1 MOOT COURT COMPETITION ORGANIZED BY: COLLEGE OF LEGAL STUDIES, MOOT COURT ASSOCIATION RULES OF THE COMPETITION
2 I. PRELIMINARY The College of Legal Studies (COLS) of University of Petroleum and Energy Studies, Announces the 4 th NOVICE (herein referred to as NMCC). II. GENERAL RULES A. LANGUAGE The Competition will be conducted in English language only. B. PARTICIPATION 4 th NMCC is open to all 1 st year students of B.A. LLB, BBA LLB. B.COM LLB and 2 nd year B.Tech LLB (Hons) IPR and B.Tech LLB ( Hons) Cyberlaw students. C. TEAM COMPOSITION A team shall comprise of three members; consisting of two advocates and one researcher. This composition cannot be altered under any circumstances. D. DRESS CODE The dress code for the competition is advocate s uniform as per Advocates Act, 1961 without band and gown. Violation of the same will bar a contestant from appearing in the oral rounds. The dress code is applicable to all the pleading teams. E. COURT MANNERISMS All participants are required to conduct themselves in a responsible and professional manner throughout the competition. All participants are required to act in dignified manner and respect the court. Any member of a participating team must not communicate with the judge/s or opposite counsels in private. 2

REGISTRATION Online Registration through Google form: OV1OdMyGr91ceerZqIcRSLb_9csIuAhDwDz1Z4/prefill Final Registration: The registration fees i.e. Rs. 150/- (per team) is to be paid at the time of the final registration at the desk outside the Auditorium of IV Novice Moot Court Competition, from 13th-17th January,. Timings are from 3:00-5:00 pm. Caution: Any delay in the registration procedure or disruption with the registration formalities or partially disruption after the expiry of the scheduled dates of registration, WILL BE TERMED AS NO REGISTRATION, therefore, no claim subsists for the teams thereafter. IV. MEMORIAL GUIDELINES The following guidelines must be strictly followed for the memorials: 1. Teams have to prepare memorials for both the sides. 2. All soft copies must be ed in PDF format only. 3. The teams must send a soft copy of their memorials by P.M. UNTIL 23 rd January, to mca.novice@gmail.com with the subject of the mail reading Submission of Soft Copy of memorial - team code. For e.g. Submission of Soft Copy of memorial NMCC The teams must submit one hard copy of their memorials by 23 th January at the Moot Court Hall strictly before 2 P.M. 5. Subject to the number of memorials received, the MCA will conduct Memorial Evaluation Rounds. 6. TEAMS MUST NOT DISCLOSE THE IDENTITY anywhere in the Memorial. Noncompliance with this rule will lead to disqualification. 7. Team codes will be allotted at the time of memorial submission for memorial evaluation rounds. 3
4 8. The content of the hard copies must be the same as that of the soft copies. Noncompliance with this rule will lead to disqualification from the oral rounds. 9. The memorials have to be submitted on A4 size paper, printed on both sides and must contain the following sections: Cover Page; Table of Contents; Index of Authorities; Statement of Jurisdiction; Statement of Facts; Statement of Issues; Summary of Arguments; Arguments Advanced, and Prayer. The following format has to be followed: The font size should be 12, Font Style should be Times New Roman and for 1.5 spaced. Footnotes must be in font size 10; Font Style should be Times New Roman single-spaced. 1 inch on all sides of each page. Page number: On the bottom, right hand side Cover Page: RED for the Respondent Memorial, BLUE for the Petitioner Memorial. 10. Arguments Advanced must not exceed 15 pages and the memorial in total must not exceed 25 pages. Non-compliance with the same would entail penalty of 2 marks per extra page. 11. Non-compliance with the deadlines of memorial submissions shall result in disqualification. 12. The Maximum Marks for each memorial shall be 100 in the following break up: 4

CLARIFICATIONS All clarification should be addressed to Last date for submitting clarification is 17 nd January, Last date of notifying clarification will be 20 th January,. V. MEMORIAL SELECTION ROUNDS Top 36 memorials will be selected on the basis of their memorial score. (Subject to change on the quality and number of memorials received). Results of the memorial selection rounds will be declared at upesmoot.blogspot.in on 30 January,. 5
6 The selected teams on the basis of memorials need to submit8 printed hard copies (4 from each side) the sides on 2 nd February by 3:00 P.M. at the Moot Court Hall, Kandoli. VII. RESEARCHERS TEST The researcher s test will be conducted on 2 nd February, at the time of the Exchange of Memorials. Only the researcher is allowed to participate in the researcher s test. VIII. ORAL ROUNDS The Oral rounds will be held from 4 th to 6 th February,. There shall be one preliminary round, one quarter finals, one semi-finals and subsequently the finals. (Subject to change on the number of memorials received) The Exchange of memorials will be followed by Draw of lots on the 2 nd February, at the Moot Court Hall, Kandoli Campus. PRELIMINARY ROUNDS: The Preliminary Rounds will be held on 04 TH February. A team will argue from both the sides in the preliminary rounds. A total of 30 minutes will be allocated to each team for its oral arguments which would include rebuttal and sub-rebuttal. The allocation of time per speaker will be on the discretion of the team, subject to a minimum of 10 minutes per speaker. QUARTER FINALS: The Quarter finals &Semi Finals will be held on 05 th February,. A total of 8 teams will qualify for the quarter finals. The Quarter Finals will be a knockout round. The team that wins the round will proceed to the semi-finals. 6
