Main Street Whitestown, IN Owner Name Address Home Phone Work Phone Cell Phone address Lessee Name Address Home Phone Work Phone Cell Phone address THIS AGREEMENT, dated this day of, 20 made by and between Sport Horse, Inc., hereinafter referred to as STABLE, providing services as an independent contractor, and, hereinafter referred to as OWNER/LESSEE, Owner/Lessee of the hereinafter-described horse. These parties warrant that they have the right to enter into this AGREEMENT: Agreement Purpose & Consideration In consideration of $650 per horse per month paid by Owner/Lessee in advance on the (day) of each month, Stable agrees to board the herein described horse on a month to month basis commencing day of, 20. Partial months boarding shall be paid on a pro-rata basis based on the numbers of days boarded in a standard 30 day month. Late payments of 1-5 days will incur a 5% penalty, 6 days or more will incur an additional 10% penalty. A fee of $50 will be applied for each returned check and checks will no longer be accepted as a form of payment. Payments shall first be credited to accrued late fees and returned-check charges. Payments not made in thirty (30) days, will incur sale of said horse to pay board and applicable fees incurred, unless payment arrangements are made in writing. Any expenses and/or fees paid by Sport Horse for clients will incur a 10% surcharge. Right of Lien Stable shall be entitled to a lien against the horse and/or equipment stored upon Stable s premises in the full amount due. Owner/Lessee warrants that it owns/leases said horse, that there are no liens against said horse, expressed or implied by law. The horse shall not be removed by Owner/Lessee, or by anyone at Horse Owner/Lessee s instruction, until payment in respect to all charges, including charges for services of others as ordered by Stable, on behalf of the Horse Owner/Lessee, such as veterinary care, shall have been made. Stable shall have a general lien upon the Horse for payment of the sums owing for the services contemplated by this Agreement. Such lien shall continue even if Horse is removed from the care, custody or control of Stable, and may be enforced as provided for enforcement of liens by the laws of the State of Indiana. Any legal action must be brought in Boone County, Indiana, provided however, the parties agree to required Mediation of any disputes relating to this transaction. In the event it becomes necessary for Stable to commence litigation to enforce any of the terms of obligations of the Horse Owner/Lessee under this Agreement including the enforcement of any lien, Stable shall be entitled to recover all costs incurred, including reasonable attorney s fees and any cost of repossession. Further, to secure performance of all obligations of this contract, Horse Owner/Lessee grants Sport Horse a security interest in the Horse. (if any) Schedule of Services Stable agrees to provide the following, in addition to normal and reasonable care and handling to maintain the health and wellbeing of the horse: Stall, Bedding & Cleaning, Grain (max. 10 lbs. per day) & Hay (max. 4 flakes per day), Use of Pastures and Facilities, and Turn-Out. In the event the aforementioned horses s physical condition, as solely determined by Stable, is considered unsuitable for showing or public representation of Stable, an additional feed fee shall be paid by Owner/Lessee. Additional feeding fees shall be based on $1.00 per one (1) pound of grain or two (2) hay flakes. Optional services available are as outlined in the Fee Schedule and shall be provided only after a written request of such desired services has been received by the Stable from the Owner/Lessee. The Owner/Lessee shall be solely responsible for the exercise of the horse and it is expressly understood by Owner/Lessee that the horse will be turned out in selected groups as decided by stable. Furthermore, it is expressly recognized and understood that the boarding of said horse, as agreed to herein, is not a personal services contract and accordingly, any services provided for hereunder may be performed by Stable or its employees, officers, agents and/or family members. Medications and supplements will only be administered after a Medication Administration Form has been completed and signed by both horse owner and Stable Management. Horse Health Warranty & Routine Care Requirement Owner/Lessee warrants that Horse(s) is/are free from infectious, contagious or transmissible disease(s), and will provide prior to time of delivery of said horse, to stable, proof satisfactory of a negative Cogging test current within the twelve month period immediately preceding delivery of the horse to stable. Owner/Lessee agrees to participate in the vaccination, worming, farrier and dentistry program as outlined in the Stable