Box 668 Huntingdon, TN (phone) ** (fax) Carroll County Watershed Authority Introduction The Carroll County Watershed Authority has adopted these rules and regulations to provide the maximum safety, pleasure, and benefit for all. It is our desire for this lake and its amenities to be a family-friendly environment. Please remember: the provisions of this document shall not exempt any person from compliance with applicable federal and/or state laws or regulations. The Carroll County Watershed Authority assumes no responsibility or liability for the safety, loss of personal property, vandalism, damage to vehicles or watercraft, etc., of anyone using the lake, beaches, recreational areas, docks, parking lots, or common grounds. Watercraft Any boat or craft, including a vessel used or capable of being used as a means of transportation on water B. Motorboat Any vessel propelled by machinery C. Pontoon Boat Boats that are defined as: constructed with detachable pontoon flotation (i.e., steel, aluminum, or fiberglass) and with a hull tunnel that does not touch the water s surface when at maximum weight load D. Operate To navigate or otherwise use a watercraft E. Operator The person who operates or has charge of navigation or use of a watercraft F. Owner The person other than the lien holder having the property in or title to the watercraft G. Wake The waves or path that a boat leaves behind as it moves across the water H. Slow No Wake Area, Idle Speed Area, and No Wake Area/Zone are all the same. These are areas in which all vessels MUST operate at idle speed. Idle speed is the slowest speed at which a vessel will move through the water while being able to maintain course. Typically a vessel operating at idle speed creates very little boat wake. I. Starboard The right side of a boat as you are facing forward J. Port The left side of a boat as you are facing forward 1

4 K. Stern The aft end or back of a boat L. Bow The forward or front part of a boat M. Length The overall length of the watercraft when measured from the bow through the mid-line of the watercraft to the stern, excluding removable protuberances and propulsion devices N. The Carroll County Watershed Authority assumes no responsibility or liability for the safety of anyone using the beaches, lake, docks, or common grounds. 2. The portion of the lake south of Tennessee Valley Authority power lines is designated as fishing only. Any vessel in this area must travel at NO WAKE area speed. 3. After sunset and before sunrise, all waterskiing or other sports involving towing are prohibited on the lake. 4. The Carroll County Watershed Authority boat ramp will open 30 minutes prior to sunrise and will close 30 minutes after sunset as set forth by the National Weather Service. The CCWA reserves the right to change these times. 5. All watercraft at anchor not in approved mooring or more than 25 feet from shore between sunset and sunrise must display a white light visible for 360 degrees. 6. No person shall operate any watercraft or manipulate any water ski, surfboard, inner tube, or similar device while intoxicated or under the influence of any narcotic drug, barbiturate, marijuana or any combination thereof. 7. The owner of any watercraft or any person in charge or control of a watercraft shall not authorize or knowingly permit such craft to be operated by any person who is under the influence of narcotics, alcohol or habit-forming drugs. 8. No person shall operate a watercraft in such a manner as to endanger the life, limb, or property of others. 9. Watercraft operation is allowed after sunset and before sunrise when equipped with lights as set out in Section 3. 3

6 10. A NO WAKE ZONE is in effect from sunset to sunrise. Violation at night is considered RECKLESS AND DANGEROUS. 11. Violation at night over NO WAKE ZONE AND/OR with improper or no lights is considered RECKLESS and DANGEROUS. 12. The capacity plate on any watercraft shall not be tampered with. 13. No person shall moor or fasten any watercraft to or willfully damage, tamper, remove, obstruct, or interfere with any regulatory markers, such as buoys, etc. 14. No person shall ride or sit on chair backs, gunwales or on the decking over the bow of a watercraft while it is underway, unless such watercraft is provided with adequate guards or railings to prevent occupants from falling overboard. 15. At times of high winds, high water level, low water level, extreme debris or other emergencies on the lake, where significant damage to property or injury to persons is likely to occur, the CCWA has the authority to close or restrict the use of the lake. CONDITION YELLOW Use of lake restricted: Warnings will be posted using a flag system displaying YELLOW FLAGS. All watercraft operation on the lake will be restricted (except emergency, water patrol, and CCWA maintenance boats). All boats on all parts of the lake MUST operate at idle speed and create very little wake. CONDITION RED Use of lake prohibited: Warnings will be posted using a flag system displaying RED FLAGS. A state of emergency exists, the lake is closed and all watercraft operations except emergency boats are prohibited. LOCATION OF FLAGS On land at Administrative Headquarters It is the watercraft operator s responsibility to assess the lake during questionable conditions and look for warning flags before using the lake. 16. Launching or retrieving of boats from CCWA property other than the main ramp is strictly prohibited. 4

