6 6 Section A. Commercial Seaport of Vanino 1. General Provisions 1.1. These Compulsory Regulations for the Vanino Commercial Sea port (hereinafter referred to as the Port of Vanino) and the Timber Loading Terminal of Siziman (hereinafter referred to as the Terminal of Siziman) have been issued in accordance with Resolution No of 17 December 1993 by the Council of Ministers/Government of the Russian Federation as amended under Resolution No. 705 of 25 September 2002 by the Government of the Russian Federation, and in compliance with Article 5 of Federal Law No.155-ФЗ On the Inland Sea Waters, the Territorial Sea and the Contiguous Zone of the Russian Federation of 31 July 1998 as a supplement to The General Rules of Navigation and Stay of Vessels in, and in the approach routes to, the Sea Ports of the Russian Federation Vol , 1994 Publ. GON&O MD (the General Rules ), to reflect the peculiarities and specific nature of the operation of the Port of Vanino and the Terminal of Siziman The requirements of these Compulsory Regulations shall apply to any Russian or foreign ship as may stay within the water area of the Port of Vanino or the Terminal of Siziman, irrespective of the institution operating such ship or the form of ownership, and to any individuals or corporate bodies carrying out their activity within the port water area and territory. Ignorance of the provisions in these Regulations may not give ground for being exempted from the liability for any breach thereof. The person guilty of the breach of any provision herein shall be held responsible in accordance with the laws of the Russian Federation The Harbour Master of the Port of Vanino shall, on behalf of the State, exercise supervision in the port water area over the abidance by the provisions of the national laws and international treaties made by the Russian Federation with respect to the adequate navigation safety, safety of life at sea and environmental pollution prevention, and shall arrange for pilot and icebreaker assistance for navigation within the water area of the Port of Vanino. The Terminal of Siziman will be declared close for navigation from the initial date of a respective freezing-over period These Compulsory Regulations shall become effective as of the publication date. A copy of the Compulsory Regulations may be obtained from the SPSI The 2001 Revision of the Compulsory Regulations shall be deemed to have become invalidated The water area of Vanino port covers the Vanino Bay bounded in the north, west and south by the coastline and the berth edges, and in the east by the straight line connecting the capes of Burny and Vesyoly, and also cover a portion of the water area of the Muchke Bay bounded by the straight line connecting the cape of Aya and the cape of Muchukei Dua. The water area of the Port of Vanino includes the inner aquatic area and the outer roads. The outer roads are the Vanino Bay water area between the straight lines connecting the capes of Burny and Vesyoly in the east, and the capes of Severny and Yuzhny in

7 7 the west, as well as the Muchke Bay water area further east than of the straight line connecting the capes of Aya and Muchukei Dua. The inner water area of the port is the Vanino Bay water area westward of the western boundary of the outer roads. The inner water area includes the inner roads which are bounded by the boundary of the inner water area in the east, by the edges of Berths Nos. 8, 7, 6, 5, 9, 10, 11 and 12 in the west, and by the Vanino Bay coastline in the north and south. The inner water area in the Muchke Bay is the water area westward of the line connecting the capes of Aya and Muchukei Dua, and the coastline The port of Vanino territory is bounded by the edges of Berths Nos. 20 to 15, then by the coastline of the south-east coast of the Bay to the dam of the Ui River, by the north-east edge of this dam, by the coastline of the north-west coast of the Bay, by the edges of Berths Nos. 12 to 9, Pier No. 1, Berths Nos. 5, 6 and 7, Pier No. 3, by the coastline in proximity of Berth No. 8, and further by the coastline up to Oil Berths Nos. 1 and 13, by the edges of Oil Berths Nos. 1 and 13, and by the embankment near Severny Cape. The northern and north-western parts of the territory are bounded on the outside by the railway line with a fence running along it; the southern part will be determined upon completing the construction of the new berths The port of Vanino is opened for navigation all the year round and takes ships having a length of up to 200m. Ships having a length of more than 200m may only enter the Vanino Bay with the special permission of the Harbour Master. 2. Navigation within the Scope of the Compulsory Regulations 2.1. Traffic Rules Navigation in the water area of the Port of Vanino and in the approach routes to the Sovetskaya Gavan Bay is subject to the prescribed order of control. The control of traffic shall be exercised by the Vessel Traffic Management Centre located in the north-west part of the port area The traffic rules effective in the functional area of the VTC have been set forth in Annex 1 to these Compulsory Regulations Vessels shall enter the Vanino Bay in transit of the lighthouses and the light beacon of the Vanino Bay from the circular motion zone of the traffic separation scheme for the approach routes to the Sovetskaya Gavan Bay and the Port of Vanino When entering the Port of Vanino, in order to make fast to the ferry dock, the ferries of the Sakhalin type shall make a turn in order to move stern first in the outer roads within the limits of a circle-like area having a radius of two cables, with the circle centre being in a position of Lat. 49º05.1 N., Long. 140º20.3 E. Under adverse weather conditions, such turn may be made in the inner roads subject to the relevant permission of the VTC. In winter, the point of the turn shall be specified by the VTC having regard to ice environment in the Vanino Bay During the period of winter navigation in ice environment, vessels are prohibited from anchoring or drifting further east than the line connecting the capes of Burny and Vesyoly, due to the risk of becoming ice-bound by floes or getting a dangerous drift toward the shore.

