2 I. GENERAL This policy provides for the management of Mercer Island Beach Club s Moorage Facilities and Adjacent Waterways as well as administration of the Club s Moorage Program. The Moorage Program provides for assignment and use of slips and storage spaces for member-owned boats on a seasonal basis. The Club Manager in conjunction with the Moorage Committee manages this policy. The Club s Board of Trustees appoints the Moorage Committee. Application for and allocation of moorage and storage space is by way of the procedures described in this policy. Slip assignments are for summer moorage only (May 1 through October 31). Moorage outside of these dates is considered winter moorage and is not allowed due to the vulnerability of the Club's facilities and member's boats to storm damage. Use of the Club s shore racks is available for both summer and winter seasons. The Club can terminate slip assignment and use of the Club s waterways if a member or their Boat loses eligibility or violates the Club s SAFE BOATING PRACTICES described herein, the rules and regulations of the Club, or is not in good standing with the Club. All boats using MIBC Moorage Facilities (slips, jet ski lifts, shore storage or launch ramp) must display an identification decal provided by the Club. II. DEFINITIONS The following definitions are used to explain certain concepts within this policy. Moorage Facilities: a. Slips, jet ski lifts and shore rack spaces b. Day Dock c. Launch ramp d. Parking facilities so designated for trailers and cars with trailers Adjacent Waterways: a. All water within the moorage facilities b. All water adjacent to the day dock and swim dock
3 Boats: a. All boats powered by some motor b. Jet skis c. All sailboats d. Kayaks, rowboats, canoes e. Windsurfers, paddleboards, rafts III. SAFE BOATING PRACTICES A. Safe boating practices are the responsibility of each person using the Club's Moorage Facilities and Adjacent Waterways. B. In order to establish safe boating practices, members must comply with: 1. All city, state, and/or federal laws, rules, and/or statutes. 2. The Boating and Moorage Safe Conduct Rules (Appendix A). Note: the Boating and Moorage Safe Conduct Rules are posted on the club website at 3. Required tie-up snubber and fender systems as shown in the Required Tie-Up Diagram (Appendix B). 4. All rules and regulations of the Mercer Island Beach Club. C. The Club requires the following minimum age requirements for operators of any Boats within the Adjacent Waterways. All operators must also meet all the requirements of local, state, or federal law. See regulations overview at: which include that operators of powerboats with 15hp or more must obtain a WA State Boaters Education Card unless born before a. Powerboat 15hp or more 16 years old b. Powerboat 10hp or less 12 years old c. Jet Ski 14 years old d. Sailboats 15ft or longer 16 years old e. Sailboats less than 15ft 12 years old f. Windsurfers, canoes, SUPs, kayaks etc. 12 years old

If, in the judgment of the Club Manager and/or the Moorage Committee, a member's Boat is being used in an unsafe manner, then the member is subject to potential loss of the right to use any or all of the Club's Moorage Facilities and/or Adjacent Waterways and forfeit any return of moorage fees. IV. MOORAGE PROGRAM OVERVIEW This section provides an overview of the Moorage Program. See Sections V through X for specific details. The Moorage Program provides slips and storage spaces for member-owned boats along the Club's waterfront. The Club's moorage slips are divided into three classifications extra - large (over 23 to 25 length), large (18 to 23 ) and medium (less than 18 ). Note: Only a limited number of extra-large slips accommodating boats of over 23 to 25 in length are available. The Moorage Program also administers space assignments on the Club s shore racks and day sailor storage. Slip assignments are for SUMMER MOORAGE only (May 1 through October 31.) Moorage outside of these dates is considered winter moorage and is NOT ALLOWED due to the vulnerability of the Club's facilities and member's boats to storm damage. Use of the Club s shore racks and day sailor storage is available for both summer and winter seasons. Procedures and conditions for application, allocation and member acceptance of moorage slips and storage spaces is described in detail in the following Sections of this policy. An overview of this process follows: A. Applications for summer moorage slips are made in January, and winter vessel storage spaces in October of each year. B. Members and Boats must meet specific conditions to qualify for moorage or storage space, see Section V. C. Following receipt of applications, the allocation process places qualifying boats into either ASSIGNED or WAIT LIST status. When demand exceeds supply, a DRAW procedure, utilizing a prioritization process, is implemented to determine whether a member receives an ASSIGNED or WAIT LIST status. The above process will also be applied to jet skis, row boats and sailboats. In the case of paddleboards and kayaks seasonal priority assignment will go to members in good standing with a current agreement for rack storage. D. A Member receiving a slip or storage space assignment signs a Boating Contract Agreement and pays the required fee(s) (See Appendices C and D). E. The Club Manager in conjunction with Moorage Committee makes individual slip assignments to boats with ASSIGNED status. Assignments are made on a best judgment basis, reflecting overall length and width