7 17. Skiing, wakeboarding, tubing, or similar activities are not allowed inside of marker buoys. Persons being towed must stay to the port side of buoys. 18. Teak surfing is considered RECKLESS AND DANGEROUS and is prohibited on the lake. 19. Wake surfing is prohibited behind outboard and I/O powered boats. 20. The Carroll County Watershed Authority has the authority to close all or portions of the lake at its discretion. 21. Scuba diving will be permitted only by law enforcement, public safety organization, and military training or in the safety interest of the lake. No boat shall knowingly be operated within fifty (50) yards of a scuba diver s marker. Such a marker shall be a red flag with a diagonal white bar to be displayed at least three (3) feet above water from a boat, raft, or other buoyant device. 22. Persons using CCWA water and ground areas shall obey the directions of CCWSA personnel and posted rules. 23. No alcoholic beverages are allowed on CCWA property or on the lake. 24. The discharging of firearms and fireworks is not permitted. 5

The Carroll County Watershed Authority assumes no responsibility or liability for the safety of anyone using the beaches, lake, docks, or common grounds. 2. Motorboat traffic on the lake shall move in a counter-clockwise pattern. 3. Boaters are required to maintain an idle speed condition when operating within 125 feet of the shoreline and in those coves or other areas so posted at the direction of the Board of Directors. 4. No person shall operate a watercraft on the lake for towing a person or persons on water skis, surfboard, or a similar device unless there is in the watercraft a person in addition to the operator in a position to observe the progress of the person or persons being towed, or unless such watercraft is equipped with a ski mirror. According to state law, the observer must be at least 12 years of age. 5. Private dock starts may only be made when the boat is at least 125 feet from shore and the boat is turned in the direction of traffic flow. All skiers must be dropped and stopped no less than 25 feet from the dock. 6. Required lighting equipment: A. Boats operating after sunset or before sunrise shall meet either the inland rules or international rules for lights (described below). 1. Inland rules a. A bright white light aft higher than the bow light, to show all around the horizon b. Separate or combined light in the forepart of the watercraft and lower than the white light aft, showing green to starboard and red to port so fixed as to throw the light from straight ahead to two points (22 degrees) abaft the beam of each side 6

9 2. International rules a. A bright white light on the stern so fixed as to show a 12-point (135 degrees) light aft b. A white light three (3) feet higher than the colored lights so fixed as to throw the light from straight ahead to two points (22 degrees) abaft the beam of each side c. Separate or combined light in the forepart of the watercraft showing green to starboard and red to port so fixed as to throw the light ahead to two points (22 degrees) abaft the beam on each side B. Every white light prescribed by this section shall be of such character as to be visible at a distance of at least two (2) miles. Every colored light prescribed by this section shall be of such character as to be visible at a distance of at least one (1) mile. The word visible in this sub-section, when applied to lights, shall mean visible on a dark night with clear atmosphere. C. When propelled by sail and machinery, every boat shall carry the lights required by this section for a motorboat propelled by machinery only. D. Canoes, rowboats, and other non-motorized boats operating between sunset and sunrise shall carry, ready at hand, a lantern or flashlight showing a white light which shall be exhibited in sufficient time to avert collision. E. Ski Flag/Towing Flag A flag indicating a PERSON IN THE WATER is required equipment for all skiing and other sports involving towing. The color of the flag must be red or orange, must be square in design and measure at least 12 inches on each side. When displayed, the flag must be visible for 360 degrees. All boat operators in the vicinity of a displayed flag will be required to operate at idle speed if closer than 50 yards to the watercraft displaying the flag. It is suggested, when operating in the vicinity of a displayed flag, that boat operators immediately start scanning the water. All watercraft operators must maneuver away from the area in which a flag is being displayed. The purpose and proper use of this flag is as follows: The purpose of this flag is to protect the person you are towing. With the flag you attempt to alert other boaters that the person you were towing has fallen or has otherwise entered the water. During all towing operations (water skiing, wakeboarding, tubing, sledding, etc.)

10 7 Carroll County Watershed Authority this flag is to be displayed ONLY when the person being towed has fallen or entered the water. Once the person is again being towed, or has returned to the boat and the towing is complete, the flag must be lowered. This flag should be vigorously waved to attract the attention of other boaters. This flag is to be displayed only when a person is in the water (including swimmers) whether the engine is running or not. This flag will NOT be permanently fixed to the watercraft. The flag WILL NOT be displayed when a person is in the act of skiing, wakeboarding, tubing, etc. The flag WILL be displayed only when the person has fallen, entered the water, or is returning to the boat.