Policies and Safety Rules (Exhibit A). Emergency Care Stable agrees to attempt to contact Owner/Lessee, utilizing the above listed phone numbers, should Stable feel that medical treatment is needed for said horse, provided however, that in the event the Stable is unable to so contact Owner/Lessee within a reasonable time, which time shall be judged and determined solely by Stable, Stable is then hereby authorized to secure emergency and routine veterinary care and/or blacksmith care, and by any licensed providers of such care who are selected by Stable, as Stable determines is required for the health and well-being of said horse. The cost of such care secured shall be due and payable by Owner/Lessee within 5 days from the date Owner/Lessee receives notice thereof. Stable is authorized to arrange direct billing by posted care provider to the Owner/Lessee. Owner/Lessee agrees to notify Stable of any and all changes of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner/Lessee in the event of an emergency. In the event Owner/Lessee departs for vacation or is otherwise unavailable, prior to departure Owner/Lessee shall notify Stable as to what party is authorized to make decisions in the Owner/Lessee s place with regard to the health, well-being, and/or medical treatment of the horse. 2 Risk of Loss and Standard of Care The standard of care applicable to Stable is that of ordinary and reasonable care of a prudent horse stable and not as a compensated bailee. During the time that the horse is in the custody of Stable, Stable shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the horse. This includes, but is not limited to, any personal injury or disability the horse may receive while on Stable s premises. Owner/Lessee fully understands and hereby acknowledges that Stable does not carry any insurance of any horse not owned by Stable, including but not limited to, such insurance for boarding or any other purposes, for which the horse is covered under any public liability, accidental injury, theft or equine mortality insurance, and that all risks relating to boarding of horse, or for any other reason, for which horse is in the possession of Stable, are borne by Owner/Lessee. In no event shall Stable be held liable to Owner/Lessee for equine death or injury in an amount in excess of Five Thousand Dollars ($5,000) per horse. Owner/Lessee agrees to obtain equine insurance for any animals valued in excess of Five Thousand Dollars ($5,000), at Owner/Lessee s expense, or forego any claim for amounts in excess of Five Thousand Dollars ($5,000). Owner/Lessee agrees to disclose this entire agreement to Owner/Lessee s insurance company and provide Stable with the company s name, address and policy number. Failure to disclose insurance information shall be at Owner/Lessee s risk. Owner Acceptance of Responsibility During the time that the horse is being boarded, the horse shall be in the custody of the Stable. Owner/Lessee has inspected the Stable s premises and/or has in some other way satisfied himself that the conditions of the premises and the facilities will provide an adequate and reasonable level of care and safety for Owner/Lessee s horse. Owner/Lessee further agrees to be responsible for any and all damages, injuries and/or loss of life caused by or to the horse while in the control of the Owner/Lessee, Owner/Lessee s family members, invitees or other handlers or agents appointed by them, and also for any acts of the horse caused by vices or dangerous behavior not disclosed to the Stable by Owner/Lessee. Owner/Lessee is also responsible for accidents, injuries, and loss of life sustained by Owner/Lessee, Owner/Lessee s family members, invitees and agents caused by or in relation to the Owner/Lessee s horse. The Owner/ Lessee will have the use of designated Tack Rooms to store their equipment, equipment which is to be removed immediately upon boarding contract termination or considered to be a donation to the lesson program. Owner/Lessee is hereby warned that direct loss or damage, theft, injury or disappearance of Owner s/lessee s horses, tack, equipment or other property is not covered by Stable s insurance and Stable shall not be liable for Owner/Lessee s horses, tack, equipment or other Property. The Owner/Lessee must tidy the stable s equipment and premises after use. The Owner/Lessee must seek permission of the stable to be on the premises outside of the barn hours as posted in the Stable Policies & Safety Rules (Exhibit A). Stable Rules Owner/Lessee hereby acknowledges receipt and understanding of the current STABLE Policies & Safety Rules (Exhibit A), which are incorporated by reference in full, as if fully set forth herein. Owner/Lessee agrees he and his guests and invitees will be bound and abide by these Rules, and accepts responsibility