1 GUN HUB, INC. (DBA GUN HUB USA) RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT 3593 COLORADO AVE, SHEFFIELD VILLAGE, OH All persons desiring to use any GUN HUB, INC. (DBA GUN HUB USA) (hereinafter GUN HUB USA ) facility, including, but not limited to the range, are required to read, understand, acknowledge, and sign these RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT, and any amendments thereto. A parent or legal guardian must sign, in the presence of an employee of GUN HUB USA, these RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT on behalf of any person under eighteen (18) years of age who desires to use the range. GUN HUB USA is NOT responsible for lost or stolen items. Please secure your property. FIREARMS & TARGETS RANGE RULES AND REGULATIONS a) All firearms brought into any GUN HUB USA facility must be UNLOADED, except for personal defense firearms carried: i. In compliance with Open Carry in the State of Ohio; and/or ii. By a person in possession of a concealed carry license that is valid in the State of Ohio. Page 1 of 6
2 b) All such personal defense firearms shall remain holstered until the person carrying the firearm is on the firing line. c) All firearms, accessories, ammunition, and targets are subject to inspection and approval by the Range Safety Officer (RSO). d) Targets may be used on the range ONLY if approved by the RSO. i. Approved targets are available for purchase at GUN HUB USA. 2. RANGE SAFETY OFFICER (RSO) a) One or more RSOs shall be on duty while the range is in use. b) The RSO(s) on duty is/are in direct charge of the range and all activities taking place on the range at all times. c) All persons on, or entering, the range shall follow the instructions/directions of the RSO. d) Any RSO, at the RSO s sole discretion, may: i. Ban from the range and/or any GUN HUB USA facility any person who handles a firearm in an unsafe or careless manner; and ii. Terminate a member s membership should said member s conduct warrant. 3. RANGE PROCEDURE a) Eye and hearing protection shall be worn by all persons entering the range and shall be put on before entering the range. NO EXCEPTIONS. b) Appropriate dress is required at all times. c) Persons who, at the sole discretion of GUN HUB USA, are deemed to be a safety concern (including, but not limited to, persons believed to be under the influence of alcohol or drugs) shall be required to leave the facility. GUN HUB USA reserves the right to refuse service to anyone. d) Persons entering the range shall take position at the lane assigned to them. Do not change lanes. e) The order to CEASE FIRE or CEASE FIRING means: i. STOP SHOOTING; ii. All shooters: REMOVE FINGERS FROM TRIGGERS; iii. Each shooter: PLACE FIREARM ON THE BENCH in the shooter s lane with MUZZLE POINTED DOWNRANGE; iv. Everyone STEP BACK from the firing line. f) No firearm handling is permitted behind the firing line. i. All firearms shall be uncased on the firing line. g) A responsible adult must accompany each person under eighteen (18) years of age onto the range. This adult shall act as a coach, and MUST remain with the minor at all times while the minor uses the range. h) A maximum of two persons are permitted in each firing lane. This may include a shooter and a coach, or a primary shooter and a guest shooter. i) No one is permitted forward of the firing line or beyond the designated area. j) Shooters shall load and fire only one firearm at a time. k) Each firearm s muzzle must be pointed down range at all times. l) If a mechanical malfunction occurs request assistance from the RSO. i. If you cannot clear a jammed or malfunctioning firearm, DO NOT REMOVE JAMMED OR MALFUNCTIONING FIREARMS from the firing line ii. Contact the RSO immediately for assistance. Page 2 of 6
3 m) Only line of sight firing is permitted. Keep your finger off the trigger until you have a sight picture on target. n) When leaving the firing line temporarily: i. Unload and clear all the firearms that are in your lane. ii. Lay all firearms down on the bench in your lane with muzzle pointed down range and action open. iii. Leave all firearms actions up so that the empty chambers can be observed by the RSO. o) Upon completion of shooting session: i. Unload and clear all firearm(s). ii. Leave all action(s) open. iii. Case, or prepare firearms for transport, in your lane. p) NO FOOD, DRINK, CHEWING TOBACCO, SNUFF, OR SMOKING ALLOWED ON THE RANGE. 4. VANDALISM a) Any shooter seen, or determined to have been, firing at anything other than the targets in that shooter s lane (including but not limited to lights, baffles, carriers, or any other range property, or equipment) will have his/her membership suspended, if any, and will be reported to the proper authorities for appropriate action. i. Each shooter will be liable for any and all damage caused by said shooter, including but not limited to the costs of replacement and installation associated with said damage. b) Firing at anything other than approved targets is prohibited. c) Only targets approved by the RSO will be permitted. 5. PERMISSABLE FIREARMS a) Rifles up to and including.30 caliber. b) Most handguns. i. Handguns chambered for centerfire rifle ammunition above 2,000 fps are not permitted on the range. c) Fully automatic firearms are allowed at the sole discretion of the Chief RSO and proper paperwork must be presented in advance. (Only handgun calibers will be allowed). i. GUN HUB USA reserves the right, in its sole discretion, to refuse to allow fully automatic firearm use in any GUN HUB USA facility. d) Shotguns are allowed at the sole discretion of the Chief RSO. e) All air guns and BB guns are allowed at the sole discretion of the RSO. f) For firearms not covered here, check with the Chief RSO prior to use. 6. PERMISSABLE AMMUNITION a) All ammunition is subject to inspection and approval by the RSO. b) In most cases, standard commercial and reloaded ammunition is permitted with the following exceptions: i. Ammunition used in firearms rented from GUN HUB USA must be purchased from GUN HUB USA. No outside ammunition shall be used in firearms rented from GUN HUB USA. ii. NOT PERMITTED: Any ammunition designed for penetrating metal. Page 3 of 6
