2 Marine personnel regulations Fishing vessels master All fishing vessels will require: a certificated master, Or A person holding a small vessel operator proficiency training certificate Or A person holding a pleasure craft operator card In accordance with its tonnage and type of voyage 3 Fishing vessels masters Fishing vessels > 15 gross tonnage or 12 m overall length: Certificated master (CFV 4, 3, 2, 1 or service) Fishing vessels 15 gross tonnage or 12 m overall length: Up to near coastal 2 voyages = Small Vessel Operator Proficiency Voyages beyond near coastal 2 = Certificated master (CFV 4, 3, 2, 1 or service) Fishing vessels 15 gross tonnage or 12 m overall length: Sheltered waters voyages or 2 miles maximum from shore = Pleasure Craft Operator Card 4 2

3 Small vessel operator proficiency (Not required for experienced captains) The master of a fishing vessel 15 gross tonnage or 12 m overall length who has acquired at least 7 fishing seasons, with no two of those seasons occurring in the same year, as master of a fishing vessel before the coming into force of this section is not required to hold the Small vessel operator proficiency training certificate 5 Entry into force regulations and requirements Publication in Canada Gazette 1 on November, Possible entry into force of regulations: July 2007 Master s certificate, small vessel operator proficiency or Pleasure Craft Operator Card, according to category required from: November 7, 2008, if more than 15 m November 7, 2009, if more than 14 m November b 7, 2010, if more than 13 m November 7, 2012, if more than 12 m November 7, 2015, if more than 6 m November 7, 2016, fishing vessels of all lengths 6 3

4 OPTIONS FOR PERSONS AFFECTED >12m or >15 T Fishing vessel >12m or >15 T & 60T New entrant 12 months service as captain on a fishing vessel of at least 12m or 15 T (prior to the entry into force of the regulations) Obtain a Fishing Master, 4 th or 3 rd Class certificate Obtain a Certificate of service as Master of a fishing vessel of 60Tor less 7 OPTIONS FOR PERSONS AFFECTED 12m or 15 GT Voyages beyond near coastal class 2 New entrant Obtain a Fishing Master, 4 th or 3 rd Class certificate Fishing vessel 12m or Voyages not exceeding near coastal class 2 12 months service as captain on a fishing vessel of at least 12m or 15 T (prior to the entry into force of the regulations) Successful Small Vessel Operator Proficiency (SVOP) course. Obtain a Certificate of service as Master of a fishing vessel of 60Tor less Not required if captain has more than 7 fishing seasons 15 T Sheltered waters voyages or 2 Miles from shore Obtain a Pleasure Craft Operator Card 8 4

6 Training and Familiarization Basic safety training A1, A2 or A3 The master and the authorized representative of a vessel shall ensure that every member of the complement of that vessel who is required to be on board in order to meet the safe manning requirements, before completing a total of six months of sea service, obtain at least one of the training certificates in marine emergency duties with respect to basic safety Except: Fishing vessels 12m or 15 GT operating in Sheltered waters voyages or 2 Miles from shore: Pleasure Craft Operator Card 11 Training and Familiarization Starting April, 1 st 2007, TCMS will take measures to enforce section 21. (1) of the Crewing regulations: Every member of the complement of a ship shall, before the member has completed six months on board ships, obtain a certificate of the member's successful completion of training, at a recognized institution, in marine emergency duties with respect to basic safety. MED A1 12 6

7 Modifications to fishing masters certificates requirements Fishing master, first class and Fishing master, second class Modified Marine Emergency Duties (MED): MED with regard to STCW basic safety proficiency in survival craft and rescue boats other than fast rescue boats advanced fire fighting for officers MED for senior officers 13 Modifications to fishing masters certificates requirements Fishing master, third class Simulated Electronic Navigation, Limited (SEN, Limited) added 14 7

8 Modifications to fishing masters certificates requirements Fishing master, fourth class Qualifying service on vessels of at least 6m instead of 5T Approved training may be substituted to a maximum of 6 months of service Electronic navigation exam (020) replaced by Simulated Electronic Navigation, Limited (SEN, Limited) course Vessel s stability exam added 15 Certificate of service as master Certificate of Service as Master, fishing vessel 60GT 12 months of qualifying service before the coming into force of these Regulations as master of a fishing vessel of at least 15 GT or 12 m Application to be made within ten years after the coming into force of these regulations MED certificate with regard to basic safety (A1) Restricted Radio Operator Certificate Maritime Commercial (ROC-MC) If the applicant has fewer than 7 fishing seasons : Simulated Electronic Navigation, Limited (SEN, Limited) course Basic first aid certificate Small vessel operator proficiency certificate 16 8

9 Medical examinations (fishing vessels) Required every 2 years for the following crew members: All certificate holders, except Certificate of Service as Master of a Fishing Vessel of less than 60 Gross Not required anymore for: Un-certificated crew members 17 First aid training The minimum complement, shall include a person designated to provide medical first aid, who shall have successfully completed at a recognized institution training in: Marine basic first aid and Marine advanced first aid, on a vessel engaged on a near coastal voyage, class 1 or an unlimited voyage 18 9

10 Inspection of Certificates and Endorsements The master shall ensure that the certificates and endorsements required by these Regulations are kept readily available on board the vessel for inspection by a marine safety inspector 19 Authorized representative written instructions to the master The authorized representative (owner) shall provide to the master written instructions that set out: the policies and procedures to be followed to ensure that each member of the complement becomes familiar with the shipboard equipment and operational instructions for the equipment that are specific to the vessel to ensure that each member of the complement of the vessel, before being assigned any duty is familiarized with the vessel and their duties can effectively fulfil their assigned tasks when performing duties vital to safety or the prevention or mitigation of pollution 20 10

11 The master is responsible for training The master shall ensure: each member of the crew, at the beginning of their employment and thereafter is trained records of training which include the following information, are available for inspection by a marine safety inspector: the names of each member who has been trained when they were trained what they were trained on 21 Hours of rest and hours of work Applies to masters and crew members of fishing vessels of 100 gross tons and above At least 6 consecutive hours of rest in every 24-hour period At least 16 hours of rest in every 48-hour period Not more than 18 hours and not less than 6 hours elapse between the end of a rest period and the beginning of the next rest period 22 11

12 Safe Manning Documents Every vessel that is required to carry an inspection certificate shall also carry on board a Safe Manning Document Valid for a maximum of 5 years after its issuance, to specify: the minimum number of members of the complement; the certificates required to be held by the members of the complement any conditions or limitations on the certificates 23 Engineers Certificates Fishing vessels Voyage unlimited voyage or near coastal voyage, class 1 Propulsive Power (kw) [1] 750 to [2] to [3] more than Number of Certificate Holders [1] 1 Third-class [2] 1 Second-class [3] 1 First-class and 1 Second-class near Coastal [1] 750 to [1] 1 Fourth-class voyage, class 2 or [2] to [2] 1 Third-class sheltered waters [3] more than [3] 1 Second-class voyage 24 12
