Dear DRB Members, We encourage each of you to meet with us, the residential neighbors on the alley. Although we are in support of Hillstone building and operating a restaurant where Bully s is currently located, we believe that this large project will have a significant negative impact on the alley and the neighbors if the noise, privacy and traffic issues are not addressed and solutions identified prior to DRB approval. We also think that a restaurant/bar project of this scale, with a history of being very popular and successful, potentially coming into Del Mar when the most recent large commercial project was 30 years ago, should be required to submit a construction plan and operations plan prior to approval. 1

2 Please read our concerns below and how they relate to several of the DRO s: Regulatory Conclusions Generally. B. The design will create a private or public nuisance. The design includes windows on the west side of the dining room/bar. The interior design specifies hard surfaces and high ceilings which will amplify the sounds of the busy and popular restaurant/bar with 120 seats for dining and bar. If the windows on the west side are operable, this noise will be directed toward the residential properties to the west of the alley and the residences beyond. The design of the parking structure with the entrance and exit located on the property line of the alley will increase traffic congestion cars, delivery trucks, trash trucks in the 20 foot wide alley. Additionally, there is a telephone pole in the alley located approximately 17 feet from the planter wall on their property line which is less than the 20 alley width that the code allows. Hillstone s Site Plan shows the location of telephone pole outside of the 20 wide alley which is not accurate. If restaurant/bar patrons are allowed access to the patio garden, the voices of these (possibly intoxicated) people will be right outside of our master bedroom window and will reverberate throughout the residential neighborhood to the west. Delivery trucks pulling into the parking lot to make deliveries and then BACKING OUT onto the alley will create a noise nuisance with beeping sound made when backing up D. The design will create an unreasonable invasion of the privacy of neighboring properties. J. The proposed development locates structures so as to unreasonably, adversely impact upon outdoor areas, excess noise, security concerns, parking and traffic congestion on adjacent properties. Refer to notes from B and D above Regulatory Conclusions Traffic, Parking and Pedestrian Circulation. A. The vehicular or pedestrian circulation, including walkways, interior drives and parking, access points to the public streets, widths of interior drives, general circulation, separation of vehicular traffic, or arrangement of parking areas, is not safe; is not as convenient as reasonably practicable; detracts from the design of the proposed structure; or adversely impacts neighboring property. On page 69 of the Draft Mitigated Negative Declaration, it is stated that there will be an additional 350 new vehicle trips per day at the project driveways and surrounding intersections. This means 2,450+ new vehicle trips per week and 10,616+ new vehicle trips per month in the alley and intersections. This increase in numbers of cars, trash trucks and delivery trucks in the alley will have a negative impact: traffic congestion in alley; limited access in and out of residents garages; delivery trucks backing out of parking lot with 20 wide alley for backing/turning radius 2

3 B. The design's traffic ingress, egress or internal traffic circulation will have an adverse effect on traffic conditions on abutting streets. Refer to notes in Item A of above C. 8 To: Evan Langan, Associate Planner, City of Del Mar From: Kelly Wallace, Project Designer, Hillstone Restaurant Group Date: 11/10/2017 Subject: Delivery and trash summary for 1404 Camino Del Mar, R+D Kitchen DELIVERIES: All deliveries will are scheduled between 7:00 am and 11:00 am, as we do not accept deliveries during operational hours. Majority of deliveries are made Monday Friday with some occurring on Saturday. Because the site provides a substantial parking area at the alley level, deliveries will be instructed to pull into the parking area so as not to obstruct alley traffic. Smaller delivery trucks and vans will be able to pull through the covered portion of the structure to exit facing forward. Larger trucks without clearance to pass under the covered portion will have to exit by reversing into the alley. From an operational perspective, it is preferable for deliveries such as produce, fish, meat, and wine to be delivered at the entrance at Camino Del Mar when possible and permitable. The shortest travel distance between vehicle and kitchen or storage area is an abiding concern for a restaurant. Expected deliveries summary of trips Produce 2 companies, six days a week = 12 trips Seafood 2 companies, six days a week = 12 trips Meat 2 companies, twice per week. = 4 trips Chicken 1 company, three times per week= 3 trips Bulk Goods 1 company, twice per week. = 2 trips Dairy 1 company, twice per week =2 trips Wine and Liquor approximately 8 deliveries per week Tues Fri = 8 trips Wood twice per week = 2 trips Paper goods 1 company, twice per week =1 trips Linen 1 company, four times per week.=4 trips Expected number of deliveries each week is 50. 9 Notes on delivery truck sizes. Both seafood companies, one meat company and some of the liquor companies typically use van sized vehicles which are refrigerated. Linen company uses large walk in truck (similar to UPS/FedEX truck) Remainder of companies use box trucks in both 15 and 24 sizes. Delivery companies typically coordinate with other stops in the area limiting the amount of trucks. For example, the beer companies most likely only deliver to downtown Del Mar on certain days, and will make all their stops at one time. This will not add additional deliveries to the alley. The same applies to liquor/wine/produce/etc. WASTE: Our trash room has space for (2) 4 yard bins, one for recycling and one for trash. Additionally, we have gallon roll carts for wet/green waste. Pick up of trash can be expected between 5 6 times a week. This is operated by Coastal Waste Management which runs waste management for Del Mar. PARKING MANAGEMENT: The parking lot will for guest and employees only. In hours of non operation, we intend to secure the lot with physical barriers (bollards, chains, etc.) The lot will be opened in the early morning to anticipate deliveries and our staff arrival. The restaurant is expected to be open to the public from 11:30 am until 11:00 pm. The parking areas and alley will be monitored with security cameras with recorded data backup. Standard operating procedure for our restaurants involve frequent management perimeter checks (typically for cleanliness and debris pick up). This will include the parking areas. See attached proposed signage plan.
