The propoet will develop detailed Biodiversity Actio Pla (BAP) i cosultatio with the Forest, Wildlife & Fisheries Departmet for the bettermet of the Natioal Park, clearly idicatig the roles ad resposibilities of all the stakeholders ad also defiig the implemetatio mechaism of the BAP alog with its cost estimates for differet activities at the earliest i the first quarter of proper commecemet of the project ad 'fill submit to EPA-AJK ad other stakeholders for review ad commets ad its approval. 3. Uder Corporate Social Resposibility (CSR) obligatio, the propoet will follow the Security ad Exchage Commissio of Pakista's Volutary CSR guidelies to develop the log term partership with the stakeholders ad the local commuity ad will develop the CSR pla with mutual cosultatio of local commuity ad EPA-AJK withi 03 moths to make it more effective ad viable. 4. The amout for CSR by, the Propoet should be at least Rs. 20 millio durig costructio period ad for operatioal period it has to be Rs Millio per aum. 5. The propoet shall strictly adhere to take all the Mitigatio measures suggested i the EIA Report & Evirometal Maagemet Pla (EMP) to esure that there is o egative impact o soil, roads, groud water, ambiet air quality, oise level, atural draiage, floodig, hill torrets, ad livelihood of local commuities ad biological resources of the project area. Istitutioal arragemets for implemetatio of Evirometal Maagemet Pla (EMP) should be fialized well before the commecemet of the project so that proposed mechaism of evirometal Protectio should be operative well i time. 6 P a g e M i r a P o w e r L i m i t e d

The propoet will udertake the acquisitio of the lad through a stadard legal process by District reveue departmet ad compesatio shall be paid to ihabitats i case of loss of agriculture lad, crops, property, usage right etc. i accordace with the rates / broader packages that were agreed upo by the affectees. All coflictig issues regardig compesatio should be settled amicably sooer tha later.. The propoet will develop detailed Lad acquisitio ad resettlemet pla after completig all legal process before the commecemet o the project as committed i the Public Hearig. 8. Propoet shall esure the adequate arragemets for addressig public grievace(s) ad implemetatio of Resettlemet Actio Pla (RAP) through Public Grievaces Redress ad Settlemet Committee (-PGRSC) without ay delay. 9. The propoet will also develop the Watershed Maagemet Pla of immediate ad upstream catchmet areas to cotrol the siltatio of the reservoir i cosultatio with the Forest Departmet ad will take all possible efforts to utilize all the excavated material i the earby watershed degraded area for lad reclamatio istead of dumpig it alog the river. 10. It will be esured that o dumpig is made alog the river. However, wheever it is uavoidable the propoet will take all the protective measures to esure o spoilage/excavated material reaches i the river. 11. The propoet will restrict removal of trees at project site to bare miimum; ad if uavoidable, the cash compesatio will be paid to the owers ad Forest Departmet alog with platig of trees five times of removed o earby available blak areas i collaboratio with AJK-Forest Departmet. 12. The Propoet shall esure compliace to Natioal Evirometal Quality Stadards (NEQS) durig costructio ad operatio of the project. 13. Propoet shall costitute Evirometal Moitorig Committee (EMC) havig the represetatives of all cocered stakeholders as metioed i EIA. The reportig mechaism ad ToRs of the Committee shall be fialized i cosultatio with EPAAJK. 14. Moitorig shall cover the etire period of the Project, costructio ad operatio. Moitorig reports shall be submitted to AJK-EPA o quarterly basis. 15. The propoet shall provide the copy of this approval ad EIA report to the cotractor(s) for compliace ad ay egligece o cotractors' part will be cosidered propoet's egligece. 16. Blastig shall be avoided; if it is ievitable, the cotrolled techiques i accordace with Pakista Explosive Act should be adopted i slidig ad perspective slidig proe areas. I case idepedet Evirometal Specialist firms/orgaizatios are to be hired as a compulsory arragemet to udertake measuremets of differet parameters critically importat i determiig water & air quality ad assessig oise emissio level either durig costructio phase or i both costructio ad operatio phases of the project, the fidig of quality aalysis o regular basis should positively be shared with EPA-AJK. 18. The propoet shall esure that strict ad efficiet health ad safety measure are i place for the protectio of workers ad passers-by backed by a comprehesive emergecy respose mechaism pla. 19. The propoet will esure the employmet opportuities to the local commuity o priority if eligible ad will icorporate it i EPC ad O&M agreemets. As far as possible, employmet should be provided to local people for all uskilled jobs. Preferece may also be give to local people for all semi-skilled ad skilled jobs as committed i Public Hearig. Employmet record for all positios shall be provided to EPA-AJK positively. 20. I the case of precious stoes/ semi-precious stoes/ mierals discovery durig tuelig or ay other excavatio activity the propoet should immediately stop the work ad the cocered departmet or agecy should be cosulted for takig appropriate actio. 