8 In the event that the visibility in the Port water area is 5 cables or less, a vessel having no radar will not be allowed to move Vessels must proceed in the inner roads at a minimum speed ensuring their safe manoeuvrability Pilot Service Applying for pilot service in the port water area is not a compulsory requirement Pilot s assistance shall be compulsory in the Port of Vanino during any mooring operation, shifting, or hauling at a distance of more than the length of a vessels hull for: Vessels flying any foreign flag; Vessels to be moored alongside Oil Berths Nos. 1 or 13, or to any terminal owned by Transbunker CJSC, or Pier No. 4; Any vessel to be moored alongside Berths Nos. 5, 6 or 7 at the period of winter navigation The pilotage from the point of pilot taking to the meridian of the lighted mark (beacon) on the Severny Cape dam (140º18.0 E), or towards Pier No. 4 to the meridian of the lighted Muchke mark (beacon) (140º20.5 E) will be an off-port service. Pilotage to any terminal in the Muchke Bay or to Pier No. 4 shall be a compulsory requirement The pilots provide assistance to mooring operations 24 hours a day. The operation of getting moored alongside another ship lying at a berth (pier) may only be performed during day-light hours as agreed upon between the masters of both ships To call for a pilot it is necessary to make a request to the Chief Controller of the Vanino Commercial Seaport, JSC at USW Channel 9 or by telephone , 2 hours prior to the expected mooring or the pilotage time A pilot shall be embarked and disembarked within the limits of the circular-like area having a radius of two cables and the centre in a position of Lat. 48º05.3 N, Long. 140º18.87 E. In the event of stormy weather (when the wind speed exceeds 15 m/sec., and the wave height is more than 1.5m) the pilot shall be embarked and disembarked in the inner roads Pilot service shall be provided to vessels depending on the sequence in which they have submitted their requests. Any previously made request may be cancelled not later than one hour before the intended commencement time of the operation in question If the master of a vessel rejects the pilot service previously requested for, after the pilot s arrival aboard the vessel, or if the commencement of a pilotage operation is delayed for a period of more than one hour as of the notified time through any cause other than force majored circumstances, the pilot may be withdrawn from such vessel and the respective request may be cancelled. The vessels master (or the person acting for the master) shall be bound to sign the pilot s bill for a vain call payable at the rate fixed for such scheduled operation and to submit another request.