5 considerations of all boats and slips. Boats with WAIT LIST status may be invited by the Club Manager to use assigned slips when they become temporarily vacant and have use of the boat ramp for the entire season. All Boats using the Club s Moorage Facility must abide by the Club s Moorage Safety and Usage Conditions (See Section VI) which includes adhering to the Required Tie-Up Diagram (Appendix B) A slip allocation or storage assignment can be terminated by the Club if the member or the boat loses eligibility or violates the BOATING AND MOORAGE SAFE CONDUCT RULES (Appendix A) of the Mercer Island Beach Club. This moorage policy applies to individual boats (i.e. Washington State License No. WN-xxxx-AA.) One application per boat will be considered for multi-owner boats. Any Club member owning a boat may submit an application each season for a moorage slip or shore rack/storage space. All Boats using MIBC moorage facilities (slips, lifts, shore storage or launch ramp) must display an identification decal provided by the Club. V. CONDITIONS TO QUALIFY FOR MOORAGE A The Member must be in good standing with the Club at time of application submittal and assignment. B. To be granted a slip, lift or shore rack/storage space, Boats with shared ownership must be co-owned with at least one member on the registration.. C. No member may moor or store a boat if their Club account is not current. D. A member must own a boat before applying to the moorage program. E. Boat owners must provide accurate overall length and width measurements as part of the application process. These measurements are essential for assignment to the proper moorage category and failure to provide accurate measurements may disqualify Member s application. F. To occupy a slip, lift or shore storage space an owner must: 1. Own a boat that the Club Manager in conjunction with Moorage Committee determines can be accommodated within the Club facilities. 2. Maintain public liability insurance for the owner and boat with second party liability minimums as stated below. Proof of insurance shall be provided to the club office with moorage payment.
6 a) Any boat powered by a 10 hp/or more motor $300,000 b) Any boat powered by less than 10 hp $100,000 c) Any sailboat 15 or more feet long $300,000 d) Any sailboat less than 15 feet $100,000 e) Any jet ski $300,000 f) Any windsurfers, kayak, SUP, canoe, rowboat $50, Accept waiver of responsibility and indemnity in order that the Club, its members, its employees and its agents shall not be liable or responsible for the safe keeping, condition, or any damages suffered by the owner, his agents or invitees arising from any cause upon the boat, or the moorage facilities. Agree to hold harmless and indemnify the Club, its members, its employees and its agents from all claims for injuries or death to any person, or for damage to any property that arises in any manner out of the owner's use or ownership of the boat, or owner's activities related to boating and/or moorage. 4. In the event the Club must act to secure and/or salvage a Member s Boat to prevent damage to the environment, the Club facilities, and other Club Member s property, the Member agrees to pay for all associated costs. 5. Agree to comply with all applicable federal, state and local laws, statutes and ordinances, and all rules and regulations of the Mercer Island Beach Club. VI. MOORAGE SAFETY AND USAGE CONDITIONS A. Due to ecological, fire, and explosion hazards, the transfer of fuel between containers is not allowed anywhere on Club property. B. All Boats using the moorage facility are required to display a Washington State license and/or Coast Guard registration number, and have the Vessel Registration, Boater Education Card on board, as well as carry required equipment including approved personal floatation devices for each passenger, an approved fire extinguisher, and a horn, whistle, or bell. C. All Boats assigned to slips are required to have a tie system, which includes, at a minimum, the following (see Appendix B). 1. A five-way snubber system rigged to effectively buffer the tie lines.

