ACCREDITED TEXAS-BRED PROGRAM (ATB - TB) To encourage the breeding of horses in this state, any Accredited Texas-Bred horse finishing first, second or third in any race in Texas (other than a stakes race restricted to Accredited Texas-Breds) may be eligible for Owner, Breeder and/or Stallion Awards through the ATB Incentive Program. Funding for awards is derived from breakage and 1% of all multiple wagers at each racetrack, with each racetrack generating awards funds only for the horses racing at that track. From the total generated, awards funds are separated into categories for eligible owners (40%), breeders (40%), and stallion owners (20%). Additionally, the first 25% of all awards generated is set aside for Owner Bonus Awards, paid to owners of ATB horses finishing first, second or third in open company races. The Owner Bonus is in addition to regular ATB Owner Awards. In this condition book, the acronym ATBOIA appearing in parentheses in race conditions after the amount of the overnight purse stands for estimated Accredited Texas-Bred Owner Incentive Awards. Owner Incentive awards are not considered part of the purse, and therefore are not subject to deductions for jockey fees. The amount of the estimated ATB owner incentive awards available for each race restricted to Accredited Texas-Breds will appear like the following example: (Plus $1,000 ATBOIA). The amount of the estimated ATB owner incentive awards available for each open company race will appear like the following example: (Plus up to $1,000 ATBOIA). All ATB Incentive Program awards - owner bonus, owner, -4-

5 breeder and stallion owner - will be paid by the Texas Thoroughbred Association approximately four weeks after the meet has ended. Quarter Horse ATB money will be paid out at the end of the meet through the office of the TQHA. Quarter Horse owners award supplements are paid 50% to first, 30% to second and 20% to third. ATB owners award supplements are not paid on fourth or fifth place finishes. All riders must be named at entry time. The racing office will be closed on Sundays and Mondays. The racing office will open at 8:00 a.m. on entry days and entries will close at 10:30 a.m. The track will be closed for training on Sundays. Post Time is 6:45 p.m. for all race days, subject to change with reasonable notice. SCRATCH POLICY All horses scratched at may only be scratched by permission of the Stewards. ELIGIBILITY A horse that is more than 12 years of age may not start in a parimutuel race in this state unless: a. The horse has finished 1st, 2nd or 3rd in an officially sanctioned pari-mutuel race during the 12 month period preceding the race in which the horse is to start; or b. Upon due consideration of the horse s prior past performance, the -5-

6 board of stewards has given specific authorization for the horse to start. LICENSING ALL PARTICIPANTS [Trainer and Owner(s)] must obtain a current Texas Racing Commission License. TRAINERS: 1. All Trainers must be licensed prior to the entry procedure. 2. A trainer may enter a horse in a stakes race without first obtaining a license, but must obtain a license before the horse may start in the stakes race. 3. It is the Trainer s responsibility to keep the Texas Racing Commission licensing office current on their Owners and employees status. Failure to do so may result in disciplinary action by the Stewards. 4. Whenever a Trainer terminates an employee, the licensing office should be notified. The license badge may be returned to the licensee if and when he/she is employed by another licensed Trainer. OWNERS: 1. All Owners, as listed on the horse registration papers, must obtain a current license. The owner must be licensed one hour prior to post time of the first race of the day in which the owner intends to race. 2. Owners licenses will not be issued unless a licensed Trainer is named on his/her application. 3. If an Owner is unable to complete his/her application due to illness or absence, the licensed Trainer desiring to enter the horse may complete an emergency Owner s license for the absent Owner. 4. All Owners who lease horses for racing purposes are responsible for licensing both the Lessee and Lessor. 5. If the Owner is not an individual, each partner who has an ownership interest of five percent (5%) or more must be licensed by the Texas Racing Commission. 