9 A vessel with her main engine, screw and steering system, or anchor-handling gear being out of order may only be piloted subject to the Harbour Master s permission thereto The Pilot Agency shall not be responsible for any possible delay or demurrage of a vessel due to her waiting for a pilot where: The request for pilot s assistance is submitted later than the time stipulated to this effect, or the vessel has been more than one hour late after the notified time in arriving at the embarkation place of the pilot; The pilot may not be embarked/disembarked because of weather or ice conditions, while pilotage by using the method of leading is impossible under the existing conditions, in the master and the pilot s opinion Tugboat Assistance The use of tugs shall be compulsory in the Port of Vanino when mooring, unmooring or shifting a vessel, or hauling her at a distance of more than the length of her hull unless the vessel has a gross tonnage of less than 500, or is equipped with two screws or with a lateral thrusting propeller The requests for towage assistance shall be submitted to the Chief Controller of the Vanino Commercial Seaport, JSC at USW Channel 9 or by telephone No , two hours prior to the commencement time of the towage operation in question The operation of the tugs during the moorage of a self-propelled vessel shall be directed and controlled by the master of such towed vessel irrespective of whether she is powered by using her own engines or not. The towage to shift a non self-propelled craft will be carried out under direction of the master of the towing vessel. In the event that the towing assistance is provided by more than one tug, it shall be the responsibility of the skipper of the most powerful tug to direct and control such operation Within the port water area, barges and pontoons may only be towed astern using a towline cable of not more than 30 metres in length A vessel having a gross tonnage of 15,000 or more may only be towed in the Port water area if the wind speed is not more than 10 m/sec Navigation of Vessels in Ice Environment The period of winter navigation in the Port of Vanino shall be established by order the Harbour Master from 1 st January till 31 st March. The beginning and the end of winter navigation will be notified of in a relevant coastal warning (notice) (CW). Any vessel expected to call at the Port of Vanino during such period shall have at least a LU3 category of ice strengthening in accordance with the classification established in the Register of Shipping of the Russian Federation or a similar category provided by any other classification society To ensure that vessels safely enter and leave the Port of Vanino, ice-breaker assistance will be available. The control over icebreaking operations shall be exercised by the Harbour Master.

10 A request for ice-breaker assistance shall be submitted to the Harbour Master one day prior to approaching the ice edge or leaving the Port of Vanino. In addition to the information required under Clause of the General Rules, the request for icebreaker assistance shall state the category of the vessels ice strengthening and the time of approaching the ice edge If no icebreaker is available by the time when a vessel approaches the ice edge and if any stable lanes or light ice exist, the vessel subject to the permission of the VTC may proceed to the Port on her own The masters of vessels proceeding to the Port of Vanino on their own shall be liable to inform the Harbour Master of the ice conditions on their way to the Port. In the event that a vessel leaves the Port without ice-breaker assistance, the master is to report by radio to the Harbour Master the information of ice conditions on her way (as long as the vessel passes the ice edge) As of the date when ice begins to form in the approach routes the Port of Vanino and until ice completely disappears the Port radio station shall transmit the information of ice conditions for vessels. The text messages on ice conditions shall be transmitted on the frequency of 8,680kHz at 04:00 a.m. and 09:00 a.m. Moscow Time, and on the frequency of 3,730kHz at 12:00 a.m. Moscow Time, transmission class being F1B. The same frequencies shall be used to transmit, at 04:10 a.m., 09:10 a.m. and 12:10 p.m. Moscow Time, the facsimile chart of ice conditions including a recommended route, with the drum rotation speed and the feed pitch of a receiving facsimile unit to be 120rpm and 0.265mm respectively. Any changes in the details and the transmitting time of text messages on ice conditions and of facsimile charts shall be notified of to the seafarers on an additional basis Neither the Harbour Master of the Port of Vanino, nor the owners of the port icebreaking craft will be responsible for any demurrage of a vessel if the ice-breaker is late in approaching the vessel within the time provided in the respective Daily Plan, due to ice-bound or adverse weather conditions Rules for Small-Tonnage Vessels The small-tonnage vessel shall mean any self-propelled vessel which has a gross tonnage of less than 80 and is equipped with a main engine of less than 55kW (75HP) in power or with outboard motors irrespective of their rating; as well as any sailing non self-propelled vessel having a gross tonnage of less than 80, or any other non self-propelled vessel (such as a rowing boat with a load-carrying capacity of 100kg or more, a kayak with a load-carrying capacity of 150kg or more, and an inflatable craft with a load-carrying capacity of 225kg or more) A small-tonnage vessel shall be permitted to navigate in the water area of the Port of Vanino provided that such vessel has been registered in accordance with the prescribed procedure and is steered by a person carrying an identity document and an adequate diploma, certificate of competency or navigating licence for the vessel in question as issued by an agency or institution duly authorized thereto.

