1 Entered into in and between And HUNTING AGREEMENT PHUDUHUDU SAFARI S (Pty) Ltd (herein after the Outfitter ) From (herein after the HUNTER ) 1. Whereas the HUNTER hereby agrees to be bound by the Hunting Rules annexed to this document, which forms part of this agreement and confirms that he/she would comply with each and every rule stipulated in this document. 2. The hunter confirms that, in order to hunt legally on the Outfitters farm, all laws of the Republic of Botswana shall be adhered to and shall apply. 3. The Hunter and those accompanying him/her, hereby unconditionally indemnifies the Outfitter against any and all claims for damages or otherwise, to person or property and/or costs, charges and expenses which he/she and those accompanying him/her may incur arising out of, or attributable to, his/their visit to the game farm. The parties hereto record that the Outfitter will not be liable for any damage caused and/or negligence of any of its agents and/or employees and/or servants and that the Hunter and those accompanying him/her, voluntarily accepts the risk involved and attendant on any hunting expedition the Hunter may embark upon. 4. In the event of the Hunter s breach of any term or condition of this agreement, it is recorded that the Outfitter or PH involved may at any time cancel this agreement and request the hunter and those accompanying him/her, to leave the game farm immediately, and all moneys, charges and costs due to the Outfitter or PH, will immediately be due and payable. 1

2 5. The Hunter hereby confirms his/her desire to hunt and kill the following animals and further hereby consents to the price of each animal, as listed below: ANIMAL QUANTITY PRICE TOTAL 6. The hunter further confirms that the accommodation costs and day fees are the following: HUNTERS day fees Accomodation DAYS PRICE TOTAL 7. The HUNTER consents to liability for all the above amounts towards animals hunted, irrespective of whether killed or only wounded, together with accommodation costs, as well as day fees and catering costs and agrees to pay the total of the above before departure. 3 HUNTING RULES PHUDUHUDU SAFARI S ODENDALSRUSTFARM, LOBATSE, BOTSWANA 1. The Hunter hereby consents to the use of the Professional Hunter ( PH ) appointed by the Outfitter and confirms that he/she would comply with and adhere to the guidelines and descissions made by the PH and/ Outfitter at all times. 2. The Hunter accepts liability for all animals killed or wounded, whether the animal/s are found or not. If you hit you pay, with or without blood. 3. The Hunter accepts liability for every shot taken. The guide will show you the animals but will not take responsibility for it s size, sex or weight. 4. No round may be chambered in any weapon during the course of the hunt. The weapon shall remain on safety mode and may only be loaded immediately prior to aiming at the selected animal. 5. Weapons and ammunition must at all times be safe and declared safe. All weapons to be secured in the safe at all times whilst at camp. 6. Hunters shall attend the shooting range before their first shot at an animal, to ensure they are comfortable with the weapon of their choice. 7. No weapons may be handled, cleaned or worked on in camp, unless prior permission was obtained from the PH/Outfitter. 8. Only animals that are pointed out by the PH/Outfitter or his guide may be shot at, in the event that the Hunter willfully aims and shoots at another animal, it is agreed that the said hunter will be liable for twice the said animal s price, irrespective of whether the said animal is found or not. 9. The consumption of alcohol is prohibited before or during the hunt, but may be used responsibily afterwards. 10. Any person who consumes or is suspected of having consumed alcohol before or during a hunt, will not be allowed to shoot or hunt. 11. If, at any time, alcohol is misused, the Outfitter or PH may call off and cancel the hunt and any deposits or amounts paid in advance shall be retained as rouw koop and be regarded as liquidated damages. 12. Nature, the environment and animals must at all times be respected. Do not break or remove any trees and/ plants and if traveling by vehicle, kindly stick to the roads. 13. No small game or birds may, at any time, be hunted or shot at without the prior permission of the PH or Outfitter. 14. All co-hunter s opinions must be respected at all times to avoid unneccessary conflict. 15. The hunting camp and all equipment, including hunting vehicles and especially rifles, must be respected and handled with reasonable care at all times. Any damages caused by the hunter, will be deducted from the deposit. 16. No open fires allowed outside the camping area. Smokers must ensure that all cigarette butts are extinguished, every smoker is responsible and liable for his own actions. No smoking is allowed in the challet rooms. 17. Littering in hunting grounds, the veld or around camps is prohibited. 3

4 18. Any problem, whatever the nature, must be reported to the PH/Outfitter immediately. The PH, in the absence of the Outfitter, is at all times in charge of the hunt and their decissions are binding and final. 19. The hunter and those accompanying him/her assumes and accepts responsibility and liability for any and all damages caused by him/her whether willfully or negligent, to the property of the Outfitter, or the PH or any of the Outfitter s employees and undertakes to pay for such damages before departure from the game farm. 20. No shooting in a Radius of 500m from the Safari Camp is permitted. 21. No Hunting allowed ½ hour before sunset, although night game drives can be arranged with PH or/outfitter in advance. 22. Fire extinguishers not to be used unless in case of fire. 23. No Hunting allowed FROM vehicles, unless a Hunter cannot walk due to a medical condition. In such cases the Hunter should arrange with PH/Outfitter in advance at time of booking. 24. Any desputes between hunters and guides/camp personnel should be brought to the attention of the PH/Outfitter immediately or as soon as practically possible. Do not take the law into your own hands. 25. The Outfitter or any of his employees will take no responsibility for any accident/incident that may occur at any time during the stay on the farm, although the personnel will take all precautions to ensure a safe stay and hunt. 26. In the event of the Outfitter or PH having to commence legal action against the Hunter for the enforcement of the terms and obligations arising from this agreement, the Hunter agrees and undertakes to pay all legal expenses arising therefrom on an attorney and clients scale, including, but not limited to, collection commission of 10% on each and every installment and value added tax.