If there is any question about the proper tie system, please contact the Club manager. Boat tie-up systems will be approved at the beginning of the season by a member of the Moorage Committee. Boats not complying with the required system will be re-tied by the Club Staff. Members will be billed for this service based upon time and material cost. If the Club Manager determines that a fee will be assessed, the fee will be a minimum of $50. D. Members may not put down any coverings on any of the dock surfaces as this will accelerate wood rot. E. Members may not install any boat or jet ski lifts. F. Any damage to the moorage facility caused by the member Boat will be repaired at the offending member s expense. G. Moorage is only allowed in a particular slip by the member assigned to that slip, and only for the summer moorage period. H. Proper use of the Day Dock is described in Appendix A. I. Proper use of the Launch Ramp is described in Appendix A. J. Members may not sub-lease, share, or otherwise make any agreement with another member to use their assigned slips. K. Members must keep all ancillary equipment inside of the boat while moored (tubes, wake boards, etc.). L. Outdrives/props must remain down while moored (unless water depth is an issue). Unauthorized use of the Moorage and Adjacent Waterways will result in the offending boat being removed at the owner's risk and expense. VII. MOORAGE APPLICATION PROCEDURE A. An annual application procedure is used to identify and register any Boat, which is owned by a member who wants to use the Club's Moorage Facilities and Adjacent Waterways. B. All Club members who own a Boat and want to use the Club's Moorage Facilities and/or Adjacent Waterways must fill out the application provided on the website AND return it to the Club office by the required due dates.
8 VIII. MOORAGE ALLOCATION PROCESS A. Moorage Allocation is done jointly by Club Manager in conjunction with the Moorage Committee for establishing ASSIGNED and WAIT LIST lists for each of the five moorage/storage categories (i.e. extra - large slips, large slips, medium slips, jet skis, and shore storage). The Club Manager is responsible for maintaining a record of a Boat's status in previous years as a factor in determining its priority. The Club Manager, with the concurrence of the Moorage Committee, may raise the priority assignment year of a member in recognition of an ongoing contribution to the Club. B. Moorage Allocation for a particular category is assigned to qualifying applicants based on their PRIORITY ASSIGNMENT YEAR. Applicants are grouped by their assignment year. Those with the highest year have the first rights to space, then the next highest year, the next, etc. A DRAW is conducted from within the group of applicants who, because of the priority assignment year, number more than the number of slips remaining available within a size category. C. PRIORITY ASSIGNMENT YEARS are allotted to member's boats as follows: 1. The highest priority goes to those who accepted a position on the previous year s WAIT LIST (see paragraph D below.) 2. The second highest priority YEAR goes to those who had an ASSIGNMENT slip/space for only the previous year. 3. The third highest priority YEAR goes to those with an ASSIGNMENT status for no more than the previous two years. 4. The fourth highest priority YEAR goes to a new moorage application that did not moor previously with the Club. 5. The lowest priority YEAR goes to those with an ASSIGNMENT status in excess of the previous three years. D. Member boats that, because of their priority assignment year and/or the luck of the draw are allocated a slip or shore space receive ASSIGNED status. Those not gaining ASSIGNED status are assigned WAIT LIST status. E. Conditions for a member's acceptance of ASSIGNED and WAIT LIST status is described in Section V, VI and VII. Members not fulfilling these conditions will be considered non-applicants and lose their status allocation and priority assignment year. F. In the case of SUPs and kayaks, seasonal priority assignment will go to members in good standing with a current agreement for rack storage.
9 IX. MEMBER ACCEPTANCE A. Those members receiving ASSIGNED status must do the following by the date requested (typically in March) to be assigned a slip or space: 1. Return the Boating Contract Agreement (see Appendix D) along with written verification of insurance coverage provided by an insurance company, with second party liability minimums as specified by section V, registration information, and payment to the Club office, OR 2. Notify the Club that they wish to be placed on WAIT LIST status or are not desirous of moorage or rack space. 3. Failure to complete (1) or (2) will result in the ASSIGNED status members being considered a nonapplicant for that year. Members assigned and accepting a slip will be billed for applicable moorage fees (APPENDIX C). B. Those members with WAIT LIST status must do the following by the date requested (typically in April) to maintain that status: 1. Return the Boating Contract Agreement along with requested insurance and registration information to the Club office. 2. Failure to complete (1) will result in the WAIT LIST status member being considered a nonapplicant for that year. REMINDER: WAIT LIST STATUS MEMBERS AS OF JUNE 30TH WILL RECEIVE TOP PRIORITY FOR THE NEXT YEAR. X. SLIP ASSIGNMENT A. Slip and storage assignments will be given to ASSIGNED status Boats following the receipt of contracts and fees. B. Individual slip assignments will be made in the best judgment of the Club Manager in conjunction with Moorage Committee and will reflect the overall length and width of all boats and slips within a size category, considering: 1. Safety of the Moorage Facility. 2. Potential damage to neighboring boats. C. Assignments are based on accurate overall hull measurements and each boat will be classified into the Medium (less than 18'), Large (18' to 23 ), Extra - Large (only two available) over 23 to 25 categories.