for the conduct of his guests and invitees according to these Rules. Owner/Lessee acknowledges the Rules include but are not limited to: Stable Policies & Safety Rules (Exhibit A); Riding Instruction & Liability Release (Exhibit B); Statement of Applicable State Equine Liability Laws and Fee Schedule (Exhibit C). Stable may revise these Rules from time to time and Owner/Lessee agrees any revision shall have the same force and effect as current Rules. Failure, as determined in Stable s sole discretion, of Owner/Lessee or Owner/Lessee s guests and invitees to abide by Stable Rules may result in Stable declaring Owner/Lessee in default hereunder and may result in termination of this AGREEMENT. Assignment This AGREEMENT may not be assigned by Owner/Lessee without the express written consent of Stable. Term This agreement will extend for a term commencing on the date hereof and ending on the Horse s departure, unless terminated pursuant to the provisions in sub-paragraphs A, B, or C as set forth below: A. Default If the Horse Owner/Lessee or Stable defaults in the performance of their respective obligations hereunder, and such default continues for thirty (30) days after written notice specifying such default, then, in that event, this Agreement, at the option of the non-defaulting party, may be terminated by written notice at any time thereafter which such default continues; provided however, that if such default is cured, or, with respect to defaults requiring action other than the payment of money, if action to cure such default is undertaken within said thirty (30) day period and diligently pursued to completion, then this Agreement will continue as if the notice of default had not been served. B. Mutual Agreement This Agreement may otherwise be immediately terminated prior to the specific termination date, as described herein, by mutual agreement of the Horse Owner/Lessee and Stable. In the event, Horse Owner/Lessee and Stable shall mutually arrange and agree upon the terms of such termination and appropriate pro-rated boarding refund if applicable. C. One Party Termination This Agreement may also be terminated by the Horse Owner/Lessee or by Stable with thirty (30) day advance written notice by certified mail and/or made by the party seeking termination to the other party. Stable will upon termination of this Agreement, at the Horse Owner/Lessee s sole expense: 1. Surrender to the Horse Owner/Lessee the records, if any, associated with the boarding of the Horse. 2. Surrender the Horse to the Horse Owner/Lessee. The Horse Owner/Lessee will, upon termination of this Agreement: 1. Make prompt and immediate payment in the form of cash, cashier s check, or bank money order, in the amount equal to any and all remaining expenses due on account relating to the Horse which are due and payable up to and including the date of the Horse s department from the Stable, prior to the Stable s required release of the Horse. 2. The Horse Owner/Lessee shall, upon termination of this Agreement, release Stable from all further obligations of any sort relating to the Horse and/or the Horse Owner/Lessee. Stable reserves the right to terminate this agreement with a seven (7) day notice via certified mail or e- mail if it deems a horse s and/or Owner s/lessee s behavior is detrimental to Stable with any boarding refunds being issued 30 days after such notice minus any outstanding expenses due on account relating to the Horse. Governing Law This Agreement shall be governed by the laws of the State of Indiana. Severability If any term, covenant, condition, or provision of this lease is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. THIS AGREEMENT constitutes the entire Agreement between the parties. Any modifications, additions or submissions must be in writing and signed by all parties to this Agreement. No oral modifications will be considered part of this agreement unless reduced to writing and signed by all parties and specifically incorporated by reference into this Agreement. The parties agree that the electronic signature of a party to this Agreement shall be as valid as an original signature of such party and shall be effective to bind such party to this Agreement. This agreement is subject to the Laws of the State of Indiana, executed at Whitestown, Indiana on the date first set forth above. STABLE, Sport Horse Inc. OWNER/LESSEE Page 2

