1 2012 AUSTRALIAN OLYMPIC TEAM SWIMMING AUSTRALIA LTD NOMINATION CRITERIA NOTE: The AOC reserves the right to require amendments to the Nomination Criteria and amend its Selection Criteria as necessary, particularly where there is a change to the Qualification System or significant circumstances affecting the nomination process. 1 Shadow Team (1) Swimming Australia Ltd (SAL) will choose Athletes from within its sport to be members of the AOC s Shadow Team. The AOC may also recognise other Athletes from within this sport to be members of the Shadow Team. (2) In order to be chosen by SAL as a member of the Shadow Team each Athlete must: (a) (b) (c) have been the first, second, third or fourth Australian place getters in the final of the Men s 1500m freestyle, Women s 800m freestyle events, and the Men s and Women s 50m freestyle, 100m freestyle, 200m freestyle, 400m freestyle, 100m backstroke, 200m backstroke, 100m breaststroke, 200m breaststroke, 100m butterfly, 200m butterfly, 200m IM and 400m IM events at the 2011 Australian Swimming Championships held from 1-8 April 2011 in Sydney, or in respect of the 100m freestyle and 200m freestyle to have placed fifth, sixth, seventh or eighth Australian place getter in the 100m freestyle and 200m freestyle finals at that event; or have been selected as a member of the 2011 World Championships Team to compete in Shanghai, China from 19 to 24 July 2011; or be an A Finalist in any individual Olympic Event at the 2012 Australian Swimming Championships (the swimming trials for nomination to the 2012 Australian Olympic Team) to be held from March 2012, in Adelaide. (3) SAL may add Athletes to the Shadow Team at any time at the absolute discretion of the SAL National Head Coach, where based on performances in 2011 the SAL National Head Coach is of the opinion that the Athlete has the potential to be nominated for selection in the 2012 Australian Olympic Team. (4) In order to be recognised as a member of the Shadow Team the Athlete must have signed the Consent to Shadow Team Membership Form (Attachment 1) and in the case of minors, the Parents/Guardians Acknowledgment for Minors Form (Attachment 2) and provided it to SAL, Gary Vandeburgt, High Performance Operations Manager and PO Box 3286, Belconnen ACT (5) SAL will provide all Athletes chosen or recognised as members of the Shadow Team with the Guide to Olympic Team Selection, the Selection Criteria and this Nomination Criteria. The AOC Olympic Team Selection By-Law and the Qualification System will be made available on the AOC s website ( (6) SAL will advise the AOC of the Athletes that it has chosen as members of the Shadow Team at such time as required by the AOC. (7) If an Athlete breaches the requirements of the Nomination Criteria, the Selection Criteria or the AOC Olympic Team Selection By-Law, SAL or AOC may suspend or terminate the Athlete s membership of the Shadow Team. 2 Nomination of Athletes For the purposes of nomination to the AOC of Athletes for selection to the 2012 Australian Olympic Team SAL will: 2012 Australian Olympic Team - Nomination Criteria Swimming - FINAL amended 28 October

2 (1) only nominate Athletes who have competed at the 2012 Australian Swimming Championships to be held from March 2012, in Adelaide; and (2) only nominate those Athletes who have met the additional competition requirements as outlined below at the 2012 Australian Swimming Championships: (a) Individual Events (i) (ii) (iii) (iv) The first and second placed finisher in the A Final of any Individual Olympic Event, provided they swim a time that equals or betters the A Qualifying time listed in Appendix 1; or where no Athlete qualifies under clause 2 (2)(a)(i) above, the first placed available finisher in the final of an Individual Olympic Event provided they swim a time that equals or betters the B Qualifying time listed in Appendix 1. Only one Athlete per Individual Olympic Event is eligible for nomination under this clause 2(2)(a)(ii). In the case of a tie by three or more Athletes for first place, or two or more Athletes for second place in the A Final of an Individual Olympic Event and all the Athletes have satisfied the Nomination Criteria and swum a time that equals or betters the A Qualifying time listed in Appendix 1, a swim off will be conducted between the Athletes that tied in that event at a time to be determined by the Technical Manager. In the case of a tie by two or more Athletes for first place in the A Final of an Individual Olympic Event and all the Athletes have satisfied the Nomination Criteria and swum a time that equals or betters the B Qualifying time listed in Appendix 1, a swim off will be conducted between the Athletes that tied in that event at a time to be determined by the Technical Manager. (b) Relay Events (i) All athletes eligible for nomination in individual events under clause 2(2) (a) are also eligible for nomination in the relay events where Australia has qualified a team. (ii) The SAL National Head Coach will determine the number of Athletes up to the maximum as per clause 2(6) to be nominated as relay only swimmers in his absolute discretion, taking into consideration all available information regarding the particular relay events, and overall needs of the team. (iii) All relay only