FAX: (716) Commissioner of Building TOWN OF AMHERST SWIMMING POOL REGULATIONS AND INFORMATION PERMITS Any private swimming pool, defined as a structure intended for bathing, swimming or diving purposes, made of concrete, masonry, metal or other impervious materials, and provided with a recirculating and/or controlled water supply, which is moved, erected, constructed or excavated, either above, below or partly above or below grade level, requires a building permit, a plumbing permit for all plumbing and drainage in connection therewith, and an electrical permit for all electrical work in connection therewith. Pre-Permit Inspection Required Prior To Issuance Of The Permit. This Inspection Shall Include The Homeowner, Contractor And Inspector. The building permit application shall be made to the Building Department, accompanied by: 1. Three (3) plot plans detailing the location of the pool. (A copy of the survey of the premises showing all building and structures and locating the pool will be acceptable.) 2. Three (3) sets of construction plans of the pool. Private swimming pools, in the ground or partly in the ground, require plans sealed by a licensed New York State Professional Engineer or Architect. (For aboveground pools, the installation brochure from the pool company will be acceptable.) Grade and Drainage plans required for in-ground pools. 3. A statement indicating if the pool is heated or not heated. If heated, equipment and control specifications must be submitted to indicate compliance with Sec or of the Energy Conservation Construction Code of New York State. 4. For premises served by overhead electric lines provide a letter from National Grid indicating that the proposed location of the pool conforms to the requirements for vertical and horizontal clearance distances to electric lines. (Call National Grid Customer Service and request a Planner Review for Pool Clearance ). 5. The application must indicate an Electrical Contractor that has a valid Town of Amherst license. 6. If plumbing work is required the application must indicate a Plumbing Contractor that has a valid Town of Amherst license. FEES Building permit fees: (a) Accessory to a one- or two-family dwelling $ (b) All other swimming pools $ Electrical permit fee: (a) Above ground swimming pool $40.00 (b) In-ground pool $85.00 LOCATION A swimming pool may be located within the rear yard or side yard, but no less then three feet (five feet in SA districts) to any lot line for any part of the pool. It shall not be located in a front yard or within five feet of any structure (Note: This distance separation may be higher in certain multi-family residential districts). A private swimming pool may be erected or installed only as an accessory to a dwelling and for the private use of the owner or occupant and his or her family and guests. 2 PLUMBING All plumbing work must be installed by individuals with a valid Town of Amherst license. All plumbing and drainage work associated with the installation of a swimming pool must comply with the International Plumbing Code. Furthermore, a plumbing permit is required for all such work. Upon the issuance of a plumbing permit, appropriate inspections will be conducted by a Town of Amherst plumbing inspector from the Building Department. No person shall discharge, or cause to be discharged, any water from a swimming pool over a public sidewalk, into a public street or onto adjacent properties. If an outside faucet is used for filling the pool, a vacuum breaker must be installed on the hose thread of the outside faucet closest to the pool and any other faucet used to fill the pool. ELECTRICAL All Electrical work must be installed by a contractor with a valid Town of Amherst license. All electrical equipment, wiring and appurtenances must be installed in compliance with the National Electrical Code, the International Residential Code, International Building Code and the International Plumbing Code. Furthermore, an electrical permit is required for all such work. Upon the issuance of an electrical permit, appropriate inspections will be conducted by a Town of Amherst electrical inspector from the Building Department. NOTE: (a) National Grid Customer Service Assistance will provide a review of the location for the required clearance of overhead conductors. (b) Pool wiring must comply with section 680 of the National Electrical Code. (c) A bonding inspection is required before the copper bond wire is covered. FENCING (a) All swimming pools accessory to one and two-family dwellings must be enclosed in accordance with Section R326 of the 2016 Uniform Code Supplement of New York State. (b) All swimming pools accessory to other uses must be enclosed in accordance with Section 3109 of the 2016 Uniform Code Supplement of New York State. (c) Temporary enclosure is required during installation shall comply with Section of the 2016 Uniform Code Supplement of New York State.. PENALTIES Violations of any of the above regulations may be prosecuted as provided for in Part I, Sec. 5 of the Town of Amherst Building Construction Administration Ordinance.