3 Policies & Safety Rules BARN HOURS April 1st through October 31st are Tuesday through Sunday, 9:00 to 21:00. November 1st through March 31st, Tuesday through Friday 9:00 to 21:00, Saturday & Sunday 9:00 to 19:00. Arena lights must be off 30 minutes prior to closing, No EXCEPTIONS. We are ALWAYS CLOSED MONDAYS, we would like to grant everyone as much access to their horse as possible however we also live on the property, please respect our hours! Non-emergency Monday visits will incur $25/incident surcharge to the owner of that horse. KEEP YOUR SPEED ON THE PROPERTY UNDER 5 MPH! We have children, ponies, cats, dogs not to mention squirrels playing & frolicking on the driveways & foot paths. Any driveways or gravel paths south of the old barn parking lot are for foot and horse traffic only, NO DRIVING OR PARKING OF VEHICLES. Trailers are to be parked in designated areas only. Please utilize the barn muck tubs (NOT the driveways, parking lot or grass areas) when cleaning out your trailer. For the safety of the property & the equines it maintains, absolutely NO SMOKING in the barns! For the safety of the horses & riders, absolutely NO OUTSIDE DOGS on the premises! For everyone s safety, DO NOT FEED ANY ANIMALS YOU DO NOT OWN (yes, treats are also considered food)! That includes horses, barn cats & dogs. All HANDLERS & RIDERS must sign a Liability Release, NO EXCEPTIONS! The forms are located in the barn office/lounge next to the payment box, completed forms may be dropped in the payment box. HELMETS and proper footwear are to be worn by all mounted riders all of the time! All minors hacking/jumping without trainer supervision MUST be accompanied by a parent or designated responsible ADULT! Isleways are to be kept free of clutter at all times. Each boarder will receive a storage space for one average size storage container (tack trunk or tupperware), one saddle and one bridle. Anyone requiring additional storage will need special permission. TAKE PERSONAL RESPONSIBILITY AND PICK UP YOUR BELONGINGS, any items (boots, halters, brushes, crops, etc.) left in the isles will be considered unwanted & disposed of. Free lunging in the indoor or outdoors rings is strictly prohibited, damaged landscaping will be charged to the responsible party! If you move any jumping equipment (standards, poles, cavalletti, etc.) please return them to the position you found them in. Please do not ride in the yard by & surrounding the house. Sharing rings with an active lesson program ranging from beginners to advanced riders please be mindful of Arena Etiquette. Riders hacking should yield to riders in lessons and yield to beginner riders. For the safety of all, follow the left to left shoulder rule when passing head on or announce inside or outside when passing. Riding alone is not advised, please try to ride with a buddy or during times when there are others on site. Leases and partial boarding of horses must be approved and deemed appropriate by the Management. Lessees and partial boarders are required to adhere to all boarding contract rules. Turn out is managed & monitored by SHi. For the health, sanity & wellbeing of the horses, expect daily turn out. Exceptions are: Winter temperatures below 15 degrees & Summer temperatures above 90 degrees (when we may opt to turn out at night) and a written veterinarian stall rest request inclusive of diagnosis and treatment protocol. 4 With the changing of the seasons, optional amenities for creature comfort are available. For the months of June-September, owner supplied stall fans will incur a monthly electrical surcharge of $10 per fan. Owner supplied fly sheets, which require daily handling, will incur a monthly surcharge of $20 per horse. For the winter months of December through March, there is no charge for occasional changes of owner supplied winter blankets (more than once per week IS NOT occasional and will be billed at a monthly surcharge of $20 per horse). To assist with keeping horses properly hydrated during the coldest winter months (December-March), a boarding requirement for every horse is the owner supplied insulated water bucket. SHi will be taking bucket orders through November 30th at a discounted rate to you, anyone interested please for more details. Compared to regular buckets these are EXPENSIVE, so please label all bottoms with permanent marker and expect to be notified of any broken bucket incidents. Plug in of these buckets is optional and will incur a monthly electrical surcharge of $10 per bucket. As a boarding requirement, your horse will need the following vaccinations & wormings performed by either of the designated SHi Veterinarians (Dr. Jason Herrmann, or Dr. Bruce McDavitt, ) Quarterly Flu/Rhino vaccine, Bi-annual fecal egg count & consequent worming (if necessary), Annual Strangles, Rabies vaccine and dental float. Prior to arrival, all new boarders must supply a Negative Coggins Test. It is YOUR responsibility to contact either veterinarian and set up billing accounts for the welfare and emergency care of your horse. All scheduling will be handled by SHi Management. If you choose to haul or have your horse hauled to utilize your own veterinarian, please provide written proof of required services