1 The Superyacht Cup Palma 2012 Sailing Instructions rd June 2012 PART I ADMINISTRATIVE 1. SUPERYACHT CUP RACE OFFICE The Superyacht Cup Race Office is located at the Muelle Viejo. The Race Office telephone number is: REGISTRATION Boat Captains are to complete their regatta registration at the Race Office no later than 14:00hrs Wednesday, 20 June. 3. DISCLAIMER OF LIABILITY / CREW WAIVER 3.1 The Disclaimer of Liability & Crew Waiver is found in Exhibit 3 and will be available at the Race Office. It must be signed by all Captains and crews. The document must be returned to the Race Office prior to Wednesday s Pre-Regatta Captain s Briefing. Yachts which do not submit these waivers will not be scored. 3.2 Competitors participate in the regatta entirely at their own risk. The Superyacht Cup sl, the Real Club Nautico de Palma, the Organizing Authority, all sponsors, all other affiliated organizations and individuals, will not accept any liability for material damage or personal injury or death sustained in conjunction with or prior to, during, or after the regatta. 4. NOTICES TO COMPETITORS Notices to competitors will be posted on the Official Notice Board at the Race Village on the Muelle Viejo. 5. AMENDMENTS TO SAILING INSTRUCTIONS Any Amendments to these Sailing Instructions will be posted on the Official Notice Board before 09:30hrs on the day it comes into effect and distributed to competitors at the daily pre-race briefing except that changes to the program shall be posted by 20:00hrs on the day before the change takes effect. It is the responsibility of competitors to acquaint themselves with these notices. 6. SIGNALS MADE ASHORE 6.1 Signals made ashore will be displayed on the Official Notice Board (no flags). The Race Committee will also broadcast its intent on the Race Committee VHF Channel. There will be no grounds for request of redress in the case of mistakes or omission of radio signals. (This amends

2 RRS 62). 6.2 Race Signal flag AP (Answering Pennant) means race not started are postponed. The warning signal will be made 60 minutes after removal unless at that time the race is postponed again or abandoned. This changes RRS Race Signals. PART II RACING RULES Due to the size, limited maneuverability and other constraints with superyachts, ISAF has allowed changes to the Racing Rules of Sailing (RRS) that will enhance safe racing at the Superyacht Cup Palma. They come in the form of changes to four definitions and one rule. One of the important safety initiatives presented is maintaining a minimum of 40 meters separation between boats. This 40 meter separation includes all mark roundings as well as meeting, passing, and crossing situations. Due to the dynamics of yachts under sail, a precise measurement of 40 meters can be difficult. If questions arise, they should be resolved via VHF bridge-to-bridge communication. The event organizer expects best efforts with compliance and good sportsmanship in maintaining minimum separation. 1. RULES. The regatta will be governed by the rules indicated in the Notice of Race and its amendments, if applicable. In case of discrepancy between the mentioned rules and these Sailing Instructions, the latter shall prevail. 2. ADVERTISING 2.1 Boats may display advertising in accordance with ISAF Regulation 20, Advertising Code. Boats shall display Event Advertising in compliance with ISAF Regulation 20 and as detailed in these Sailing Instructions. 2.2 The Organizing Authority may also require the installation, at no cost to competitors, of on board video cameras for the official television production and/or a GPS tracking system. 2.3 Boats intending to display advertising during the regatta shall state in the entry form the nature of such advertising. 2.4 Boats are responsible to inform advertisers and sponsors that no activities advertising any brand will be permitted ashore within the Muelle Viejo Marina area without the consent in writing of the Organizing Authority obtained before the start of the Regatta. 2.5 Boats will be required to display the Pantaenius sponsor flag on the first race day (Thursday, June 21st) from their backstay or shroud from the time they leave the dock until returning following the racing that day. The Organizing Authority will supply the flag to the boats on the morning of June 21st. 3. SAFETY TACTICIAN 3.1 Each boat shall designate a Safety Tactician and submit his or her name, mobile telephone number and address to the Race Office at registration no later than 1800 Wednesday, June 20 th. Additionally, boats shall submit the name, mobile telephone number and address for the Boat Captain and Racing Tactician (if applicable). 3.2 The Safety Tactician must be a member of the afterguard whose primary responsibility will be collision avoidance and have no other responsibility above and beyond safety related matters