3 NEW YORK STATE 2016 UNIFORM CODE SUPPLEMENT SWIMMING POOLS, SPAS AND HOT TUBS SECTION R326.1 GENERAL R326.1 General. The provisions of this appendix shall control the design and construction of swimming pools, spas and hot tubs installed in or on the lot of a one- or two-family dwelling. SECTION R326.2 DEFINITIONS R326.2 Definitions. For the purposes of these requirements, the terms used shall be defined as follows and as set forth in Chapter 2. ABOVE-GROUND/ON-GROUND POOL. See "Swimming pool." BARRIER PERMANENT. A fence, wall, building wall or combination thereof which completely surrounds the swimming pool and obstructs access to the swimming pool. BARRIER TEMPORARY. An approved temporary fence, permanent fence, the wall of a permanent structure, any other structure, or any combination thereof that prevents access to the swimming pool by any person not engaged in the installation or construction of the swimming pool during its installation or construction. HOT TUB. See "Swimming pool." IN-GROUND POOL. See "Swimming pool." RESIDENTIAL. That which is situated on the premises of a detached one- or two-family dwelling or a one-family townhouse not more than three stories in height. SPA, NONPORTABLE. See "Swimming pool." SPA, PORTABLE. A nonpermanent structure intended for recreational bathing, in which all controls, water-heating and Water-circulating equipment are an integral part of the product. SUBSTANTIAL DAMAGE. For the purpose of determining compliance with the pool alarm provisions of this appendix, damage of any origin sustained by a swimming pool whereby the cost of restoring the swimming pool to its before-damaged condition would equal or exceed 50 percent of the market value of the swimming pool before the damage occurred. SUBSTANTIAL MODIFICATION. For the purpose of determining compliance with the pool alarm provisions of this appendix, any repair, alteration, addition or improvement of a swimming pool, the cost of which equals or exceeds 50 percent of the market value of the swimming pool before the improvement or repair is started. If a swimming pool has sustained substantial damage, any repairs are considered substantial modification regardless of the actual repair work performed. SWIMMING POOL. Any structure, basin, chamber or tank which is intended for swimming, diving, recreational bathing or wading and which contains, is designed to contain, or is capable of containing water more than 24 inches (610 mm) deep at any point. This includes in-ground, above-ground and on-ground pools; indoor pools; hot tubs; spas; and fixed-in-place wading pools. SWIMMING POOL, INDOOR. A swimming pool which is totally contained within a structure and surrounded on all four sides by the walls of the enclosing structure. SWIMMING POOL, OUTDOOR. Any swimming pool which is not an indoor pool. SECTION R326.3 SWIMMING POOLS R In-ground pools. In-ground pools shall be designed and constructed in conformance with ANSI/NSPI-5. R Above-ground and on-ground pools. Aboveground and on-ground pools shall be designed and constructed in conformance with ANSI/NSPI-4. SECTION R326.4 SPAS AND HOT TUBS R Permanently installed spas and hot tubs. Permanently installed spas and hot tubs shall be designed and constructed in conformance with ANSI/NSPI-3 as listed in Section R R Portable spas and hot tubs. Portable spas and hot tubs shall be designed and constructed in conformance with ANSI/NSPI-6. SECTION R326.5 BARRIER REQUIREMENTS R Application. The provisions of this chapter shall control the design of barriers for residential swimming pools, spas and hot tubs. These design controls are intended to provide protection against potential drownings and near- drownings by restricting access to swimming pools, spas and hot tubs. R Temporary barriers. An outdoor swimming pool, including an in-ground, above-ground or on-ground pool, hot tub or spa shall be surrounded by a temporary barrier during installation or construction and shall remain in place until a permanent barrier in compliance with Section R is provided. 1. Above-ground or on-ground pools where the pool structure is the baffler in compliance with Section R Spas or hot tubs with a safety cover which complies with ASTM F 1346, provided that such safety cover is in place during the period of installation or construction of such hot tub or spa. The temporary removal of a safety cover as required to facilitate the installation or construction of a hot tub or spa during periods when at least one person engaged in the installation or construction is present is permitted. R Height. The top of the temporary barrier shall be at least 48 inches (1219 mm) above grade measured on the side of the barrier which faces away from the swimming pool. R Replacement by a permanent barrier. A temporary barrier shall be replaced by a complying permanent barrier within either of the following periods: days of the date of issuance of the building permit for the installation or construction of the swimming pool; or days of the date of commencement of the installation or construction of the swimming pool. R Replacement extension. Subject to the approval of the code enforcement official, the time period for completion of the permanent baffler may be extended for good cause, including, but not limited to, adverse weather conditions delaying construction. R Outdoor swimming pool. An outdoor swimming pool, including an in-ground, above-ground or on-ground pool, hot tub or spa shall be surrounded by a baffler which shall comply with the following: 1. The top of the barrier shall be at least 48 inches (1219 mm) above grade measured on the side of the barrier which faces away from the swimming pool. The maxi mum vertical clearance between grade and the bottom of the barrier shall be 2 inches (51 mm) measured on the side of the baffler which faces away from the swimming pool. Where the top of the pool structure is above grade, such as an above-ground pool, the baffler may be at ground level, such as the pool structure, or mounted on top of the pool structure. Where the barrier is mounted on top of the pool structure, the maxi mum vertical clearance between the top of the pool structure and the bottom of the barrier shall be 4 inches (102 rum). 2. Openings in the barrier shall not allow passage of a 4 inch-diameter (102mm) sphere. 3. Solid barriers which do not have openings, such as a masonry or stone wall, shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints. 4. Where the baffler is composed of horizontal and vertical members and the distance between the tops of the horizontal members is less than 45 inches (1143 mm), the horizontal members shall be located on the swimming pool side of the fence. Spacing between vertical members shall not exceed 1 3/4 inches (44 mm) in width. Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 1 3/4 inches (44 mm) in width. 5. Where the baffler is composed of horizontal and vertical members and the distance between the tops of the horizontal members is 45 inches (1143 mm) or more, spacing between vertical members shall not exceed 4 inches (102 mm). Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 1 3/4 inches (44mm) in width. 6. Maximum mesh size for chain link fences shall be a 2 1/4-inch (57 mm) square unless the fence has slats fastened at the top or the bottom which reduce the openings to not more than 1 3/4 inches (44mm). 7. Where the baffler is composed of diagonal members, such as a lattice fence, the maximum opening formed by the diagonal members shall not be more than 1 3/4 inches (44 mm). 8. Gates shall comply with the requirements of Section AG1O5.2, Items 1 though 7, and with the following requirements: 8.1. All gates shall be self-closing. In addition, if the gate is a pedestrian access gate, the gate shall open outward, away from the pool.