having been performed prior to the published deadline as published on the website via the boarder s blog. Farriery is also a bi-monthly (every 8 weeks) requirement of the boarding program. We have two SHi approved farriers that are on a regular monthly rotation, Brandon Fouch and Danvers Childs. All scheduling will be handled by SHi Management. If you choose to haul or have your horse hauled to utilize your own farrier, please provide written proof of this service having been performed. Our Equine Nutrition Program, comprised of three different Buckeye Quality Feeds, is monitored by SHi management & endorsed by the resident Veterinarian. Along with grass & grass/alfalfa hay, catering to your horse s individual needs & activity level, we strive to keep each horse at it s optimum weight. If you feel your horse requires a dietary change, please discuss it with management. A board discount will not be given for optional owner supplied feed. Owner supplied supplement will be fed as requested, free of charge if all supplements are contained in one bag/container. Any prescribed medications (including bute) will only be administered to your horse after a Medication Form has been received by management. Forms are located in the barn office/lounge by the payment box. Please be courteous, helpful and respectful to those around you. SHi is a cooperative group, the goal is for everyone to enjoy their time spent here. Be aware of your safety and those around you! Cross ties, wash rack and barn office/lounge require CLEAN UP AFTER YOURSELF AND YOUR HORSE! These common areas are used by EVERYONE, do not leave a mess for the next person! If you feel you cannot clean up after yourself or your horse, please do not use these shared areas! Take nothing but pictures. Leave nothing but footprints. 5 Riding Instruction & Liability Release Under Indiana Law, an equine activity sponsor or equine professional is not liable for any injury to or the death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. In consideration of the payment of a fee and signing of this agreement, I, the above referenced listed individual, and the parent or legal guardians thereof if a minor, do hereby voluntarily request and agree to participate in riding instruction as a student at Sport Horse Inc. for instructional purpose, today and of all scheduled future dates. Policies. Lessons are payable as outlined in the current Fee Schedule, which is incorporated by reference in full and attached hereto as Exhibit C. Cancellations with a 24 hour notice will not incur a fee, all others will be charged the fee of a lesson per no show or late cancellation. The first lesson for any new student will serve not only as a consultation visit to assess their riding ability but also be an introduction to the riding center and staff. It is the responsibility of the student to have the appropriate attire for riding and weather conditions. Required supplies provided by student are: ASTM/SEI approved riding helmet, paddock boots with jodhpurs or jeans & chaps. Optional supplies provided by students include: Hair net, gloves, spurs and crop. No mounting of horses in barn or stall, lead horses to the riding arena to mount. While in the ring area, please be aware that quick gestures, clapping, unsecured papers, flash from cameras, etc. may cause a horse to startle. No amount of training can eliminate the flight or fight instincts of horses and thus the equine is to be considered a possible danger to the Rider and to those persons engaged in all activities involving the equine. In light of the aforementioned, please supervise your children closely, NO running, yelling or horseplay permitted on the premises. For safety reasons, at no time are children to be left unsupervised or pets allowed on the premises. Parents, caregivers and visitors are asked to stay on the outside of the ring unless asked to enter by the instructor. While the instructor is giving instruction, interaction with riders should be avoided so that they can focus on the lesson. In consideration of safety and others, there is NO SMOKING permitted in the barn areas or arenas. Signature below acknowledges receipt and understanding of the current Lesson and Safety RULES, which are incorporated by reference in full, and attached as Exhibit D. Students agree they and their guests and invitees will be bound and abide by these Rules, and accept responsibility for the conduct of their guests and invitees according to these Rules. Agreement Scope & Definitions. This agreement shall be legally binding upon me the registered student, and the parents or legal guardians thereof if a minor, my heirs, estate, assigns, including all minor children, and personal representatives; and if it shall be interpreted according to the laws of the State and County