3 Section 4: Questionnaire 1. Have you read, and do you understand, the requirements of the Class Order issued by ASIC? 2. Are you familiar with the requirements of the Personal Property Securities Act 2009? 3. After you have been granted an AFSL, do you understand that you must not make an offer that is considered a managed investment scheme until you have received approval to do so from Racing Victoria? 4. Do you understand the requirements of a Product Disclosure Statement (PDS)? 5. Are you aware that you must declare a manager for each scheme within a PDS? 6. Are you aware that a separate bank account must be established for each scheme? 7. Do you intend to enter into a purchase agreement with breeders and auction houses (E.g. extended settlement terms)? 8. Do you intend to purchase horses through lease finance? 9. If yes, are you aware that the lease finance agreement must be disclosed within the PDS to the potential investors? 10. Will your horses (or the scheme) be insured? 11. How will you communicate information about the horse to the syndicate members and how regularly will you communicate this information? 5 Section 5: Privacy, acknowledgment and consent For the purposes of Racing Victoria performing its functions as a Lead Regulator and thoroughbred racing s controlling body in Victoria, Racing Victoria will seek and obtain personal or financial information about you from you and others. Racing Victoria may disclose your personal and financial information to other racing controlling bodies, ASIC and enforcement bodies. Should you decline to provide personal or financial information to Racing Victoria when requested, Racing Victoria may refuse to grant or renew this application/registration or may revoke registration. You may gain access to information held by Racing Victoria in relation to your activities as a promoter by contacting the Racing Victoria Privacy Officer. By signing below, I/we agree: a. that all particulars contained within this application are true and correct; b. to be bound by the Australian Rules of Racing as amended from time to time; c. to promptly comply with any requests or requirements of Racing Victoria exercising its functions as a thoroughbred racing controlling body or as a Lead Regulator; d. to promptly comply with any requirements of ASIC; e. that Racing Victoria may in its absolute discretion refuse to grant this application or may grant this application subject to conditions; f. that Racing Victoria may in its absolute discretion revoke this registration should it be granted; g. to comply with Racing Victoria s directions or requirements in relation to the advertising or the promotion of horse racing schemes and syndicates; h. to promptly comply with Racing Victoria s request for the production of information, accounts, receipts or other documents relating to the promotions of horse racing syndicates; i. to pay Racing Victoria any renewal fee notified by Racing Victoria for each racing or calendar year; and j. that if the applicant is a company, all directors must sign. Once completed, please sign where applicable and return to Racing Victoria for lodgement along with all relevant information as per Section 3 Supporting Information. Racing Victoria does not accept any liability for matters relating to, or arising from, the applicant s conduct and activities as a promoter.