6. A person may not be licensed as an Owner if the Person is not the Owner of record of a properly registered race animal which the person intends to race in Texas which is in the care of a Trainer licensed by the Texas Racing Commission. Trainers, Lessors, and Lessees must be licensed prior to time of entry, except for stakes races. License forms can be obtained in advance by calling the Texas Racing Commission at (512) All Jockeys, Backside Personnel and Employees of must be licensed by the Texas Racing Commission. Multi-year licenses are now available for the following: jockeys, owners, trainers and veterinarians. For QH, AR, PT and AP a valid negative Piroplasmosis test and negative Coggins test performed within the past year are mandatory. Preferred tests dated after September 5, For TB, a valid negative Coggins test performed within the past year is mandatory. Preferred tests dated after September 5, All horses must show proof of vaccination on the Health Certificate for EHV-1 in the past 6 months (180 days) 4. Original Health certificates issued within the last 30 days must accompany any horse (all breeds) shipping into grounds. ENTRY RULES 1. Racing office will open for entries at 8:00 a.m. Entries close at 10:30 a.m. 2. A horse must be tattooed, and the registration papers and current negative Coggins must be on file in the Racing Secretary s office not later than one hour before post time for the first race of that day. 3. When a person makes a coupled entry, the entry with the better date will be preferred in an overnight race. If they have the same date, the trainer must make first and second choice. Two horses having a common tie through ownership or trainer cannot start to the exclusion of a single interest with an established date (Stakes excluded). 4. A blinker change must be approved by the starter and reported at time of entry. 5. In all races, winners are preferred except where the conditions of the race state otherwise. Maidens entering in winner s race must declare at time of entry that the horse is a maiden. 6. Owners and trainers must claim allowances and preference date at the time of entry. This is the sole responsibility of the person making the entry. 7. Horses not entitled to first allowance in a race are not entitled to the second and, if not to the second, then to no subsequent allowances. 8. No horse shall be entered in more than one race on any racing day (excluding stakes races). 9. Blinker cups must be a minimum of.75 of an inch. VETERINARIAN S EXAMS Pre-race examinations will begin at 3:00 p.m. All ship-in horses on the Texas Furosemide program should be on the grounds at least five (5) hours prior to the scheduled post time of their race. 8 Commission Veterinarian will be available to examine horses in the Receiving Barn between 4:30 p.m. and 6:30 p.m. Please have legs unwrapped and clean. WORKOUTS AND FIRST-TIME STARTERS If a horse has not started in the 60-day period preceding a race, the horse must have one published workout to be eligible to start in that race. If a horse is a first-time starter, the horse must have two published workouts, one of which must be from the starting gate within 90 days and one must be within the last 60 days prior to the race entered in order to be eligible to start in a race. The first time starter must also be approved from the starting gate by the Retama Park starter for proficiency in the starter gate. All horses working at must be identified by name (breeding if unnamed), type of workout and distance to the Gap Attendant. Failure to report this information will result in referral to the Stewards. For Quarter Horse first time starters around the turn must be approved by the clocker prior to racing in a one turn race and have a minimum 660-yard published workout within the last 60 days. Trainers must notify the clocker prior to working a horse for turn approval Foal certificates, or a copy of, must be on file in the Racing Office before a horse will receive an official work. SHIPPERS All horses entering the stable area must have a valid negative Coggins test performed within the past year, and an original health certificate issued in the 30-day period preceding the horse s arrival. All horses shipping in to race must stable in the receiving barn. Horses shipping in to to work or shipping earlier than their scheduled race day must contact the Stall Superintendent before shipping. All horses shipping in to work out must vacate the receiving barn by 11:00 a.m. NAMING OF JOCKEYS 1. Each horse to be drawn into the body of a race must have its jockey named by the time established by the Racing Secretary for the draw of post positions and before the overnight is printed. 2. An apprentice allowance may only be claimed before entries have closed. 3. It is the trainer s responsibility to engage and name a jockey before the drawing of the race. Should a jockey remain unnamed at the time of the drawing of entries, the Stewards or their appointee shall select one. No jockey, once named, shall be changed except for good cause by the Stewards. RETAMA PARK PREFERENCE SYSTEM 1. A preference date will not be assigned until the horse s foal certificate and current negative Coggins test are on file in the Racing Office. -8-