10 D. Any boats that cannot be accommodated within a specific size category will be bumped to the WAIT LIST and be eligible for top priority next season. E. The Club Manager and/or Moorage Committee may preclude a Boat from moorage for any of the reasons in Section VII. If this occurs, the member may appeal to the MIBC Board. F. Members will typically be notified of assigned slips in April of each year. G. The Club Manager in conjunction with the Moorage Committee may make slip assignment changes at any time, as they deem necessary to better utilize the moorage facility. Failure to cooperate with this may forfeit moorage assignment. H. Engine drive configuration or draft of a boat will not be a determining factor in slip assignment. The Club cannot/will not use boat draft or engine type (e.g. OB, I/O, V-drive) as part of the slip assignment considerations. XI. BOAT AND TRAILER IDENTIFICATION & ACCESS A. After the Club office receives the signed Boating Contract Agreement and slip assignments have been made, an annual identification decal will be sent to each boat with ASSIGNED status. This decal is to be attached to the Boat in such a way that it is clearly visible. After May 1st of each calendar year, staff members will be instructed to not allow use of the Moorage Facilities by a Boat, which does not have the current year's identification. B. A member planning to temporarily park their trailer on Club grounds must have the Club Manager s permission prior to parking. Fees may apply depending on length of stay. XII. FEES A. There will be no application fee. B. See attached Moorage Fees (Appendix C) for the current year s fee schedule. C. A prorated credit will be made for cancellation of ASSIGNED status, provided the assignment can be filled by a member on the WAIT LIST for the remainder of the season. D. A fine may be levied, as approved by the Board of Trustees, for trailers and/or cars with trailers, which are not parked according to the conditions described in Section XIV of this policy. E. A fine may be levied for tie-up not in accordance with the Required Tie-Up Diagram or an approved exception. F. Fees may be levied for repairing damage to marina due to tie-up not in accordance with the Required Tie-Up Diagram.
11 XIII. TRAILER PARKING AND/OR CAR-TRAILER PARKING A. The Club has several designated car-trailer parking stalls in the upper parking lot. Members, who have the current ID decal, may park in these stalls (for day use only) without separating the trailer from the car. If these stalls are full, the trailer is to be separated from the car so that the trailer and the car each use one regular parking stall. B. Trailers, trailers with boats, and/or car trailer combinations are not to be left overnight on the club grounds without permission from the Club Manager. C. Failure to comply with the parking requirements described in A or B may result in a fine and/or loss of boating privileges at the Club. XIV. PENALTIES/RESTRICTIONS. Any member who does not comply with all requirements of this Moorage Policy, with Boating and Moorage Safe Conduct Rules (Appendix A), with Required Tie-Up and Snubber Systems (Appendix B), with any stipulations of the Boating Contract Agreement (Appendix D), and/or any other rules or policies, established by the Board of Trustees, is subject to potential loss of the right to use any or all of the Club's Moorage Facilities and/or Adjacent Waterways. Fines may also be assessed for violations of the Moorage Policy.