The Carroll County Watershed Authority assumes no responsibility or liability for the safety of anyone using the beaches, lake, docks, or common grounds. 2. No lifeguard is on duty; swim at your own risk. 3. Persons using the beaches shall obey the direction of CCWA personnel and posted rules. 4. No alcoholic beverages are allowed on CCWA property or on the lake. 5. Swimming from the beaches is permitted only between sunrise and sunset. 6. Swimming is not permitted beyond the buoys in the beach area. 7. All swimmers shall observe all rules for the safety and enjoyment of all visitors. 8. No animals are permitted on beaches or in the Administrative Headquarters area. 9. Glass and glass containers are not allowed on beaches. 10. No loud music is allowed on CCWA property or on the lake. 11. No profanity is allowed on CCWA property or on the lake. 12. All trash must be disposed of properly.

12 9 CARROLL COUNTY WATERSHED AUTHORITY TOPIC: Parks, Playgrounds, and Outdoor Recreational Areas DATE: 3/19/12 PAGE 10 SECTION 5 Parks, Playgrounds, and Outdoor Recreational Areas 1. The Carroll County Watershed Authority assumes no responsibility or liability for the safety of anyone using the beaches, lake, docks, or common grounds. 2. The parks, playgrounds and other recreational areas are available for use from sunrise to sunset. 3. Visitors are required to police and clean the picnic and park areas and to dispose of trash by placing refuse in proper containers provided for that purpose. 4. Visitors will be held responsible for damage to CCWA property. 5. Camping equipment is not permitted in any picnic, park, or playground area. 6. The CCWA reserves the right to control, restrict, or limit the use of these amenities for group activities. Groups over twelve (12) people must have written permission to use these areas prior to the day of use. 7. No animals are allowed in the recreational areas or in the Administrative Headquarters area. 8. No alcoholic beverages are allowed on CCWA property or on the lake. 9. Persons using CCWA water and ground areas shall obey the directions of CCWA personnel and posted rules. 10. No loud music is allowed on CCWA property or on the lake 11. No profanity is allowed on CCWA property or on the lake.

13 12. All trash must be disposed of properly. Carroll County Watershed Authority 10 CARROLL COUNTY WATERSHED AUTHORITY TOPIC: Water Pollution DATE: 3/19/12 PAGE 11 SECTION 6 Water Pollution 1. Dumping of any waste, trash, and/or other foreign matter overboard or upon any shoreline of the Carroll County Watershed Authority lake is prohibited. 2. Heads on all watercraft must be sealed. 3. There shall be no application of aquatic chemicals on the Carroll County Watershed Authority lake unless authorized by the Board of Directors.

The Carroll County Watershed Authority assumes no responsibility or liability for the safety of anyone using the beaches, lake, docks, or common grounds. 2. An appropriate state license shall be required as provided by the rules and regulations of Tennessee Wildlife Resources Agency (TWRA). 3. All fishing must be in compliance with and governed by TWRA rules and regulations and laws of the State of Tennessee. 4. No fishing is permitted in the swimming areas. 5. No trout lines, jug lines, limb lines, grabbing or snagging shall be permitted on the lake. 6. No cleaning of fish shall take place on Carroll County Watershed Authority property. 7. No stocking shall be done in the lake or water area with any species of fish or other marine life unless authorized by the CCWA Board of Directors. 8. Disposing of aquatic life or use of live baits not native to the State of Tennessee is prohibited, except that no dangerous marine life, even if native to the State, may be introduced into the CCWA lake. Live bait, as used by this section, means any animal that is living and has not been preserved in chemical preservatives. 9. There shall be no commercial fishing of any kind from the lake and water areas. 10. Fishing from the dam is prohibited. Fishing from the 50 buffer is prohibited except

15 by the adjacent property owner. Carroll County Watershed Authority 11. No hunting is permitted on CCWA property. 12 CARROLL COUNTY WATERSHED AUTHORITY TOPIC: Miscellaneous DATE: 3/19/12 PAGE 13 SECTION 8 Miscellaneous Winter activities 1. No motor driven conveyances shall be allowed on the lake when frozen. 2. Ice skating is prohibited. Accidents and Casualties 1. It shall be the duty of the operator of a watercraft involved in a collision, accident, or other casualty, so far as he can do so without serious danger to his own watercraft, crew, and passengers, to render to other person affected by the collision, accident, or other casualty, assistance as may be practicable and as may be necessary in order to save them from or minimize any danger caused by the collision, accident, or other casualty, and also to give his/her name, address, and identification of his/her watercraft in writing to any person injured, and to the owner of any property damaged in the collision, accident, or other casualty. 2. TWRA must be notified of any accident that has personal injury beyond first aid, or any incident involving property damage above $2, Any boat/watercraft that has sunk must immediately be removed by its owner. If the boat/watercraft is not removed, the CCWA will have it removed after giving the registered owner 48 hours notice by certified mail. The total cost of the removal will be billed to the registered owner (the costs incurred by the contractor plus cost incurred by the CCWA). The boat/watercraft will not be released until all costs have been paid. Any sunken boat/watercraft that is or could be a safety hazard and that is