3 (collision avoidance, navigation, etc.). 3.3 The Safety Tactician will be responsible for communications on the Bridge to Bridge VHF Safety Channel (refer to SI 7.2) and any other communications which enhance the safety of the boat. 3.4 The Safety Tactician must attend all pre-race briefings and will be responsible for ensuring the Course Log, Safe Racing & Penalty Declaration Forms are properly filled out, signed and returned to the Race Office as soon as practical following racing. 4. MANDATORY SAFETY BRIEFINGS 4.1 The pre-regatta Captain s Briefing will be held, Wednesday, 20 June at 18:00hrs at the Casa Del Mar opposite the regatta village entrance. Attendance is mandatory for the Boat Captain, designated Safety Tactician and Racing Tactician (if applicable). 4.2 There will also be daily, pre-race briefings each morning at 09:30hrs in the regatta village. The race course, weather, commercial shipping movements and any safety issues will be addressed. Starting time options and Course Log, Safe Racing & Penalty Declaration Forms will be distributed. Starting times are subject to change depending on conditions in the course area. Any such change will be broadcast on Race Committee VHF Channel. 5. COURSE LOG/DECLARATION FORM 5.1 Course Log, Safe Racing & Penalty Declaration Forms will be distributed to all Safety Tacticians at the daily pre-race briefings. The Declaration Form will call for mark rounding times, recorded wind speed and direction, penalties taken and any safety related anomalies encountered in navigating the course. The declaration form must specify all safety related incidents the boat is involved in. The completed signed Declaration Forms are to be submitted to the Race Office as soon as practical after racing, but no later than 2 hours after each yacht finishes racing. 6. USE OF ENGINES AND THRUSTERS 6.1 For safety reasons, boats are encouraged to run their engines in neutral at any time during the race. Engines may be put into gear and thrusters may be used at any time during the race for collision avoidance. 6.2 A boat that puts her engine in gear or uses her thruster at any time after four minutes prior to her individual start, must submit a written declaration of engine use to the Race Office as soon as practical after racing, stating the time the engine was in gear or thruster used, the reason for using it, and any potential competitive gain. 6.3 The race committee will review all declarations on engine and thruster use to determine whether use was appropriate and if there was competitive gain. The use of engine or thruster at any time shall not be ground for protest by another boat. This changes RRS COMMUNICATION (VHF RADIO / AIS) 7.1 The Race Committee will use VHF Channel 73 for communication. All competitors must monitor this channel from the time they approach the starting area until departing the finishing area following the race. A time check will be broadcast at 1200 each day. 7.2 The primary Bridge-to-Bridge Safety Channel is VHF 17. All boats must maintain an active radio watch on VHF 17 from their approach to the starting area until departing the finish area following the race. This channel should be used in close quarters to determine other boat s

4 intentions, resolve confusion, and assist with collision avoidance. 7.3 If VHF 17 is congested, yachts may also use Race Committee Channel VHF 73, VHF 68 or mobile telephone for collision avoidance. Boats hailed by another boat must respond. All competitors will be provided with a list of mobile phone numbers for each yacht s Boat Captain and Safety Tactician. 7.4 Boats equipped with an Automatic Identification System (AIS) are required to operate their AIS system from the time they approach the starting area until departing the finishing area following the race. This can assist in maintaining safe separation between boats and collision avoidance. 8. SCHEDULE OF RACES There are three races scheduled, one each day from Thursday, 21 June through Saturday, 23 June. The scheduled warning signal for the first boat each day is 13:00hrs. The Race Committee reserves the right to modify the schedule and will communicate their intentions on the Race Committee channel prior to the start. It is the Race Committee s intention to have boats return to the harbor by 18:00hrs daily. 