1 2016 AUSTRALIAN OLYMPIC TEAM DIVING AUSTRALIA NOMINATION CRITERIA DIVING NOTE: The AOC reserves the right to require amendments to the Nomination Criteria and amend its Selection Criteria as necessary, particularly where there is a change to the Qualification System or significant circumstances affecting the nomination process. 1. Shadow Team (1) Diving Australia (DA) will choose Athletes from within its sport to be members of the AOC s Shadow Team. The AOC may also recognise other Athletes from within this sport to be members of the Shadow Team. (2) In order to be chosen by Diving Australia as a member of the Shadow Team each Athlete must be a member of DA s National Squad in The process for selection in DA s National Squad is set out in DA s annual Selection Policy document found at (3) For the avoidance of doubt, subject to meeting the requirements under clause 1(4) below, athletes that are members of the 2016 National Squad will be eligible for nomination under clause 2 of this Nomination Criteria. (4) In order to be recognised by the AOC as a member of the Shadow Team the Athlete must have signed: the Consent to Shadow Team Membership Form (FORM 1A, attached) and in the case of minors, the Parents/Guardians Acknowledgment for Minors Form (FORM 1B) and provided it electronically to the AOC; and where over the age of 18, the AOC statutory declaration regarding anti-doping matters as required by the AOC from time to time (FORM 2, attached) and provide the original to the AOC at PO Box R1788 Royal Exchange NSW (5) Diving Australia will provide all Athletes chosen or recognised as members of the Shadow Team with the Guide to Olympic Team Selection, the Selection Criteria and this Nomination Criteria. The AOC Olympic Team Selection By-Law and the Qualification System will be made available on the AOC s website ( (6) Diving Australia will advise the AOC of the Athletes that it has chosen as members of the Shadow Team at such time as required by the AOC. (7) If an Athlete breaches the requirements of the Nomination Criteria, the Selection Criteria or the AOC Olympic Team Selection By-Law, Diving Australia or the AOC may suspend or terminate the Athlete s membership of the Shadow Team. 2. Nomination of Athletes (1) For the purposes of nomination to the AOC of Athletes for selection to the 2016 Australian Olympic Team, Diving Australia will: only nominate those Athletes who are, or are recognised by the AOC as, members of the Shadow Team; only nominate those Athletes it honestly believes have met the requirements described in this Nomination Criteria and only if those athletes have maintained the appropriate level of performance, maintained a suitable Diving Australia approved training program and attended camps and competitions as determined by Diving Australia under this Nomination Criteria; only nominate those Athletes (provided such athlete is over the age of 18) who have signed the AOC statutory declaration regarding anti-doping matters as required by the AOC from time to time;

2 (d) (e) not nominate more Athletes (including reserves) than the maximum number permitted under the Qualification System; not nominate Athletes who have breached the AOC Anti-Doping By-Law unless the Athlete has already been sanctioned for the breach and has completed the sanction imposed. (2) For Individual Events, there will be two pathways to achieve Nomination. (2.1) World Cup Gold Medal Pathway Provided that Australia has a qualified quota place(s) to compete in the 2016 Rio Olympic Games in the applicable event; (i) any athlete that has won a gold medal at the 2016 FINA World Cup competition in Rio de Janeiro, February 2016; and demonstrates form and fitness between 28 February 2016 and the conclusion of the 2016 Australian Open Championships, to the satisfaction of the DA Selection Committee as detailed in clause 2(2)(2.1); will be nominated to the AOC for selection in that event. The DA Selection Committee will consider advice from the DA National Coach Panel, advice from the DA Chief Medical Officer, as well as results at domestic and international competitions between 28 February 2016 and the conclusion of the 2016 Australian Open Championships to determine whether form and fitness can be demonstrated. Such determination will be at the absolute discretion of the DA Selection Committee. (2.2) Olympic Selection Trials Pathway In each applicable event, provided that Australia has one or two qualified quota places remaining following the application of clause 2(2)(2.1) above, the eligible athlete(s) that have: (i) (iii) competed at the 2016 Australian Open Championships with a minimum DD as required for Tier 1, 2 and 3 of the DA National Squad Performance Standards; and achieved a minimum of a HPP D Score (as set out in the DA National Squad Performance Standards) in both the Preliminary and Semi Final of the 2016 Australian Open Championships and a minimum of a HPP C Score (as set out in the DA National Squad Performance Standards) in the Final of the 2016 Australian Open Championships; and has the highest (and if two quota places remain, the second highest) combined score from the Preliminary, Semi Final and Final: will be nominated to the AOC for Selection in that event. (3) For Synchronised Events, there will be two pathways to achieve Nomination. (3.1) World Cup Gold Medal Pathway Provided that Australia has a qualified quota place to compete in the 2016 Rio Olympic Games in the applicable synchronised event; (i) any eligible synchronised pair that has won a gold medal at the 2016 FINA World Cup competition in Rio de Janeiro, February 2016; and