12 Appendix A MERCER ISLAND BEACH CLUB BOATING AND MOORAGE SAFE CONDUCT RULES The following Boating and Moorage Safe Conduct Rules summarize the regulations governing boating and moorage privileges at the Mercer Island Beach Club. Their primary objective is to establish safe boating practices in and around the Club s Moorage Facilities and Adjacent Waterways and to increase members enjoyment of the Club s waterfront. Failure to observe these rules or boat use in an unsafe manner can result in loss of boating privileges. Boat Operations 1. All boaters must comply with all city, state and/or federal laws, rules and/or statutes. 2. All boaters must comply with the Mercer Island Beach Club Moorage Policy. 3. No water skiing or tubing, including landings and take-offs is allowed from the Club facilities. 4. Boats towing a water skier or tuber shall remain 300 feet from the shore. 5. Boats must comply with Mercer Island regulations as to boat speed, distance from shore, etc. Boats, when approaching or leaving the moorage area shall be travelling at a speed which produces no wake. 6. The speed limit within the moorage area is 3 mph (no wake) 7. The transfer of fuel between containers (e.g. from a portable gas can into a gas tank) is not allowed on Club property. 8. All members boats using the Club facilities shall have a registered Coast Guard number and/or a Washington State license number and an identification decal provided by the club. 9. All Boats must comply with local boating laws and U.S. Coast Guard minimum recommendations for safety equipment. 10. A member must accompany a guest when the guest is using member s boat in or around the Club s adjacent waterways, moorage facilities or launch ramp. 11. The Club requires the following minimum age requirements for use of a Boat in the Moorage Facility and Adjacent Waterways. a. Powerboats 15hp or more 16 years old b. Powerboats 10hp or less 12 years old
13 c. Jet Skis 14 years old d. Sailboats 15ft or longer 16 years old e. Sailboats less than 15ft 12 years old f. Windsurfers, SUPs, canoes, etc 12 years old Moorage Facility Operations 1. Members using the Club s boating facilities must adhere to the Club s closing hour of 9:30 PM (Winter hours), 10:30 PM (Summer hours) 2. The Club does not allow overnight trailer parking without specific permission from the Club Manager. All trailers and/or boats must be removed from the parking lot at the end of each day. 3. Please inspect your assigned slip. Let the Club Manager know if any repairs are needed before you put your boat into the slip. You are responsible for any damage to the slip or Club docks. 4. A member who has been assigned a moorage slip or storage space may not assign, share, or lease the moorage space with any other member or non-member. 5. Any alterations to the slip such as adding bumpers must be approved (nailing carpeting and putting matting down on the dock is not allowed) and may be considered at the member s expense. 6. All boats assigned slips shall follow the Required Tie-Up and Snubber Systems Diagram. Boat Ramp and Launch Area 1. All watercraft must be properly registered with the Club Office to use the launch ramp. 2. After launching your boat and/or unloading equipment, please promptly move your trailer and car to the upper parking lot. If there is room in the designated boat/trailer parking spaces, please park there. If not, please use only two parking spaces, one space for your car and one space for your trailer (unhooked from the car). 3. Only temporary tie-ups are allowable at the Boat Ramp area (less than 15 minutes) while launching or loading your Boat.
14 Day Dock and Docks 1. At this time, the Day Dock is closed. No boat, airplane or foot traffic allowed. 2. E dock may be used for temporary pick-up and drop-off of passengers. Members are NOT to leave boats unattended. 3. No horseplay, sunbathing or loitering is allowed on any dock. See the Mercer Island Beach Club Moorage Policy for complete information on Boating and Moorage provisions. Questions regarding the Boating and Moorage Safe Conduct Rules may be directed to the Club Manager.

