Specifically, in October, in Fergus County, the defendant hunted a trophy bull elk without a license (Bull No. ). PENALTY: A person convicted of Hunting Without a License shall be imprisoned in the county jail for a term of not more than six () months or be fined an amount of not less than $0 or more than $1,000, or both. In addition, the person may be subject to forfeiture of any current hunting, fishing, or trapping license issued by this State and the privilege to hunt, fish, or trap in this State or to use State lands as defined in -1-1 for recreational purposes for a period of time set by the Court. COUNT V: FAILURE OBTAIN LANDOWNER PERMISSION FOR HUNTING, a misdemeanor, in violation of Montana Code Annotated --, in that the defendant failed to obtain permission of the landowner, the lessee, or their agent INFORMATION -

4 1 1 before taking a game animal while hunting on private property. Specifically, in October, in Fergus County, the defendant hunted on the Bar Ranch without permission. PENALTY: A person convicted of Failure Obtain Landowner Permission for Hunting shall be fined an amount of not more than $. COUNT VI: TAMPERING WITH OR FABRICATING PHYSICAL EVIDENCE, a felony, in violation of Montana Code Annotated --, in that the defendant, believing an official proceeding or investigation is pending or about to be instituted, altered, destroyed, concealed, or removed any record, document, or thing with purpose to impair its verity or availability in the proceeding or investigation. Specifically, in September or October, in Fergus County after Fish, Wildlife, and Parks executed a search warrant at the Meadow Creek Ranch, the defendant cut the antlers of a trophy bull elk skull and threw them into a pond (Bull No. ). PENALTY: A person convicted of Tampering With Or Fabricating Physical Evidence shall be imprisoned in the state prison for a term of not more than ten () years or be fined an amount of not more than $0,000, or both.