9 2. Preference dates will not supersede conditions of a race. Horses without foal papers on file will receive least preference in overnight races, except over Maidens entering in winners' races. 3. All Quarter Horses registered prior to noon on Wednesday, June 27, 2018, will receive a zero which is the lowest possible date. A horse keeps his zero until he runs, scratches, or the papers are removed from the Office (unless, for just cause - tattoo, corrections, etc.). The Racing Secretary may determine the status of the preference date established. 4. All horses registering on the first racing day and afterwards will receive an P date corresponding to the racing day of the meeting when registered. A "P Date" and "R Date" are equal when determining preference. 5. When a horse with a zero date is excluded from a maiden special weight race, the horse will be given a 01, 02, etc. The number following the zero is the number of times the horse has been excluded from a maiden special weight race. For example, a 01 would have preference over a 0, and a 03 would have preference over a 02. This applies only to races that are used. These dates apply only when re-entering a Maiden Special race. 6. All horses foal certificates registered prior to 10:00 a.m. on Tuesday, July 24, 2018, will receive a zero which is the lowest possible date. A horse keeps his zero until he runs, scratches, or the papers are removed from the Office (unless, for just cause - tattoo, corrections, etc.). The Racing Secretary may determine the status of the preference date established. 7. All horses' foal certificates registered after Tuesday, July 24, 2018, will receive a P Date corresponding to the 1 st available race date. P Dates and R Dates are of equal value when determining preference. 8. Preference dates are good at any distance. 9. A Zero has first preference. 10. Horses that run will receive a running date (R Date) corresponding to the date they race and lose all dates previously held. This includes stakes. 11. Horses which scratch or are scratched will keep their preference date as if they had run. 12. All horses placed on the Steward s, Starter s or Veterinarian s lists will be posted on the bulletin board. They will not be permitted to enter until they have been approved to start. A horse which ran before going on a list will keep its R date. Horses which were scratched will be given an R date of the date the horse comes off the list. 13. If a horse is registered or comes off a list on a non-racing day, the next racing day (R Date) will be used. 14. In no way does the claiming, ownership transfer or trainer transfer of a horse affect the preference date. 15. It is the responsibility of the person making an entry to claim preference at time of entry. The Stewards will consider no claims that do not comply with the above regulations. 16. When a horse s name appears in a race, other than a Sweepstakes, and is entered for the following day, such entry will be given no consideration should the race in which it is entered be overfilled. -9-

68 DORM ROOM POLICIES 1. All dorm rooms shall be assigned to trainers stabled at Retama Park and shall be the responsibility of the trainer for maintaining the livable condition of each room to which they are assigned. 2. One (1) dorm room shall be allowed for each twelve (12) stalls assigned to the trainer. The dorm rooms are for the use of backside employees only. 3. A $100 nonrefundable fee shall be required per dorm room. 4. All dorm rooms are property of and shall be made available for inspection by, TXRC and DPS personnel at any time without prior notice. 5. Any room not found in satisfactory condition at any time shall be grounds for eviction without prior notice. 6. Dorm room keys must be returned at the end of the race meet. 7. A $75 fee shall be charged for any lost or unreturned key. 8. Per the Selma Fire Marshall, each dorm room is limited to one occupant. CONDUCT IN STABLE AREA 1. A licensee who is mounted on a horse or stable pony on association grounds must wear an approved safety helmet at all times. 2. A licensee may not hold a horse in a starting gate unless the licensee wears a properly fastened and approved safety helmet. 