4 8.2. All gates shall be self-latching, with the latch handle located within the enclosure (i.e. on the pool side of the enclosure) and at least 40 inches (1016 mm) above grade. In addition, if the latch handle is located less than 54 inches (1372 mm) from the bottom of the gate, the latch handle shall be located at least 3 inches (76 mm) below the top of the gate, and neither the gate nor the baffler shall have any opening greater than 0.5 inch (12.7 mm) within 18 inches (457 mm) of the latch handle All gates shall he securely locked with a key, combination or other child proof lock sufficient to prevent access to the swimming pool through such gate when the swimming pool is not in use or supervised. 9. Where a wall of a dwelling serves as part of the barrier, one of the following conditions shall be met: 9.1. The pool shall he equipped with a powered safety cover in compliance with ASTM F 1346; or 9.2. Doors with direct access to the pool through that wall shall be equipped with an alarm which produces an audible warning when the door and/or its screen, if present, are opened. The alarm shall be listed in accordance with UL The audible alarm shall activate within 7 seconds and sound continuously for a minimum of 30 seconds after the door and/or its screen, if present, are opened and be capable of being heard throughout the house during normal household activities. The alarm shall automatically reset under all conditions. The alarm system shall be equipped with a manual means, such as touch pad or switch, to temporarily deactivate the alarm for a single opening. Deactivation shall last for not more than 15 seconds. The deactivation switch(es) shall be located at least 54 inches (1372 mm) above the threshold of the door; or 9.3. Other means of protection, such as self-closing doors with self-latching devices, shall be acceptable so long as the degree of protection afforded is not less than the protection afforded by Item 9.1 or 9.2 described above. 10. Where an above-ground pool structure is used as a barrier or where the barrier is mounted on top of the pool structure, and the means of access is a ladder or steps: The ladder or steps shall be capable of being secured, locked or removed to prevent access; or The ladder or steps shall be surrounded by a baffler which meets the requirements of Section R , Items 1 through 9. When the ladder or steps are secured, locked or removed, any opening created shall not allow the passage of a 4 inch-diameter (102 mm) sphere. R Indoor swimming pool. Walls surrounding an indoor swimming pool shall comply with Section R , Item 9. R Prohibited locations. Barriers shall be located to prohibit permanent structures, equipment or similar objects from being used to climb them. R Barrier exceptions. Spas or hot tubs with a safety cover which complies with ASTM F 1346 shall be exempt from the provisions of this appendix. SECTION R326.6 ENTRAPMENT PROTECTION FOR SWIMMING POOL AND SPA SUCTION OUTLETS R General. Suction outlets shall be designed to produce circulation throughout the pool or spa. Single-outlet systems, such as automatic vacuum cleaner systems, or multiple suction outlets, whether isolated by valves or otherwise, shall be protected against user entrapment. R Compliance alternative. Suction outlets may be designed and installed in accordance with ANSIIAPSP R Suction fittings. Pool and spa suction outlets shall have a cover that conforms to ANSTIASME Al , or an 18 inch by 23 inch (457mm by 584 mm) drain grate or larger, or an approved channel drain system. Exception: Surface skimmers R Atmospheric vacuum relief system required. Pool and spa single- or multiple-outlet circulation systems shall be equipped with atmospheric vacuum relief should grate covers located therein become missing or broken. This vacuum relief system shall include at least one approved or engineered method of the type specified herein, as follows: 1. Safety vacuum release system conforming to ASME A ; or 2. An approved gravity drainage system. R Dual drain separation. Single or multiple pump circulation systems have a minimum of two suction outlets of the approved type. A minimum horizontal or vertical distance of 3 feet (914 mm) shall separate the outlets. These suction outlets shall be piped so that water is drawn though them simultaneously through a vacuumrelief-protected line to the pump or pumps. R Pool cleaner fittings. Where provided, vacuum or pressure cleaner fining(s) shall be located in an accessible position(s) at least 6 inches (152 mm) and not more than 12 inches (305 mm) below the minimum operational water level or as an attachment to the skimmer(s). SECTION R326.7 SWIMMING POOL AND SPA ALARMS R Applicability. A swimming pool or spa installed, constructed or substantially modified after December 14, 2006, shall be equipped with an approved pool alarm. 1. A hot tub or spa equipped with a safety cover which complies with ASTM F1346, as listed in Section A A swimming pool (other than a hot tub or spa) equipped with an automatic power safety cover which complies with ASTM P1346, as listed in Section A0109. Pool alarms shall comply with ASTM P2208, and shall be installed, used and maintained in accordance with the manufacturer's instructions and this section. R Multiple alarms. A pool alarm must be capable of detecting entry into the water at any point on the surface of the swimming pool. If necessary to provide detection capability at every point on the surface of the swimming pool, more than one pool alarm shall be provided. R Alarm activation. Pool alarms shall activate upon detecting entry into the water and shall sound poolside and inside the dwelling. R Prohibited alarms. The use of personal immersion alarms shall not be construed as compliance with this section.