11 Small-tonnage vessels are prohibited, without a relevant permission of the frontier and the customs authorities, from approaching any foreign ship staying in the water area of the Port of Vanino or any vessel lying on the Port s berth People shall be conveyed to any vessel lying on the roads by employing an estuary launch or a service-crew launch equipped with survival aids adequate to such launch s passenger capacity and provided with a passenger certificate and a licence to carry passengers. The responsibility for the safe embarkation/disembarkation of passengers to/from a vessel lying on the roads shall rest on the master of such vessel, and the responsibility for the safe embarkation of passengers from the wharf aboard a launch shall rest on the crew of the launch. It will be prohibited to convey jointly crew members of foreign vessels and nationals of the Russian Federation on board an estuary launch Any craft may only be launched from a vessel and navigate in the water area of the Port of Vanino subject to prior permission therefor of the SPSI and the frontier guard authorities unless such launching is necessary for the purposes of emergency and rescue operations No small-tonnage vessel will be allowed in the water area of the Port of Vanino: To navigate within the strip of one cable in width on either side of the range axis of the Vanino Bay lighthouses and beacon; To navigate in the anchorage areas thus impeding the movements of manoeuvring vessels; To navigate without having a USW communication link with the VTC; To navigate when the wind speed is more than 15 m/sec. and/or the visibility is less than 5 cables; To approach any vessel riding at anchor; To cross the course ahead of any carrier navigating in the port water area The sport craft shall mean a vessel designed, built or reequipped mainly or exclusively for the purposes of engaging in any sport activity, sporting events, contests, coaching, long sporting voyages or other technical aquatic sports The public registration of small-tonnage vessels and recreational craft with a passenger capacity of 12 persons or less, owned by any corporate bodies or individuals, as well as the engineering supervision over such vessels and craft shall be conducted by the State Inspectorate of Small-tonnage Vessels under the Central Administrative Board for Khabarovsk Territory of the Russian Federation Ministry for Civil Defence, Emergencies and Elimination of Consequences of Natural Disasters The public registration of sport craft used for any sporting, training or coaching purposes, irrespective of the rating of their main engines and their gross tonnage, as well as the engineering supervision over such craft shall be conducted by the Federal Inspection Service in the Field of Transport The public registration of craft constituting the harbour and technical fleet of the Port, with a power of 55kW or more and a gross tonnage of 80 or more, as well as the public registration of small-tonnage recreational craft with a passenger capacity of more than 12 persons as owned by any corporate bodies or individuals, irrespective of the rating of their main engines and their gross tonnage, shall be conducted by the

12 12 Harbour Master of the Port of Vanino, the technical supervision over such vessels being conducted by the Russian Register of Shipping Any small-tonnage vessel or sport craft must bear an official registration mark showing her name or number (on her board or sail), and the name and seat of her Owners. Such registration mark shall be made in a conspicuous place on the outside and the inside of the board The responsibility that the category of a sport craft or the seaworthiness of a smalltonnage vessel be adequate to the actual weather conditions, and that she be duly manned with a crew, shall lie with her Owners or the person on duty at her basic station (yacht club, marina) who has let such craft or vessel leave the basic station A small-tonnage vessel, a sport motor craft with a main engine of 55kW (75HP) in power, or a sailing craft or a rowing sport boat with a gross tonnage of less than 80 shall be bear the following documents: Ship Ticket; Certificate of Seaworthiness; Crew list It will be prohibited in the Port inner roads to coach or stage any contest by using rowing, sailing or motor vessels or craft Any small-tonnage motor vessel, or any sport sailing or motor craft operating in the water area of the Port of Vanino shall have on board sea navigation charts for her navigation area, plotting instruments, a magnetic compass, and a plummet (an echosounder) No craft may approach any foreign vessel which is lying on the Port s berth, riding at anchor or under way, or any vessel flying the Russian flag, which is under customs examination and border control or has been cleared for an overseas trip Any craft may only be launched from a vessel and navigated in the water area of the Port of Vanino subject to prior approval of the VTC, the SPSI and the FD FSS of Russia unless such launching is necessary for the purposes of emergency and rescue operations. 3. Regulations on Vessels Entering and Leaving the Port of Vanino 3.1. Notification of Arrival The Owners or the master of a vessel shall give (through her ship agent) an advance 48 hours notice of arrival, a repeated 24 hours notice of arrival and an adjusted 4 hours notice of arrival to the Harbour Master of the Port of Vanino prior to the vessels arrival at the circular motion zone of the traffic separation scheme for the approach routes to the Sovetskaya Gavan Bay and the Port of Vanino. If the duration of a trip is less than 48 hours a notice of arrival must be submitted within two hours after the vessels sailing for this Port In addition to the information required under Clause of the General Rules, the shipmaster shall, directly or through the ship agent, report in his advance notice of arrival to the Harbour Master the following details: Call signs of the vessel and her IMO identification number;

