1 2008 AUSTRALIAN OLYMPIC TEAM SWIMMING AUSTRALIA LTD NOMINATION CRITERIA NOTE: The AOC reserves the right to require amendments to the Nomination Criteria and amend its Selection Criteria as necessary. 1 Shadow Team (1) Swimming Australia Ltd (SAL) will choose athletes from within its sport to be members of the AOC s Shadow Team. The AOC may recognise other athletes from within this sport to also be members of the Shadow Team. (2) SAL may only nominate members of the Shadow Team to the AOC for selection in the 2008 Australian Olympic Team. (3) SAL will advise the AOC of the athletes that it has chosen as members of the Shadow Team at such time as required by the AOC. (4) No athlete is eligible to be chosen or recognised as a member of the Shadow Team unless the athlete has signed the Consent to Consideration for Nomination (See Attachment 1 for form of Consent to Consideration for Nomination and Attachment 2 for Parents/Guardians Acknowledgment for Minors) and provided it to SAL. (5) In order to be chosen by SAL as a member of the Shadow Team each athlete must be a member of the Gold or Silver Telstra Dolphins Squad (refer Attachment 3) and: (a) (b) (c) have been selected as a member of the 2007 World Championships Team; or have been the first, second, third or fourth place getters in the final of the Men s 1500m freestyle, Women s 800m freestyle events, and the Men s and Women s 50m freestyle, 400m freestyle, 100m backstroke, 200m backstroke, 100m breaststroke, 200m breaststroke, 100m butterfly, 200m butterfly, 200m IM and 400m IM events. In respect of the 100m freestyle and 200m freestyle to have placed fifth, sixth, seventh or eighth Australian place getter in the 100m freestyle and 200m freestyle finals at the 2007 Telstra Australian Championships held 3 to 10 December 2006 in Brisbane (if not selected in the 2007 World Championships Team); or be a finalist at the Telstra Swimming Selection Trials for the Beijing 2008 Australian Olympic Team to be held March 2008 in Sydney in any Olympic event. (6) SAL will provide all athletes chosen or recognised as members of the Shadow Team with an informative précis of the AOC Selection By-Law, a copy of the Selection Criteria, Participation Criteria and this Nomination Criteria, and on the request of any such athlete, a copy of the AOC Selection By-Law. 2 Making of Nominations SAL will not make any nominations for selection to the 2008 Australian Olympic Team to the AOC unless it has adopted and implemented an anti-doping policy that conforms with the World Anti-Doping Code. Nominations will be made to the AOC by 5:00pm on 1 April Any nominations made after this deadline will be invalid unless made pursuant to a direction or award in respect of an appeal against nomination or non-nomination to SAL Appeals Tribunal or the Court of Arbitration for Sport pursuant to the AOC s Selection By-Law and which appeal had been commenced prior to 5:00pm on 1 April Australian Olympic Team Nomination Criteria SAL FINAL - 2 August
2 The 5:00pm on 1 April 2008 deadline for the making of nominations by SAL is absolute and mandatory and applies irrespective of any deadline prescribed under the Participation Criteria or by the Organising Committee for the 2008 Olympic Games. 3 Nomination of Athletes For the purposes of nomination to the AOC of individual athletes for selection to the 2008 Australian Olympic Team SAL will: (1) only nominate athletes who are, or are recognised by the AOC as, members of the Shadow Team; (2) only nominate those athletes it honestly believes have met the requirements described in the Selection Criteria; (3) only nominate those athletes who have signed the athlete nomination form issued by the AOC from time to time; (4) not nominate more athletes than the maximum number permitted under the Participation Criteria (see Attachment 4); (5) not nominate athletes who have breached the AOC Anti-Doping By-Law and have had a sanction imposed which has not been completed; (6) only nominate those athletes who to the satisfaction of SAL have competed in the Telstra Swimming Selection Trials for the Beijing 2008 Australian Olympic Team March 2008 in Sydney; and (7) only nominate those athletes who have met the additional competition results outlined below at the Telstra Swimming Selection Trials for the Beijing 2008 Australian Olympic Team in those events to be contested at the 2008 Olympic Games: (A) Individual Events (i) First two placed finishers in the final of all individual Olympic events provided the time swum meets or betters the A" Qualifying Time Standard (refer Annexure A) for that individual event for the 2008 Olympic Games. (ii) First placed finisher in the final of all individual Olympic events where no swimmer qualified under this clause 3(7)(A)(i) above provided the time swum meets or betters the "B" Qualifying Time Standard (refer Annexure A) for that individual event for the 2008 Olympic Games. (B) Relay Events (i) Any additional athletes that have not met the requirements of clause 3(7)(A) will be considered for selection for a relay event using the following criteria provided they have achieved the B Qualifying Time Standard (refer Annexure A) for that individual event for the 2008 Olympic Games in the final of the respective individual event; 4 x 100 Freestyle Relay (a) Second placed finisher in the final of 100m freestyle events if not already qualified under clause 3(7)(A)(i) above in the individual event. (b) Third, fourth, fifth, sixth, seventh or eighth in the final of the 100m freestyle events. 4 x 200 Freestyle Relay (c) Second placed finisher in the final of 200m freestyle events if not already qualified under clause 3(7)(A)(i) above in the individual events. (d) Third, fourth, fifth, sixth, seventh or eighth in the final of the 100m and 200m freestyle events Australian Olympic Team Nomination Criteria SAL FINAL - 2 August