3 demonstrates form and fitness between 28 February 2016 and the conclusion of the 2016 Australian Open Championships, to the satisfaction of the DA Selection Committee as detailed in clause 2(3)(3.1); will be nominated to the AOC for selection in that event. The DA Selection Committee will consider advice from the DA National Coach Panel, advice from the DA Chief Medical Officer, as well as results at domestic and international competitions between 28 February 2016 and the conclusion of the 2016 Australian Open Championships to determine whether good form and fitness can be demonstrated. Such determination will be at the absolute discretion of the DA Selection Committee. (3.2) Selectors Discretion Pathway In each applicable event, provided that Australia has a quota place remaining following the application of clause 2(3)(3.1) above, the DA Selection Committee, in its absolute discretion, will nominate to the AOC the pair that it best feels can achieve a medal winning performance at the 2016 Rio Olympic Games. In arriving at its nomination decision, the DA Selection Committee will take into account the following: (i) (iii) (iv) (v) (vi) (vii) The requirements listed in clause 2(1) above; Performances at the 2016 Australian Open Championships; Performances at 2016 FINA World Cup; Performances at 2016 FINA World Series Events; Performances at 2016 FINA Grand Prix Events; Performances at the 2016 World Cup Selection Trials held in Melbourne in December, 2015; and Advice from the DA National Coach Panel (and other High Performance Coaches should that be necessary) on athletes training effort and form. For the avoidance of doubt, performances means scores as well as DD and finishing position. 3. Illness/Misadventure/Extenuating Circumstances (1) In considering the performances of Athletes at events, trials, training camps or other attendances required under clause 2 of this Nomination Criteria, the DA Selection Committee may in their discretion give weight to extenuating circumstances. For the purposes of this clause 3, extenuating circumstances means an inability to compete and/or attend events, trials, training camps or other attendances arising from: (i) injury or illness; (iii) bereavement or disability arising from death or serious illness of an immediate family member; and/or any other factors reasonably considered by the Diving Australia Selection Committee to constitute extenuating circumstances. Athletes unable to compete at events, trials, training camps or other attendances required under this Nomination Criteria must advise the Diving Australia Chief Executive Officer in writing of this fact and the reasons as soon as possible but in any