3. The outriders will enforce these rules for your safety. PONY PERSON S ATTIRE Pony persons taking horses to the post must wear Retama Park shirts, jackets and helmet covers and must have saddle towels. The required items are available for purchase in the Jockeys Room. All pony people are required to wear a safety helmet. Under TXRC Section : (a) A Thoroughbred or Arabian is ineligible to start in a race when it has shoes (racing plates) that have toe grabs with a height greater than two millimeters ( inches), bends, jar chalks, stickers or any other traction device on the front hooves. (b) A Quarter Horse, Paint Horse or Appaloosa is ineligible to start in a race when it has shoes (racing plates) that have toe grabs with a height greater than four millimeters ( inches), bends, jar chalks, stickers or any other traction device on the front hooves. On the turf course, the only shoes allowed are queen xt, silver queen xt and world racing plates. All shoes will be inspected upon arrival in the paddock and violators will be scratched and are subject to be fined. Eligibility - Winners are preferred in all turf races. (a) Except as otherwise provided by this section, in a claiming race, each horse is subject to be claimed for its entered price by: (1) a licensed owner or lessee or an authorized agent acting on behalf of the owner or lessee; or (2) a person who has applied for an owner s license and has been granted approval by the stewards to make a claim. (b) A claim may not be made directly or indirectly by an owner for his or her own horse. Sec Claim Procedure. (a) A Steward or a designee of the Stewards shall supervise the making of claims and ensure the accuracy of all claims made in a race. (b) A claim must be made in writing on forms and in envelopes approved by the commission. The form and envelope must be filled out completely and must be accurate in every detail. For purposes of this section, the name of the horse as it appears in the official program governs. (c) The person making a claim is responsible for determining the sex of the horse. (d) A claim must be deposited in a locked box provided by the Racing Secretary not later than 15 minutes before post time of the race in which the horse being claimed is to start. A person may not place money or its equivalent in the claim box. The claim box is located in the Race Office. (e) Before the deadline for filing claims for a race, a person may not open the box in which claims are deposited or reveal information regarding the filing of a claim. (f) After the deadline for filing claims for a race, a Steward or a designee of the Stewards shall open the box, examine the -71-

72 claims, and notify the Stewards of all accurate claims. The Steward or designee will then notify the horsemen s bookkeeper of the claims to determine whether the appropriate amount is on deposit with the bookkeeper in accordance with (relating to amounts of deposit) and to debit the claimant s account for the amount of the claim, plus all applicable fees. If more than one person enters a claim for a horse, a Steward or a designee of the Stewards shall determine the disposition of the horse by lot. Sec Effective Time of Claim. (a) A person who has a valid claim to a horse becomes the owner of the horse when the horse goes on to the race track for the race. This subsection applies regardless of whether the horse reaches the starting gate and regardless of subsequent injury to the horse during or after the race. (b) On the day claimed, a claimed horse runs in the interest of and for the account of the owner from whom the horse was claimed. (c) Effective as of August 26, 2013, the Texas Racing Commission license number will be required when making a claim. If an individual claims a horse for a Multiple Owner, Stable, or Farm, the entity s correct license number will be required. (Prior to claiming a horse, please call the TxRC licensing office to verify the correct license number.) Sec Claim Irrevocable. (a) Except as otherwise provided by this section, a claim that is filed in accordance with this subchapter is irrevocable. (b) If the Stewards declare a claiming race a no-race, all claims for that race are invalid. Sec Amounts of Deposit. (a) To make a valid claim, a person must have on deposit with the horsemen s bookkeeper an amount of the claim, plus all transfer fees, in the form of cash, money order, certified check or cashier s check. (b) A person who files a claim may not exhaust the person s account with the association during the two-hour period after the claim was filed. Sec Transfer of Claimed Horse. (a) A horse that has been claimed in a claiming race shall be taken after the race to the area designated by the association for delivery to the claimant, unless the horse is designated for -72-

