2 Notice to all Purchasers CONDITIONS OF SALE 1. In the event that the Vendor wishes to place a reserve on a lot the amount must be specified on the entry form 2. All purchasers and vendors are deemed to have full knowledge of these Conditions, and purchasers to have heard and understood the Auctioneer s description of the lot. 3. The Auctioneer may refuse, without giving a reason to accept either entries or bids from certain people. 4. Each lot shall be entirely at the owners risk until the fall of the hammer at which point it is the responsibility of the Purchaser. The Auctioneer will not be responsible for loss, injury or death of an animal or article on the Sale unless by negligence of the auctioneers or their staff. 5. The highest bidder shall be the purchaser and in the event of a dispute the lot shall be re-offered. 6. Neither the Vendor nor the Purchaser of a lot shall have any remedy against the Auctioneer in respect of a lot. The Auctioneer acts only as an agent inviting bids for the lot, but will supply names and addresses of principals on request by either in the event of a dispute. 7. Any lot bought in by any person other than the owner will be treated as sale and commission charged. The vendor has the right to place a reserve on each lot. 8. If any purchaser fails to comply with these or any other Conditions the lot in question may be re-offered and if upon resale a lower price is obtained than when first sold then the shortfall as well as expenses incurred shall be liability of the purchaser in default on the first sale. 9. Sales can be made privately providing that the animal has first been offered by Auction and the sale is booked through the Auctioneers and the commission deducted. 10. Should a horse not be sold by auction the Auctioneers reserve the right on the sale day to negotiate the sale of that lot by private treaty to interested party at the reserve price of the lot without reference to the seller. 11. The Auctioneers do not give any warranty as to the seller title or right to sell the same and that the entry has been accepted by the Auctioneer in good faith and without express knowledge of any default in the sellers title. 12. Any lot taken from the sale before payment will be treated as stolen and the matter reported to the police. 13. All lots to be sold in guineas 14. All lots while offered for sale in good faith will be sold under dispersal sale conditions without any warranty whatsoever 15. All Covering dates are given as a guide only. 16. A Foal must be issued with a passport by 31 ST December of the year of birth or by 6 months of age, whichever is the later. However, if the foal is sold or exported with or without it s dam or sent for slaughter it will require a passport regardless of its age