3 4 x 100 Medley Relay (e) Second placed finishers in the final of 100m Backstroke, Breaststroke, Butterfly and Freestyle events if not already qualified under clause 3(7)(A)(i) above in the individual events. (ii) All individual event athletes selected as part of the 2008 Australian Olympic Team are eligible to participate in relay events where Australia has qualified a team. In addition to the athletes selected for individual events, the SAL National Head Coach will consider all available information regarding the particular relay event, the overall number of relay places available, the current FINA World Rankings of individual swimmers being considered and the overall needs of the team and recommend to the AOC the inclusion of up to a maximum of sixteen additional relay only athletes to compete in particular relay events. The SAL National Head Coach will recommend to the AOC which athletes should be entered to participate in each relay event for which Australia has qualified a relay team. Meeting the relay performance requirements does not guarantee nomination for selection. If a nominated athlete is unable to take their position on the 2008 Australian Olympic Team for any reason, SAL may nominate the next highest ranked athlete in that event, provided that the athlete has met the Qualifying Time Standards. If the number of athletes who qualify under this nomination process exceeds the number permitted under the Participation Criteria, then the number of athletes being nominated will be reduced to the required number using the following process: a) the athlete with the highest ranking from the 2007 FINA World Long Course Rankings (adjusted two per nation) will be nominated first, with the remaining number of places filled by the next highest ranked athletes respectively until all the available places are filled. b) In the case of a tie for the final position, the most recent FINA Pointscore will be used to separate the tied athletes. c) In the case of a tie for a possible position on the team in a given event, a swim off will be conducted in that event at a time to be determined by the Meet Director. d) Relay team times for ranking, will be calculated by adding the four fastest available performances in the relevant individual events, less 1.50 seconds. 4 Illness/Misadventure/Extenuating Circumstances For the purpose of determining whether an athlete has met the requirements for this Nomination Criteria, SAL will not have regard to any extenuating circumstances. 5 Amendments to Nomination Criteria This Nomination Criteria may be amended by SAL with the approval of the AOC. Amended criteria will be distributed by SAL through State Associations and ASCTA for distribution to its members and mailed to all members of the Telstra Dolphins Squad and Shadow Team Australian Olympic Team Nomination Criteria SAL FINAL - 2 August
4 6 Interpretation (1) Words used in this Nomination Criteria have the same meaning ascribed to them in the AOC s Selection By-Law unless a contrary meaning appears from the context. (2) In this Nomination Criteria the following words and phrases have the following meanings: Olympic Events Are the following swimming events that will be contested at the 2008 Beijing Olympic Games as part of the swimming program: Freestyle 50m, 100m, 200m, 400m, 800m (women only) and 1500m (men only) Backstroke 100m and 200m Breaststroke 100m and 200m Butterfly 100m and 200m Individual Medley 200m and 400m Freestyle Relay 4 x 100m and 4 x 200m Medley Relay 4 x 100m 2008 Australian Olympic Team Nomination Criteria SAL FINAL - 2 August
5 Attachment AUSTRALIAN OLYMPIC TEAM CONSENT TO CONSIDERATION FOR NOMINATION Swimming Australia Ltd [insert name of athlete] I, the above athlete, consent to being considered for nomination by the above NF for selection to the 2008 Australian Olympic Team. I acknowledge that: 1 I have been provided with copies of and will be bound by and observe the terms of the AOC Selection By-Law, the AOC Selection Criteria applicable to my sport and my NF s Nomination Criteria. 2 The AOC s Selection By-Law and the Selection Criteria may be amended by the AOC from time to time. I will be bound by and observe the AOC s Selection By-Law and the Selection Criteria as amended, and acknowledge that any amendments to the AOC s Selection By-Law and Selection Criteria will be posted to the AOC s web site (olympics.com.au) along with the Participation Criteria applicable to my event. 3 The decision whether or not to nominate me to the AOC for selection in the 2008 Australian Olympic Team is subject to the Nomination Criteria and is at the discretion of my NF. 4 If my NF decides to nominate me for selection to the 2008 Australian Olympic Team I will be required to complete a nomination form as determined by the AOC from time to time. 5 In the event that my NF nominates me to the AOC for selection in the 2008 Australian Olympic Team I am not guaranteed to be selected in the 2008 Australian Olympic Team. The decision whether or not to select me as a member of the 2008 Australian Olympic Team is subject to the AOC s Selection By-Law and Selection Criteria and is at the sole and absolute discretion of the AOC. 6 My contact details are: Address: Facsimile: 7 I will notify my NF in writing of any change in the above contact details. Any failure by me to advise my NF in writing of a change in