73 testing. (b) A person may not refuse delivery of a claimed horse. (c) The engagements of a claimed horse automatically transfer to the new owner. A claimed horse is ineligible for entry in a future race unless the entry is made on behalf of the new owner. (d) A horse may not be delivered to a successful claimant without authorization from a Steward or a designee of the Stewards. Sec Responsibility of Testing. (a) The trainer losing a horse through a claim is nevertheless responsible for the results of any drug tests performed on specimens obtained from the horse. The trainer is responsible for the horse during the testing procedures and may not deliver the horse to the successful claimant in the test barn until the commission veterinarian informs the trainer or representative that all testing procedures are complete. Sec Restrictions on Subsequent Use. (a) A horse claimed in a claiming race in Texas: (1) may not be sold or transferred, in whole or part, by any method other than a claiming race during the 30-day period after the initial claim; and (2) is ineligible to start in a race at a race meeting other than the one at which it was claimed until the end of the race meeting at which the horse was claimed, except in a stakes race after verification by the stewards. (b) A horse claimed in another state is subject to the eligibility requirements for claimed horses in effect at the time of the claim in the jurisdiction in which the horse was claimed. PURSE DISTRIBUTION Overnight Races All places shall be paid in overnight races. Sixth through last place shall be paid as follows: Thoroughbreds - $100.00; Arabian s - $100.00; Quarter Horses - $ Once 6 th through last place monies have been deducted from the total purse then 1 st through 5 th place purse monies shall be distributed as follows: 1 st 60%, 2 nd 20%, 3 rd 11%, 4 th 6% and 5 th 3% Stakes/Handicaps/Futurity/Derby and Trials Purse distribution will be in accordance with methods previously established or dictated by race conditions. -73-

74 HORSEMEN'S BOOKKEEPING In the State of Texas, the horsemen's bookkeeping system is centralized by the Texas Horsemen's Partnership, in order to better serve the horsemen running at the numerous tracks throughout the state. It is now similar to branch banking. This means that any necessary account maintenance can be done from any racetrack running a live meet in the state and through the Texas Horsemen's Partnership's main office in Elgin year round. Horsemen's Bookkeeper Requirements Prior to starting a race an owner must have on deposit with the Horsemen's Bookkeeper the amount required to cover all costs incurred in starting that horse. Prior to putting in a claim for a horse the owner or their Designated Representative must insure that all funds incurred with claiming a horse are on deposit in said account. In accordance with Commission Rules 319.1(b) and 319.3(b)-(c), the following substances are permissible if found at or below the following specified concentration levels in postrace samples taken from a horse. NON-STEROIDAL ANTI-INFLAMMATORY DRUGS (NSAIDs) Samples collected may contain one of the following NSAIDs at a concentration up to but not exceeding the Primary Threshold. Samples may also contain another of the following NSAIDs at a concentration up to but not exceeding the Secondary Threshold. No more than two of these NSAIDs may be present in any given sample. Ketoprofen...Primary threshold: 2 ng/ml of plasma or serum Secondary threshold: 1 ng/ml of plasma or serum Flunixin...Primary threshold: 20 ng/ml of plasma or serum Secondary threshold: 3 ng/ml of plasma or serum Phenylbutazone...Primary threshold: 2 mcg/ml of plasma or serum Secondary threshold: 0.3 mcg/ml of plasma or serum ANDROGENIC-ANABOLIC STEROIDS: MAXIMUM PERMISSIBLE CONCENTRATION Boldenone...25 pg/ml of plasma or serum, regardless of sex 1 ng/ml of urine for fillies, mares, and geldings 15 ng/ml of urine in male horses other than geldings Nandrolone...25 pg/ml of plasma or urine for fillies, mares, and geldings; 1 ng/ml of urine for fillies, mares and geldings 45 ng/ml (as 5a-estrane-3ß, 17a-diol) of urine in male horses other than geldings -76-

77 Testosterone pg/ml of plasma or serum for fillies, mares, and geldings 55 ng/ml of urine in fillies and mares (unless in foal) 20 ng/ml or urine in geldings TOTAL CARBON DIOXIDE MAXIMUM PERMISSIBLE CONCENTRATION Total Carbon Dioxide Must remain below 37 mmol/l of serum Lasix-Texas Racing Commission Excerpts: Bleeders and Furosemide (Lasix) Program Diagnosis of EIPH A bleeder is a horse that experiences Exercise Induced Pulmonary Hemorrhage (EIPH). The medical diagnosis of EIPH may be made only by a commission veterinarian or a practicing veterinarian holding a current license from the commission. A veterinarian who diagnoses an EIPH event in a horse participating in pari-mutuel racing in this state shall report the event to the commission veterinarian in a format prescribed by the commission. On receipt of the first report of a diagnosed EIPH event for a horse, the commission veterinarian shall certify the horse as a bleeder. Admission to the