7 A total of 40 minutes will be allocated per team for its oral arguments which would include rebuttal and sub-rebuttal. The allocation of time per speaker is on the discretion of the team, subject to a minimum of 15 minutes per speaker. A team will be deemed to win a round only if its total score in the oral round is higher than the opponent team. SEMI FINALS: The Quarter finals &Semi Finals will be held on 05 th February,. A total of 4 teams will qualify for the quarter finals. The Quarter Finals will be a knockout round. The team that wins the round will proceed to the semi-finals. A total of 40 minutes will be allocated per team for its oral arguments which would include rebuttal and sub-rebuttal. The allocation of time per speaker is on the discretion of the team, subject to a minimum of 15 minutes per speaker. A team will be deemed to win a round only if its total score in the oral round is higher than the opponent team. FINALS: The Finals will be held on 06 th February,. A total of 45 minutes will be allocated per team for its oral arguments which would include rebuttal and sub-rebuttal. The allocation of time per speaker will be on the discretion of the team, subject to a minimum of 20 minutes per speaker. Two teams shall qualify for the finals. A team will be deemed to win the Final if its total score in the oral round is higher than the team against it. Finals will take place in Moot Court Hall. 7
8 IX. EVALUATION IV NOVICE a) ROUND POINTS The teams will be adjudicated on the basis of Round Points( RP ) system. Each preliminary round shall consist of a total of 9 points, out of which 6 points are dedicated to Oral scores and remaining 3 points to Memorial scores. Maximum points that a team may score after the completion of Two Preliminary rounds may be 18 (9+9). Therefore, the top-8 teams obtaining total Round Point score closest to 18 shall be qualified for the next round. Note: For advanced rounds, memorial marks will not be taken into consideration. Maximum points that a team can obtain in such advanced rounds may be 9. i) Memorial round points Every memorial shall be judged by the bench of two judges. Each Memorial will be marked on a scale of as specified in clause 9(b). Every memorial shall account for 3 Round Points for each Preliminary round. The Memorial scores of the side (Claimant or Respondent) that the teams are arguing in that particular round shall be compared against each other. i.1) Each Judge shall provide marks to the memorial of both the parties. i.2) In case the difference between the memorial marks is 7%, the team obtaining higher memorial marks shall be awarded 1.5 Round Points and the team obtaining lower marks shall obtain 0 Round points. i.3) In case the difference between the memorial marks is < 7%, the team obtaining higher memorial marks shall be awarded 1 Round Points and the team obtaining lower marks shall obtain 0.5 Round points. 8
9 i.4) Illustration: IV NOVICE Judge 1 gives80 marks to Team Aand;70 marks to Team B Team A shall obtain 1.5 Round points and Team B shall obtain 0 Round points. Judge 2 gives85 marks to Team Aand;80 marks to Team B Team A shall obtain 1 Round points and Team B shall obtain 0.5 Round points. i.5) In case of a tie, each team shall be awarded 0.75 Round Points from the judge(s) in whose score-sheet such tie persisted. ii) Oral rounds Each Preliminary Round will be judged by a bench of two Judges, each of whom shall mark every speaker on a score of The team with the higher total marks on a particular Judge s score-sheet will be the winner on that Judge s score-sheet. ii.1) Each Judge shall provide marks to both the speakers of both the parties. ii.2) In case the difference between the Oral marks ofspeaker A1 (or A2) from that of Speaker B1 (or B2) is 7%, The team obtaining higher oral marks shall be awarded 3 Round Points and the team obtaining lower marks shall obtain 0 Round points. ii.3) In case the difference between the Oral marks of Speaker A1 (or A2) from that of Speaker B1 (or B2) is < 7%, the team obtaining higher orals marks shall be awarded 2 Round Points and the team obtaining lower marks shall obtain 1 Round points. ii.4) Illustration: 9
10 Judge 1 gives70 marks to Team Aand;60 marks to Team B(Difference being >7%) Team A shall obtain 3 Round points and Team B shall obtain 0 Round points. Judge 2 gives85 marks to Team Aand;80 marks to Team B(Difference being <7%) Team A shall obtain 2 Round points and Team B shall obtain 1 Round points. ii.5) In case of a tie between the two Teams, each team shall be awarded 1.5 Round Points from the judge(s) in whose score-sheet such tie persisted. ii.6) Each Advanced Round will be judged by three judges, each of whom shall award a maximum of 3 Round Points. iii) General rules The top eight (8) ranking teams after considering the Preliminary Rounds will qualify for the Advanced Rounds. Teams shall be ranked according to the following criteria: a) Teams with a better win-loss record in the Preliminary Rounds shall be prioritized; after that; (Explanation: In case two teams have equal number of wins, the team with a lower number of losses would have the better win-loss record.) b) Second, in case two teams have the same win-loss record, the tie shall be broken in favor of the team having a higher total number of Round Points; c) Third, in case two teams have the same Round points, the tie shall be broken on the basis of aggregate absolute speaker scores; Fourth, teams tied on absolute speaker score shall be separated on the basis of their memorial scores; 10
11 Fifth, in an unexpected circumstance if a tie still persists, it shall be decided by the toss of a coin. X. SCOUTING AND ANONYMITY: The action of gathering any kind of information with respect to the other participants shall be deemed as scouting. This may include trying to gain information regarding proceedings inside the courtrooms, information regarding other teams etc. Teams shall not disclose their identity or be allowed to observe the oral rounds of another team. Scouting is strictly prohibited. Scouting by any team shall entail instant disqualification. Teams are not allowed to use any electronic device inside the courtroom. X. SCHEDULE OF THE EVENT: 1.