Athletes must have achieved the B Qualifying team listed in Appendix 1, and will be considered for nomination in a relay event pursuant to the following priority process: a. the second, third and fourth finisher in the final of the 100m and 200m freestyle events, and at the discretion of the SAL National Head Coach, the fifth and sixth finisher in the 100m and 200m freestyle events; and b. second finisher in the final of the 100m backstroke, 100m breaststroke and 100m butterfly events; and c. in the case of a tie by two or more Athletes in the A Final of an Individual Olympic Event where all the Athletes have satisfied the requirements of this Nomination Criteria but only one position is available for nomination to the team as a relay only Athlete, a swim off 2012 Australian Olympic Team - Nomination Criteria Swimming - FINAL amended 28 October

3 will be conducted in that event between the Athletes that tied at a time to be determined by the Technical Manager d. If the number of athletes who satisfy the process outlined in clauses 2(2)(b)(iv)(a), 2(2)(b)(iv)(b) and 2(2)(b)(iv)(c) above exceeds the number of Athletes to be nominated under clause 2(2)(b)(iii), Athletes will be ranked using the 2011 FINA Point Score to determine the highest ranked athletes for nomination. (iv) During the 2012 Olympic Games, the SAL National Head Coach will determine the Athletes to compete in any relay event in his absolute discretion taking into consideration all available information regarding the particular relay event, and the overall needs of the team. For the avoidance of doubt, meeting the relay only performance requirements does not guarantee nomination for selection. (c) Replacement of Athletes (a) Individual (i) If an athlete who is eligible for nomination or who has been nominated is unable to take their position on the 2012Australian Olympic Team for any reason, SAL in its absolute discretion, will determine whether or not to replace that athlete. In the event of replacement, SAL will nominate the next highest ranked athlete in that event at the 2012 Australian Swimming Championships pursuant to the nomination process set out in clauses 2(2)(a) and (b) above, provided that the athlete has met the Olympic A or Olympic B Qualifying Time (whichever is applicable), as outlined in Appendix 1, in the A Final at the 2012 Australian Swimming Championships. (ii) If SAL determines that an Athlete who has been nominated to and selected by the AOC should be replaced, then: a. SAL will recommend to the AOC that the selected Athlete be replaced; b. should the AOC (or during the period of the 2012 Olympic Games, the Chef de Mission of the 2012 Australian Olympic Team) determine that the selected Athlete should have their selection withdrawn; then c. SAL will choose the Athlete to be nominated based on the next highest ranked Athlete in that event at the 2012 Australian Swimming Championships pursuant to the nomination process set out in clauses 2(2)(a) and (b) above, provided that the athlete has met the Olympic A or Olympic B Qualifying Time (whichever is applicable), as outlined in Appendix 1, in the A Final at the 2012 Australian Swimming Championships for selection by the AOC; d. the AOC (or during the period of the 2012 Olympic Games, the Chef de Mission of the 2012 Australian Olympic Team) may in its absolute discretion select that nominated Athlete. In exercising its discretion, the AOC will be subject to any conditions that apply in relation to entry for the 2012 Olympic Games, including the LOCOG Late Athlete Replacement Policy. (b) Relay Events (i) If a relay only Athlete who is eligible for nomination or who has been nominated as is unable to take their position on the 2012 Australian Olympic Team for any reason, SAL, in its absolute discretion, will determine whether or not to replace that athlete. In the event of replacement, SAL will nominate the next highest ranked athlete using the FINA Point Score as determined under clause 2(2)(b)(d)(c). (ii) If SAL determines that a relay only Athlete who has been nominated to and selected by the AOC should have their selection withdrawn, then: 2012 Australian Olympic Team - Nomination Criteria Swimming - FINAL amended 28 October

4 a. SAL will recommend to the AOC that the selected Athlete have their selection withdrawn; and b. SAL will recommend to the AOC whether or not the selected Athlete be replaced; and c. should the AOC (or during the period of the 2012 Olympic Games, the Chef de Mission of the 2012 Australian Olympic Team) determine that the selected Athlete should have their selection withdrawn; then d. should SAL recommend to the AOC that the selected Athlete be replaced, and the AOC determine that the selected Athlete should have their selection withdrawn, SAL will nominate the next highest ranked Athlete in that event at the 2012 Australian Swimming Championships pursuant to the nomination process set out in clauses 2(2)(a) and (b) above, provided that the athlete has met the Olympic A or Olympic B Qualifying Time (whichever is applicable), as outlined in Appendix 1, in the A Final at the 2012 Australian Swimming Championships for selection by the AOC; e. the AOC (or during the period of the 2012 Olympic Games, the Chef de Mission of the 2012 Australian Olympic