13 13 Port of registry; Beam of the vessel and her hull height; Name of the ship agency and its registered address; Purpose of call at the Port; Name of the Charterers and their registered address; Condition of the vessels gears which may affect her manoeuvring characteristics and safety; Description of the goods carried, their specific properties, the name of fumigant used (if the goods were fumigated on board the vessel), quantity (weight) of the goods, the stowage thereof on the deck, in the tweendeck and/or the holds, the length of one package of long-length goods or the weight of heavy goods, and whether any dangerous goods are on board the vessel and the category of such goods in accordance with the International Maritime Dangerous Goods (IMDG) Code Prior to entering the Port of Vanino the master of a vessel shall implement all appropriate measures as provided in SOLAS 74, Chapter XI-2 and the ISPS Code in order to ensure that the vessel complies with the security level effective in the Port of Vanino, and shall advise thereof the security officer in the Port of Vanino. Whenever the vessel security level changes for level 2 or 3, or whenever these levels are set, the vessel shall acknowledge receipt of the respective instruction and shall confirm to the Port officer the initiation of the implementation of the appropriate measures and procedures as detailed in the vessels security plan The masters of tankers, taking into account the provisions in Clause of the General Rules, shall report, in addition to the information required under Clause hereof, the following details: the quantity of ballast (isolated, clean and dirty) on board and the number of non decontaminated cargo tanks, if any The masters of vessels carrying bulk cargo shall, in addition to the details to be advised to the Harbour Master of the Port of Vanino pursuant to Clause of these Compulsory Regulations, also furnish the port terminal through their ship agent or their Owners (operator) with the information required under Section 3, Clause 3.2. in the Code of the Safe Practice of Loading/Unloading of Bulk Cargoes (IMO Resolution A.862(20) of November 27, 1997) If a vessel is proceeding to the Port with any self-propelled or non self-propelled object in tow, her master is in addition to the details required under Clause hereof, to report: the dimensions of such towed object; its draft; the length of the towing line; the heel and the trim of the towed object, if any; and the number of extra tugboats required to bring the object to the Port of Vanino The information of a vessels sanitary condition in accordance with the requirements of the maritime sanitary declaration (maritime declaration of health) shall be reported by the master through the vessels agent or the SPSI to the Quarantine-Sanitary Authority (QSA) of the Port of Vanino 48 hours prior to her arrival at the Port The vessels arrival at the Port shall be notified of to the Harbour Master of the Port of Vanino by one of the following means: By radio transmission to the Harbour Master; By telephone message to telephone No.: (42137) ;

14 By facsimile No.: (42137) or Any delays in the Port resulting from the failure to comply or the improper compliance with Clause hereof shall be for the vessels account Clearance Inwards The arrival of a vessel at the Port of Vanino shall be registered at the premises of the State Port Surveillance Inspection (SPSI) located near Berth No. 9 in the territory of the Port of Vanino (Tel: (42137) , Fax: (42137) ) within 24 hours from the time of arrival To have the arrival of a vessel at the Port of Vanino registered the following documents shall be submitted to the SPSI in addition to the documents required under Clauses and of the General Rules: Certificate of Seaworthiness; Copies the Shipowners or the Operator s Licence; Documents permitting carriage of the dangerous goods (when the vessel intends to load such goods); Copies of the Cargo Manifests (Cargo Statements in case of coastal traffic) for all the goods aboard; Declaration (information) of the goods where the vessel is put for loading Each vessel inbound from a foreign country shall be subject to the quarantine-sanitary examination, and to the frontier and customs inspection. Such vessel must fly the Q (Quebec) flag in accordance with the International Code of Signals until the free pratique is granted to her by the Quarantine-Sanitary Authority (QSA). The quarantine-sanitary examination, and the frontier and customs inspection will be carried out on board the vessel lying alongside her berth or at an anchorage point in the inner roads No things may be transferred from or to a foreign-going vessel and no person shall be allowed to move from the vessel ashore and backwards until the quarantine-sanitary, frontier and customs control formalities are completed The vessels arriving at the Port during solar day shall keep their pennants made from the time of their entry to the Port to the completion time of inward clearance The arrival of a vessel of coastal navigation shall be registered by the vessels master with the SPSI latest by 23:00 p.m. on the expiry date of the respective shipping documents as indicated in the Departure stamp imprint in the crew list Clearance Outwards The outward clearance formalities shall be completed 24 hours a day on board a vessel or at the premises of the SPSI two hours prior to the scheduled time of departure in accordance with the requirements in Clause 3.3 of the General Rules To go through the outward formalities, the following documents shall be submitted to the SPSI in addition to the documents required under Clause of the General Rules: Copies of the Cargo Manifests;