my contact details may be to my detriment. Any announcement to be made or notice required to be sent pursuant to the AOC s Selection By-Law may be sent to one or more of the above contacts, or such other contact as notified in writing by me, and in the case of: (1) post, the announcement or notice is deemed to have been received by me by properly addressing, prepaying and posting a letter containing the announcement or notice, and to have been received on the third business day after the date of its posting. Any announcement or notice sent by post to me overseas will be forwarded by air mail; (2) facsimile transmission, the announcement or notice is deemed to have been received by me by properly addressing the facsimile transmission and transmitting it to the number supplied by me and to have been received by me the next business day after the date of its transmission; and 2008 Australian Olympic Team Nomination Criteria SAL FINAL - 2 August

7 Attachment AUSTRALIAN OLYMPIC TEAM CONSENT TO CONSIDERATION FOR NOMINATION Parents/Guardians Acknowledgement for Minors Swimming Australia Ltd [insert name of athlete] I/we, the undersigned parents/guardians of the athlete agree (and if more than one, then jointly and severally agree) as follows: 1. the athlete is under the age of 18 years as at the date of signing the agreement; 2. I/we have read and understood the AOC Selection By-Law, the AOC Selection Criteria applicable to the sport of Swimming ( the agreements ) and have fully explained to the athlete the terms and effects of the agreements. To this end I/we have obtained independent legal advice as to the terms and effects of the agreements in order to clarify any doubts or concerns I/we may have had in this regard; 3. the athlete has read the agreements and, together with the benefit of our full explanation, understands its terms and effects; 4. the agreements are for the benefit of the athlete; and 5. the athlete's eligibility for being considered for nomination by the above NF for selection to the 2008 Australian Olympic Team, ( Team ), may be terminated in the event of any breach of these agreements. 9 Attachment 3 AUSTRALIAN DOLPHIN SQUADS Eligibility To be eligible for selection as a member of the Australian Dolphins Squads, the swimmer must be an Australian Citizen who is eligible to represent Australia according to the rules of FINA and is currently a registered member of Australian Swimming Inc and of good standing. Pool Swimmers Period: January 2007 March 2008 Criteria Gold Squad: Silver Squad: Bronze Squad: Priority 4: All swimmers that are selected on the 2007 World Championship Team. The second, third and fourth placed Australians in individual Olympic events other than the 100m freestyle and 200m freestyle at the 2007 Australian Championships and the fifth, sixth, seventh and eighth Australian place getters in the 100m freestyle and 200m freestyle finals at the 2007 Australian Championships if not selected in the major team. All other swimmers selected onto teams to represent Australia not included in the Gold or Silver Squad (ie. Oceania, Junior Pan Pacs etc.). The selectors may recommend for inclusion in the Dolphins Squad swimmers who have not met the above criteria if they have achieved or are listed in the Top 50 FINA Long Course World Rankings to 31 December 2006 provided they are: 1. Not retired; 2. Not absent overseas; 3. Still training at the level required for international success or are participating in a rehabilitation program after injury. General 1. In exceptional circumstances the Swimming Australia Selectors have discretion to recommend additions to the Telstra Dolphins Squads throughout the period of the Squads formation. 2. A and B qualifying standard - individuals FINA Rule BL For each individual event at the Olympic Games the FINA Bureau will establish Standard Entry Times on two levels: A and B, of which B shall be easier to achieve. If a National Federation/NOC enters only one swimmer per event all swimmers entered must meet the qualifying B standard time. If two swimmers are entered in the same event, both of them must meet the qualifying A standard time. Standard entry times can only be achieved in competitions approved for that purpose by FINA. 2. NFs/NOCs without qualified athletes FINA Rule BL National Federations/NOCs may enter swimmers regardless of time standard as follows: provided that: - having no swimmer qualified: one man and one woman - having one swimmer qualified: one swimmer of the other sex - the swimmer(s) participated in the 12 th FINA World Championships Melbourne FINA will decide which swimmers will be invited to take part at the Olympic Games based on their performance. NFs/NOCs without qualified entries must submit their applications for entries to FINA for approval by 15 June Relay teams FINA Rule BL Each NF/NOC may enter only one team in each relay event. All swimmers entered in individual events can be used in relays. In the Olympic Games, not more than sixteen (16) teams can be entered in each relay competition. The top twelve (12) finishers at the 12 th FINA World Championships Melbourne 2007 shall be qualified based upon the results achieved. The four (4) other teams shall be selected by FINA on the basis of the fastest times achieved in the fifteen-month period before the Olympic Games in competitions approved for that purpose by FINA. The NFs/NOCs must confirm to FINA the participation of their qualified relay team by no later than 31 May Each NF/NOC may enter additional swimmers for the relays only, provided that they have achieved the B standard for the stroke and distance.
