year shall be conducted under the Rules determined by Show Horse Queensland. SH7 The Equestrian Queensland event known as the EQ Horse Of The Year shall be conducted under the EFA National Rules.
5 BY-LAWS PERTAINING TO SHOWJUMPING SJ1 SJ2 All Official Showjumping Events conducted within Queensland, with the exception of those nominated as otherwise by the Federation and/or the Federation Equestre Internationale, shall be conducted under the Rules of the Equestrian Federation of Australia Incorporated. When the Rules of the Equestrian Federation of Australia Inc. are silent, the Rules of the Federation Equestre Internationale shall apply. All Senior Showjumping events conducted within Queensland that are conducted under either EFA Inc Rules or FEI Rules, and fulfil the criteria of an Official Showjumping event by being: (a) (b) (c) In excess of $75.00 prize money For single horse and rider combinations Not specifically for Juniors are considered to be Official Events counting for grading points. It is necessary for the organiser to be a financial Affiliate Member of Equestrian Queensland for a Showjumping event to be considered Official. SJ3 SJ4 SJ5 SJ6 SJ7 SJ8 SJ9 Any Showjumping Event, which has less than ten (10) horses shall be deemed to be Unofficial All horses competing in Foxhunter competitions conducted in Queensland must be currently registered with Equestrian Queensland and must have a current Performance Card issued in their name by Equestrian Queensland. All Riders competing in Foxhunter competitions conducted in Queensland must be a current financial Member of the Equestrian Federation of Australia. In order to be eligible to compete in a Foxhunter competition conducted in Queensland, the Rider of any horse competing in a Foxhunter competition must have his name recorded upon the current Equestrian Queensland Showjumping Performance Card, or a current Equestrian Queensland Lease for that horse. The Junior Showjumping Rule (SJ11 below) shall apply in all Foxhunter events conducted in Queensland. Horses awarded First placing in any Foxhunter Preliminary round competition are no longer eligible to compete in any further Foxhunter Preliminary round competitions. This rule will apply even if the event is Unofficial (due to insufficient entries) and no points have to be entered on the horse's card. SJ10 Horses awarded First to Sixth Placing inclusive in any Foxhunter Preliminary round competition are eligible to compete in the Foxhunter Series Championship Final for that year. SJ11 Any horses ridden in a Junior Event at any Show can only compete in Junior Events at that Show, unless otherwise stipulated in the Schedule. SJ12 Rowel (roller) spurs may be used but they must be blunt and if a horse shows blood from the use of spurs, either in the ring or in the practice arena, the Ground Jury shall eliminate that horse for the rest of the event.
6 BY-LAW PERTAINING TO EQUESTRIAN QUEENSLAND GENERAL RULES AND REGULATION S PENALTY PROCEDURES For the purposes of these procedures, the following definitions apply: OFFICIAL EVENT Any competition programmed at: (a) any event conducted by Equestrian Queensland Inc. or any of its sub-committees; (b) any club or show society affiliated with Equestrian Queensland Inc. COMPETITOR A person riding, driving, leading or otherwise presenting a horse in any event. EXHIBITOR The owner, lessee or representative of the owner or lessee of a horse entered in any event. DEFAULT LIST A list of persons who have failed to pay a fine imposed under these or any other rules of the EFA or the FEI by the time specified for the payment thereof or who have in any other respect failed to comply with the terms of any sanction applied under any such rule. BOARD The Board of Equestrian Queensland. PENALTIES (effective from 1 June 2004) will be as follows: 1. COMPETING IN OFFICIAL EVENT ON UNREGISTERED HORSE Competitor and Exhibitor each subject to the same penalty. First offence; fine of $ Second and subsequent offences; fine up to $ and/or suspension to a maximum of six (6) months. 2. COMPETING IN OFFICIAL EVENT ON HORSE WHOSE REGISTRATION AND/OR PERFORMANCE CARD IS NOT CURRENT Competitor and Exhibitor each subject to the same penalty. First offence; pay outstanding fees, plus fine of $ Second and subsequent offences; pay outstanding fees, plus fine up to $ and/or suspension to a maximum of three (3) months. 3. COMPETING IN AN OFFICIAL EVENT OUT OF AGE, GRADE OR HEIGHT Competitor or Exhibitor each subject to the same penalty. First offence; fine of $ Second and subsequent offences; fine up to $ and/or suspension to a maximum of twelve (12) months. 4. FORGING OR FALSIFYING BIRTH CERTIFICATE OR ANY PART THEREOF FOR ENTRY INTO ANY EVENT First offence; fine of $ Second and subsequent offences; fine up to $ and/or suspension to a maximum of six (6) months. 5. FALSIFYING PERFORMANCE FOR ENTRY INTO ANY EVENT First offence; fine of $ Second and subsequent offences; fine up to $ and/or suspension to a maximum of six (6) months. 6. FALSIFYING INFORMATION OF APPLICATION FOR REGISTRATION OF A HORSE AND/OR APPLICATION FOR MEMBERSHIP First offence; fine of $ Second and subsequent offences; fine up to $ and/or suspension to a maximum of six (6) months.