15 15 Certificates for cargo securing outfits; Certificate of safe cargo stowage and securing, and the stability calculation To have an outbound vessel cleared, her master shall submit a request for clearance outwards to the SPSI not later than 6 hours prior to the expected time of departure. All cargo handling and bunkering operations must be completed by the commencement time of the frontier inspection and customs examination procedures. No crafts will be allowed to moor alongside a vessel that has passed the frontier and customs clearance for an overseas voyage The request for clearance outwards of a vessel bound for an overseas voyage shall be submitted to the CCP FD FSS of Russia, to the customs officer on duty, and to the QSA of the Port of Vanino 24 hours prior to the scheduled time of departure, and shall be further confirmed two hours prior to such time When a foreign-going vessel intends to leave the Port of Vanino the outward formalities in respect of such vessel with the SPSI shall be completed before commencement of the respective frontier and customs inspection or any other inspection procedure The clearance outwards with the Port QSA shall be completed on board a vessel prior to clearing her with the SPSI. When clearing outwards a vessel under the Russian flag the following documents shall be submitted to the representative of the QSA: Ship s sanitary book; Ship s Sanitary Certificate of Navigation; Certificates of health for the crew members in accordance with the Crew List; International certificates of vaccination (if the vessel intends to proceed to a region where such certificates are necessary). The approval of the QSA for the vessels departure will be a stamp on the Crew List certified with the signature of the QSA official on duty After the quarantine-sanitary, frontier and customs control procedures begin, no things may be transferred from or to a foreign-going vessel and no person shall be allowed to move from the vessel ashore and backwards To be cleared outwards, a rescue vessel intending to render assistance to any craft or people in distress shall, when being ready to sail, submit a request for clearance outwards to the SPSI stating the objective of the vessels departure, the area of her expected operation, and the crew list. The vessel will sail subject to the approval by the Harbour Master of the Port of Vanino Where the master believes that his vessel will not be ready to sail by the specified time he shall be bound to advise the SPSI thereof directly or through the vessels agents not later than 30 minutes before the expected departure If the departure of a vessel cleared outwards is delayed for more than two hours, the CCP FD FSS of Russia will have liberty to cancel their permission for departure Coastal vessels or any harbour craft making voyages beyond the limits of the Port water area shall be cleared outwards with the special permission of the SPSI for a

16 16 period of up to one month which period may not, however, exceed the minimum term of any of the vessels documents. To be granted such permission the vessel shall submit the following documents: Certificate of Navigation under the National Flag of the Russian Federation; Certificate of Ownership for the vessel; Certificate of Seaworthiness; Crew List in duplicate checked by the QSA; Diplomas and certificates of competency issued to the vessels officers and other crew members. The masters of the vessels having such permissions shall notify the SPSI of each voyage during which their vessel sails beyond the water area of the Port of Vanino During the currency of the respective permission to sail beyond the Port limits, the master of a coastal vessel or a harbour craft having such permission shall immediately notify the SPSI of any change in or amendment to the vessels crew list or her documents To take the representatives of the frontier, customs and quarantine-sanitary authorities, the vessel staying in the roads must be equipped with a main embarkation ladder. 4. Stay of Vessels in the Port 4.1. Stay of Vessels in the Roads To anchor vessels in the inner roads or in the outer roads, the following anchorage points have been assigned: Point No. Position Latitude, N Longitude, E Inner roads 1 49º05.35 N 140º17.30 E Outer roads a

