Interpretation The Applicant means the individual who signs this Contract and agrees to be bound by its terms and includes a guardian of that individual if the individual is under 18 years of age. 2. The applicant, hereby agree to be bound by the terms of this Contract with THE SHAOLIN JEE SHIN WING CHUN KUNG FU ASSOCIATION and the persons named and described in Schedule 1, hereinafter jointly and severally referred to as the providers. The providers agree to permit me to use their premises and facilities for Martial Arts, to instruct me in Martial Arts and related activities ( the service ) upon and subject to the following terms and conditions. (a) Club Fees The Applicant will pay on demand the prescribed or stated fees for this service. Such fees may be notified to the Applicant by letter or memorandum or by notice displayed in the provider s premises or premises occupied by the provider or verbally. (ii) Insurance Charges A Student s Insurance premium must be paid for by the end of February of each year and every following year. The balance of membership costs can be paid by your joining date. (b) Medical Conditions The Applicant warrants that he or she has not at any time suffered any blackout, seizure, convulsion, fainting or dizzy spells and is not presently receiving treatment for any illness, disorder or injury which would render it unsafe for the Applicant to take part in Martial Arts. (c) Exclusion of Applicant The Applicant warrants that he or she has not at any time been excluded from Martial Arts by a medical practitioner or any person or entity including a Martial Arts Club. (d) Rights of a Consumer If the Practices Act 1974 or similar state laws apply to this agreement then certain terms and rights may be implied into this contract which operate for the benefit of the supplier flowing from them, cannot be excluded, restricted or modified by any provision of the contract. 3 (e) Waiver and Indemnity In all other cases and except where inconsistent with the above, the Applicant for him/ herself, his/her executors, administrators, dependents and other personal representatives, hereby absolves and indemnifies the providers and all their servants, agents, employees and other students or persons under the providers control (the indemnified ) from all liability howsoever arising for injury or damage (including but not limited to the Applicants person, whether fatal or otherwise, property and personal belongings) however caused including by the negligence of the indemnified, arising out of or participating in Martial Arts or in connection with Martial Arts or in any way caused by, or arising out of, any activity carried on by the indemnified. (f) Martial Arts done at Applicant s own Risk Any person training Martial Arts, or in activities connected with Martial Arts or participating in any activity carried out by this Club/Academy Company are only allowed to do so on the distinct understanding that they do so entirely at their own risk. (g) Acceptance Performance of the provider s obligations under the contract may be affected by any one or more of the providers either jointly or severally. (h) Governing Law Any agreement entered into pursuant to this acceptance is to be governed by the laws of the State of and the Courts of shall have exclusive jurisdiction to entertain any action in respect of any such agreement. 4 Wing Chun Bendigo Etiquette. We are all on different journeys with our kung fu training. To ensure we get the most out of our trip and arrive at your destination we have put together the following guidelines so we work as a team. Park your car at the rear of the building. Fingernails and toe nails need to be clipped as these can injure a fellow student, spread blood and possibly AIDS. UNIFORM New students up to three months can wear casual clothing. After your induction time we go by the Jee shin attire. The pants can be purchased from The Greensborough office and must resemble Chinese pants which are gathered at the ankle. This is also part of our image and marketing. Pants that are open at the ankle don t represent our Chinese heritage and Jee Shin Brand. TRAINING SHOES are to be worn in all gradings and when training in Melbourne. They are a flat sole shoe and are only worn in the Kwoon. The idea is not to bring dirt onto the mats. GRADINGS. There is a minimum of 25 classes between each grading. 40 classes to do two grading s on the same day. It is suggested the grading should be done between 6 and 9 months. Any longer than this and you work rate is too low. Grading for the black sash a minimum of 12 months since you last grading and so forth for each gold sash.

5 MOBILE PHONES Please turn theses off or don t bring to class. You are there to train so is the student working with you. You have both paid good money to learn, maximise you time each lesson. At the start of each class we bow in respect of our teacher, our teacher s teacher, the founders of wing chun (Five styles Kung FU). Bow to you fellow students before and after each time you training with them in respect they have given their time to put into your learning and help grow you on your journey. When training with fellow students don t down load them with much information as you will confuse them and keep talk to a minimum in the class. Once again you are here to train not maximise you time on the KWOON. HAI What does this mean? Ideally after your instructor has given you an instruction we reply with HAI. 6 Black Sash. People often tell me they want to get a black sash. I always believe there is s deeper reason for achieving this, they never tell me why. Dig deep and be honest with yourself because it is this hidden reason that will carry you thru to get this grading. Only one in a hundred people ever get to this level. When you do get your black sash remember this is only the beginning of your study. In the old days the fable went something like this. After many years of training and retying your black sash the die eventually goes white. You to come back to learning the basics again. Then after hard work the Sash will get dirty and go black again. Each time you rise to another level. Enjoy your journey with Kung fu. Be honest with yourself and never believe that once you are a Black Sash you are better than anyone else. The moment you do you will get hit in a fight or in life. I believe it takes a minimum of eight years for your body to internally train the muscle to become instinctive in the moment of conflict.