5 NEW YORK STATE 2016 UNIFORM CODE SUPPLEMENT IBC SECTION 3109 SWIMMING POOLS, SPAS AND HOT TUBS General. Swimming pools shall comply with the requirements of this section and other applicable sections of this code. The requirements of this section and of the other applicable sections of this code shall be in addition to, and not in replacement of or substitution for, the requirements of other applicable federal, state and local laws and regulations, including, but not necessarily limited to, (a) the requirements of Subpart 6-i (Swimming pools) of Title 10 of the Official Compilation of Codes, Rules and Regulations of the State of New York (NYCRR), where applicable, and (b) the requirements of section 8003 (Federal swimming pool and spa drain cover standard) of Tide 15 of the United States Code, where applicable Definitions. The following words and terms shall, for the purposes of this section, and as used elsewhere in this code, have the meanings shown herein. BARRIER, TEMPORARY. An approved temporary fence, permanent fence, the wall of a permanent structure, any other structure, or any combination thereof that prevents access to the swimming pool by any person not engaged in the installation or construction of the swimming pool during its installation or construction. SUBSTANTIAL DAMAGE. For the purpose of determining compliance with the pool alarm provisions of this Sec don, damage of any origin sustained by a swimming pool whereby the cost of restoring the swimming pool to its before-damaged condition would equal or exceed 50 percent of the market value of the swimming pool before the damage occurred. SUBSTANTIAL MODIFICATION. For the purpose of determining compliance with the pool alarm provisions of this Section, any repair, alteration, addition or improvement of a swimming pool, the cost of which exceeds 50 percent of the market value of the swimming pool before the improvement or repair is started. If a swimming pool sustained substantial damage, any repairs are considered substantial improvement regardless of the actual repair work performed. SWIMMING POOLS. Any structure, basin, chamber or tank which is intended for swimming, diving, recreational bathing or wading and which contains, is designated to contain, or is capable of containing water more than 24 inches (610 mm) deep at any point. This includes in-ground, above ground and on-ground pools; indoor pools; hot tubs; spas; and fixed-in-place wading pools Public swimming pools. Public swimming pools shall be completely enclosed by a fence at least 4 feet (1290 mm) in height or a screen enclosure. Openings in the fence shall not permit the passage of a 4-inch-diameter (102 mm) sphere. The fence or screen enclosure shall be equipped with gates Gates. Gates shall comply with the following requirements Self-closing; opening configuration. All gates shall be self-closing. In addition, if the gate is a pedestrian access gate, the gate shall open outward, away from the pool Self-latching; location of latch handle. All gates shall be self-latching, with the latch handle located within the enclosure (i.e., on the pool side of the enclosure) and at least 40 inches (1016 mm) above grade. In addition, if the latch handle is located less than 54 inches (1372 mm) from the bottom of the gate, the latch handle shall be located at least 3 inches (76 mm) below the top of the gate, and neither the gate nor baffler shall have any opening greater than 0.5 inch (12.7) within 18 inches (457 mm) of the latch handle Locking. All gates shall be securely locked with a key, combination or other child proof lock sufficient to prevent access to the swimming pool through such gate when the swimming pool is not in use or supervised Residential swimming pools. Residential swimming pools shall comply with Sections through Exception: A swimming pool with a power safety cover or a spa with a safety cover complying with ASTM P1346 need not comply with this section Barrier height and clearances. The top of the barrier shall be at least 48 inches (1219 mm) above grade measured on the side of the baffler that faces away from the swimming pool. The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches (51 mm) measured on the side of the baffler that faces away from the swimming pool. Where the top of the pool structure is above grade, the barrier is authorized to be at ground level or mounted on top of the pool structure, and the maximum vertical clearance between the top of the pool structure and the bottom of the barrier shall be 4 inches (102 mm) Openings. Openings in the harrier shall not allow passage of a 4-inch-diameter (102 mm) sphere Solid barrier surfaces. Solid barriers which do not have openings shall not contain indentations or protrusions except for normal construction tolerances and tooled masonry joints Closely spaced horizontal members. Where the barrier is composed of horizontal and vertical members and the distance between the tops of the horizontal members is less than 45 inches (1143 nun), the horizontal members shall be located on the swimming pool side of the fence. Spacing between vertical members shall not exceed 1.75 inches (44 mm) in width. Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 1 3/4 inches (44 mm) in width Widely spaced horizontal members. Where the barrier is composed of horizontal and vertical members and the distance between the tops of the horizontal members is 45 inches (1143 nun) or more, spacing between vertical members shall not exceed 4 inches (102 mm). Where there are decorative cutouts within vertical members, spacing within the cutouts shall not exceed 1 3/4 inches (44 mm) in width Chain link dimensions. Maximum mesh size for chain link fences shall be a 2.25 inch square (57 mm square) unless the fence is provided with slats fastened at the top or the bottom which reduce the openings to no more than 1 3/4 inches (44 mm) Diagonal members. Where the baffler is composed of diagonal members, the maximum opening formed by the diagonal members shall be no more than 1 3/4 inches (44mm) Gates. Gates shall comply with the requirements of Sections through and with the following requirements Self-closing; opening configuration. All gates shall be self-closing. In addition, if the gate is a pedestrian access gate, the gate shall open outward, away from the pool Self-latching; location of latch handle. All gates shall be self-latching, with the latch handle located within the enclosure (i.e., on the pool side of the enclosure) and at least 40 inches (1016 mm) above grade. In addition, if the latch handle is located less than 54 inches (1372 mm) from the bottom of the gate, the latch handle shall be located at least 3 inches (76 mm) below the top of the gate, and neither the gate nor baffler shall have any opening greater than 1/2 inch (12.7) within 18 inches (457 mm) of the latch handle Locking. All gates shall be securely locked with a key, combination or other child proof lock sufficient to prevent access to the swimming pool through such gate when the swimming pool is not in use or supervised Dwelling wall as a barrier. Where a wall of a dwelling serves as part of the baffler, one of the following shall apply: 1. Doors with direct access to the pool through that wall shall be equipped with an alarm that produces an audible warning when the door and/or its screen, if present, are opened. The alarm shall be listed in accordance with UL The audible alarm shall activate within 7 seconds and sound continuously for a minimum of 30 seconds after the door and/or its screen, if present, are opened and be capable of being heard throughout the house during normal household activities. In dwellings not required to be Accessible, Type A or Type B units, the deactivation switch shall be located 54 inches (1372 mm) or more above the threshold of the door. In dwellings required to be Accessible, Type A or Type B units, the deactivation switch(es) shall be located at 54 inches (1372 mm) maximum and 48 inches minimum above the threshold of the door. 2. The pool shall be equipped with a power safety cover that complies with ASTM F Other means of protection, such as self-closing doors with self-latching devices, which are approved by the administrative authority, shall be accepted so long as the degree of protection afforded is not less than the protection afforded by Item 1 or 2 above Pool structure as barrier. Where an aboveground pool structure is used as a barrier or where the hairier is mounted on top of the pool structure, and the means of access is a ladder or steps, then the ladder or steps either shall be capable of being secured, locked or removed to prevent access, or the ladder or steps shall be surrounded by a baffler which meets the requirements of Sections through When the ladder or steps are secured, locked or removed, any opening created shall not allow the passage of a 4-inch-diameter (102 mm) sphere.

6 Indoor swimming pools. Walls surrounding indoor swimming pools shall not be required to comply with Section Prohibited locations. Barriers shall be located so as to prohibit permanent structures, equipment or similar objects from being used to climb the barriers Temporary Barriers. An outdoor swimming poo1, including an in-ground, above-ground or on-ground pool, hot tub or spa shall be surrounded by a temporary barrier during installation or construction and shall remain in place until a permanent fence in compliance with Section or barrier in compliance with Section is provided. 1. Above-ground or on-ground residential swimming pools where the pool structure is the barrier in compliance with Section Spas or hot tubs with a safety cover which complies with ASTM F 1346, provided that such safety cover is in place during the period of installation or construction of such hot tub or spa. The temporary removal of a safety cover as required to facilitate the installation or construction of a hot tub or spa during periods when at least one person engaged in the installation or construction is present is permitted Height. The top of the temporary baffler shall be at least 48 inches (1219) above grade measured on the side of the baffler which faces away from the swimming pool Replacement by a permanent harrier. A temporary barrier shall be replaced by a complying permanent barrier within either of the following periods: days of the date of issuance of the building permit for the installation or construction of the swimming pool; or, days of the date of commencement of the installation or construction of the swimming pool Replacement extension. Subject to the approval of the code enforcement official, the time period for completion of the permanent barrier may be extended for good cause, including, but not limited to, adverse weather conditions delaying construction Entrapment protection. Entrapment protection shall be provided in compliance with ANSI/APSP Swimming Pool and Spa Alarms Applicability. A swimming pool or spa installed, constructed or substantially modified after December 14, 2006, shall be equipped with an approved pool alarm. 1. A hot tub or spa equipped with a safety cover which complies with ASTM F A swimming pool (other than a hot tub or spa) equipped with an automatic power safety cover which complies with ASTM F Pool alarms shall comply with ASTM F 2208 and shall be installed, used and maintained in accordance with the manufacturer's instructions and this section Multiple alarms. A pool alarm must be capable of detecting entry into the water at any point on the surface of the swimming pool. If necessary to provide detection capability at every point on the surface of the swimming pool, more than one pool alarm shall be provided Alarm activation. Pool alarms shall activate upon detecting entry into the water and shall sound pool side and inside the building Prohibited alarms. The use of personal immersion alarms shall not be construed as compliance with this section.