17 Anchorage points Nos. 1, 2 and 3 are intended for short-term lying of vessels while taking in provisions and during the clearance inwards/outwards Points Nos. 10 and 12 are intended as a quarantine anchorage, and the anchorage of oil-carrying vessels or vessels carrying any dangerous cargo on board The vessel may be brought to any anchorage point subject to the approval of the VTC as closely as possible, or at the master s request by using a pilot operator of the VTC The vessels riding at anchor in the roads shall be bound to keep radio watch at USW Channel 16 twenty-four hours a day The master of a vessel shall immediately notify the VTC of having cast or weighed the anchor The anchored vessel shall be prohibited from launching a pulling boat, a motorboat or any other craft to communicate with the shore or other vessels In the event that the wind speeds exceeds 15 m/sec., it shall be prohibited: For tugs to lie in the roads, with any non self-propelled vessel being moored alongside them; To bunker any vessels with fuel, oils or lubricants while in the roads Preparation of Wharves for Mooring Vessels The Port wharves shall be prepared to moor vessels in accordance with the provisions in Chapter 4.2 of the General Rules The responsibility for preparing a wharf for mooring operations shall lie with the entity using the wharf in question. The readiness of a wharf for mooring operations will be checked up by an authorized executive of the entity using the wharf and by a VTC representative 30 minutes prior to the commencement time of such operations It shall be the responsibility of the SPSI master on duty to check up the serviceability of the wharf fender protection, the clean condition of the 3 metre zone along the wharf edge, and the availability of free access to the mooring bollards The SPSI master on duty shall inform the master of a vessel about the wharf being ready for mooring and about the size of free space at the berth Mooring of Vessels The representatives of the SPSI and the entity using a wharf shall be present on such wharf while a vessel is moored thereto/unmoored therefrom Mooring operations will be allowed in the Port when the wind speed is not more than 15 m/sec. and the visibility is not less than 5 cables. In exceptional cases, mooring may be effected in worse hydrometeorological conditions with the specific approval of the Harbour Master, subject to the availability of tug assistance and the attendance of a pilot A single-screw vessel having a gross tonnage of more than 500 and no bow thruster may only be moored by using tugs When mooring to any wharf or pier in the Port of Vanino, a vessel shall comply with the following conditions:

18 18 The angle of her approach to the wharf/pier may not be more than 30 grades; If a vessel gets berthed alongside another vessel, the vessel allowing to lie alongside her shall have her decks and board illuminated to the sufficient degree, and have no list or a maximum list of 2 degrees in the direction of the wharf; The speed of a vessels approach to the wharf must not exceed 0.22, 0.15, 0.13, 0.10, 0.09 or 0.08 m/sec. when the vessel has a tonnage of up to 2,000; 5,000; 10,000; 20,000; 40,000; 100,000; or 200,000 tons respectively A large-tonnage vessel (such as dry cargo vessels having a length of more than 160 metres; tankers and bulk carriers having a length of more than 150 metres) may only moor to any wharf in the Port of Vanino, the wharf of Transbunker, CJSC or any terminal in the Muchke Bay during day-light hours if the wind speed is no more than 10 m/sec The operation of the tugs during the moorage of a self-propelled vessel shall be directed and controlled by the master of such towed vessel. The towage to shift a non self-propelled craft will be carried out under direction of the master of the towing vessel. The necessary number of tugs shall be determined by the master of a vessel in cooperation with the pilot Stay at Berths No foreign vessel will be allowed to get berthed alongside another vessel in the Port of Vanino. A Russian vessel may only be moored alongside another vessel with the permission therefore of the SPSI and subject to the respective agreement between the masters of both vessels. Mooring alongside another vessel lying in the roads will only be allowed subject to the specific approval of the SPSI. It shall be prohibited to moor more than two vessels alongside each other at on the Port berths A vessel shall be prohibited from running her screw(s) while lying at a Port berth except for a short-term turnover of the ME or with the purpose of ensuring the vessels safety No vessel lying in the roads, or at Berth No.1 or No. 13, or at Pier No. 4 may put out of operation her powerplant, drainage system or fire-fighting unit. To obtain a permission for repair the vessel is to submit a written request to the Harbour Master after having agreed upon the necessary repair period with the Chief Controller of the Port of Vanino Change of Moorage A vessel may only change her anchorage point with the permission therefor of the VTC A vessel may be shifted along the wharf by using mooring ropes without tug assistance at a maximum distance of 50 metres. The shifting at a distance of more than 50 metres shall only be made by using tugs and will be considered as two operations (mooring and unmooring).