Required mooring gear and tie-up are best practices and is not a guarantee from boat or dock damage. Registered boat owner(s) must respond to Club Manager or Moorage Committee, when contacted, within 24hrs when boat is in active slip during season. 19 Appendix D MERCER ISLAND BEACH CLUB 2019 BOATING CONTRACT AGREEMENT The Mercer Island Beach Club hereby grants to the undersigned boat owner permission to use the boating areas at the Club. Please read the Moorage Policy before completing this agreement. A signed boating contract acknowledges that you have read and will abide by the Moorage Policy. Copies of the policy are available in the Club office or on the website ASSIGNMENT The following allocation status is based upon your historical use and application information. Member Name: Allocation: Assigned - Member will be assigned slip. See moorage policy. Wait List - Member has water and ramp privileges. Slip may come available. See moorage policy. Kayak & SUP Rack - Includes water privileges and dry moorage on rack for canoes, SUPs and kayaks. Day Sailor Parking - Member will be assigned parking spot. Launch - Enables member to use launch ramp, day dock, &/or adjacent waterways-no fee. Jet Ski - Member has access to assigned jet ski lift or assigned slip. GUARANTEE OF STATUS To guarantee your assignment status, you must complete the following and return to the Club office by March 31, Be in good standing with the Club at all times. 2. Completed and signed contract. 3. Completed and signed Moorage Policy acknowledgement. 4. If your status is Assigned then you need to submit payment in full by the deadline. Failure to return this contract and payment will result in loss of the privileges described in the Moorage Policy. Additionally, we will need a copy of the following prior to April 30, These are also required if you are only using the launch ramp. 1. Copy of current insurance reflecting satisfaction of insurance requirement. 2. Copy of current boat registration. 3. Completed and signed Moorage Policy acknowledgement. WAIVER OF RESPONSIBILITY & INDEMNITY The Club, its members, and its agents shall not be liable or responsible for the safekeeping, condition, or any damage to the owner's boat or equipment, or any injuries or damages suffered by the owner, his agents or invitees arising from any cause upon the boat, or the moorage facilities. The owner agrees to hold harmless and indemnify the Club, its members, its employees and its agents from all claims for injuries or death to any person, or for damage to any property that arises in any manner out of the owner's use or ownership of the boat, or owner's activities related to boating and/or moorage. The owner agrees to hold harmless, indemnify and defend the Club. In the event the Club must act to secure an Owner s boat and prevent damage to the environment, the Club facilities and other Club Member s property, the Owner agrees to pay for all associated costs. COMPLIANCE WITH LAWS AND REGULATIONS The owner agrees to comply with all applicable federal, state, and local laws, statutes and ordinances, and all rules and regulations of
20 the Mercer Island Beach Club. All boaters must comply with the WA state boater license requirement, ensuring that each listed operator has a valid license for the year of assignment and can produce that license on demand. CONTRACT CANNOT BE TRANSFERRED This contract is personal to the registered boat owner and right to use the boat slip cannot be transferred, assigned, sublet, or gifted in whole or in part. Furthermore, the registered boat owner cannot loan the boat slip to a third party. DEFAULT & TERMINATION OF AGREEMENT The Club reserves the right to terminate, at any time, the owner s boating privileges at the Club if any provisions of this agreement are violated. The Club may remove a boat from an assigned slip or shore space, at the owner's expense if any provisions of this agreement are violated. Further, the Club reserves the right to terminate, at any time, the owner's moorage at the Club upon the refund to the owner of the moorage fee (pro-rated), and the owner agrees to promptly remove the boat from the Club. Any violation of the Safe Conduct Rules in Appendix A (attached) or the Required Tie-Up and Snubber System in Appendix B (attached) will be grounds to terminate the contract and boat owner s privileges. SLIP, SHORE OR ROTATION ASSIGNMENT The Club reserves the right based on Club policy, to assign a moorage slip or shore space. Further, it is agreed that assignments may be changed if the Club Moorage Committee deems it necessary to do so. Actual assignments are made after boating contract, payment, boat registration, and proof of insurance are received. Boat owners will be notified in writing of their assignment. INSURANCE Insurance verification is required for all boating categories. Liability coverage required is as follows: Windsurfer, kayak, canoe, SUP, rowboat $50,000 Boats powered by less that 10hp and Sailboats less than 15 feet $100,000 Boats powered by 10hp/or more, Jet skis and Sailboats 15 feet+ $300,000 Please provide us with a copy of your insurance per Moorage Policy. Failure to provide insurance verification will result in cancellation of your boating privileges. SAFETY Fuelling your boat(s) at the Club is prohibited. DECAL AND RAMP KEY A decal supplied by the club shall be attached to the boat that is clearly visible. Members using the car-trailer parking shall have a decal, supplied by the club clearly visible on the trailer. FEES Moorage Fee Schedule (Appendix C) for 2019 is available on the MIBC Website. NAMES AND AGES OF ELIGIBLE OPERATORS (See Moorage Policy) I understand and will comply with the terms and conditions as set by this Moorage Contract Agreement with Mercer Island Beach Club.