7 7. ENTERING REGISTERED HORSE USING INCORRECT NAME AND/OR LISTING INCORRECT OWNER/S IN OFFICIAL EVENTS Competitor or Exhibitor each subject to the same penalty. Each offence; fine of $ COMPETING IN OFFICIAL EVENT WHILE MEMBERSHIP OF OWNER/S AND/OR RIDER IS NOT CURRENT Competitor or exhibitor each subject to the same penalty. First offence; pay outstanding fees, plus fine of $ Second and subsequent offences; pay outstanding fees, plus fine up to $ and/or suspension to a maximum of three (3) months. 9. COMPETING IN OFFICIAL EVENT WHILE UNDER SUSPENSION Each offence; suspension of membership for twelve (12) months. 10. AS A REGISTERED MEMBER OF THE EFA ONE FAILS TO TRANSFER OWNERSHIP OF A REGISTERED HORSE WITHIN 30 DAYS Each offence; fine equivalent to double the current transfer fee. 11. COMPETING IN OFFICIAL EVENT WHILE ON THE DEFAULT LIST Each offence; suspension of membership for three (3) months. RULES 1, 2 AND 11 DO NOT APPLY TO SHOW HORSE EVENTS WHERE THERE IS NO REQUIREMENT FOR THE HORSE, COMPETITOR &/OR OWNER TO BE EFA REGISTERED. HOW THE DISCIPLINARY SYSTEM WORKS: If an infringement of these rules is brought to the notice of the Board or the General Manager, from Organising Committees, Judges or other Officials, the alleged offender will be informed in writing of the infringement and will be requested within a prescribed time to show cause in writing why the penalty as outlined should not be taken against him/her. The alleged offender's written submission (if any) and the offence, will then be further considered by the Board, which may: (a) (b) (c) find no case to answer and take no further action; or find the offence proven and apply the penalty; or refer the matter to the Judiciary of Equestrian Queensland for determination. In any case, where the Board has acted under Clause (b) hereof, the alleged offender may within fourteen (14) days of being advised of the Board's determination, by notice in writing, appeal against the Board s determination, in which case the matter will be placed before an Appeals Tribunal. Every such appeal notice shall be accompanied by a deposit of $ that will be refundable at the discretion of the Appeals Tribunal. Upon the hearing of any such appeal, the Appeals Tribunal may uphold the Boards decision, reduce or increase any fine or suspension as it thinks fit or alternatively, over-rule the determination of the Board either in whole or in part and hand down its own decision accordingly. THESE RULES ARE TO BE READ IN CONJUNCTION WITH ALL OTHER EFA (NATIONAL AND STATE) RULES AND FEI RULES IN FORCE AT THE TIME OF THE OFFENCE, AS APPLICABLE GENERALLY AND TO SPECIFIC EVENTS OR COMPETITIONS.