19 To shift her position in the Port, a Russian foreign-going vessel or a foreign vessel shall also obtain, in addition to the approvals of the SPSI and the Port Controller, the permissions from the CCP FD FSS of Russia and the Customs Office If a vessel fails to fulfil the demands of the Port of Vanino as to leaving her berth, the vessels master (Owners) shall be liable for such delay in leaving the berth at the rate of actual damages so caused Any pontoon may only be placed between the wharf and a vessel the draught of which prevents her from making fast right to the wharf with the attendance of a pilot and by using tugs Actions in the Event of Storm Upon receiving a storm warning, the SPSI shall immediately notify thereof all vessels lying in the roads and at the berths of the Port by using USW radio and telephone service When receiving a storm warning about an increase of more than 15 m/sec. in the speed of the wind blowing from the eastern half-horizon, no vessel will be allowed to stay in the inner roads, or at Anchorage Points Nos. 4, 5, 7 or 8. Vessels may put to sea to ride out the storm or to seek shelter in the Sovetskaya Gavan Bay The harbour craft shall seek shelter from storm at the locations specified by the SPSI Wintering and Lying-up in the Port A vessel may only be permitted to winter or lie up in the Port of Vanino in exceptional cases, subject to the Harbour Master s specific direction Environmental Pollution Prevention Vessels operating in the water area of the Port of Vanino shall comply with the MARPOL 73/78 International Convention with Annexes I-V thereto, and the Russian laws concerning the prevention of marine pollution Before a vessel enters the Port of Vanino and throughout her stay in the Port of Vanino all the valves, sluices and other cut-off devices which lead to the vessels board or through which oily mixtures and harmful substances are discharged overboard shall be closed and sealed by the master personally or by the person authorised thereto by the master. Such person may be any officer of the vessel who is personally responsible for proper technical operation of the vessels systems and devices that may cause pollution of the sea The vessels lying at the berths or in the roads in the Port of Vanino may not: Discharge overboard any oily mixtures including clean water ballast; Throw overboard any wastes whatsoever; Kindle an open fire or burn any waste whatsoever; Release harmful substances to the atmosphere in contravention of the established standards; Use vessels incinerators;

20 Perform any work with the purpose of cleaning and painting vessels hulls; Wash vessels hulls, holds, and tanks A vessel may discharge treated and disinfected sewage within the water area of the Port of Vanino subject to the following provisions: The vessel is equipped with a functioning sewage treatment plant approved by the Register of Shipping, whose values of treatment and disinfection conform to the relevant standards, namely the coli index is 2,500 maximum, the biochemical oxygen demand for five days is 50 mg/l maximum, and the suspended matters are 100 mg/l maximum above the content of suspended matters in cleaning purposes water; The discharge is not of volley nature It shall be the responsibility of the wharf owners and the entities using the Port wharves to provide that both the wharves and the adjacent territory and water area be in clean condition. It shall be prohibited to discharge any garbage, industrial or domestic waste, polluted snow etc. from the wharves into the sea or onto the ice cover The Port has facilities for collecting waste, domestic garbage, oily and waste water, used oils and oiled rags. The vessels requests for the removal of polluted water and dry waste shall be made directly by the masters of vessels or through their marine agents by Channel 16, call sign: SLV Koppi, or to Rosmorport, FPUE Vanino Branch not later than two hours prior to the time on which the vessel will be ready for such operation Vessels shall furnish information of any pollution of the water area within the scope of these Compulsory Obligations to the VTC and the SPSI at Channel The oil berths shall be equipped with the boom defences. The procedure for using such boom defences shall be submitted for approval of Rosmorport, FPUE Vanino Branch When loading any oil product or substance detrimental to human health or harmful for marine living resources, the owners (leasers) of the respective wharf and the master of the vessel shall take adequate measures to prevent spillage of such cargo into the sea If any oil product is spilled on the deck of a vessel or overboard the vessel shall suspend the bunkering operations, sound total emergency alarm, make her firefighting means ready for action, and start removing the spilled oil product from the deck by efforts of the crew. The master shall be liable to immediately inform the SPSI s master on duty and the VTC about the incident. Any dispersing agent will be used to restore the Port water area always subject to prior agreement thereupon with the PMA and approval by the relevant environmental and sanitary authorities. The bunkering operations may only be resumed with the permission of the SPSI Any dangerous goods of Class 6 or Class 7 as classified in the I.M.D.G. Code shall be loaded and unloaded upon approval of the Public Environmental Authorities A person guilty of environment pollution shall be suited in accordance with the laws of the Russian Federation currently in force.

21 21 Charges for any work as may be required to abolish the pollution consequences shall be recoverable from the person at fault without prejudice to any other remedies Using Radio and Wire Communication Facilities in the Commercial Seaport of Vanino All vessels staying in the Port shall be bound to keep radio watch at USW Channel 16 twenty-four hours a day A list of the Port services and subscribers located in the Port of Vanino, with their call signs and USW-communication channels, is given in Table 1.