4 event before the commencement of the competition, or if the extenuating circumstances arise during the competition, immediately. (d) In the case of illness or injury, Athletes will be required to undergo a medical examination by a doctor or doctors nominated by the DA Chief Medical Officer. A decision in each case of extenuating circumstances will be made by the DA Selection Committee on an individual basis. Any such decision will not be binding on the AOC. (2) If the application of clause 2(2)(2.2) above results in not all quota places being filled, the DA Selection Committee may, in its absolute discretion, nominate an athlete(s) to the vacant place(s). If the Selection Committee choose to exercise this discretion, and for the avoidance of doubt, there is no obligation to do so, the Selection Committee will take into consideration the items listed in clause 2(3)(3.2). 4. Making of Nominations Nominations by Diving Australia must be received by the AOC by 5pm AEST on Monday 4 July Nominations made after this deadline (or within such further deadline as the AOC may allow) will be invalid unless made pursuant to a direction or award in respect of an appeal against non-nomination to the Diving Australia Appeals Tribunal or the Court of Arbitration for Sport pursuant to the AOC s Olympic Team Selection By-Law and which appeal had been commenced prior to the deadline for receipt of nominations by the AOC. The 5pm AEST on Monday 4 July 2016 deadline for the making of nominations by Diving Australia applies irrespective of any deadline prescribed under the Qualification System or by the Organising Committee for the 2016 Olympic Games. 5. Amendments to Nomination Criteria This Nomination Criteria may be amended by Diving Australia with the prior written approval of the AOC. Any amended Nomination Criteria will be distributed by Diving Australia to members of the Shadow Team by and by posting the amended Nomination Criteria on the Diving Australia website. 6. Replacement of Athletes in Synchro events With regard to athletes that have already been nominated to the AOC for the 2016 Australian Olympic Games team: (1) Athletes or Pairs nominated will only be replaced if, in the opinion of the DA Selection Committee, the following circumstances exist: the Athlete or Pair will not be capable of performing in the 2016 Olympic Games, to the level which the Athlete or Pair would be expected to perform if not affected by the illness/injury in question; or by competing with the illness or injury in question on the 2016 Olympic Games, the Athlete may suffer significant short or long term medical complications that pose an unacceptable risk to the Athlete. (2) The DA Selection Committee must consider the recommendation of the DA Chief Medical Officer when determining whether an Athlete or Pair should be replaced.

5 (3) The Diving Australia Selection Committee will also take into consideration factors including: (d) Injury history; Fitness level over 6 weeks prior to injury; Training intensity over 6 weeks prior to injury; and Ability to complete competition list and at what level (4) If the DA Selection Committee determine to replace a selected Athlete or Pair, the DA Selection Committee will recommend to the AOC that the Athlete or Pair should be replaced. (5) The DA Selection Committee will, in its sole and absolute discretion, determine whether it will recommend to the AOC the replacement of the Pair, or one Athlete from the Pair. Without in any way limiting its discretion. the DA Selection Committee may take into consideration factors including, but not limited to: which Pair it believes can achieve a medal winning performance at the 2016 Rio Olympic Games; performances of Athletes and Pairs in previous international competition during ; (d) Advice from the DA National Coach Panel (and other High Performance Coaches should that be necessary); fitness level and training intensity of Athletes and Pairs since the 2016 Australian Open Championships; (6) The AOC will determine whether a selected Athlete or Pair should be replaced, in its absolute discretion. In exercising its discretion, the AOC will be subject to any conditions that apply in relation to entry for the 2016 Olympic Games. (7) The final date of replacement will be determined by the Rio 2016 Late Athlete Replacement Policy. 7. Interpretation (1) Words used in this Nomination Criteria have the same meaning ascribed to them in the AOC s Olympic Team Selection By-Law unless a contrary meaning appears from the context. (2) Headings contained in this Nomination Criteria are for reference purposes only and shall not affect the meaning or interpretation of this Nomination Criteria. (3) In this Nomination Criteria the following words and phrases have the following meanings: 2016 Australian Open Championships means the competition known as the 2016 Australian Open Championships incorporating the 2016 Olympic Trials to be conducted by Diving

6 Australia at Aquanation, Melbourne prior to the second week of May 2016 (exact dates to be confirmed following release of FINA Calendar). DD means Degree of Difficulty; DA Selection Committee means the group of individuals appointed by Diving Australia from time to time and at the time of publishing this policy, comprised: Matthew Adamson (Chair) Dean Pullar (Member) Martha Barnett (Member) DA National Coach Panel means the three DA National Coaches, which at the time of publishing this Nomination Criteria, comprised Michel Larouche (National Coach Adelaide) Hui Tong (National Coach Brisbane) Salvador Sobrino (National Coach Sydney) DA National Squad Performance Standards means the current published list of standards required for DD and for scores. The 2016 version is attached to this Nomination Criteria. It must be noted that an updated version will be published by DA following the conclusion of the 2016 FINA World Cup. DA Chief Medical Officer means the sports medicine practitioner appointed by DA to the position of Chief Medical Officer that, at the time of publishing this Nomination Criteria was Dr Mark Young. Qualification System means the 2016 FINA Qualification System issued and approved by the IOC. 8. Law This document is governed by the laws applicable in the State of New South Wales.