7 Electrical Information 2015 INTERNATIONAL RESIDENTIAL CODE CHAPTER 42 - SWIMMING POOLS SECTION E4201 GENERAL E Scope. The provisions of this chapter shall apply to the construction and installation of electric wiring and equipment associated with all swimming pools, wading pools, decorative pools, fountains, hot tubs and spas, and hydromassage bathtubs, whether permanently installed or storable, and shall apply to metallic auxiliary equipment, such as pumps, filters and similar equipment. Sections E4202 through E4206 provide general rules for permanent pools, spas and hot tubs. Section E4207 provides specific rules for storable pools and storable/portable spas and hot tubs. Section E4208 provides specific rules for spas and hot tubs. Section E4209 provides specific rules for hydromassage bathtubs. (680.1) E Definitions. CORD-AND PLUG-CONNECTED LIGHTING ASSEMBLY. A lighting assembly consisting of a cord and plug-connected transformer and a lighting fixture intended for installation in the wall of a spa, hot tub, or storable pool. DRY-NICHE LIGHTING FIXTURE. A luminaire intended for installation in the floor or wall of a pool, spa or fountain in a niche that is sealed against the entry of water. FORMING SHELL. A structure designed to support a wet-niche lighting fixture assembly and intended for mounting in a pool or fountain structure. FOUNTAIN. Fountains, ornamental pools, display pools, and reflection pools. The definition does not include drinking fountains. HYDROMASSAGE BATHTUB. A permanently installed bathtub equipped with a recirculating piping system, pump, and associated equipment. It is designed so it can accept, circulate and discharge water upon each use. LOW VOLTAGE CONTACT LIMIT. A voltage not exceeding the following values: volts (RMS) for sinusoidal AC volts peak for nonsinusoidal AC volts for continuous DC volts peak for DC that is interrupted at a rate of 10 to 200 Hz MAXIMUM WATER LEVEL. The highest level that water can reach before it spills out. NO-NICHE LIGHTING LUMINAIRE. A luminaire intended for installation above or below the water without a niche. PACKAGED SPA OR HOT TUB EQUIPMENT ASSEMBLY. A factory-fabricated unit consisting of water-circulating, heating and control equipment mounted on a common base, intended to operate a spa or hot tub. Equipment may include pumps, air blowers, heaters, luminaires, controls and sanitizer generators. PERMANENTLY INSTALLED SWIMMING AND WADING POOLS. Those that are constructed in the ground or partially in the ground, and all others capable of holding water with a depth greater than 42 inches (1067 mm), and all pools installed inside of a building, regardless of water depth, whether or not served by electrical circuits of any nature. POOL. Manufactured or field-constructed equipment designed to contain water on a permanent or semipermanent basis and used for swimming, wading, immersion, or therapeutic purposes. POOL COVER, ELECTRICALLY OPERATED. Motor-driven equipment designed to cover and uncover the water surface of a pool by means of a flexible sheet or rigid frame. SELF-CONTAINED SPA OR HOT TUB. A factory-fabricated unit consisting of a spa or hot tub vessel with all water-circulating, heating and control equipment integral to the unit. Equipment may include pumps, air blowers, heaters, luminaires, controls and sanitizer generators. SPA OR HOT TUB. A hydromassage pool, or tub for recreational or therapeutic use, not located in health care facilities, designed for immersion of users, and usually having a filter, heater, and motor-driven blower. They are installed indoors or outdoors, on the ground or supporting structure, or in the ground or supporting structure. Generally, a spa or hot tub is not designed or intended to have its contents drained or discharged after each use. STORABLE SWIMMING, WADING OR IMMERSION POOLS; OR STORABLE/PORTABLE SPAS AND HOT TUBS. Those that are constructed on or above the ground and are capable of holding water with a maximum depth of 42 inches (1067 mm), or a pool with nonmetallic, molded polymeric walls or inflatable fabric walls regardless of dimension. THROUGH-WALL LIGHTING ASSEMBLY. A lighting assembly intended for installation above grade, on or through the wall of a pool, consisting of two interconnected groups of components separated by the pool wall. WET-NICHE LUMINAIRE. A luminaire intended for installation in a forming shell mounted in a pool or fountain structure where the luminaire will be completely surrounded by water. SECTION E4202 WIRING METHODS FOR POOLS, SPAS, HOT TUBS AND HYDROMASSAGE BATHTUBS E General. Wiring methods used in conjunction with permanently installed swimming pools, spas, hot tubs or hydromassage bathtubs shall be installed in accordance with Table E and Chapter 38 except as otherwise stated in this section. Storable swimming pools shall comply with E4207. [680.7; (A); (B) and (F); (A); ; ; and ] E Flexible cords. Flexible cords used in conjunction with a pool, spa, hot tub or hydromassage bathtub shall be installed in accordance with the following: 1. For other than underwater luminaires, fixed or stationary equipment, rated at 20 amperes or less shall be permitted to be connected with a flexible cord to facilitate the removal or disconnection for maintenance or repair. For other than storable pools, the flexible cord shall not exceed 3 feet (914 mm) in length. Cords that supply swimming pool equipment, shall have a copper equipment grounding conductor not smaller than 12 AWG and shall be provided with a grounding-type attachment plug. [680.7(A), (B), and (C); (A)(5)] 2. Other than listed low-voltage lighting systems not requiring grounding, wet-niche luminaires that are supplied by a flexible cord or cable shall have all