9. RACING AREA / STARTING LINE LOCATION Racing will take place in the Bahia de Palma. The intended starting area will be located near N / E. The Race Committee reserves the right to change the starting area and will notify the competitors at the pre-race briefings and on the Race Committee VHF Channel. 10. TURNING MARKS, BUOYS AND COURSES 10.1 A list of the marks for the various courses and their approximate location can be found in Exhibit Inflatable buoys will be yellow cylindrical buoys Courses for each race will be selected by the Race Committee from those outlined in Exhibit 2. The marks for each course, order to be rounded and side to be passed will be included If a mark is missing or out of position, the race committee shall, if possible, replace it in its correct position or substitute with a new one. If a replacement mark is not possible, then a latitude and longitude position to sail around will be announced on the Race Committee VHF Channel After the Race Committee is on station and has observed the prevailing conditions the course for the day and starting time options will be announced on VHF Channel THE START 11.1 The Superyacht Cup Palma features a Pursuit Start with the slowest rated boat starting first. The starting time for each boat is determined using the Bucket Rule, which takes into consideration projected wind conditions and the course configuration. Start times for all but the first boat are likely to change race to race based on the use of different courses and projected wind conditions The starting area will extend 200 meters on either side of the starting line and 400 meters on the prestart side of the line. Boats which are not within 5 minutes of their start should stay clear of the starting area The starting line will be between an orange flag on the Race Committee signal boat on the

5 Starboard end and a yellow inflatable cylindrical buoy on the Port end The start time for the first boat in fleet is scheduled for 1305 each day. Starting time options for all boats will be distributed at the daily pre-race briefing. The start times will be staggered at not less than 1 minute intervals. A sound signal will be made for each start and the Race Committee will attempt to broadcast countdowns for each start. The absence of visual signals shall be disregarded Rule 26 is changed to: Races shall be started by using the following signals. The flag utilized as the class flag will be Flag D. Minutes before Signal Flag Sound 1 st starting signal Warning Class Flag D 1sound 5 Preparatory 1 st boat NP1 1 sound 4 Starting 1 st boat NP1 removed 1 sound 0 Starting 2 nd boat 1 sound To Be Determined Etc. Starting last boat Class flag removed 1 sound A boat s preparatory signal is 4 minutes prior to its scheduled start. Apart from the first starter, there will be no visual or sound signals for the individual preparatory signals. Apart from the first starter, there will be no visual signal for individual starts. The Race Committee will attempt to broadcast countdowns for each start on the Race Committee VHF Channel. 12. RECALLS There will be no individual recalls. Any boat crossing the starting line early shall not restart and will be awarded a 5 minute penalty. A boat that crosses the starting line more than 2 minutes early will not be scored. This modifies rules 28.1, 29.1, A THE FINISH 13.1 The finishing line will be between an orange flag on the Race Committee signal boat and a yellow cylindrical buoy The Race Committee Signal Boat and pin end of the finishing line are considered marks of the course Once boats have finished the race, they should move away from the finishing line and remain clear of all boats that have not yet finished The time limit for racing will be 18:00hrs unless announced otherwise at the daily pre-race briefings or over the Race Committee VHF Channel. If at least one boat sails the course and finishes within the time limit, all other boats which complete the course within 120 minutes after the arrival of the first boat will be scored. Boats failing to finish within