Team) may in its absolute discretion select that nominated Athlete. In exercising its discretion, the AOC will be subject to any conditions that apply in relation to entry for the 2012 Olympic Games, including the LOCOG Late Athlete Replacement Policy. (3) only nominate athletes who are, or are recognised by the AOC as, members of the Shadow Team; (4) only nominate those Athletes it honestly believes have met the requirements described in the Selection Criteria; (5) only nominate those Athletes who have signed the Athlete Nomination Form as issued by the AOC from time to time; (6) not nominate more Athletes (including reserves) than the maximum number permitted under the Qualification System. As per the FINA Qualification System, up to a maximum of twelve (12) additional relay only Athletes may be selected; and (7) not nominate Athletes who have breached the AOC Anti-Doping By-Law unless the Athlete has already been sanctioned for the breach and has completed the sanction imposed. 3 Illness/Misadventure/Extenuating Circumstances For the purposes of determining whether an athlete has met the requirements of this Nomination Criteria the SAL will not have regard to any extenuating circumstances. 4 Making of Nominations Nominations by SAL will be received by the AOC by Thursday 22 March The deadline for nominations to be received by the AOC is 10am Friday 22 June Nominations made after this deadline (or within such further deadline as the AOC may allow) will be invalid unless made pursuant to a direction or award in respect of an appeal against non-nomination to the SAL Appeals Tribunal or the Court of Arbitration for Sport pursuant to the AOC s Olympic Team Selection By-Law and which appeal had been commenced prior to the deadline for receipt of nominations by the AOC. 10:00am AEST on Friday 22 June 2012 is the deadline for the making of nominations by the SAL and applies irrespective of any deadline prescribed under the Qualification System or by the Organising Committee for the 2012 Olympic Games Australian Olympic Team - Nomination Criteria Swimming - FINAL amended 28 October

5 5 Amendments to Nomination Criteria This Nomination Criteria may be amended by SAL with the prior written approval of the AOC. Any amended Nomination Criteria will be distributed by SAL via to members of the Shadow Squad members, posted on the SAL website and be made available in hard copy at the 2012 Australian Swimming Championships March 2012, in Adelaide. 6 Interpretation (1) Words used in this Nomination Criteria have the same meaning ascribed to them in the AOC s Olympic Team Selection By-Law unless a contrary meaning appears from the context. (2) In this Nomination Criteria the following words and phrases have the following meanings: 2011 FINA Point Score 2011 FINA Point Score will be released January 2011 and will be available on the FINA website ( The FINA Point Score allows comparisons of results among different events. The FINA Point Score assigns point values to swimming performances, more points for world class performances typically 1000 or more and fewer points for slower performances. The base times are defined every year, based on the latest World Record that was approved by FINA. Individual Olympic Events Are the following swimming events that will be contested at the 2012 London Olympic Games as part of the swimming program: Freestyle 50m, 100m, 200m, 400m, 800m (women only) and 1500m (men only) Backstroke 100m and 200m Breaststroke 100m and 200m Butterfly 100m and 200m Individual Medley 200m and 400m Relay only Swimmers Relay Events Are those athletes are nominated for the team to compete in the Relay events only and have not qualified for an Individual Olympic Event Are the following team swimming events that will be contested at the 2012 London Olympic Games as part of the swimming program: Freestyle Relay 4 x 100m and 4 x 200m Medley Relay 4 x 100m Technical Manager The Technical Manager is the Meet Director for the 2012 Australian Swimming Championships. 7 Law This document is governed by the laws applicable in the State of New South Wales Australian Olympic Team - Nomination Criteria Swimming - FINAL amended 28 October

6 Attachment AUSTRALIAN OLYMPIC TEAM CONSENT TO SHADOW TEAM MEMBERSHIP Swimming Australia Ltd [insert name of Athlete] I consent to being a member of the Shadow Team for nomination by the above NF for selection to the 2012 Australian Olympic Team. I make this acknowledgement honestly and fully and confirm that this acknowledgement is not false or misleading: 1 I have been provided with, or been given access to, and will be bound by and observe the terms of the AOC Olympic Team Selection By-Law, the AOC Selection Criteria applicable to my sport and my NF s Nomination Criteria in force and as amended from time to time. I acknowledge that all members of the Shadow Team will likewise be bound by and must observe the same terms. 2 The AOC s Olympic Team Selection By-Law and the Selection Criteria may be amended by the AOC from time to time. I will be bound by and observe the AOC s Olympic Team Selection By-Law, and the Selection Criteria as amended, and acknowledge that any amendments to the AOC s Selection By- Law and Selection Criteria will be posted to the AOC s website ( along with the Qualification System applicable to my event. 