exposed noncurrent-carrying metal parts grounded by an insulated copper equipment grounding conductor that is an integral part of the cord or cable. Such grounding conductor shall be connected to a grounding terminal in the supply junction box, transformer enclosure, or other enclosure and shall be not smaller than the supply conductors and not smaller than 16 AWG. [680.23(B)(3)] 3. A listed packaged spa or hot tub installed outdoors that is GFCI protected, shall be permitted to be cord and plug connected provided that such cord does not exceed 15 feet (4572 mm) in length. [680.42(A)(2)] 4. A listed packaged spa or hot tub rated at 20 amperes or less and installed indoors shall be permitted to be cord and plug connected to facilitate maintenance and repair. ( Exception No. 1) 5. For other than underwater and storable pool lighting luminaire, the requirements of Item 1 shall apply to any cord equipped luminaire that is located within 16 feet (4877 mm) radially from any point on the water surface. [680.22(B)(5)]

Flexible cord shall be installed in accordance with Section E h. Nonmetallic conduit shall be rigid polyvinyl chloride conduit Type PVC or reinforced thermosetting resin conduit Type RTRC. i. Aluminum conduits shall not be permitted in the pool area where subject to corrosion. j. Where installed as direct burial cable or in wet locations, Type MC cable shall be listed and identified for the location. k. See Section E for listed, double-insulated pool pump motors. l. Limited to use in individual lengths not to exceed 6 feet. The total length of all individual runs of LFMC shall not exceed 10 feet. E Double insulated pool pumps. A listed cord and plug-connected pool pump incorporating an approved system of double insulation that provides a means for grounding only the internal and nonaccessible, noncurrent-carrying metal parts of the pump shall be connected to any wiring method recognized in Chapter 38 that is suitable for the location. Where the bonding grid is connected to the equipment grounding conductor of the motor circuit in accordance with Section E4204.2, Item 6.1, the branch circuit wiring shall comply with Sections E and E [680.21(B)] SECTION E4203 EQUIPMENT LOCATION AND CLEARANCES E Receptacle outlets. Receptacles outlets shall be installed and located in accordance with E through E Distances shall be measured as the shortest path that an appliance supply cord connected to the receptacle would follow without penetrating a floor, wall, ceiling, doorway with hinged or sliding door, window opening, or other effective permanent barrier. [680.22(A)(5)] E Location. Receptacles that provide power for water-pump motors or other loads directly related to the circulation and sanitation system shall be permitted to be located between 6 feet and 10 feet (1829 mm and 3048 mm) from the inside walls of pools and outdoor spas and hot tubs, where the receptacle is single and of the grounding type and protected by ground-fault circuit interrupters. Other receptacles on the property shall be located not less than 6 feet (1829 mm) from the inside walls of pools and outdoor spas and hot tubs. [680.22(A)(2) and (A)(3)] E Where required. At least one 125-volt, 15- or 20-ampere receptacle supplied by a general-purpose branch circuit shall be located a minimum of 6 feet (1829 mm) from and not more than 20 feet (6096 mm) from the inside wall of pools and outdoor spas and hot tubs. This receptacle shall be located not more than 6 feet, 6 inches (1981 mm) above the floor, platform or grade level serving the pool, spa or hot tub. [680.22(A)(1)] E GFCI protection. All 15- and 20-ampere, single phase, 125-volt receptacles located within 20 feet (6096 mm) of the inside walls of pools and outdoor spas and hot tubs shall be protected by a ground-fault circuitinterrupter. Outlets supplying pool pump motors supplied from branch circuits rated at 120 volts through 240 volts, single phase, whether by receptacle or direct connection, shall be provided with ground-fault circuit-interrupter protection for personnel. [680.21(C) and (A)(4)] E Indoor locations. Receptacles shall be located not less than 6 feet (1829 mm) from the inside walls of indoor spas and hot tubs. A minimum of one 125-volt receptacle shall be located between 6 feet (1829 mm) and 10 feet (3048 mm) from the inside walls of indoor spas or hot tubs. [680.43(A) and (A)(1)] E Indoor GFCI protection. All 125-volt receptacles rated 30 amperes or less and located within 10 feet (3048 mm) of the inside walls of spas and hot tubs installed indoors, shall be protected by ground-fault circuit- interrupters. [680.43(A)(2)]

9 E Switching devices. Switching devices shall be located not less than 5 feet (1524 mm) horizontally from the inside walls of pools, spas and hot tubs except where separated from the pool, spa or hot tub by a solid fence, wall, or other permanent barrier. Switching devices located in a room or area containing a hydromassage bathtub shall be located in accordance with the general requirements of this code. [680.22(C); (C); and ] E Disconnecting means. One or more means to simultaneously disconnect all ungrounded conductors for all utilization equipment, other than lighting, shall be provided. Each of such means shall be readily accessible and within sight from the equipment it serves and shall be located at least 5 feet (1524 mm) horizontally from the inside walls of a pool, spa, or hot tub unless separated from the open water by a permanently installed barrier that provides a 5-foot (1524 mm) or greater reach path. This horizontal distance shall be measured from the water s edge along the shortest path required to reach the disconnect. (680.12) E Luminaires and ceiling fans. Lighting outlets, luminaires, and