2 Moorings Under Massachusetts General Laws, Ch 91, Sec 10A, a Harbormaster is empowered to authorize by permit, on a temporary basis, the mooring of floats and rafts held by anchors or bottom moorings; upon such terms and conditions the Harbormaster deems necessary. In keeping with the spirit and intent of this law, a mooring program has been established. The program intent is to provide efficient utilization of harbor areas, to improve safety of moored vessels, provide adequate space for users and to balance the needs of all users. This is done by controlling the placement of moorings, establishing standards for mooring tackle, and regular, systematic mooring inspections.

3 9.07: Activities Subject to Annual Permit (1) General. A written application for an annual permit must be submitted to the harbormaster of a city or town or, in a municipality where no harbormaster has been appointed, to the municipal official or other designated local official(s), for the placement on a temporary basis of moorings, floats or rafts held by bottom-anchor, and ramps associated thereto, which are located within the territorial jurisdiction of the municipality.. Any permit may contain such terms, conditions and restrictions as deemed necessary, consistent with the requirements of 310 CMR A city or town implementing 310 CMR 9.07 shall not discriminate against any citizen of the Commonwealth on the basis of residency, race, religion, sex, age, disability, or other illegal distinction...

4 United States Army Corps of Engineers Maintains a policy that to qualify for federally funded projects, such as dredging projects, mooring regulations should be open and available to all on equal terms. Failure to follow the Army Corps of Engineers mooring policy could serve to jeopardize the Town s eligibility for future federally funded projects.

5 The mooring process is a complex process involving: Regulation review and promulgation Fee collection and making payments to Town Treasurer Annual issuance of permits, stickers and tags Oversight of mooring inspections and placement Renewal by mail program Working with Assessors and Tax Collectors Office for compliance with boat excise tax laws Data entry and update Oversight and monitoring licensed mooring servicers Mooring Enforcement Removal of illegal and abandoned moorings Mooring wait list fee collection and administration

7 In 2014, the Town of Barnstable permitted 2,432 moorings. 8 In 1990 Camp Dresser & McKee performed a Coastal Resources Management Plan for the Town of Barnstable. The plan recommend Rental Moorings should be granted to commercial establishments at a level not to exceed 10 percent of total moorings or a maximum of 165, whichever is less.

9 Recommended Distribution In the 3 bay area, there is a total of 1,282 moorings. 83 Rental (Seasonal and Transient) Moorings. 6.5% of total moorings.

11 Town of Barnstable Mooring Program As the demand far exceeds the supply, waitlists for most of our mooring areas have been established. Currently there are over 1,100 people on waitlists.

12 Seasonal Rental Moorings If user relinquishes use, the owner of the mooring must notify the Harbormasters Office by April 1. If a waitlist has been established, a vacated rental mooring shall be offered to all individuals on the rental mooring waitlist, beginning at the top.

13 Transient Rental Mooring Permit Transient rental mooring owners must obtain an annual permit for each transient rental mooring. Transient rental mooring permit holders shall submit annually the days/dates of use of each transient mooring by November 1.

14 Counselor Questions Answered 1. How many moorings are outside the town issued ones and their location? The Town of Barnstable issues all mooring permits.

15 Counselor Questions Answered 2. What entities control them and who determines the price for these moorings? Harbormaster controls placement of all moorings, including placement of individuals from all waiting lists on moorings. Town Manager establishes permit fees. Rental Mooring Permit Holders establish rental rates.

16 Counselor Questions Answered 3. Do these private entities have any responsibility to report to the town what kind of revenue they make from such fee and whether this goes back to the town? No and No. Rental moorings are part of boatyard s marinas business plans. Have had rental moorings for many years.

17 Counselor Questions Answered 4. Are there trainsient moorings reserved for residents only and if so the cost? No. The Department of the Army Corps of Engineers maintains an ongoing policy that boat moorings should be open and available to all on equal terms. 18 Counselor Questions Answered 5. Has the Harbormaster considered installing a seasonal pier and float (similar to CMYC s) at the boat ramp at Hooper s landing? To some degree, yes. Logistics difficult for placement of pier/float at this location (does not meet set back requirerments on both side, depth of water needed for floats. Dredging (new) expensive and difficult to permit. Small boat landing.