Sport Horse Inc. physical location. Any disputes by the rider shall be litigated in, and venue shall be in the county in which Sport Horse Inc. is physically located. If any clause, phrase, or word is in conflict with state law, then that single part is null and void. The term Horse herein shall refer to all equine species. The term Horseback Riding herein shall refer to riding or otherwise handling of horse or ponies, whether from the ground or mounted. The terms Student and/or Rider shall herein refer to a person who rides a horse mounted or otherwise handles or comes near a horse from the ground. The terms Me, My shall herein refer to the above registered student rider and the parents or legal guardian thereof if a minor. Page 5

6 Rider Responsibility & Equipment. I understand that: Upon my mounting a horse and taking up the reins the rider is in primary control of the horse. The rider s safety largely depends upon his/her ability to carry out simple instructions, and his/her ability to remain balanced aboard the moving animal. I agree that the rider shall be responsible for his/her own safety, including that of an unborn child, if the rider is pregnant. Pregnant women should ride horses only under the advice of their physician. Sport Horse Inc. advises pregnant women not to ride horses. I agree that: I, for myself and on behalf of my child and/or legal ward have been fully warned and advised by Sport Horse Inc. that protective headgear which meets or exceeds the quality standards of the SEI CERTIFIED ASTM STANDARD F1163 Equestrian Helmet, should be purchased and worn while riding and being near horses and I do understand that that the wearing of such headgear at these times may reduce severity of some of the riders head injuries and possible prevention of riders death from occurring as the result of a fall and other occurrences. I understand that: In consideration of being permitted to use the equipment/tack of Sport Horse Inc., I/we for myself and my personal representatives, heirs, distributes, guardians, legal representatives, next of kin, and assigns acknowledges, agrees and represent that he/she, or will immediately prior to using such equipment/tack, and will continuously thereafter inspect such equipment/tack, and does further warrant that his/her use of such equipment/tack constitutes an acknowledgement that he/she finds and accepts such equipment/tack as being safe and reasonable suited for the purposes of its use, and he/she further agrees and warrants that if, at any time, he/she feels any equipment/tack are unsafe, he/she will immediately advise his/her instructor and will immediately cease using such equipment/tack or will immediately correct the condition which makes the equipment/tack unsafe. For example: Saddle girths may loosen during a ride. Upon the riders awareness of a loose girth, immediate notification to the trainer may prevent sliding of the saddle and a possible fall from the animal. The student must tidy the stable s equipment and premises after use. The student must seek permission of the stable to be on the premises outside of the allotted lesson time and posted stable hours (as referenced in the Barn Rules). Activity Risk & Inspection of Premises. I understand that: Horseback Riding is classified as RUGGED ADVENTURE RECREATIONAL SPORT ACTIVITY and that there are numerous obvious and non-obvious inherent risks always present in such activity despite all safety precautions. Sport Horse Inc. follows a rigid safety program, yet no horse is a completely safe horse. Horses are 5 to 15 times larger, 20 to 40 times more powerful, and 3 to 4 times faster than a human. If a rider falls from a horse to the ground, it will generally be at a distance of 3½ to 5 feet and the impact may result in injury to the rider. If a horse is frightened or provoked it may divert from its training and act according to its natural survival instincts. These may include but are not limited to: stopping short, changing directions or speed at will, shifting its weight, bucking, rearing, kicking, biting or running from perceived danger. I understand that: A horse has two blind areas around it in which it cannot see. It cannot see directly behind it or what it is eating. This is the reason it is best to approach a horse calmly and quietly close to the shoulder, and never to surprise a horse from the rear, or to reach first for the horse s mouth. I understand that: Sport Horse Inc. is NOT responsible for total or partial acts, occurrences or elements of nature that can scare a horse, cause it to fall, or react in some other unsafe way (i.e. thunder & lightening, hail, wind, wild & domestic animals flying or running nearby, insects which may bite or sting a horse, irregular footing, temperature changes, natural or man made landscape changes).