ceiling-suspended paddle fans shall be installed and located in accordance with Sections E through E [680.22(B)] E Outdoor location. In outdoor pool, outdoor spas and outdoor hot tubs areas, luminaires, lighting outlets, and ceiling-suspended paddle fans shall not be installed over the pool or over the area extending 5 feet (1524 mm) horizontally from the inside walls of a pool except where no part of the luminaire or ceilingsuspended paddle fan is less than 12 feet (3658 mm) above the maximum water level. [680.22(B)(1)] E Indoor locations. In indoor pool areas, the limitations of E shall apply except where the luminaires, lighting outlets and ceiling-suspended paddle fans comply with all of the following conditions: 1. The luminaires are of a totally enclosed type, and 2. Ceiling-suspended paddle fans are identified for use beneath ceiling structures such as porches and patios. 2. A ground-fault circuit interrupter is installed in the branch circuit supplying the luminaires or ceiling-suspended paddle fans, and 3. The distance from the bottom of the luminaire or ceiling-suspended paddle fan to the maximum water level is not less than 7 feet, 6 inches (2286 mm). [680.22(B)(2)] E Low-voltage luminaires. Listed low-voltage luminaires not requiring grounding, not exceeding the low-voltage contact limit, and supplied by listed transformers or power supplies that comply with Section E shall be permitted to be located less than 1.5 m (5 ft) from the inside walls of the pool. [680.22(B)(6)] E Existing lighting outlets and luminaires. Existing lighting outlets and luminaires. Existing lighting outlets and luminaires that are located within 5 feet (1524 mm) horizontally from the inside walls of pools and outdoor spas and hot tubs shall be permitted to be located not less than 5 feet (1524 mm) vertically above the maximum water level, provided that such luminaires and outlets are rigidly attached to the existing structure and are protected by a ground-fault circuit-interrupter. [680.22(B)(3)] E Indoor spas and hot tubs. 1. Luminaires, lighting outlets, and ceiling-suspended paddle fans located over the spa or hot tub or within 5 feet (1524 mm) from the inside walls of the spa or hot tub shall be not less than 7 feet, 6 inches (2286 mm) above the maximum water level and shall be protected by a ground-fault circuit interrupter. [680.43(B)(1)(b)] Luminaires, lighting outlets, and ceiling-suspended paddle fans that are located 12 feet (3658 mm) or more above the maximum water level shall not require ground-fault circuit interrupter protection. [680.43(B)(1)(a)] 2. Luminaires protected by a ground-fault circuit interrupter and complying with Item 2.1 or 2.2 shall be permitted to be installed less than 7 feet, 6 inches (2286 mm) over a spa or hot tub Recessed luminaires shall have a glass or plastic lens and nonmetallic or electrically isolated metal trim, and shall be suitable for use in damp locations Surface-mounted luminaires shall have a glass or plastic globe and a nonmetallic body or a metallic body isolated from contact. Such luminaires shall be suitable for use in damp locations. [680.43(B)(1)(c)] E GFCI protection in adjacent areas. Luminaires and outlets that are installed in the area extending between 5 feet (1524 mm) and 10 feet (3048 mm) from the inside walls of pools and outdoor spas and hot tubs shall be protected by ground-fault circuit-interrupters except where such fixtures and outlets are installed not less than 5 feet (1524 mm) above the maximum water level and are rigidly attached to the structure. [680.22(B)(4)] E Other outlets. Other outlets such as for remote control, signaling, fire alarm and communications shall be not less than 10 feet (3048 mm) from the inside walls of the pool. Measurements shall be determined in accordance with Section E4203.l. [680.22(D)] E Overhead conductor clearances. Except where installed with the clearances specified in Table E4203.5, the following parts of pools and outdoor spas and hot tubs shall not be placed under existing service-drop conductors or any other open overhead wiring; nor shall such wiring be installed above the following: 1 Pools and the areas extending 10 feet (3048 mm) horizontally from the inside of the walls of the pool; 2. Diving structures and the areas extending not less than 10 feet (3048 mm) horizontally from the outer edge of such structures. 3. Observation stands, towers, and platforms and the areas extending not less than 10 feet (3048 mm) horizontally from the outer edge of such structures. Overhead conductors of network-powered broadband communications systems shall comply with the provisions in Table P for conductors operating at 0 to 750 volts to ground. Utility-owned, operated and maintained communications conductors, community antenna system coaxial cables and the supporting messengers shall be permitted at a height of not less than 10 feet (3048 mm) above swimming and wading pools, diving structures, and observation stands, towers, and platforms. E Underground wiring. Underground wiring shall not be installed under or within the area extending 5 feet (1524 mm) horizontally from the inside walls of pools and outdoor hot tubs and spas except where the wiring is installed to supply pool, spa or hot tub equipment or where space limitations prevent wiring from being routed 5 feet (1524 mm) or more horizontally from the inside walls. Where installed within 5 feet (1524 mm) of the inside walls, the wiring method shall be a complete raceway system of rigid metal conduit, intermediate metal conduit or a nonmetallic raceway system. Metal conduit shall be corrosion resistant and suitable for the location. The minimum cover depth shall be in accordance with Table E (680.10) A.