3 The decision whether or not to nominate me to the AOC for selection in the 2012 Australian Olympic Team is subject to the Nomination Criteria and is at the discretion of my NF. 4 If my NF decides to nominate me for selection to the 2012 Australian Olympic Team I will be required to complete an Athlete Acknowledgement as determined by the AOC from time to time. 5 In the event that my NF nominates me to the AOC for selection in the 2012 Australian Olympic Team I am not guaranteed to be selected in the 2012 Australian Olympic Team. The decision whether or not to select me as a member of the 2012 Australian Olympic Team is subject to the AOC s Olympic Team Selection By-Law and Selection Criteria and is at the absolute discretion of the AOC. 6 (1) I have not at any time engaged in conduct (whether publicly known or not and whether before or after the date of my selection), which has brought, brings or would have the tendency to bring me or my sport into disrepute or censure, or which is or would have the tendency to be inconsistent with, contrary to or prejudicial to the best interests, image or values of the AOC or Team Sponsors, or as a result of which my membership would not be or would not likely be in the best interests of the 2012 Australian Olympic Team or the Shadow Team; (2) I have not at any time (whether before or after the date of my selection) been convicted of, or charged with, any serious offence involving violence, alcohol or drugs, or any sex offence, or any offence relating to any betting or gambling activities on sport, or any offence which is punishable by imprisonment; (3) I have and will continue to honestly and fully disclose information to my NF and the AOC concerning any conduct that might be in breach of (1) or (2) above or concerning any criminal offence of whatever nature, with which I have been charged, or of which the I have been convicted, and consent to my NF and the AOC making enquiries to relevant authorities for any details of my criminal record (if any), including details of any charges pending or any spent convictions disclosable by law, and consent to those authorities providing that information in answer to those enquiries; 2012 Australian Olympic Team - Nomination Criteria Swimming - FINAL amended 28 October

7 (4) any matter arising under (1), (2) or (3) above is to be determined, or breach thereof excused, by the AOC in its sole and absolute discretion. Any announcement to be made or notice required to be sent pursuant to the AOC s Olympic Team Selection By-Law may be sent to one or more of the above contacts, or such other contact as notified in writing by me, and in the case of: (1) post, the announcement or notice is deemed to have been received by me by properly addressing, prepaying and posting a letter containing the announcement or notice, and to have been received by me on the third business day after the date of its posting. Any announcement or notice sent by post to me overseas will be forwarded by air mail; (2) facsimile transmission, the announcement or notice is deemed to have been received by me by properly addressing the facsimile transmission and transmitting it to the number supplied by me and to have been received by me the next business day after the date of its transmission; and (3) , the announcement or notice is deemed to have been received by me by properly addressing the address and transmitting it to the address supplied by me and to have been received by me on the next business day after the date of transmission unless the AOC or NF is advised that the transmission failed to send to the addressee. 9 If I wish to utilise Specialised Equipment at the Games, I will submit a request in writing to the AOC Director of Sport no later than 6 months prior to the Games. This request is subject to the approval of the AOC in accordance with the 2012 Australian Olympic Team Membership Agreement Athletes. 10 This consent is governed by the laws applicable in the State of New South Wales. 8 Attachment AUSTRALIAN OLYMPIC TEAM PARENTS/GUARDIANS ACKNOWLEDGEMENT FOR MINORS Swimming Australia Ltd [insert name of Athlete] I/we, the undersigned parents/guardians of the Athlete agree (and if more than one, then jointly and severally agree) as follows: 1. the Athlete is under the age of 18 years as at the date of signing the Consent to Shadow Team Membership; 2. I/we have read and understood the AOC Olympic Team Selection By-Law and the AOC Selection Criteria applicable to the sport of Swimming ( the Selection Terms ) and have fully explained to the Athlete the Selection Terms. To this end I/we have obtained independent legal advice as to the Selection Terms in order to clarify any doubts or concerns I/we may have had in this regard; 3. the Athlete has read the Selection Terms and, together with the benefit of our full explanation, understands their meaning and effect; 4. the Selection Terms are for the benefit of the Athlete; 5. the Athlete's eligibility for being considered for nomination by the above NF for selection to the 2012 Australian Olympic Team, may be terminated in the event of any breach of the Selection Terms; and 6. this acknowledgement is governed by the laws applicable in the State of New South Wales.