6 120 minutes after the finish of the first boat will be scored one position worse than the last scored boat. This changes RRS 35 and A4.1. In case of postponement of the starting time the time limit will not be changed. 14. PENALTIES 14.1 The Event Organizer will take a proactive stance on enforcing safety and sportsmanship. Safe racing is the responsibility of everyone involved in the Superyacht Cup Palma A boat shall not take a Two-Turns Penalty. This modifies rules The Scoring Penalty as provided in Rule 44.3 shall apply except that Rule 44.3(c) is deleted and replaced with the following: 44.3 (c). The elapsed time for a boat that takes a Scoring Penalty shall be the elapsed time she would have been allocated without that penalty increased by 3%. If she takes more than one Scoring Penalty in a race, her elapsed time will be increased by 3% for each Scoring Penalty taken A boat that has broken rule 31 (touching a mark) shall not take a One-Turn Penalty. The yacht will be penalized 5 minutes. This modifies rule The jury may impose a penalty less than disqualification (including no penalty) in the event of a breach of a rule other than a rule of Part 2. This changes Rule A boat shall declare any penalties on the Course Log, Safe Racing and Penalty Declaration Form If the Event Organizer receives corroborative or substantiated reports of a yacht being handled in any unsafe or unsportsmanlike manner, they may excuse the yacht from that race, the regatta or future Superyacht Cup events. Alternatively, the Safety and/or Racing Tactician may be excused from the regatta or future regattas In the event of a collision, the Event Organizer shall not be compelled by any authority to convene a hearing and/or render a third party opinion as to which yacht is at fault. Nor shall they be required to give evidence or disclose any documentation for any civil hearing. Any claim for damages arising from an incident while a boat is bound by the Sailing Instructions shall be subject to the jurisdiction of the courts, according to applicable Civil and Admiralty laws. 15. PROTESTS 15.1 Protests shall be made in accordance with RRS 60 and Protests forms are available at the Race Office and the completed Protest Form shall be lodged there within 90 minutes after the last boat has finished Schedule of hearings will be posted on the Official Notice Board as soon as possible. Protests shall be heard as soon as possible in approximately the order received. All persons involved in the hearings shall remain in the vicinity of the Jury Room It is the boat's representative s sole responsibility to check the protest notices at the end of the protest filing time to see if she is cited in a protest. Competitors are reminded of RRS 63.3 (b) There shall be no claim for redress in the case of failure to make a radio transmission, delay or a transmission, or failure to receive or hear a transmission. This changes.rrs 60.1 (b) and 62.1 (a).

7 16. SCORING 16.1 Boats will be scored based on the order of finish The Low Point System RRS Appendix A will apply. There will be no discard The decisions concerning course distance, wind strength and direction are the responsibility of the race committee and are not grounds for request for redress. This amends RRS SAFETY 17.1 In an emergency, boats requiring assistance should call the Centro Regional de Coordinación de Salvamento Marítimo on VHF Channel 16. They should also apprise the Race Committee of the situation on the Race Committee VHF Channel The boat s man-overboard procedure shall be practiced aboard each boat at least once by the crew racing in the regatta prior to the first race of the series A boat that retires from a race or does not intend to start a scheduled race shall promptly report this on the Race Committee VHF Channel and receive acknowledgement. If this is not possible she shall promptly report her actions to Race Office on shore. 18. CLASSES AND CLASS FLAGS At the discretion of the Event Organizer, boats may be separated into two classes. If so, a list of boats by class will be posted on the Official Notice Board. At the Race Committee s discretion, the two classes may sail different courses on any given day. The start times would be adjusted accordingly to compensate for any course differential. Class flags (P1 for Class 1 and P2 for Class 2) would be displayed on the backstay at least six feet above deck at all times while the boat is racing. If such display is not feasible, class flags would be displayed from the stern pulpit. 19. AWARDS 19.1 The Event Organizer reserves the right to divide the fleet into classes and present class awards daily and for series. The awards ceremony will be held at 20:00hrs on Saturday, June 23 at the Es Baluard Museum There will be prizes awarded to first in class daily Series awards for 1st, 2nd, and 3rd place in class and overall for fleet will be presented There may be special trophies awarded as well, for meritorious acts, boat handling and other notable behavior. 20. BOTTOM LINE The rules outlined here constitute a comprehensive set of safety guidelines that will be used in all Superyacht Cup Regattas. The purpose of the rules is to encourage good competition, good sportsmanship and absolute collision avoidance.