21. I the case the articles of Archeological importace like artifacts, cois rock-art ad other archeological relics are discovered, the work at the site should immediately be stopped ad the cocered departmet or agecy should be cosulted for the appropriate actio. 22. Propoet shall take special safety measures while workig close to settlemets, tows, schools ad hospitals etc. for safety of the geeral public ad livestock. 23. Propoet/cotractor shall make sure the safety & security of wildlife ad their habitats at the project site ad i its eviros with the prior cosultatio ad adherig strictly to the guidelies of Forestry & Wildlife Departmet. 24. Durig the excavatio of tuel; the dug material ad spoil should be utilized as per para 9, 10. Free roll dow of excavated material shall be prohibited to avert damage to gree vegetatio cover, water bodies, pereial & o-pereial drais, irrigatio chaels,. Commuicatio routes ad productive lads. 10 2. The propoet shall maage scietifically all waste geerated by costructio activities ad machiery, chemicals' spill, ad o damage to flora faua ad overall ecology etc. 28. The propoet shall rehabilitate all sites to their atural coditios affected by temporary use durig the costructio phase at the ed of the costructio period. 29. The propoet shall be liable for the correctess ad validity of the iformatio furished by them or their cosultats ad will provide periodic moitorig reports to the Departmet as specified i the report. 30. Propoet shall be liable for compliace of regulatios 13, 14, & 18 of IEE/ EIA Regulatios 2009, which euciate the coditios for approval, cofirmatio of compliace, etry, ispectio ad moitorig of the proposed project. 31. Propoet would be resposible to facilitate EPA-AJK teams for ay visit for ispectio/ moitorig etc. 32. Ay chage i the approved project shall be commuicated to EPA-AJK ad shall be commeced after obtaiig the approval. 33. The approval shall stad ull ad void if ay of the coditios, metioed herei before, are ot fully complied with. 34. This approval does ot absolve the propoet of the duty to obtai ay other approval or clearace that may be required uder ay law i force or by ay competet forum/ court of law. 35. 12 102 MW D. Status of Biodiversity Actio Pla 1. The implemetatio of BAP is i progress after the egagemet of Himalaya Wildlife Foudatio (HWF) as Implemetig Orgaizatio. HWF is submittig quarterly BAP implemetatio reports. Hagler Bailly Pakista (HBP) has bee egaged as Moitorig ad Evaluatio (M&E) Cosultats. HBP is also submittig all seasoal M&E reports. 2. I the sprig 20 Survey the Mahaseer was foud to be less abudat i the mai River as well as tributaries i compariso with the sprig 2016 Survey. 3. The fish species icludig Mahaseer, Idus Garua, Alwa Sow Trout ad Pakistai Labeo are trapped i the pools dowstream of the bypass tuel as supported by the data. These are migratory as well as idicator species. 4. There are ucofirmed reports of local commuities ivolved i fishig of these trapped fish. Capture ad trasport of the trapped fish should be cosidered ad studied o priority basis. 5. Most of the observed plat species i the Sprig 20 Survey were commo ad foud i more tha oe habitat type. No threateed or edemic plat species were observed i the Terrestrial Study Area. 6. The plat cover recorded i the Sprig 2016 ad Sprig 20 Survey differed sigificatly. The mai reaso for this is slight shiftig of the trasect locatio due to built i error i GPS. It was also observed at some locatios that the plat cover ad compositio at samplig sites was modified by some huma activity, such as clearig of lad. The samplig methodology is beig reviewed to avoid errors due to such chages i lad use which are likely to occur at a poit i the log term, which ca icrease or decrease lad cover. Such chages, however, may ot be reflective of chages occurrig at ladscape level which are of iterest i the cotext of moitorig for the BAP.. Damage to the lik road i Villagers of Dera Nawab Kha. Yield of groudwater wells i Barali villages has reduced. Few wome from Barali village complaied that their privacy is beig affected. Affected lad by proposed Thalalat bridge could ot be icluded i the award. Affected water tak is ot compesated. 4 Local commuities complaied that their privacy is beig breached aroud the lad acquired for power, cotractor camp ad offices alog the resideces of the local commuities i Barali village. 98 title holders have cotacted district court agaist the lad price assessmets from Gulhar Sharif, Hill Kala, Madi ad Burali villages. A committee has already bee formed to settle all the idividual issues idetified by the APs. DLRP will be implemeted ad will have aligmet with CSR pla. All proposed itervetios will be implemeted. ) Special measures particularly for vulerable idividuals Vulerable allowace is dedicated for vulerable families. Apart from that all vulerable idividuals are iculcated i project activities, i.e. skilled/uskilled jobs, supplies ad cotracts. Furthermore durig the CSR iitiatives they will be particularly cosidered. o) CSR Programs i the Followig Areas of Itervetio Employmet Ehacemet Mira i coordiatio with EPCC is i a process of egagemet of local residets i skilled, semi-skilled ad uskilled jobs. Locals are beig egaged i jobs o priority basis, wheever ad wherever their services are required. Social Services There was a delay i approval of CSR pla at the part of govermet, however MPL ad KOEN joitly orgaized CSR activities like, KOEN voluteers did activities with a local govermet school.