Furosemide (Lasix/Salix) program Sec (b)(1) A trainer may admit a horse to the Furosemide Program by stating at the time of entry that the horse will compete with Furosemide. (Horses will no longer have to be certified bleeders to race on Furosemide and you will not have to sign up with the Racing Commission. Make sure you know the Furosemide status of your horse when entering for races.) Sec (b)(3) An EIPH event experienced by a horse that is admitted to the Furosemide Program is deemed to be a second EIPH event for purposes of Subsection (g) of this section. Sec (f)...a horse may be readmitted to the Furosemide program if: (1) at least 60 days have elapsed since the horse was withdrawn from the program; (2) the horse is required to compete with Furosemide pursuant to subsection (b)(2) of this section (its last race was out of state on Furosemide); or (3) the commission veterinarian diagnoses the horse with another EIPH event. Administration of Furosemide (Lasix) Furosemide (Lasix) -77-

78 shall be administered to a horse in the furosemide (Lasix) program not later than four hours before the published post time for the race in which the horse is entered to run. The furosemide (Lasix) must be administered intravenously by a veterinarian licensed by the commission. The chief veterinarian shall periodically publish the permissible blood levels of furosemide (Lasix) in post race specimens and shall post the levels at each licensed racetrack. Requirement to Use Furosemide (Lasix) A horse in the furosemide (Lasix) program in Texas must compete with furosemide (Lasix) until withdrawn from the program. Withdrawal from Furosemide (Lasix) The chief veterinarian of the commission shall establish criteria for withdrawing a horse from the Lasix program and shall make those criteria available in the commission veterinarian's office at each racetrack. To withdraw a horse from the Lasix program, the trainer must apply to the commission veterinarian. The commission veterinarian shall require a signed medical statement from the trainer s regular practicing veterinarian that it is in the horse s best interest to be withdrawn from the furosemide (Lasix) program. The commission veterinarian may also request any other additional information the commission veterinarian needs to justify the removal of the horse from the furosemide (Lasix) program. A withdrawal request and all accompanying information must be reviewed and decision rendered by the commission veterinarian as soon as possible. (2) A horse in the furosemide (Lasix) program may not compete without furosemide (Lasix) until its withdrawal from the program has been approved by the commission veterinarians. Withdrawal from the furosemide (Lasix) program does not prohibit a horse from subsequent readmission to the program in accordance with this section. Bleeders List (1) The commission veterinarian shall maintain a list of horses that have been certified as bleeders and a list of horses that have been admitted to the furosemide (Lasix) program. (2) On receipt of a report of diagnosed EIPH event, the commission veterinarian shall place the horse on the veterinarian s list. For the first diagnosed EIPH event, a horse shall be placed on the veterinarian s list and is ineligible to start in a race before the 12th day after the date the horse is placed on the list. For the second diagnosed EIPH event, a horse shall be placed on the veterinarian's list and is ineligible to start 78-

79 in a race before the 30th day after the date the horse is placed on the list. For the third diagnosed EIPH event, a horse shall be placed on the veterinarian's list and is ineligible to start in a race before the 180th day after the date the horse is placed on the list. For the fourth diagnosed EIPH event, a horse is barred from pari-mutuel racing in this state. A horse that does not have an EIPH (bleeder) event for 365 consecutive days is considered a non-bleeder for the purposes of the paragraph. (3) Notwithstanding the foregoing, if after reviewing a report of a diagnosed EIPH event the commission veterinarian determines additional days on the veterinarian's list are essential to the health and safety of the horse, the commission veterinarian may extend the number of days the horse in on the veterinarian's list. The commission veterinarian shall record the medical reasons for the additional days. Report by Veterinarian A veterinarian who administers furosemide (Lasix) to a horse that has been admitted to the furosemide (Lasix) program shall report the administration on a form prescribed by the commission. A report made under this subsection must be filed with the commission veterinarian not later than one hour before post time for the first race of that day. -79-