16 causing or could cause environmental damage will be removed immediately by the CCWA with costs handled as described above. Any boat/watercraft that has been abandoned will likewise be dealt with as above. 13 CARROLL COUNTY WATERSHED AUTHORITY TOPIC: Fees DATE: 3/17/14 PAGE 14 SECTION 9 FEES 1. Annual Permits: $20 per person with CC license plate $30 per person without CC license plate (Permit expires 1 year from date issued) 2. Daily Permits: CC Resident - $3.00 each Non- CC Resident - $5.00 each 3. Free Admittance: Children under age of ten years Persons 65 years of age with CC license plate Disabled Veterans 4. Life-time fishing permit (Only Carroll County Residents with Carroll County license plate) - $ Boat Docks Land owner fee - 1 time fee - $5, Community dock - 1 time fee - ($5, x number of slips)

17 Dock permit fee (years 2-10) - $100 per year Dock permit fee (after 10 years) - $25 per year Carroll County Watershed Authority 14 CARROLL COUNTY WATERSHED AUTHORITY TOPIC: Docks DATE: 9/25/12 PAGES SECTION 10 Docks All persons desiring docks must submit an application and receive permission from the Carroll County Watershed Authority s Waterfront Improvement committee prior to any construction. All plans shall be submitted in writing, including a drawing and a $35 application fee. Docks are allowed only if they do not impede or present a hazard to boat traffic and meet all other guidelines and requirements as described herein. General Dock Rules 1. Only one dock shall be permitted per waterfront lot, and no dock shall have more than two slips and two personal watercraft platforms. 2. No boat ramps will be allowed. 3. No boat houses will be allowed. 4. Docks shall not extend more than 25 feet into the water at normal lake level and in coves shall not extend more than one-third the distance to the opposite shore. All requests for more than 25 shall be considered individually by the Watershed Authority. 5. No docks shall be located within 15 feet from any neighbor s property line. Where this density requirement cannot be met, only community docks will be allowed. (This would require waterfront lots to be at least 100 feet at the lake if a dock is desired.)

18 6. Boat lifts and hoists shall be considered a dock if they stand alone. Carroll County Watershed Authority 7. Boat lifts and hoists not placed adjacent to or enclosed within a dock shall be considered to be a dock. 8. Boat lifts and hoists may be placed adjacent to or enclosed within a dock with a limit of two per dock. 15 Dock Construction 1. Wooden or metal-framed floating docks are preferred. Recycled plastic wood products are permitted. Only one dock per waterfront lot is permitted. 2. Styrofoam encased in plastic (encapsulated foam) is required. Barrels are strictly prohibited. 3. Permanent piers or pilings are discouraged. If pilings are necessary, they must be at least four (4) inches in diameter. Anchoring devices may only be used directly beneath the dock and must not present a hazard to boaters or swimmers. 4. Covered docks are permitted. Docks must meet minimum standards established by the Watershed Authority. 5. Dock bumpers can be a fire hose or commercial bumper material. No cut or uncut tires are allowed. 6. Carpeting is permitted only on the top of the dock. 7. Swim ladders, slides, diving boards, etc., are permitted but are to be calculated as part of the dock s overall width or length for purposes of meeting other requirements stated above. No dock or its attachments can extend more than 30 feet into the water from the shoreline at normal lake level. 8. Docks must be constructed to withstand vertical movement caused by the lowering of the lake for maintenance purposes. 9. No dock shall have more than two slips. 10. The Carroll County Watershed Authority reserves the right to require the temporary

19 removal of docks for lake maintenance purposes. 16 Requirements for Community Docks, Piers, or other Community Water-Use Facilities 1. The maximum number of boat moorings or slips in a community water-use facility is four. Navigation issues, safety issues, site conditions, other environmental factors or any other criteria may lead the Carroll County Watershed Authority to determine that less than four moorings or slips should be permitted at a community water-use facility. 2. The Carroll County Watershed Authority may limit water-use facilities to community water-use facilities where physical or environmental constraints preclude approval of private docks, boat slips, or piers.. When private water-use facilities are not allowed, no more than one slip for each qualified applicant will be approved for any community water-use facility. The CCWA shall determine the location of the facility and the named permittees, taking into consideration the preferences of the qualified applicants and such other factors as the CCWA determines to be appropriate. The CCWA shall establish harbor limits for community water-use facilities. 3. Applications for a permit to construct a community water-use facility to be constructed at a community out lot must be submitted with 100 percent concurrence of all co-owners of such lot.