4 7. BRASS RETRIEVAL iii. NOT PERMITTED: steel shot, and/or steel jacketed/core projectiles. iv. NOT PERMITTED: tracer, incendiary, armor piercing, gas or explosive ammunition. a. Shooters are permitted to collect their brass with the following exceptions: i. Shooters are NOT permitted to take brass left by other shooters. ii. No one may move forward of the firing line to retrieve brass. iii. No one may collect brass that has fallen forward of the firing line. b. Upon completion of shooting session, shooters shall sweep all brass not collected by the shooter forward of the firing line. 8. EYE PROTECTION: Safety glasses are MANDATORY when entering the range. GUN HUB USA sells safety glasses for a nominal fee. 9. HEARING PROTECTION: Hearing protection is MANDATORY when entering the range. GUN HUB USA sells hearing protection for a nominal fee. PLEASE ASK THE RANGE SAFETY OFFICER ABOUT ANYTHING TO WHICH YOU ARE NOT SURE Page 4 of 6
5 RELEASE AND INDEMNITY AGREEMENT I, the undersigned, for myself and on behalf of my representatives, assigns, heirs, executors, and administrators, in consideration for GUN HUB, INC. (DBA GUN HUB USA) (hereinafter GUN HUB USA ) allowing me to use its facilities, including the firing range, and to participate in, or observe, any other firearms related activities/programs, including, but not limited to, firearms instruction and training, test firing, firearms rentals (if any), and demonstrations (together the Activities ), having perceived, appreciated, and assumed the risk inherent in firearms operation, lead exposure, and the Activities including, but not limited to, the possibility of personal or property injury, permanent disability, and/or death due to accidental discharge; equipment malfunction and/or failure; ricochet; misunderstanding of instructions; omission or error on the part of instructors, range/safety officers, and/or other participants in the Activities; and/or actions of other participants in the Activities I do hereby agree as follows: 1) I hereby FULLY RELEASE, INDEMNIFY, HOLD HARMLESS, AND DISCHARGE: GUN HUB USA and all other persons and organizations associated with GUN HUB USA including, but not limited to, its owners, directors, officers, associates, employees, representatives, trainees, trainers, instructors, range/safety officers, gunsmiths, affiliates, agents, and members (together the Released Parties ) with regard to any and all claims, liabilities, and expenses (including attorney s fees) related in any way to my participation in the Activities. 2) I certify that I have read and understand the foregoing RANGE RULES AND REGULATIONS of GUN HUB USA (hereinafter Rules ) and agree to abide by said Rules and all instructions given by range/safety officers. I understand and agree that my failure to abide by any rule or instruction may result in my immediate removal from the firing line, and expulsion from the Activities and the GUN HUB USA facility. I will, at all times, exercise safe firearm handling practices and will not operate any firearms or equipment with which I am not completely familiar. 3) I certify that: a) I have answered all the questions on this form truthfully, completely and accurately; b) I have no medical or physical conditions that could compromise my safety and/or the safety of others in any of the Activities; c) I am not currently under the influence of alcohol and/or drugs, and I am not impaired in any way that would affect my ability to safely participate in the Activities; d) I have adequate insurance to cover any injury or damage I may cause or suffer, or else I agree to personally bear the costs of such injury or damage; e) I can lawfully possess and/or control firearms under federal, state, and local laws and regulations; f) I am not a Prohibited Person under federal law. 4) I consent to be financially responsible for, and to reimburse GUN HUB USA for, any action on my part (including, but not limited to, the discharge of a firearm) that causes damage to the range or equipment. I agree that I shall be liable for all costs, including attorney s fees, associated with enforcement of this RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT. 5) This RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT shall be governed by the laws of the State of Ohio. The venue for any cause of action related to this Agreement shall be a court of competent jurisdiction in Lorain County, Ohio. 6) Young Adults: If the participant is a young adult who is age eighteen (18) years old or older, but has not yet reached the age of twenty-one (21) years old, the participant acknowledges that the participant will not be permitted to rent firearms from GUN HUB USA and, absent the consent of the participant s parent or legal guardian as set forth below, will only be permitted to possess and/or control rifles and shotguns, at any GUN HUB USA facility, that are not regulated by the National Firearms Act. I have fully and carefully read this RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT and understand its contents. I am aware that this is a release from liability and indemnification agreement and a contract between the Released Parties and me and that this Agreement imposes limitations to my legal rights. 6 sign this RANGE RULES, REGULATIONS AND RELEASE AND INDEMNITY AGREEMENT of my own free will and with the intent to be legally bound by the terms set forth herein. Consent for Minor: If the participant is a minor who has not yet reached the age of eighteen (18) years old, the undersigned warrants that she/he is the natural or adoptive parent, or is the legal guardian of said minor and that the undersigned for him/herself, and on behalf of the minor and the minor s representatives, assigns, heirs, executors, and administrators, agrees to be legally bound the terms set forth herein and to be liable for any and all damages caused by said minor, if any. Consent for Young Adult: If the participant is a young adult who is age eighteen (18) years old or older, but has not yet reached the age of twenty-one (21) years old, the undersigned warrants that he/she is the natural or adoptive parent, or is the legal guardian of said young adult and that the undersigned: (a) authorizes said young adult to use/shoot one or more pistols/handguns, and (b) for him/herself, and on behalf of the young adult and the young adult s representatives, assigns, heirs, executors, and administrators, agrees to be legally bound the terms set forth herein and to be liable for any and all damages caused by said young adult, if any.
