Hanshin Pilot District covers the sea surface surrounded by the shoreline and the lines: the line extending from the left shore end of the mouth of Sakai River in Hyogo Prefecture to the position of 8,000m at 180 (Position C); and the line extending in sequence through the Position C, the Position B, the position of 2,070m at 45 from the lighthouse at new east breakwater in Kishiwada in Hannan Port, as well as the rivers within the limits of Osaka Port, Amagasaki Port, Nishinomiya Port, Ashiya Port and Kobe Port.
5 . Description of Pilotage In conformity to Article 23 of the Law of Piloting, the rates of pilotage stipulated in Clause 2, Article 22 thereof shall be 105% of those in the above table. Description of the rates of pilotage specified in the above table shall be as follows. 1. Piloting Service within the time from sunrise to sunset (1) Vessels exclusive of towed vessels 1) Vessels with 2 or more decks (multiple-deck vessel) provided in Clause 3, Article 5 in the Law of Measurement for Tonnage of Vessel, excluding those provided by the notification of Ministry of Land, Infrastructure and Transport. a) Basic Rates shall apply to the vessels of the tonnage up to 1,000 gross tons with the draft up to 3m. b) For the vessels of the tonnage over 1,000 gross tons or those with the draft over 3m, Additional Charges shall apply to such vessels per each additional tonnage of 1,000 gross tons or fraction thereof, or per each additional draft of 30cm or fraction thereof. 2) Multiple-deck vessels Up to 100% of applicable Basic Rate (and other charges if any) in tonnage and/or draft shall be billed additionally as Extra Charge. (2) Towed Vessels 180% of the rate for the vessels exclusive of towed vessels stipulated in the previous (1) shall be charged. 2. Piloting Service within the time from sunset to sunrise 150% of Basic Rate (and other charges if any) for Piloting Service within from sunrise to sunset shall be charged. Note 1. Piloting Service within the time from sunrise to sunset or from sunset to sunrise, whichever may be, shall be qualified hereinafter as the operation of piloting after start of piloting on board (including necessary preparations for piloting on board) the objective vessel until completion thereof. Note 2. Applicable draft herein shall be the deepest throughout the operation of piloting. For the vessel, whereof tonnage is indicated on the basis of notation by displacement tonnage, 60% of the displacement tonnage shall be regarded herein as her gross tonnage. Note 3. Special rate for extra charge shall be computed with the equation;

L: Length of vessel in meter T: Gross tonnage (The tonnage under 1,000 shall be defined as 1,000). Pilotage in the following cases shall be105% of applicable rates specified in respective cases regardless of the stipulations in. 1. Piloting for trial run, compass correction, error measurement of direct finder or other similar objects. (1) On the port 1) Operation within 2 hours shall apply to the rates of pilotage for berth-shifting vessels specified in the above table. 2) For operation in excess of 2 hours, 50% of the rates of pilotage for berth-shifting vessels specified in the Enforcement Regulation for Law of Piloting, Attachment Table 3 shall be additionally charged per additional hour or fraction thereof. (2) Off the port 1) Operation within 2 hours shall apply to the rates of pilotage for incoming/outgoing vessels specified in the attached table No.3. 2) For operation in excess of 2 hours, 50% of the rates of pilotage for berth-shifting vessels specified in the attached table No.3 shall be additionally charged per additional hour or fraction thereof. 2. For piloting of incoming/outgoing vessels uncommonly far from the pilot station, up to 50% of the rates of pilotage for incoming/outgoing vessels specified in the attached table No.3 shall be decided in proportion to the distance upon mutual consultation between the shipowner or shipmaster and the contractor, and charged additionally. 3. For piloting at the waters uncommonly far from the port whereon the contractor s office is located, all the traveling and lodging expenses and embarking and disembarking costs required for the pilot shall be billed additionally. 4. For waiting during the period from reaching the appointed place to disembarking the vessel for causes attributable to the captain of the vessel, additional charges of 105%
7 of 5,400 (or 100% of 5,400 for piloting stipulated each phrase in ) per each 30 minutes or fraction thereof in excess after scheduled time shall be billed in addition to the stipulated rate of pilotage, regardless of the previous stipulations.. Pilotage in the following cases shall apply to the rates specified in the above table (or to the rates for piloting stipulated in ), regardless of the stipulations in and. 1. Piloting service for the vessels engaged exclusively in domestic or international transportation of passengers and/or cargos, which is provided to the traders engaged in ship operation defined in Clause 2, Article 2 of the Law of Ocean Transportation or engaged in ship leasing defined in Clause 7, Article 2 of the law. 2. Piloting service provided to non-residents defined in Clause 1.6, Article 6 of the Law of Foreign Exchange and the Law of Foreign Trade Control, excluding the traders stated above.. For joint piloting by two licensed pilots (excluding the service on board the vessel with wheelhouse), the pilotage shall be 75% of applicable rates stipulated in, regardless of the stipulations therein (with the exception of the additional charges stipulated in -3.) (effective January 1, 2003). Rates of pilotage shall conform to the Law of Pilotage, provided that greater or greatest tonnage shown on the tonnage certificate shall be regarded as the gross tonnage for the following vessels. 1. The vessel, whereof tonnage is shown in dual notation on the tonnage certificate 2. The vessel under the flag of a non-signatory to the Inter-Governmental Agreements on Tonnage Measurement, whereof tonnage is shown in shingle notation on the tonnage certificate with various values for each occasion with the intention of the shipper or shipowner. Cancellation Charges 1. Cancellation Charges of 105% (or 100% under tax-exemption) of 21,600 shall apply to the following cases. (1) Cancellation after leaving of the pilot to the vessel from the pilot station (2) Refusal by the shipmaster to piloting on board the vessel without sufficient reason despite his demand (3) Cancellation after 23:00 hrs. of the preceding day for piloting during 00:00 06:00 hrs.
8 2. For cancellation after leaving of the pilot to the vessel from the pilot station during 17:00 08:00 hrs. in the above cases )(1and (2), 150% of applicable rates shall be charged.. Waiting Charges For waiting during the period from reaching the appointed place to disembarking the vessel for causes attributable to the captain of the vessel, additional charge of 105% of 5,400 (or 100% of 5,400 for piloting stipulated each phrase of ) per each 30 minutes or fraction thereof in excess after scheduled time shall be billed in addition to the stipulated rate of pilotage, regardless of the previous stipulation.. Taking of the Pilot to the Outside District In case of taking of the pilot to the waters outside the pilot district concerned, 105% (or 100% of under tax-exemption) of all the expenses and costs required for his returning shall be billed, provided that the causes thereof attribute to the pilot.. Other Reparation 1. In case of any damage to the pilot boat and/or other properties that attributes to the vessel, reparation therefore shall be made by the vessel. Likewise, in case of loss of life, personal injury or damage to personal effects of the pilot, apprentice pilot or other personnel concerned for causes attributable to the vessel, reparation therefore shall be made by the vessel. 2. In case of detaining of the pilot on board the vessel or in the quarantine office as a result of quarantine of the vessel, 105% (or 100% under tax-exemption) of all the necessary expenses and costs shall be billed.
