2 Pilotage In Canada Marine pilots have been navigating vessels through Canadian waters, since the mid 1800s. To reconcile the different practices of pilotage in Canada, the Pilotage Act was enacted in 1972, following the conclusion of the Royal Commission on Pilotage (Bernier). The Pilotage Act established the 4 pilotage authorities: The Atlantic Pilotage Authority, the Laurentian Pilotage Authority, the Great Lakes Pilotage Authority and the Pacific Pilotage Authority. The authorities are Crown corporations and have a mandate to provide safe and efficient pilotage services, that respond to traffic and the varied geography and climatic conditions of the region. 2

3 Background of the Pilotage Act Review Overall, the Pilotage Act works well. Safety records for all Authorities are excellent (over 99.9%), and the Authorities strive for a minimum of delays. However, the Act has not been substantively amended since As part of the Oceans Protection Plan, the Government of Canada committed to reviewing the Pilotage Ac to modernize the legislative and regulatory framework for pilotage services. Mr. Marc Grégoire was named as the Review Chairperson on May 31,

4 Scope of the Pilotage Act Review The review will examine the following themes based on suggestions of past reviews of the Pilotage Act and stakeholder feedback: Governance Safety including technology Labour Models Tariff setting process and revenue Economic and Public Policy Considerations Enforcement and Emerging Issues 4

5 Technology and Pilotage Technology will be considered in two different ways: Encouraging innovation of technology; and Establishing standards for technology. The Review will also review best practices of other modes of transportation to create a robust and agile legislative and regulatory framework increasingly rapid advent of innovation marine technologies. 5

6 Technology and Pilotage: Things to consider The Review will consider the regulatory powers and standards for the interface of technology and pilots. The following technology are being considered to assist pilots with their duties: Automation of tasks and vessels Development of Navigational Aids and systems ECDIS, AIS, ENAV, Radio etc Changes of Bridges Integrated Bridges, Dynamic Positioning Simulation technology for training and testing Shore based pilotage systems Advancements in harbor tugs The Review will also consider the flexibility and support timeliness response of TC in regulations and standards for new upcoming technologies such as autonomous vessels. 6

7 Canadian Arctic and Pilotage The Review will be engaging interested parties in Canada s Arctic Region in the coming weeks. Our objectives currently are to: Seek feedback from communities, partners and stakeholders in Canada s Arctic Region regarding any shipping concerns; Review the concerns received and determine how the Review can respond to these concerns; Monitor the development of shipping in the Arctic; and Explore ways to modernize the legislation and regulatory framework to respond to current concerns and potential future developments. 7

8 Next steps Phase 2- Starting November, 2017-December 2017 Roundtable consultations will be conducted in BC, ON, QC, NS and NFLD OPP Engagements will be conducted in BC, QC, NS and Nunavut Consultations at National CMAC in Ottawa December, 2017 Online engagement process Phase 3- January April 2018 Final discussions with stakeholders Analysis of stakeholder and public feedback on pilotage concerns Chairperson to present options and recommendations to the Minister of Transport. 8
